Call to Order. The Regular City Council Meeting was called to order at 6:00 p.m. on Tuesday, September 22, 2020, by Mayor Ramona Neal A quorum was present. Council Members Present: City of Weston Lakes Staff Present: Mayor Ramona Neal City Secretary, Jenni McJunkin Mayor Pro Tem Linda Harnist Alderman Ted Case Alderman Denis DeLuca Absent: Alderman Bill Ragle Alderman Trent Thomas 2. Invocation and Pledge of Allegiance by Alderman Thomas. Alderman Ted Case led the Council in the Invocation and the Pledge of Allegiance. 3. Reading of Public Statement Rules and Public Statements. City Secretary, Jenni McJunkin read the following statement: “Each individual who wishes to make a public comment should sign the sign-in sheet before the Call to Order located in the entrance. Please note topic of conversation. Three minutes will be allotted for conversation. City Council may respond. Please turn off cell phone ringers so assembly isn’t disturbed.” People who spoke; Hazel Shaughnessy, Cindy McNab, Steve Spears, Harry Chapman and Jerry Santi 4. Mayor’s Comments 5. Discuss and take action on approval of meeting minutes. Consent Agenda: 6. Present and take action on approval of minutes of regular City Council meetings for August 2020. Motion made by Alderman Denis DeLuca to approve minutes of regular City Council meetings for August 2020. Seconded by Alderman Ted Case. Minutes – Regular City Council meeting September 22, 2020  Ayes: All Noes: None MOTION PASSED 7. Present and take action on approval of August financials. No action was taken. 8. Present and take action on approval of June, July workshop minutes. Tabled 9. Consider purchase of microphones for use at City Council Meetings. Motion made by Alderman Bill Ragle to postpone. Seconded by Mayor Pro Tem Linda Harnist. 10. Get update on burn Ordinance information by Alderman Ted Case and Mayor Pro Tem Linda Harnist. Alderman Ted Case gave an update on burn Ordinance information. Stating that his and Linda’s efforts to seek advice/direction from the City Attorney for a draft Resolution was stopped by the Mayor. Mayor’s email regarding Burn Ordinance: See attached email. 11. Consider and take possible action to amend Resolution 1-09. Discussion of proposed changes. Take action on directing Mayor and Mayor Pro Tem to draft meeting rules and procedures as per our policy and resolution. Request Mayor and Mayor Pro Tem to create such a draft to bring back for council approval. Motion made by Mayor Pro Tem Linda Harnist to Table because it is with the attorney. Seconded by Alderman Bill Ragle. 12. Consider and take possible action to amend Resolution 2-09. Discussion of proposed changes. Take action on directing Mayor and Mayor Pro Tem to draft meeting rules and procedures as per our policy and resolution. Request Mayor and Mayor Pro Tem to create such a draft to bring back for council approval. Motion made by Mayor Pro Tem Linda Harnist to Table. Second by Alderman Ted Case. 13. Discuss and take action on purchase of cameras to film the meeting with possible labor cost so that all meetings can be placed on website for all citizens to see meetings in entirety. Paid for out of CARES Act funds as it promotes social distancing. Discussion and take action on Ordinance 05-09. Motion made by Mayor Pro Tem Linda Harnist approve the updates/changes per Jones and Carter to Ordinance 05-09. Seconded by Alderman Bill Ragle. Ayes: Three, Denis DeLuca, Linda Harnist and Bill Ragle Noes: None Abstained: Ted Case MOTION PASSED Minutes – Regular City Council meeting September 22, 2020 15. Consider and take action on mayor signing the Resolution required by Wallis State Bank for use of City credit card issued. Motion made by Alderman Denis DeLuca to Table until Mayor and Mayor Pro Tem can meet with Wallis Bank to authorize 2 members of Council be signers on the card. This was an authorization form not a Resolution. Seconded by Alderman Ted Case. 16. Texas Municipal League Intergovernmental Risk Pool Board of Trustees Election (Insurance carrier for city). City Council to vote on board members to be submitted by the City of Weston Lakes. Motion made by Mayor Pro Tem Linda Harnist to vote for the incumbents running for board members of the Texas Municipal League Intergovernmental Risk Pool Board of Trustees Election (Insurance carrier for city). Seconded by Alderman Bill Ragle. Ayes: All Noes: None MOTION PASSED 17. Discuss and take action on approving the Mayor to sign engagement letter with Lloyd and Gosselink to work with Thomas Brocato in order to facilitate CenterPoint energy issue resolution. Motion mad by Alderman Bill Ragle to discuss and take action on approving the Mayor to sign engagement letter with Lloyd and Gosselink to work with Thomas Brocato in order to facilitate CenterPoint energy issue. Restated for the Mayor to write a letter to the PUC about the CenterPoint issues of Weston Lakes. Seconded by Mayor Pro Tem Linda Harnist. Ayes: None Noes: All MOTION DID NOT PASSED 18. Discussion of and taking action on holding a City celebration for the holiday season. Motion made by Alderman Ted Case on holding a City celebration for the holiday season due to COVID was deemed inappropriate. Seconded by Alderman Denis DeLuca. Ayes: None Noes: All MOTION DID NOT PASSED 19. Presentation by Weston Lakes Drainage Committee with Recommendations and Associated Costs for budget consideration. Weston Lakes Drainage Committee gave a presentation with recommendations and associated costs for budget consideration, 20. Consider and take action on paying Other Engineering Expenses in the amount of $917.50 to Jones and Carter. Motion made by Alderman Bill Ragle to pay Other Engineering Expenses in the amount of $917.50 to Jones and Carter. Seconded by Mayor Pro Tem Linda Harnist. Ayes: All Noes: None MOTION PASSED 21. Discussion regarding the future location for City Hall meetings due to non-renewal of Memorandum of Understanding of the Country Club Ballroom. Postponed. Mayor appointed Minutes – Regular City Council meeting September 22, 2020  Alderman Bill Ragle to work with her as a committee, to explore a place for future location for City Hall Meetings due to non-renewal of Memorandum of Understanding of the Country Club Ballroom. A. Creation of line item for expenditure for committees to spend for research. No action taken. B. Change of income, see letter from AT&T SB 1152. Discussed by Council, no action was taken. C. City holiday celebration budget line-item commitment of funds. No action taken. See item #18 above. D. Consider and take action on other Budget changes as needed. Discussion centered around proposed budget filing and proposed budget public hearing. No action was taken. 22. Discussion of agenda items for future meetings. Discussed that agenda items would be discussed as needed, at this time Council had no requests. 23. Consider and take action on Adjournment. Motion made by Alderman Denis DeLuca for adjournment. The Mayor directed Aldermen Harnist and Case to look into the matter and bring their findings back to council. We are not ready to write a resolution. The county does not support burning. This issue has not been brought to the citizens for discussion. Further, this was a assignment to find out what our parameters are and to define the ideas of what we want to do or if want to take action. So far 98% of feedback from residents is against burning. Please, do not move forward with this resolution writing. I will direct you on this when we are ready. By your response David, if someone is already looking into this, this subject has been previously addressed. Repeatedly, the mayor asks to be included in communications and repeatedly the mayor is denied. An after the fact email is not sufficient nor is it from the city attorney. Our neighbors along Bowser Road and on larger acreage properties within the City, but outside of the POA, have been impacted by the Incorporation as it relates to outdoor burning. TCEQ has stated to these property owners they must follow City Regulations on outdoor burning because they are now in an incorporated area. The Committee for Outdoor Burning would like to have Olson and Olson prepare for Council consideration and possible action, a Resolution of the City which recognizes, conforms to and adopts TCEQ Regulations.
