She does not want this to be forgotten. Fiene said the recommendation from the committee was to move forward with reduced engineering fees. Donner said the Committee did not recommend taking out the costs associated with the mains. The engineering fees have been adjusted as shown in the meeting packet. Karen Walker commented on the $17,424.59 fee and feels this came out of nowhere and feels this benefits the Village. PUBLIC HEARING 4. Open Hearing and hear comments • Consider amending the future land use map found in Map 3-1 of Volume 2 Vision and Direction of the Village’s Comprehensive Plan for 8111 Birch St and two unaddressed adjoining parcels Maloney opened the hearing at 6:06 p.m. Guy Gauger owns property to the south and east of the Hinner Springs project. He wants to make sure that his driveway and access to his land will always be the same. Wodalski said it will not be impacted. 5. Police Schulz reported there were a total of 1,640 calls in May, with 1,182 calls in Weston. The department is struggling with staffing because of vacancies. He gave an update on staffing. Resolution No. 2021-017 authorizing resolution for Special Assessments for Driveway Approach, Water and Sanitary Sewer Improvements for the Apache Ln Utility Looping Project Wodalski said the Public Works and Utility Committee made the recommendation to remove the engineering costs. During that process an error was found on the spreadsheet. Those changes were made, and the total cost went from $21,990.18 to $18,604.26. This was a reduction $3385.92 per lot. Zeyghami asked what the engineering fee is. Wodalski said it is $22,700 for the design and $39,700 for the construction. White also said the lift station was not included in the assessment. Randy Tabaka, 5203 Apache Ln, said he is concerned about the Apache Lane and pumping station project. There is no more room for development on Apache Ln. If this is for village development down the road, why are residents getting assessed $18,000? Not all the residents of the subdivision are included. There are a lot of young and retired families in the community and the Village is putting a financial burden on a lot of people. He feels this should have gone for referendum. This is also not a good time to purchase well and water materials. Donner said the Village is trying to have some consistency in how charges for improvements are handled. These improvements are a benefit to the property owners. They would have the option to hook up to sewer and water if their septic system fails. The Village must allow for deferrals. A ten-year window of deferral has been proposed. Residents would not have to pay on the assessment until year 10. The Board could extend that. White said we have done the same kind of assessments in the past. Zeyghami said the looping will help other subdivisions but will also help this subdivision. Karen Walker, 5201 Apache, said at the June 14th meeting they talked about reducing the assessment $17,424.59 and the Village would be paying for the sanitary and water mains. She suggested putting some of the covid infrastructure money towards the costs. She said there is no room for future development on Apache Lane. She does not understand why they have to pay for something that benefits the Village. There is no room for growth in their area. Maloney said eventually if systems fail the property owners will need this and eventually it will go down the other roads as well. It will be much cheaper to hook up to this system than fixing an existing one. He also said at some point a portion of this has to be paid by the property owner that gets the benefit. Walker said they are assessed at $24,000 and this does not include what it would cost to pay a plumber to hook up to the system. There was a short discussion regarding the 10- and 20-year deferments. Wodalski said it is approximately 75% Village and 25% resident. Motion by White second by Fiene to approve Resolution No. 2021-017 authorizing staff to move forward with the Apache Lane utility looping project. Q/Wodalski said there are a couple different options. White said he is open to a friendly amendment. Fiene said amendment one would include waiving the engineering costs. White said that he would welcome that amendment. Fiene would also like added the 20-year deferment. White also accepted that amendment. Q/Meinel asked if the Village could legally allow a 20-year deferment. Maloney said this would set a precedent. Donner said the PSC would not allow us to have a capital recovery after 10 years. It would have to be recorded as a contributed asset in both sewer and water and connect the revenue when the connection is made. He suggested that anyone wanting to defer after 10 years the Village put in a requirement to make sure their current system is still functioning properly at that time. Maloney asked if we defer to 20 years as being the point of payment then the property owner would have 10 years to pay. Fiene said it would be 10 years after hook up. Wodalski said this is correct. White said it would probably be better if someone added an amendment to the motion. Zeyghami asked if this was according to ordinance and meets the PSC requirements. Donner said we would need to make these amendments to the current ordinance as recommended by the attorney. Zeyghami asked about the financing and interest. Donner said the Village would have to cover the interest. Motion by Zeyghami second by Xiong to amend the original motion by adding that assessments can be deferred up to 20-years, connection will also be required when current system fails or the sale of the property. He said the resolution that the Board decided to go with is the amendment that reduced the cost by $3,385.92 per lot and the connection requirements would be failure of system, sale of property or year 20. It was moved by year 10 to year 20. At year 20 you would still have to make 10 annual payments. Maloney also said in 10 years the Village will test the current systems to see if they are functioning correctly. If they are functioning correctly the homeowner can wait another 10 years before they connect. One of the residents asked if this could be paid before connecting. Maloney said there is a 25% reduction on the sewer portion if you start paying in year one. 52. Resolution No. 2021-018 approving the Preliminary Plat of Hinner Springs Subdivision Motion by Fiene second by Meinel to approve Resolution No. 2021-018. Update on American Rescue Plan (ARPA) Funds Trautman said this was requested at the last meeting to be brought back up. We received half of the funds on June 1st in the amount of $1,110,041.50. The Village cannot use the money toward borrowed funds. Maloney feels this needs to benefit the entire Village. The full amount needs to be obligated by 2024 and spent by 2026. Donner said Marathon County is working on the idea of using the funds for rural broadband access. We do have some areas in the Village not being served. Fiene said it should be used as a village wide benefit. He also suggested using the funds for a one-time bonus for essential workers, such as the EMT’s firefighters, and police officers. Xiong asked about the County using the funds. Osterbrink said they are focusing on towns. No Mow May in the Village of Weston Fiene said this would be a one-month moratorium of having individuals fined for unruly lawns that exceed the ordinance. Fiene is fine if the Board addresses in the future since May has passed. Xiong suggested sending to a committee for discussion. It was already discussed at Public Works. Maloney said the grass would not grow in a month to the standard of a citation. It could also be pushed out on social media. Motion by Zeyghami second by Fiene to defer until January 2022. This is a non- profit organization. They recently held an event on June 5th. It exceeded all their expectations. The event was held at the YMCA. People came from out of state to attend the event. They are asking to get the permit application and police officers costs covered. Xiong questioned the costs. Police Chief Schulz said the EMPD does not have the staff to guarantee for these events. This does require overtime. He is running over in the overtime budget. There are a lot of events each year and it does get tough to schedule officers for these events. It is his recommendation that the Village does not waive the fees. Maloney said the Village is not in the position to donate public money. If hotel room stay can be established this could go before the Tourism Commission. In his opinion Gigi’s Playhouse should request donations from for-profit businesses. Trautman said the Tourism Committee recommended that these kind of requests go through the Wausau/Central Wisconsin Convention & Visitors Bureau (CVB). White agreed this request could go to the CVB. Gary Guerndt had approached the Village of Weston, Village of Kronenwetter and Towns of Reid and Ringle regarding the desire to extend East Nick Avenue to connect to CTH J. This road has been treated like a logging road over the years. Guerndt would like to open a non-metallic mine on the property in Kronenwetter and create a rural, large lot, subdivision in Weston. The developer would be willing to contribute to the connection. The Village needs to decide if they want to contribute as well. He reviewed a proposed agreement between both Villages and Towns. Kronnenwtter suggested an Ad Hoc Committee be created with representatives from both Weston and Kronenwetter. He also received phone calls. He visited some of the residents in that neighborhood and listened to their concerns. This neighborhood was never designed for sidewalks. Maloney said the Village needs to give some closure to the neighborhood right now. Zeyghami suggested telling the contractor not to put in sidewalk. Motion by Meinel second by Xiong to skip putting the sidewalk in the Crestwood neighborhood and direct staff to come back with modifications to the municipal code, as well as addressing staff concerns with the sidewalk map and addressing if it is an isolated neighborhood. Q/Xiong asked if the motion was to put a stop to the construction of the sidewalk and allow staff to bring back changes. Meinel said he wants the changes to be brought back but wants to stop the sidewalk construction in this neighborhood. Xiong would like the motion to include contingent on amending the ordinance.
