Village of Weston, Wisconsin MEETING MINUTES OF THE PARK & RECREATION COMMITTEE MEETING Monday, November 27, 2017, at 4:30 p.m. CALL TO ORDER AT 4:30 P.M. Zeyghami called the meeting to order at 4:30 p.m. ROLL CALL OF THE COMMITTEE Recording Secretary Falkowski took attendance and roll call. Discussion Disc Golf Course Request. Osterbrink stated that we received a request from Thomas Reamer and Jarek Alsteen who are avid users of the Yellowbanks Disc Golf Course to expand the current 11-hole course to an 18-hole course utilizing the same area as the current course. Reamer and Alsteen would like to modify the course by adding 2 tee pads and 2 baskets at different locations at each hole of the course. This design would allow a 9-hole course to be played as an 18-hole course. When completed it would provide 36 different playable options. Reamer and Alsteen plan to fundraise and provide their own volunteer work force to complete the project. They expect minimal participation from the village for this project. Reamer and Alsteen also contacted Pete Hoover from Wausau Area Disc Golf Enthusiasts, the original designer of the course to request permission to modify the current course design. Hooshang and Porlier stated that they would like to see a detailed plan, budget, the wetland delineation, work schedule, method of construction and equipment needed before the project moves forward. Discussion Water Slide Attendants Osterbrink discussed and updated the committee on the current Federal and State requirements regarding the minimum age requirements of lifeguards and slide attendants. Current state requirement for lifeguards is 16 years old but the federal requirement is 15 years old. The slide attendant minimum age for both government entities is 16 years old. There is currently a bill being proposed at the state level to lower the age requirement to 15 but the water slide attendant would remain at 16 at both levels. This bill could impact recruiting and hiring staff at the Aquatic Center. No action was taken and waiting to see if the state decides to change the minimum age requirement of lifeguards to 15 years old. No action taken 4. Discuss Request to Move Shed from Municipal Center to Machmueller Park Osterbrink discussed that he was approached by DCE Youth Baseball to have the shed located at the old Farmer’s Market moved to Machmueller Park for baseball to store their equipment. This would eliminate non-staff members having access to the chase area in the restroom building and would remove the possibility of additional lost keys to our facility. Osterbrink also gave examples of possible options to increase revenue at the Aquatic Center. Some of these options would be to construct a rentable shelter, expanding the birthday party packages, adding a splash pad, expanding the facility to be more accommodating to families and changing prices. Osterbrink gave an update on the status of the Sports Complex project. Stating that it may be possible to complete additional planning for this project in 2018 utilizing room tax dollars if approved. Street staff continues to work on the entry road into Prohaska Park. This past summer they installed culverts and installed additional material on the road. This prep work should allow them to complete additional work this winter. Osterbrink contacted the Central Wisconsin Off Road Cycling Coalition to see when they may be able to start planning and constructing trails. They stated that due to their current workload they do not expect to be able to begin working on this Village of Weston Park & Recreation Meeting Minutes for November 27th, 2017 Page 2 of 3 project in 2018 except possibly some design work. Village staff could complete some of the planning and work on the trails to keep the project moving forward. Osterbrink gave an update on the Tree City USA Application and 2017 Urban Forestry Grant project. REMARKS FROM COMMITTEE MEMBERS Porlier asked what are some of the deficiencies in the parks and at the Aquatic Center. Osterbrink stated that an inventory of the parks is in the Comprehensive Outdoor Recreation Plan. Osterbrink will send a link to the committee of the most recent version of the plan. Lewitzke asked about the dog park lights and Osterbrink explained that 2 out of the 4 lights of the initial order did not work so we had to send them back. We then ordered a different brand of lights and installed them on the four test well boxes closest to the entrance as a test. If these 4 provide sufficient light we will then order and install the remaining 16 lights. Due to some concern about the amount of light provided by the new lights it was discussed that we would change the setting on the lights to be on bright all the time instead of on the motion detection setting. DISCUSS ITEMS TO BE INCLUDED FOR NEXT AGENDA Policy changes at the aquatic center including minimum patron load. Discussion Aquatic Center 2017 Season report Osterbrink and Mroczenski discussed the overview of the 2017 season and made the following recommendations for: • Selling items at the front desk – sunscreen and goggles. • Add more life jackets to accommodate more patrons of all sizes. • Programming – kayaking class (Dive Point), zumba/water aerobics, dog day, dive in movie night. Will use Survey Monkey to conduct a survey to ask the community to find out the level of interest. • Digital advertising – additional way to inform patrons. No action taken 4. Discussion Emerald Ash Borer Osterbrink discussed the find of Emerald Ash Borer in Rib Mountain and the possible affects the insect would have in the Village of Weston. Osterbrink stated the Village currently has 111 Ash trees inventoried in parks, municipal properties, and right-of-ways, excluding forested and private areas. Osterbrink stated options for treatment and removal. Discussion of removal of the ash trees over the next three years with planting of other species of trees. No action taken 5. Discussion Dog Park Fence Osterbrink discussed the option of replacing the east side fencing of the dog park because of the poor condition of the fence. Zeyghami would like Osterbrink to check the plans to determine placement of the fence, Contact Andy at MI-Tech. No action taken 6. Discussion Garbage Enclosure Repair Osterbrink discussed the deteriorating conditions of the screening on the garbage enclosures at the Aquatic Center, Yellowbanks and Kennedy. Osterbrink recommended to replace the screening with green slats. BRIEF: Staff has been approached by two individuals (Thomas Reamer and Jarek Alsteen both avid disc golfers) that are interested in donating their time and raising the necessary funds to make changes to the Yellowbanks Disc Golf Course. These two individuals regularly play the Yellowbanks Course and would like to see some improvements made along with expanding it to 18 holes. Their plan is different and less costly than previous plans that have been presented to the Village by members of Wausau Area Disc Golf Enthusiasts. Instead of expanding the course to the west they have requested permission to allow them to modify the current design of the 11-hole course into an 18-hole course. They would modify the current design slightly to incorporate their idea of installing two tee pads and two baskets at each hole of the course. These tee pads and baskets would be installed at different locations within each of the holes thus allowing a 9-hole course to be played as an 18-hole course. Due to this design the course would offer 36 different playable options when completed as you could play each basket from either tee pad. They would like to perform their own fundraising to raise the necessary funds to complete the work such as timbers for building up tee pad areas, additional rubber tee pads, new signage and other expenses. They also plan on organizing their own workforce to complete the modifications. They are currently requesting just a small amount of village participation to complete this work. First, they are requesting approval to allow them to complete this work. Next, they are asking that the Village contact the Wisconsin Department of Natural Resources to see what type of restrictions there may be on their design as a large portion of the course is in wetlands. Finally, they are requesting to utilize the remaining 7 baskets that the village currently has in storage to complete the course. The Village may also choose to participate with providing some materials and/or labor to assist with the improvements. Since these gentlemen are not members of WADGE and were not involved in the initial design and installation of the course they also contacted Pete Hoover (WADGE Member). If you don’t recall he is the individual that designed and was significantly responsible for the installation and other work completed at both courses the village has installed. They contacted him to request permission to modify the course and the design as he has invested a significant amount of time in the development of the course and they are not trying to cause any problems in the local Disc Golf Community. Pete has given them permission to modify the current design to accommodate their proposal. Staff feels that this would be a worthwhile venture as it will allow us to the expand the course to 18-holes which should bring more people to the course, allow tournaments to be ran at the course, reduce costs to expand the course to 18-holes compared to previous proposals and will improve our facility for all users with minimal investment from the Village. BRIEF: Staff has discussed with the committee the shortage of available lifeguards over the past few years and even made modifications to the staffing plan at the Aquatic Center to utilize front desk staff as slide attendants to cut down on the lifeguards needed to operate. Due to the circumstances staff requested that Attorney Yde look at the current state and federal laws and provide an opinion letter regarding the issue. To summarize the letter currently state and federal law differ for the age of lifeguards but are the same for slide attendants. Currently federal law allows 15-year-olds to lifeguard but not be slide attendants. State law does not allow 15-year-olds to either lifeguard or be slide attendants. Earlier this year Senate Bill 251 was introduced to change the minimum lifeguard age from 16 to 15 in Wisconsin. This bill has passed the Senate and is available for scheduling. If this bill does get full approval it would allow the village to hire 15-year-olds to lifeguard but would still not allow slide attendants to be under 16. The approval of this bill may help with the lifeguard shortage as it should expand the pool of potential lifeguards and provide additional employment opportunities for 15-year-olds. State law requires lifeguards to be at least 16 years old. Front desk attendants can be 14 or 15 years old. Under current Wisconsin law, a water slide attendant must be at least 16 years old. You asked me to review the child labor laws and identify what changes are necessary to permit 14 and 15 year olds to work as water slide attendants at the Weston Aquatic Center. Please consider this letter my response. Federal Law Under Federal law, properly certified 15-year-olds may be employed as lifeguards at water amusement park wave pools, lazy rivers, and activities areas, but not at the top of elevated water slides. Generally, all youth under 16 years of age are prohibited from operating or tending power-driven equipment and may not assist the public as they enter, ride, and leave water-park or amusement-park-type rides. Thus, minors under 16, even if properly certified as lifeguards, may not be employed as dispatchers, attendants, or slide monitors at the top of elevated water slides. 15–year-olds who are properly certified may be employed as lifeguards stationed at the splashdown pools located at the bottom of elevated water slides. 29 C.F.R. §570. 34(l)(1) provides as follows: (l)(1) Lifeguard. The employment of 15–year-olds (but not 14- year-olds) to perform permitted lifeguard duties at traditional swimming pools and water amusement parks (including such water park facilities as wave pools, lazy rivers, specialized activity areas that may include waterfalls and sprinkler areas, and baby pools; but not including the elevated areas of power- driven water slides) when such youth have been trained and certified by the American Red Cross, or a similar certified organization, in aquatics and water safety. 29 C.F.R. §570.34(2) defines the permitted lifeguard duties of a properly trained and certified 15-year- old as follows: Permitted lifeguard duties include the rescuing of swimmers in danger of drowning, the monitoring of activities at pool side to prevent accidents, the teaching of water safety, and providing assistance to patrons . . . Minors under 16 years of age may not be employed as dispatchers or attendants at the top of elevated water slides performing such tasks as maintaining order, directing patrons as to when to depart the top of the slide, and ensuring that patrons have begun their “ride” safely. Properly certified 15- year-old lifeguards may, however, be stationed at the “splashdown pools” located at the bottom of the elevated water slides to perform those permitted duties listed in this subsection. Wisconsin Law Wis. Adm. Code § DWD 270.12(2) provides, in pertinent part, as follows: (2) AMUSEMENT PARKS, SKI HILLS, STREET CARNIVALS, AND TRAVELING SHOWS. (a) Prohibition. No minor may be employed in . . . the loading or unloading of passengers, in the operation of amusement park rides, ski hills, street carnivals, or traveling shows. (b) Definitions. For the purpose of this subsection: 1. “Amusement park ride” means a device or animal that carries, transports, or supports passengers in unusual, entertaining, or thrilling modes of motion . . ., including, but not limited to, . . . water slides . . .. 2. “Water slide” means a slide that incorporates a flow of water intended to carry a rider down a flume and that is required under s. DHS 172.23 (1)(d). to have an attendant stationed at the entrance to enforce slide usage rules. “Water slide” does not include a slide that meets all of the following conditions: a. The slide is less than or equal to 6 feet high as measured vertically from the slide entrance to the deck. b. The user has a clear view of the landing area when measured from the slide entrance at a height of 43 inches. c. The flume carries less than 100 gallons per minute of water. (c) Exception. Minors 16 and 17 years of age may be employed in occupations involving the loading or unloading of passengers on water slides. DHS 172.23(1)(d) requires the attendant responsible for enforcing water slide usage rules to be stationed at the entrance to the water slide flume. Table DHS 172.23-B lists the required number of lifeguards in attendance for pools with slides as follows: 1. Children's slide: No attendant is required. 2. Poolslide: Greater than 4 feet by less than 6 feet in height, which drops into water greater than 4 feet deep: At least one lifeguard. 3. Poolslide: Less than 6 feet in height, with an obstructed view of slide terminus at 43 inches at entry point: At least one lifeguard. 4. Drop slide: Less than 6 feet in height: At least one lifeguard. 5. Run–out slide: Greater than 6 feet in height clear view of the terminus end: at least one attendant on top platform. Greater than 6 feet obstructed view of the terminus end: At least one attendant on top and bottom of run-out. Less than 6 feet clear view of terminus end: No attendant or lifeguard required. 6. Water slide: Greater than 6 feet: Attendant on top of the slide, lifeguard on bottom and means of two-way communication between attendants and lifeguards. Less than 6 feet with a clear view of terminus end and no obstructions around slide: At least one lifeguard. While Federal law allows 15-year-olds to be employed as lifeguards, Wisconsin law requires lifeguards to be 16 years of age. A person may take the American Red Cross lifeguarding course at age 15, but cannot be employed as a lifeguard in Wisconsin until his or her 16th birthday. Wisconsin is an outlier among states concerning its minimum age requirement for lifeguards, with most states setting the bar at age 15. Recently, Senator Luther Olsen introduced Senate Bill 251, which changes the minimum lifeguard age from 16 to 15, aligning Wisconsin with Federal law. The intention of the bill was to expand the pool of potential lifeguards and provide additional employment opportunities for 15 year olds. Steps Necessary to Change the Law When state child labor laws differ from the federal provisions, an employer must comply with the higher standard. As a result, Senator Olson's bill to bring Wisconsin in conformity with Federal law, if successful, will expand the employment pool for certified lifeguards. However, both Wisconsin and Federal law currently prohibit 14 and 15 year olds from working as a dispatcher or attendant at the top of an elevated water slide. Therefore, we will need to change both Wisconsin and Federal law to allow 14 and 15 year olds to work as water slide attendants. I look forward to discussing this letter with you at our next meeting. BRIEF: Staff has been in contact with members of the Everest Youth Baseball League regarding the storage of their equipment at Machmueller Park for the past couple of years. Currently the league struggles with the amount of equipment that they store and the location of storage at Machmueller Park. Currently this park has four fields that are utilized at a minimum of four nights per week for games with additional nights for practices and make-up games. The league currently uses the middle room of the restroom building for storage of baseball and field maintenance equipment for the large diamond and a separate small storage shed for the baseball equipment for the three t-ball fields. Each time the field is used the coaches must pick up the gear and field maintenance equipment from the restroom building and transport it to the field. This is cumbersome for some coaches as they don’t have a vehicle sufficient to transport all the gear, rakes, lime and limer for lining the field. Besides the issue of moving this gear back and forth each day the league has lost a key to our restroom facility for the past two years. The loss of these keys compromises the security of our facility unless the village chooses to change the locks each time something like this happens. Besides people having access to our facility that are not supposed to there is also the possibility of items being damaged within this storage area by continuing to allow access. During our discussions about what could possibly be done to remedy this problem I mentioned that the village currently owns a storage shed that is currently at the former Farmers Market site that is not being used. After discussing this option with them they asked if it would be possible to move this shed to Machmueller Park? FISCAL IMPACT: Labor to move and prepare a pad for the shed, base material from Ryan Street and equipment used to prepare the site and move the shed. RECOMMEND: Staff recommends that the shed from the former Farmers Market be moved to Machmueller Park. PRIOR REVIEW: None. VILLAGE OF WESTON, WISCONSIN MONTHLY DEPARTMENT REPORT #2017-11 FOR OCTOBER 2017 FROM THE DIRECTOR OF PARKS, RECREATION & FORESTRY 1. FOR YOUR IMMEDIATE ATTENTION – TRUSTEES • There are three items that the Park and Recreation Committee recommended at their 10/23 meeting. Due to limitations in the 2018 budget staff feels that we will not be able to move forward with some of these recommendations. 1. 2018 Pay rates for seasonal employees at the Aquatic Center and Ice Rink Attendants – The Park and Recreation Committee recommended approval to increase Head Guard wages from $10.25 per hour to $11.30 per hour, Lifeguard wages from $9.25 per hour to $10.30 per hour, Swim Instructors wages from $9.35 per hour to $10.40 per hour, Front Desk/Slide Attendant wages from $7.75 per hour to $9.79 and Ice Rink Attendant wages from $7.75 per hour to $9.79 per hour. Four of the proposed increases are recommended to bring them up to or above the minimum on the pay matrix and all pay increases are proposed to be more competitive and attract more applicants. Due to limitations in the budget staff is proposing to hold off on the pay increases for 2018 except the Ice Rink Attendant Positions. The additional $700.00 in cost can be absorbed by the current budget. 2. Garbage Enclosure Repair – The Park and Recreation Committee recommended approval to replace the fabric on the garbage enclosures with slats at the Aquatic Center, Kennedy and Yellowbanks at a cost of $1,371.00. The current fabric lasted just 2 years and if we don’t replace we will not be up to code on the enclosures. There is $4,000.00 in the building maintenance budget that should be able to cover this expenditure. 3. Warming House Hours – The Park and Recreation Committee recommended changing the operating hours of the warming house. Due to a decrease in attendance between the hours of 8:00 and 9:00 p.m. staff in proposing to change the operating hours from 6:00 - 9:00 p.m. Monday through Friday and 1:00 - 5:00 p.m. and 6:00 - 9:00 p.m. Saturday, Sundays and School Holidays to 5:00 - 8:00 p.m. and 1:00 – 8:00 p.m. This change does not affect the budget in any way as we are still proposing to be open the same amount of hours per day/week. 2. ANNUAL WORK PLAN PROJECT STATUS • Urban Forestry Grant – We received our tree inventory information in early October. Unfortunately, staff in the Park Department does not have the necessary software to be able to view the information. We forwarded the information to Nate Crowe so he can review. In late October we also requested the remaining information from Kelli. She stated that she is almost finished with the Management Plan, Ordinance update and EAB Plan. She plans to send to the WDNR and the Village the week of 11/13 to begin review of the work product. • Skills Matrix – Sent to Personnel Committee on 9/22. • Yearly work plan calendar – Continue to work on this project as time allows. I should have a draft completed by mid to late November that I can share with Keith and Michael. • Park Committee Responsibilities – Daniel requested on 10/24 that each Director put together a list of the responsibilities of their committee. I started work on this project on 11/6. Document is due by the end of the year. • Schofield Avenue Landscape Bid – The Village received just one bid prior to the 10/30 deadline for the landscape project. The Village Board will need to decide if we move forward with this project. • Noxious Weeds – Daniel and Jennifer informed staff at the 10/3 C-Team meeting that we will be holding off on finishing these ordinances till later this year. Daniel sent out drafts of the ordinances on 10/4 which we have not reviewed as of 11/10. 3. BUDGET STATUS • Aquatic Center Reconciliation – Staff has reconciled the 2017 budget as well as they could due to issues with Book King and the credit card processing issues. Finance staff also received a request to get Rothschild the joint season pass numbers so they can reconcile their portion with Schofield. Jenna Trittin sent Rothschild those numbers on 11/3 as requested. 4. EMPLOYEE DEVELOPMENT & ENGAGEMENT • Attended c-team, scheduling, services, all staff, finance, personnel, board and various other meetings. • Staff refresher training with Fehr Graham is scheduled for November 14th and 15th. • Brad completed his Lifeguard Instructor In-person review and water portion on October 29th at the YMCA. It was necessary for him to complete this so he can teach the updated R 17 American Red Cross Lifeguarding and other courses that he is certified to train. • All evaluations and appropriate documents were completed and sent to Daniel and Sherry prior to the 10/16 deadline. 5. COMMUNITY FEEDBACK • Solar lighting at the Dog Park – The funds that were raised by the go fund me page were delivered in October. Staff ordered just 4 of the 20 solar lights to try them out before ordering all of them. Unfortunately, only 2 of the 4 that we received worked so we had to send them back. We ordered 4 more of a different brand which arrived on November 3rd and we installed them immediately. Once it is determined how well they are working we will either order the remaining lights or come up with a different plan to add more light to the park utilizing the funds that were raised. 6. IDENTIFIED NEEDS 7. NEW IDEAS & OPPORTUNITIES 8. MISCELLANOUS COMMENTS / ISSUES − Fishing regulations Mashuda and Prohaska Ponds – We heard back from Al Neibur the Wausau Fisheries Work Unit Supervisor on 10/18. He stated that he is a little concerned about the Urban Water Designation. Apparently, this program is in limbo and the department is uncertain if it will continue. The other alternative is the rule change which the earliest it could be proposed is at the 2019 Conservation Hearings and go into effect in 2020. Providing there is good local support and it gets passed. He stated that the fisheries program is having a statewide meeting in late November and he is hoping to get some answers regarding the UWD. He asked that we contact him in early December.
