There was no one wishing to address the Common Council during the hearing. 1 With no further comments, Mayor Becker closed the public hearing at 7:08 p.m. Ordinance No. 2025-01, Automobile Uses Text Amendment Mayor Becker conducted a public hearing beginning at 7:08 p.m., regarding Ordinance No. 2025-01, Automobile Uses Text Amendment, an Ordinance of the Mayor and Common Council of Westminster, Amending Chapter 164, “Zoning and Subdivision of Land”, of the Code of the City of Westminster, § 164-3 “Definitions and Word Usage” to add the definitions of “Automobile Detailing Shop”, “Automobile Repair and Service Shop, Major”, “Automobile Repair and Service Shop, Minor”, and “Automobile Sales”, and to replace the term “Service Station” with “Automobile Service Station”; to amend §164-121 “On-Premises Business Signs” and Article XX “Special Provisions,” § 164-149 “Automobile Service Stations,” as well as the permitted uses and/or special exception uses in the Mixed Use Infill Zone(§ 164-39.2), B Business Zone (§ 164-41 and § 164-42), D-B Downtown Business Zone, (§ 164-45.8 and § 164-45.9), (I-R Restricted Industrial Zone, (§ 164-54), I-G General Industrial Zone, (§ 164-61 and § 164-62), N-C Neighborhood Commercial Zone (§ 164-64.2), P-I Planned Industrial Zone (§ 164-66 and § 164-75) and PRSC Planned Regional Shopping Center Zone (§ 164-100 and § 164-101), to reflect the newly defined uses. The following spoke and addressed the Common Council during the hearing: Attorney Kelly Shaffer Miller, with Shaffer, Miller, & Hurff, LLP, 73 East Main Street, addressed the Common Council representing Carroll Commerce Center, and stated her points of concern along with her suggested amendments to the proposed legislation (Ordinance 2025-01). Mr. Brian Ditto, Carroll Commerce Center, 69-715 Corporate Center Drive, stated his points of concern to the proposed legislation (Ordinance 2025-01). With no further comments, Mayor Becker closed the public hearing at 7:42 p.m. APPROVAL OF MINUTES A motion was made by Councilmember Dayhoff and seconded by Councilmember Gilbert to approve the Mayor and Common Council Meeting Minutes of July 14, 2025, the Mayor and the Common Council Work Session Meeting Minutes of July 14, 2025. NAYS: None. 2 REPORT FROM THE MAYOR Mayor Becker noted that on Tuesday, July 15, 2025, she spent some time with Mr. Robin Summerfield from Senator Chris Van Hollen’s Office and Ms. Delanie Blubaugh from Senator Alsobrooks’s Office with a walking tour around the City of Westminster. REPORTS FROM COMMITTEES Council President Chiavacci, on behalf of the Public Safety Committee, reported that during the week of July 14-18, 2005, Sgt. Dellospedale and Officer Hara participated in the annual Camp Cops Youth Outreach event. Council President Chiavacci also noted that on July 24, 2025, Lt. Rife was recognized by our local High’s Store with their Hometown Hero Award as a community partner who exemplifies exceptional service and dedication for his unwavering commitment to making a positive impact in our community. Council President Chiavacci closed his report by noting that on July 25, 2025, Detective Hinds received the designation of Police Officer First Class or “PFC” for successfully completing the probationary period at the Westminster Police Department (WPD) and for performing in a manner that supports the agency’s mission. COUNCIL COMMENTS AND DISCUSSION Councilmember Dayhoff noted his attendance at the Westminster Pride Festival held on Saturday, July 26, 2025, held at City Park in Westminster. BIDS Approval of Award to EARN Contractors Inc., for Exterior Painting at the Cranberry Water Treatment Plant in the amount of $ 82,100.00. A motion was made by Councilmember Pecoraro and seconded by Councilmember Dayhoff to approve the award of bid to EARN Contractors Inc., for the exterior painting at the Cranberry Water Treatment Plant in the amount of $ 82,100.00. DEPARTMENTAL REPORTS Department of Public Works City Administrator Imhulse provided an update on the ongoing night road paving in the City. Technology Services Director Moore noted several projects the department has been handling. Community Planning and Development Director of Community Planning and Development reported the following: On July 17, 2025, the Planning and Zoning Commission: • Held a public hearing for Annexation Resolution 25-06, approving Annexation 87 and Annexation Plan for Annexation 87. The Commission forwarded Annexation Resolution 25-06 to the Mayor and Common Council with a favorable recommendation, as introduced; The Board of Zoning Appeals July 1, 2025, meeting was cancelled as there were no applications to come before the Board. • Held a public hearing for Ordinance No. 2025-01, Automobile Uses Text Amendment. The Commission forwarded Ordinance No. 2025-01 to the Mayor and Common Council with a favorable recommendation, as amended. • Approved Sign Permit 1988, for David Ross Orthodontics at 255 Baltimore Boulevard allowing a sign that is greater than 64 square feet and up to but not exceeding 125 square feet. • Heard a presentation regarding the Carroll County Water Resource Element. 4 On August 5, 2025, the Board of Zoning Appeals is scheduled to hear BZA Case No. 25-04, an application by Modular Genius, Inc., appealing May 21, 2025, Zoning Determination ZDET 25-04 made by the Zoning Administrator concerning outdoor storage as a permitted use in the Meadow Branch Industrial Park on Lot 2C. Finance Director of Finance Rodger provided a status update on the preliminary work of the FY25 Audit. Westminster Police Department (WPD) Chief of Police Ledwell provided updates on the work of the department. CITIZEN COMMENTS Ms. Lyndi McNulty, 195 West Main Street, addressed the Common Council with praise of the newly renovated Wakefield Valley Park Pavilion and Event Center noting that it will be a great venue for the City of Westminster. This proposed purchase is for a replacement pickup truck. The requested vehicle is available via an existing contract between Baltimore County (#0004504) and Apple Ford, located at 8800 Stanford Blvd. Columbia MD. Westminster’s procurement code allows the City to piggyback on this competitively awarded contract. The vehicle being purchased is a 2026 replacement pickup truck from Ford. Further information is provided in the attached specification sheet. The cost of the unit is $84,998.30 inclusive of all selected options. Project Funding The FY26 budget for this project is $85,000.00. Background The City has contracted with Funk & Bolton P.A. to provide government-relations services at the State level since FY23. This relationship has proven fruitful, and staff is recommending the continuation of this service. The FY25 contract expired in June. Funk & Bolton P.A. has suggested a fixed monthly fee arrangement of $4,583.33 for 12 months of service, for a total contract amount of $54,999.96. Recommendation Staff recommends the Common Council to approve a Sole Source contract with Funk & Bolton P.A. in the amount of $54,999.96 for government relations services. Consent Calendar – GHD Change Order #9 To: Mayor and Common Council From: Vance Summerhill Date: August 6, 2025 Re: Approval of Change Order #9 with GHD in the amount of $100,000 for additional construction management, inspection, and testing services for Westminster ENR project. Background The original ENR project scope with GHD for construction management outlined a substantial completion date of 6-26-22 (1,266 days) and a final completion date of 9-24-22 (1,356 days). Unfortunately, the contractor, HRI, has delayed the project significantly. A reasonable estimate is that the contractor, HRI, is still several months away from reaching Substantial and Final completion. The City has exhausted funds from Change Order #8 in the contract with GHD because of this delay from HRI. Change Order #8 was based on HRI’s anticipated Substantial completion date of December 14,2024 and Final completion date of March 10, 2025. Therefore, it is necessary to adjust the contract and increase funding for additional construction management, inspection, and testing services. If those dates are further delayed, the City may need to consider another change order. Project Funding Funds have been exceeded for this project and will require a budget amendment in the future. The budget amendment will reallocate funds likely from sewer fund reserves. Additionally, we have notified HRI that we intend to pursue liquidated damages. Recommendation Staff recommend that the Mayor and Common Council approve Change Order #8 with GHD in the amount of $100,000 for additional construction management, inspection, and testing services for Westminster ENR project. The following is a detailed description of the proposed scope of services and estimates that are anticipated for the remaining duration of the contract: 1. Construction Management and Inspection GHD’s original scope of work for construction management and inspection services was executed in an agreement dated 12/20/18 titled “Construction Management, Inspection and Testing Services for Westminster WWTP ENR and Biosolids Upgrade”. The original construction contract was 1,266 days (6/26/22) to Substantial Completion and 1,356 days (9/24/22) to Final Completion. These services were extended several times by the City to account for delays in completing the project. In May 2025, the City executed Amendment No. 8 to extend GHD’s construction management/inspection services beyond April 2025 with the expectation that the $120,000 budget would be sufficient to completion of the project. The Contractor has not achieved Substantial Completion to date and are expected to be on-site for a minimum of the next 3 months. Since the budget associated with Amendment No. 8 was fully exhausted during the month of July, an additional amendment is necessary to extend CM/I services. As with Amendment No. 8 construction management and inspection services will be billed on an hourly and expense basis in accordance with the table below. Background The original ENR project scope with GHD for engineering outlined a substantial completion date of 6-26-22 (1,266 days) and a final completion date of 9-24-22 (1,356 days). Unfortunately, the contractor, HRI, has delayed the project significantly. A reasonable estimate is that the contractor, HRI, is still several months away from reaching Substantial and Final completion. The City has exhausted funds from Change Order #18 in the contract with GHD because of this delay from HRI. Change Order #18 was based on HRI’s anticipated Substantial completion date of December 14,2024 and Final completion date of March 10, 2025. Therefore, it is necessary to adjust the contract and increase funding for additional construction phase engineering services. Should the project be further delayed past, the City may need to consider another change order. Project Funding Funds have been exceeded for this project and will require a budget amendment in the future. The budget amendment will reallocate funds likely from sewer fund reserves. Additionally, we have notified HRI that we intend to pursue liquidated damages.
