From: Keith Donner, Village Administrator Jennifer Higgins, Director of Planning and Development Question: Should the Board of Trustees approve the development agreement and land sale at 8902 Progress Way to From the Forest to build a 62,000 square foot addition? BACKGROUND On February 20, 2018, the Village of Weston Community Development Authority approved a development agreement that allows From the Forest (FTF) to acquire the parcel of land west of their current location at 9004 Progress Way. The agreement was executed by both parties on June 5, 2018. The terms of the agreement result in transfer of the land from the Village of Weston to FTF for the purchase price of $96,800 with a TIF grant to FTF of the same amount at time of sale. The agreement also contains a provision for earth fill to be provided to FTF which was recently discussed with the Board of Trustees. From the Forest exercised the option to purchase the land on January 15th, 2021. This is within the designated time frame outlined in the development agreement. From the Forest will be constructing a 62,000 square foot addition to their current building. From the Forest has submitted site plans that will be reviewed by the Planning Commission on February 8th, 2021. In preparation for closing on the sale of the property it was discovered the agreement had not been taken to the Village Board of Trustees for action. The closing agent requires a resolution of the governing body of the municipality to file with other closing documents. Fiscal Impact: $96,800.00 land value; $37,500.00 maximum for fill = $134,300.00 Recommendation: Staff recommend approval and acknowledgment of the sale of land at 8902 Progress Way to From the Forest, LLC. RECOMMENDED LANGUAGE FOR OFFICIAL ACTION I move to [Approve / Deny] the sale of land at 8902 Progress Way to From the Forest as outlined in the Real Property option and Land Sale Development Agreement. ADDITIONAL ACTION: VILLAGE OF WESTON 5500 SCHOFIELD AVENUE  VILLAGE OF WESTON, WISCONSIN RESOLUTION NO. 2021-001 A RESOLUTION, TO APPROVE THE SALE OF WESTON OWNED PROPERTY AT 8902 PROGRESS WAY TO FROM THE FOREST, LLC, FOR A 62,000 SQUARE FOOT ADDITION. WHEREAS, From the Forest, LLC, (“Developer”) proposed purchasing a 3.84 acre parcel owned by the Village of Weston (“Weston”) known as 8902 Progress Way (the “Parcel”) to build a 62,000 square foot facility that extends from the Developer’s existing site into the Parcel; and WHEREAS, On June 5, 2018, the Developer and Weston executed a Real Property Option and Land Sale and Development Agreement involving the Parcel and on January 15, 2021 the Developer exercised its option to purchase the Parcel. BE IT RESOLVED That the Village Board of Trustees does hereby authorize the sale of the Parcel to Developer and hereby ratify the Real Property Option and Land Sale and Development Agreement Between the Village of Weston and FTF Properties, LLC that was executed by the parties on June 5, 2018, a copy of which is attached hereto as Exhibit “A”.
