Cassandra Ambrosius asked for consideration of placing a memorial monument at Kennedy Park. The monument represents the four victims of the March 22nd, 2017 shooting. The monument is a four-sided pillar, one side for each victim and a reflective emerald glass eternal flame on top. Twenty-five thousand dollars has been raised for the monument and a June 2019 installation date is anticipated. b. Andrea Ingvalson, President of the Greater Wausau Area Pickleball (GWAP), stated they have over 200 active members. Marathon County built 3 pickleball courts that sustain 12 players at a time. GWAP currently has 30-40 players at any given time wanting to play. GWAP is looking to partner with a municipality to build 10-12 pickleball courts. This would allow enough courts to sustain the number of players locally, host tournaments, clinics and Badger State games. Village of Weston Park & Recreation Meeting Minutes for January 28, 2019  Osterbrink explained the Committee previously discussed the possibility of installing pickleball courts at one of the Village parks and even included 5 pickleball courts in the Kellyland Park Master Plan draft. Average costs for an 8-court complex is between $110,000-$150,000, this does not include lighting. c. Don Kuss is a member of GWAP and is in charge of fundraising. GWAP is interested in possibly partnering with the village to build pickleball courts and fundraise to help offset costs. Mark Strehlow, an active member of GWAP, explained the need for more pickleball courts because of the current number of people playing and the growing interest. Strehlow mentioned that people will travel to play in tournaments which, impacts the economy by staying at hotels, shopping, and eating at restaurants. Xiong asked how much the organization is willing to fund to offset the costs of building pickleball courts. Strehlow explains that GWAP is in the beginning stages of planning. GWAP is contacting surrounding communities that would be willing to partner with the organization, have space to build the courts, and then work on details of fundraising and expenses. Zeyghami stated that pickleball is a growing sport throughout the country and not just in our area. Strehlow mentioned that if a 10-12 court complex is built then a state tournament could be held along with a few smaller tournaments and clinics. Osterbrink asked if they were considering lights for the courts. Ingvalson said yes, but not in the first phase. Osterbrink mentioned that lighting and parking are factors to consider for location of the courts within the Village. d. Lucas Chariton, Concession Manager for D.C.Everest Youth Baseball (DCEYB) stated that their group is looking to offer sponsorship opportunities to local businesses/families to help support the league. In exchange for their contributions they will get either a banner hung on a ball diamond fence with their name or business on it or on a donor board on the concession stand at Kennedy Park. The donations will help ease some of the financial burden to the Village of Weston and families of the players. Banner sizes being considered are 3’x8’ or 4’x8’. EDUCATIONAL PRESENTATIONS & REPORTS 5. Sports Complex Feasibility Study Update Osterbrink received an update from Victus stating they are on schedule to complete a draft of the feasibility study by the end of February. Committee members and staff discussed having Victus contact the pickleball group to discuss and see if it would make sense to add pickleball courts to the either of the proposed complexes. Village of Weston Park & Recreation Meeting Minutes for January 28, 2019  6. Vacant Committee Position Osterbrink stated the village has received a few applicants for the vacant committee position but Village President, Ermeling, suggested to wait until after the April election and have the new president appoint a new committee member. 7. Fitness Classes in Village Parks Osterbrink was approached by an individual wanting to host 50-minute fitness classes once or twice a week at a Village Park. The individual would be charging a fee to the participants. The Committee would like Osterbrink to present this to the Village Attorney to consider the legal aspect on behalf of the Village. POLICY ISSUES – DISCUSSIONS/RECOMMENDATIONS. 8. Placement of Memorial at Kennedy Park Osterbrink informed the Committee that the Village will be taking on the expense of insuring the memorial and any future maintenance costs. Committee and staff discussed the placement of the monument to be a safe distance from the intersection of Alderson St and Jelinek Ave but in the lighted area. *M/S/P Sparks/Esker: to recommend approval to install the memorial honoring the victims of the March 22, 2017 at Kennedy Park. Pickleball Court Requests Committee and staff continued the discussion on the concerns of lighting and location of building pickleball courts. Committee members would like the pickleball court request to be presented to Victus and would like more information overall before taking any action. Stats. sec. 895.52) as long as we do not charge an admission fee for spectators, as long as the activity is not organized as a team sport activity that is sponsored by the Village, and as long as the death or injury is not caused by a malicious act or by a malicious failure to warn against an unsafe condition of which an officer, employee or agent of the Village knew.    Under sec. 895.52(2), the owner of the property (Village in this case) owes no duty to any person who enters the property to engage in a recreational activity, no duty to keep the property safe for recreational activities, no duty to inspect the property except as provided is Wis. Stats. sec. 23.115(2) (relating to inspecting twice a year for trail signs by the Wis. Dept. of Natural Resources) and no duty to give a warning of an unsafe condition, use or activity on the property. There are several exceptions to property owned by the Village set forth in sub sec. (4). The Village is not immune from liability if injury or death occurs on its property at an event for which the Village charges a fee for spectators. The Village is also not immune from injuries or death caused by the Village’s malicious act or malicious failure to warn against an unsafe condition of which an officer, employee or agent of the Village knew , which occurs on property designated by the Village for recreational activities. An act or failure to warn is “malicious” if it results from hatred, ill will, or a desire for revenge or is inflicted under circumstances where insult or injury is intended. Milton v. Washburn County (App. 2011) 797 N.W.2d 924, 332 Wis.2d 319, review denied 803 N.W.2d 850, 335 Wis.2d 148. An example for such a condition would be failure to warn or fence off the edge of a cliff or fence off or seal a well opening. Another example would be if a vandal spread nails in an area of lawn in a park that was discovered by an employee of the Village and the area was not cordoned off or warning signs posted until the area could be cleared of the dangerous items. However, in such an instance, the Village would not have a duty to inspect the area in the first instance, but has a duty only once the danger is known. The proposed activity generally described as an outdoor exercise class is specifically mentioned as a recreational activity in sec. (1)(g) which states “Recreational Activity” means any outdoor activity undertaken for the purpose of exercise, relaxation or pleasure, including…..” . It should be noted that specifically excluded from the definition of recreational activity is any organized team sport activity sponsored by the Village on its park property. However, from the description of the proposed activity, it does not appear to be a team sport activity and further, is not sponsored by the Village. Since the exercise class organizer is not reserving any particular location for these classes, I do not believe that we should require any paperwork from her. I think we should make it clear to her that she can use the park space in the same way as any other resident and that all of her marketing material should specifically say that the class is not a Village of Weston sponsored class or event. Although the Village has immunity as described above, the same is not true of the exercise class organizer or her employees.   As a result, it would be wise for the organizer to talk to her attorney about creating a participant liability waiver form for all participants to sign and her insurance agent to make sure she has sufficient liability coverage. Background The Village has designated a week in May for several years encouraging residents to ride a bike or walk to their destination throughout the week. As the village works to include bicycle and pedestrian accommodations in future developments and add facilities to existing neighborhoods this proclamation shows the villages commitment to support utilizing these facilities. This proclamation also shows support to raise awareness of the benefits to biking and walking instead of traveling in motor vehicles. From: Shawn Osterbrink, Director of Parks, Recreation & Forestry Question: Should the Park and Recreation Committee recommend that the Board of Trustees approve the purchase of a Turfco riding sprayer/spreader with optional 3 in 1 tank from Horst Distributing? Background This would be a new piece of equipment for the village. The reason staff is requesting to purchase this piece of equipment is because it would significantly reduce the amount of staff time utilized spraying weeds in landscape beds and fence lines in parks, which will also reduce the amount of time staff spends trimming these areas. This machine will also reduce the time spent fertilizing by more than half. The village utilized a demonstration machine last fall and was able to fertilize all village landscape turf areas in about 1 ½ days compared to the 3+ days it typically takes. Besides the items listed above this machine will also help the village maintain the skinned areas, gives the village the capability to spray herbicides on turf areas and in various other capacities. Borrowing for the 2019 CIP was approved at the 3/18/19 meeting of the Board of Trustees. From: Shawn Osterbrink, Director of Parks, Recreation & Forestry Question: Should the Park and Recreation Committee recommend that the Board of Trustees approve the purchase of a Walker Model D Zero Turn Mower from Jerry’s Small Engine Supply Company? Background The purchase of this piece of equipment is to replace the current 2007 Walker Zero Turn Mower the village owns. This piece of equipment is utilized for mowing of the aquatic center, Schofield Avenue, spring thatching and fall cleanup on various areas due to its ability to collect grass clippings and leaves. Having this ability at the aquatic center is especially helpful since this significantly reduces the amount of grass clippings in the pool and therefore reduces the frequency that staff must clean the filters, which is a 4 to 5-hour process. It also keeps grass clippings off sidewalks, paths, pool deck, etc. thus reducing the amount of time that staff would have to spend blowing off these areas. Staff is recommending replacing this machine due to significant repairs that have been needed the past two years. In 2018 staff replaced the main blower assembly and in 2017 staff replaced the main pto gearbox, cooling fan and temperature sensors. Borrowing for the 2019 CIP was approved at the 3/18/19 meeting of the Board of Trustees. From: Shawn Osterbrink, Director of Parks, Recreation & Forestry Question: Should the Park and Recreation Committee recommend that the Board of Trustees approve the use of room tax funds for a specific purpose? Background Village staff recently discussed that there is over $100,000.00 remaining in the room tax fund and started to discuss if there are specific projects or events where these funds could be used. We also discussed if these funds should be given to the Convention and Visitors Bureau if the funds are not going to be used for projects or events in the village. Staff discussed that there may be some possible options to use these funds if there are specific projects that are tourism related. Staff discussed a few different projects that may be eligible for the use of some of these funds. Some of the ideas that staff came up with could be the installation of pickleball courts (as long as there is a commitment to host a certain amount of tournaments each year that would bring in people for overnight stays), improvements on the baseball fields (same requirement as pickleball as the fields would have to be used for tournaments that bring people in for overnight stays). Everest Youth Baseball has at least three tournaments scheduled in 2019 that will bring in hundreds of people and should provide some overnight stays. The next idea would be to develop the walking and bicycle paths on the Prohaska property. If these trails would be developed it would be part of the larger plan for Central Wisconsin Off-road Cycling Coalition to develop the area as an International Mountain Bicycling Association Ride Center. If this would happen it should bring people to the area to use the vast amount of mountain bike facilities in the area. These are just some of the ideas that staff came up with in a short time and we are sure there are other possibilities. Staff feels that there are also events in the area that could probably utilize some of these funds for their events. Does the village want to distribute these funds for events’, or would they prefer having the CVB distribute them? Staff needs to further discuss this item but wanted to inform the committee to get the discussion going as it probably does not make sense to hold on to these funds in a village account unless there is a plan to utilize them.
