The amendment will fall under the Agreement Provisions, and under the Construction Methods paragraph. The language to include reads “However, MTS is liable for failing to timely report any work that MTS was aware of and was not performed in accordance with the contract documents and accepted industry standards if MTS was negligent and the cost to remedy the defect is more than what it would have been had it been immediately discovered and timely reported”.
