Maggie Cronin spoke to the Board on behalf of Congressman Tom Tiffany’s office
regarding federal grants for municipalities for which they could identify potential grants and
write letters of support. She also wanted pointed out that the Village could refer residents
to contact congressman Tom Tiffany’s office for various grants for regarding IRS issues,
passport issues, etc., for which they can assist with.
Ryan Cortright – 6503 Alta Verde Street, Weston spoke to the Board regarding his support
of the ordinance to allow chickens in the Village.
Kelly Marcott – 6302 Jacquelyn Road, Weston spoke to the Board regarding her support
of the ordinance to allow chickens in the Village.
Edward Swank – 4311 Schofield Avenue #104, Weston spoke to the Board regarding the
condition of the mobile home park. He has noticed some improvements and thanked the
Board.
Maloney stated that he received an email from Kevin and Julie Keller and Brad and Linda
Wyro which were provided in opposition to the ordinance to allow chickens in the Village.

Maloney stated that he received several emails from Suzanne and Michael Kuether
regarding the conditions of the Stillwater Landing Mobile Home Park which have also been
read by staff.
Maloney stated that he received about 35 emails in support of the Agenda Item #41 from
the real estate community, banks, and closing companies.
Jan Ehrhardt – 5501 Alex Street, Weston spoke regarding the ordinance to allow chickens.
She is not in support of them as they attract wild animals and expressed her concern of
how the manure will be disposed of.
Grace Klopotek – 6003 Jessica Street, #3, Weston spoke regarding her support in the
ordinance to allow chickens in the Village if there are limitations and controls in place.

Discussion: Pinsonneault asked to review Page 103, paragraph 6, which reads that all
outdoor storage areas must be completely enclosed. Pinsonneault stated that there was
a discussion at the Plan Commission meeting that included a roof so there would be
complete screening. Higgins stated that pursuant to that discussion, the language had
been changed but it did not copy over when she prepared the final ordinance. Pinsonneault
also had questions on Page 104 about the rewording that they discussed in the Plan
Commission meeting in which Higgins stated that the language was changed but it did not
copy over as well.
At that time, Cronin made motion to rescind the prior motion with a second by Zeyghami.
At this time, the Board by agreement moved on to Agenda Item 31.

Higgins retrieved the changes that were going to be included and placed them on the
monitor for the Board. The verbiage was “All outdoor storage areas shall be completely
screened by any permitted combination of buildings, structures, walls, and solid fencing”
was the terminology to be inserted.” The Board reviewed this language provided.

Extraterritorial Zoning Area of the Town of Weston.
Discussion: Pinsonneault recapped that a discussion was held in Plan Commission with
Humane Officer Bishop present. The ordinance being discussed has been in place in the
City of Wausau since 2018 and at the current time, they have between 15-20 active chicken
sites. From 2018 until now there has been only one complaint which was more of a
language barrier complaint and ultimately was worked out. The lot size being discussed
for chickens in Weston is at a minimum of 5,000 square feet so that is about a third of an
acre, which would exclude small residential lots. Free range chickens were also discussed
at the Plan Commission level and it was decided that the ordinance should lay out that
there would be a coop for the chickens and a run which would all be enclosed. A survey
was extended to the public which resulted in about a 20 percent response of which over
60 percent were in support of the ordinance. No roosters would be allowed, and the
chickens must be registered with Department of Agriculture. The Humane Officer would
be responsible for making onsite visits for compliance. Pinsonneault stated that he would
propose taking 25 feet away from any pre-existing dwelling and wanted to know who added
the word school site to the ordinance in which Higgins stated that “school site” was present
in this ordinance already because the school came forward at a time prior because it
wanted to raise bees for classrooms. Maloney stated his concern with what is the next
animal that would be allowed in the Village and where the line is drawn. Ermeling
expressed concern regarding the smell and the chickens getting out and having wild
animals drawn into the Village. Hartinger inquired who would be following up on
registrations in which the response was the Humane Officer. Higgins stated that as far as
the licensing application process is concerned, Zoning would have to sign off on all
applications and there would have to be something built into the Evolve licensing system
for complaints to go to the Humane Officer. Higgins stated there would be a $35 application
fee for chickens.

Motion by Pinsonneault, second by Hartinger to amend the prior motion to
approve changing it to 10 feet from any pre-existing dwelling and 75 feet from a
dwelling on a neighboring parcel and to remove the school site language.
Discussion: Maloney stated that 75 feet sounded like quite a bit of distance in a lot in the
Village of Weston that was not rural.
Motion by Pinsonneault, second by Hartinger to rescind amendment to motion.

35. Resolution No. 2023-019: A Resolution discontinuing a portion of Dominika Street in
the Village of Weston, Marathon County, Wisconsin (on recording

Discussion: Joe Muzynoski – 5803 Mary Lane, Weston was present. Maloney
identified if Mr. Muzynoski understood what was coming before the Board on this
agenda item which Muzynoski said yes, that the Village wants to discontinue a portion
of 16 feet of the roadway. Maloney explained that with the interest rates, the
delineation by Tappe did not happen and the subdivision was put on hold. Higgins
explained that there would be no cost to Muzynoski when the road is completed. All
restorations will be completed at no cost to him. Higgins explained that this would kick
off a discontinuance hearing in December. Maloney read an email that was sent by
Heath Tappe in opposition to vacate the right-of-way due to the option of growth and
expansion. Tappe does support a discontinuation of the portion as described in the
resolution.

No updates on 2023-2025 Strategic Plan goals. Hartinger indicated that public works
were working on their standard operation plan.
38. Update on Stillwater Landing Mobile Home Park (on recording

Property inspector Meverden was present and said that he has been to the mobile
home park on several occasions and provided a report to the Board in the packet. An
email was received from the Park with a proposed road construction. Maloney would
like to see the potholes filled within the next two weeks or the Village will fill the potholes
at the Park’s expense. Ermeling asked about the water main pipe replacement and
Wodalski explained that it was being held off because the Village would end up paying
for re-pavement of that road this year. It will be coordinated with a street project for
next year and cover both at the same time. Pinsonneault asked Meverden to let the
park know that the new pavement should be completed by a deadline date next year.
The Board agreed that the new payment should be completed by June 15, 2024. If not
completed, it could result in a non-renewal of its license.
39. Update on punch list items for Municipal Center (on recording https://youtu.be/jv6PUVjh1y4?t=5196)
a. Extended Warranty with Miron for Landscaping
Discussion was held that by the end of the summer of 2024, a concrete deadline should
be placed to allow for time to remedy the current landscape situation. Wodalski said
that there has never been an acceptance of the grass as being installed and the
warranty period starts when it is accepted. Currently, it is not under warranty.
Zeyghami stated that the concrete sidewalk still has not been fixed where the asphalt
is higher. A date was set of August 31, 2024, to remedy the landscape situation.
Pinsonneault commented that he would like to see staff looking for building construction
issues that need to be remedied and also inquired if the drainage system issue in the
mezzanine was fixed. Maguire said that this needed to be coordinated with the HVAC
provider, so we are not upcharged by Miron for fixing that issue and that any additional
issues the Village sees with the building needs to be added prior to January 4, 2024.
Zeyghami asked if the issue with the overhead door color had been fixed. Wodalski
said that issues was fixed but there was a door opening issue as well and Overhead
Door had been in to repair that. Zeyghami said that the steps in the lobby area where
the vinyl was placed is cracked open in a spot and the vinyl needs to be repaired as
there should not be any cracks or openings. Maloney commented on the leakage in
the tile which Maguire pointed out those areas that needed to be fixed. Weiland
mentioned the foundation cracking in the large unfinished room. Pinsonneault said the
engineer has never responded to his requests. Zeyghami asked if the lower roof had
been finished. Maguire said that nothing has been added to the roof’s scupper and
there is no downspout on there. Zeyghami added that needs to be fixed.

Motion by Ermeling, second by Cronin to approve adding assessment
information to website.
Discussion: Brehm said she spoke to the Village Assessor and the options are to 1)
Place Assessordata.com on the Village website and requesters would have to pay per
request or 2) The Village pay a quote of an additional $1,500 for the information to be
free to all requesters. Pinsonneault said that he would like to make a motion to amend
the prior motion to direct staff to add that it would not be the .com and .org version but
the website that would allow for everyone to access the assessor data information for
free. Hartinger said that he agreed that residents should have that information for free
but does not agree that any realtor should have it for free. Ermeling asked how we are
going to get past who the request would be coming from to charge a fee or not charge
a fee. Pinsonneault said that he would motion for it to be of no cost to the residents
and Cronin said that he would be willing to second that motion. That request of a motion
was not voted on.

Impoundment Services Agreement between the Humane Society of Marathon
County, Inc. and the Village of Weston for a total of three years beginning January
1, 2024, at a contract price not to exceed the actual costs up to $18,500 per
calendar year.
Weiland requested to fund the services for non-dog-strays for the remaining of 2023.
Ermeling asked where the money would come from if we were to do that. Trautman
indicated that the Village has a surplus and would be able to place funds towards this
service. Maloney said that we should start those services as soon as possible.
Motion by Pinsonneault, second by Weiland to amend motion to approve
Purchase of Animal Impoundment Services Agreement between the Human
Society of Marathon County, Inc. and the Village of Weston with a contract start
date of October 17, 2023 and continuing for a total of three years beginning
January 1, 2024, at a yearly contract price not to exceed the actual costs up to
$18,500 per calendar year with the funds coming from pet licensing dollars and
room tax dollars.

with no action to be taken on it at this time. The new administrator should review
the study and provide a recommendation to the Board in early 2024 based on her
discretion.
Hartinger stated this was reviewed at the Human Resource Committee meeting and
what is basically being done is moving the recommended scale for these positions by
the firm that did the study. The current pay structure now has the studied positions at
the median. If approved, the scale will be moved and will be higher than the current
scale. The people would now be lower than the middle and that could change our
budget.

Discussion: Pinsonneault requests to amend the motion of the accounts payable,
payroll, and HR specialist position as it relates to the farmers market stating that a
market manager was hired by the Village for that. That even though the job oversees
it, it is not what the job description states. Maloney stated that the motion was to defer
this item and Pinsonneault said yes, but that the new administrator should look into this
part of the job description.

Maloney stated that he would like to see a tree for the Christmas holiday in the atrium
above the front door. Village staff reported to the Board what we currently have for
decorations and how many light poles on Schofield Avenue have electrical fixtures on
them. Cronin stated that he would like to see decorations from Walgreens to Birch
Street. Maloney said he would just like to see lights on the poles to make the Village
more festive. Cronin said that he would like to see some cost estimates for how much
it would cost to put lights on the poles along Schofield Avenue.
Motion by Ermeling, second by Cronin to approve the purchase of a tree for the
Municipal Center atrium and obtaining prices for next year for Schofield Avenue.

DuPont Class Action Settlement (PFAS) and 3M Class Action Settlement (PFAS): (on recording

Agenda item was handled outside of closed session.
Wodalski provided background on the notices from DuPont and 3M Class Action Settlements for
PFAS. There is paperwork that can be completed to see what settlement the Village is eligible
for in which the Village staff will be completing. Municipalities are able to opt out of the class
action settlement if they have more direct correlations to PFAS contamination and are confident
that they can go after the entity individually. The Village of Weston does not have a direct
correlation. If the Village wishes to be automatically included in the settlement, nothing needs to
be done but if it would wish to opt out and pursue separately, it would have to notify by 12/4/23
and 12/11/23. Attorney Yde was present and explained the legal portion of the class action suit.
