Beth Flory and David Pierchalla re: Crestwood Acres Neighborhood Reconstruction Project Beth Flory, 4207 Douglas Lane, said the reconstruction project is not so much about her property but has concerns about others in her neighborhood that have sidewalk to close to their house. She is very concerned about the loss of trees. She understands there is an ordinance in place but hopes the Board will really think about their vote. Esthetics are important. Very few people walk in the area. She does not feel it will look that nice. She would like to see green grass and more trees instead of sidewalk. Dave Pierchalla, 4307 Douglas Lane, said a significant amount of grass will be lost in front of his house. He would like the Board to reconsider the sidewalk. A survey was done in neighborhood. There was a total of 48 property owners that signed the survey. 9 approved of the sidewalk and 39 disapproved. He understands the reconstruction of the road but hopes the Board will reconsider placing sidewalk along the sides of the road. He also suggested, in the future, staking out the neighborhoods to help residents visualize ahead of time. Public Works Director Wodalski explained the current ordinance and said in following the ordinance this is how the project unfolded to date. Fiene asked if there was a way to leave Douglas as is. Donner said staff is currently looking at options to minimize the impact. Staff is willing to work out a compromise and still put in sidewalk. Zeyghami said the Board cannot vote against the ordinance. Ermeling read an email from Scott and Jean Berger supporting the redistricting resolution. Fiene read an email from Gayle Marschall asking the Board to vote no on the redistricting resolution. HEARINGS 8. Open Hearings and Hear comments Ermeling opened all the hearings at 6:23 p.m. • Agent change for Brandon James BOARD OF TRUSTEES MEETING MINUTES 5/17/2021 Prepared by: Sherry Weinkauf, Village Clerk  VILLAGE OF WESTON, WISCONSIN OFFICIAL MEETING MINUTES OF THE BOARD OF TRUSTEES Brandon James, Schofield, said he provided the Board a letter, which was attached to the meeting packet. Maloney asked Mr. James if he was alcohol free for six years. Mr. James said it will be six years on July 4th. Maloney asked about serving alcohol and the urge that may come along with that. Mr. James said it is will power. Customers will let him know what they like and do not like. He said his mother is currently the agent and since he runs the business he would like to be listed on the license. He also said it is quite delightful to be sober. Xiong asked about the changes he has made. Mr. James said he stopped drinking after serving jailtime, he was then on house arrest, a year of psychiatric treatment, and probation. He wanted to quit drinking for himself and others around him. He feels more responsible now. He also said he maintained sobriety during the stressful pandemic. Xiong asked if he had a strong support base. Mr. James said yes. • Operator License for Dakotah Blum Dakotah Blum, Weston, said he was objecting to denial because he feels the charges are not related to the operator license. Police Chief Schultz said he recommended denial. He read the ordinance he followed for the denial and gave examples of substantially related. Fiene asked Mr. Blum if he was using drugs or hanging with friends that use drugs. Mr. Blum said no and said he cut ties with those friends. He served 3 months in jail and worked with his probation officer. Before this job he was struggling to find a purpose to get up in the morning. It is hard for him to find a job and he loves his job. If the license is denied he would have to work different hours. He also has a good support system. Mr. Blum’s manager was present and said she has been his manager for over three years. He is not selling open intoxicants. He is doing a great job and shows up all the time. He has come a long way. Customers like him. Xiong asked about trust. She trusts him. • Chih Wei Tsai, President, - Class B Beer & Liquor license for Wasabi, LLC Attorney Rick Cyvekus said he believes Chief Schulz recommended denial of the liquor license because of a felony conviction for 4th OWI. Mr. Tsai is pursuing an appeal. A notice of intent to pursue postconviction relief was filed with circuit court. The Judge then signed an order staying sentence, which indicated Mr. Tsai was to start probation immediately and that the Department of Corrections should not place any condition of probation that would prevent him from operating his restaurant. Mr. Cveykus then reviewed some case law regarding convictions after the right of appeal has been exhausted. He said that Mr. Tsai is appealing his case and has not exhausted that remedy and therefore he does not fit under conviction. Since that time, he has been on bond and regularly tested for alcohol. He has had zero violations in three years. He will remain on probation until the appeal is decided. He will not purchase, procure, or sell any of the alcohol at the restaurant. Employees will do that. Maloney asked about the prior OWI’s. Administrator Donner reported staff will meet with Miron Construction and Kueny Architects on May 27th to discuss the new Municipal Center timeline. He also said construction has started in the Crestwood Acres neighborhood. The Village received a refund on the ATC Powerline relocation. 28. Clerks Weinkauf reminded the Board that she still has a Board of Review DVD available for anyone interested in taking the training. 29. Finance No comments. 30. Fire/EMS Deputy Chief Finke said the department is quite busy. Call volume is over what it was last year. He reported on the large structure fire that took place on Packer Drive and a small outbuilding fire across the street from the Municipal Center. The Department has two ambulances on order and one of them will be here in 3 to 4 weeks. Xiong asked about vacancies. Finke said they could use 5 to 6 more part time employees. There was a short discussion regarding training. White reviewed some of the proposed changes in the Charter agreement with SAFER. There was a short discussion on some of the changes. White said to let him know if there were any other changes the Board would like to see. Finke said that would help and the Department will talk about that again during budget season. It is hard to get part time workers to commit to work. 31. Parks & Recreation Osterbrink reported their new fulltime employee started today. Seasonal employees will start next week. 32. Plan/Dev Higgins reminded the Board about the Schofield Avenue Corridor Plan Public Hearing on Monday, May 24th. She also reported that Assistant Planner Wheaton passed her test and is now a certified planner. 33. Police Chief Schulz reported there were 1,447 calls for service in April. He gave an update on staffing. There are two vacancies. He talked about the mental health issues the Department continues to deal with. He talked about the back log at the county level. Because of the backlog they are having to deal with the same people over and over. The department is getting more complains from businesses asking why the department is not patrolling. There was a short discussion on the use of force guidelines. He said that Wisconsin has been a leader on this issue for a long time. 34. Public Works Wodalski reported that some of the capital projects are starting to wrap up. The first yardwaste pick-up which included branches is complete. Q/Maloney asked staff about taking a commonsense approach on Douglas Lane. Some neighbors will gain land, and some will lose land. If the road had been put in correctly the homes would never have been built where they are. He feels for the neighbors that will lose so much land. Donner said staff is trying to work out a commonsense approach. Wodalski said he did meet with the neighbors on the south side of the road. There was a short discussion on potential changes for Douglas. Maloney said he is representing the entire Village and all the people, races, and genders of the Village. He is troubled by this resolution for the Village. Chief Schulz said that is correct. Maloney cannot support this. Resolution No. 2021-015 Creating a Nonpartisan Procedure for the preparation of State Legislative and Congressional Redistricting Motion by Fiene second by Ermeling to approve Resolution No. 2021- 015. Q/Fiene said this is not a partisan issue in any way shape or form. 51 counties have already passed this including Taylor County where former President Trump won 71.6% of the vote, Oconto County 68.89%, Greenlake County 67.17% of the vote, Clark County 67.14%, and Rusk with 66.67% of the vote. Some people believe this is a partisan thing, but it is not. Maloney feels it is. This does not belong in the Village of Weston. This resolution is a state issue. All it is doing is adding little relevance to the person who put it on the agenda. He said this is not necessary or prudent. It is his opinion, and it is not up for discussion or debate. Ermeling said she has been against gerrymandering from day one. It does not belong anywhere. She stood up and said there should not be any district lines on the map. The districts should be created by population, and it should have nothing to do with who is where. NEW BUSINESS 58. Placement of a Picture Post in a Village Park White asked Osterbrink about maintenance. Osterbrink said they will be responsible for it. Motion by White second by Maloney to approve the installation of a Picture Post at either Yellowbanks Park or the Silver Creek Memorial Launch with the exact location to be approved by the Park Director. Q/Maloney is really pleased to see this. This could bring a completely different group, with excitement and passion, to our parks. Yellowbanks Restroom Facility Osterbrink laid out several options for future use of a restroom facility at this park. It is currently a pit restroom. The recommendation from the Parks and Recreation Committee is remove the existing facility and put in two handicap accessible portable restrooms at this site. White feels the village should not spend a lot of money on this. Xiong said the Parks and Recreation Committee took into consideration staff time and cleaning costs when recommending the portable restrooms. Ermeling said this has been needed for several years. Motion by Xiong second by Maloney to approve the removal of the existing facility and placement of portable toilets. Q/Zeyghami asked how many and if it was sufficient. Osterbrink said two and that is sufficient. Ermeling has concerns with the parks having too many memorials. How do you say yes to one and no to another? Discussion on American Rescue Plan (ARPA) Funds Trautman said the Village will receive the ARPA funds directly from the federal government. Xiong asked if the Village could have a town hall meeting to get feedback on using the ARPA funds. Trautman said there would be time to hold meetings. Fiene said the funds need to be spent by 2024. There was a short discussion on what expenditures would qualify. Trautman said the funds are to counteract the negative effects that COVID had in the community. She said that might be hard to determine and we may not have enough staff for that. Donner said staff will be evaluating how other communities are using the funds. Xiong would be supportive of holding a town hall meeting. Ermeling said once we have a list of qualified items we could meet with the public. Xiong would like staff to do more research on what we can spend the money on. White asked if these expenditures could affect out expenditure restraint program. Trautman said it will not. Xiong suggested bringing this item back to the next meeting. Trautman said staff will attend webinars that address this item in the next few weeks. 66. Discussion and possible recommendation on TIF grant philosophy Donner said we need to tighten up the application process. Both TID #1 and TID #2 have project expenditure periods expiring in 2026 with closure dates in 2031. Frank Roman, with Ehlers, gave an overview and direction for TID #2. He then presented a mixed use example which included a sales analysis. He then reviewed a mixed use example for the Village to include the PAYGO TIF and TIF grant. Donner said the sentiment is to work more closely with Ehlers on the applications. Staff would like to proceed with the project plan amendment to TID #2 and work on modifications to our policy, along with working more closely with Ehlers. Trautman said there are funds in TID #2 and the Village needs to expend them. If the Village is not going to commit to redevelopment, we need to close the TID. Maloney said the Board is in complete agreement that Village of Weston should be regulating and ensuring our residents that the food is safe on public or private property. White asked if these mobile food vendors had to be licensed through a county health department. Weinkauf said yes. Xiong said we should be consistent with surrounding municipalities. Weinkauf said Wausau is only regulating on public property and the other municipalities around us are not doing any regulating. Weinkauf said she is fine with regulating them and staff is currently doing that. Maloney said we need to be the community that does it right. Weinkauf said mobile food vendors only need to get one health department license as long as it is located in the state of Wisconsin. Meinel feels the same as Xiong that other communities should be doing the same thing. Higgins said they do not. Weinkauf said some modifications or clarifications need to be made to the current licensing ordinance. She will bring it back to the next meeting. 68. No Mow May Discussion Fiene said he saw that Appleton and Wausau are doing this. Bees and other pollinators really struggle to find food in April and May. This program is a voluntary relaxation of the grass nuisance ordinance for one month. Appleton and Wausau have a sign-up process, but he does not feel we need to take it that far. Xiong asked if this would be extended to June. Fiene said it is just for May. Maloney said this is fine to do on a volunteer basis and not take names. Ermeling said if someone wants to leave their grass grow in May that is fine, and they won’t get a call from the Village. Fiene also feels we do not need to take names. Fiene said the Village could just put a one-month moratorium on the grass nuisance ordinance. Maloney suggested that in April of each year the Village put something on social media. Ermeling said it would probably be ok if they at least mow through April. Fiene asked for this to be put on the next meeting agenda. 69.
