MINUTES OF CITY OF WHARTON CITY COUNCIL MEETING FEBRUARY 10, 2020 Mayor Tim Barker declared a Regular Meeting duly open for the transaction of business at 7: 00 P.M at City Hall 120 E. Caney Street Wharton, TX. Councilmember Russell Machann led the opening devotion and Mayor Tim Barker led the pledge of allegiance. Councilmember' s present were: Mayor Tim Barker and Councilmembers Terry Freese, Alice Heard- Roberts, Clifford Jackson, Russell Machann, Don Mueller and Steve Schneider. Councilmember absent was: None. Staff members present were: City Manager Andres Garza, Jr, City Attorney Paul Webb, Finance Director Joan Andel, City Secretary Paula Favors, TRMC, CPM, MMC, Assistant to the City Manager Brandi Jimenez, Public Works Director John Plaia, Airport Manager David Allen and Community Development Director Gwyn Teves. Visitors present were: Elizabeth Quillin of the Wharton County Long Term Recovery, Superintendent Tina Herrington, with Wharton I. S. D., Rachel Rust, Duria Jackson, Curtis W. Evans, Christine L. Stransky, Randy Meyer and Cynthia Davis. Roll Call and Excused Absences. All Councilmembers were present. Public Comments. Mayor Tim Barker called for Public Comments. No comments were made. Wharton Moment. Mayor Tim Barker stated Mr. John McCain' s 102" d birthday and Dr. Robert Caraway, Jr.' s 100' h year birthday parties would be celebrated at the Wharton Civic Center during a come and go event from 5 p. m. until 7 p. m. on February 14, 2020. He said all were welcome to attend. Mayor Barker stated another candidate had filed for the May 2, 2020 General Election, bringing the total to three candidates running for Mayor. The first item on the agenda was to review and consider the reading of the minutes from the regular meetings held January 13, 2020 and January 27, 2020. After some discussion, Councilmember Russell Machann moved to approve the reading of the minutes from the regular meetings held January 13, 2020 and January 27, 2020. Councilmember Don Mueller seconded the motion. All voted in favor. City of Wharton City Council Regular Meeting Minutes- February 10, 2020 Page 2 of 14 The second item on the agenda was to review and consider a request for approval of an extension on a variance for temporary placement of travel trailers at 1504 Connie Street and 312 Boatwright from the Wharton County Long Term Recovery Team. City Manager Andres Garza, Jr. presented a copy of a request for approval of an extension on a variance for temporary placement of travel trailers Team. at 1504 Connie Street and 312 Boatwright from the Wharton County Long Term Recovery Community Development Director Gwyn Teves stated the request was for a six month extension ending July 25, 2020. After some discussion, Councilmember Terry Freese moved on to approve the request of an extension on a variance for temporary placement of travel trailers at 1504 Connie Street and 312 Boatwright from the Wharton County Long Term Recovery Team until July 25, 2020. Councilmember Clifford Jackson seconded the motion. All voted in favor. The third item on the agenda was to review and consider a resolution ofthe Wharton City Council approving a revised contract offered by the Texas Department of Public Safety to accommodate Chapter 706 ofthe Texas Transportation Code for the Failure to Appear Program with the Wharton Municipal Court and to authorize the Mayor of the City of Wharton to execute a revised interlocal cooperation contract with the Texas Department of Public Safety. City Manager Andres Garza, Jr. presented information regarding the revised Interlocal Cooperation Contract for the Failure to Appear Program through the Texas Department of Public Safety. City Manager Garza stated the Wharton City Council approved a contract on February 25, 2019 with the purpose to improve court collection and compliance and to comply with mandated State Collection Improvement Program requirements. City Secretary Paula Favors stated that since the approval of the contract, Senate Bill 346 was passed and become effective January 1, 2020, which changed the statutory administration fee that could be collected by a defendant who failed to appear in court for the prosecution of an offense or the failure to pay or satisfy a judgement that ordered the payment of a fine and cost in the manner ordered by the court from$ 30. 00 to $ 10. 00, $ 6. 00 paid to the vendor and $ 4. 00 would go to the City' s general fund. Mrs. Favors stated Assistant City Attorney Amy Rod had reviewed the documents related to the contract and found the contract to be in order and she was recommending the City Council consider approving it. After some discussion, Councilmember Russell Machann moved to approve City of Wharton Resolution No. 2020-09, which read as follows: CITY OF WHARTON RESOLUTION NO. 2020- 09 A RESOLUTION OF THE WHARTON CITY COUNCIL APPROVING A REVISED CONTRACT OFFERED BY THE TEXAS DEPARTMENT OF PUBLIC SAFETY TO ACCOMMODATE CHAPTER 706 OF THE TEXAS TRANSPORTATION CODE FOR THE FAILURE TO APPEAR PROGRAM WITH THE WHARTON MUNICIPAL COURT AND TO AUTHORIZE THE MAYOR OF THE CITY OF WHARTON TO EXECUTE A REVISED INTERLOCAL COOPERATION CONTRACT WITH THE TEXAS DEPARTMENT OF PUBLIC SAFETY. WHEREAS, The City of Wharton participates in the Failure to Appear Program; and, City of Wharton City Council Regular Meeting Minutes- February 10, 2020 Page 3 of 14 WHEREAS, The Wharton City Council wishes to continue participating in said program and to enter into a revised Interlocal Cooperation Contract with the Texas Department of Public Safety to meet requirements of Senate Bill 346; and, WHEREAS, The Wharton City Council wishes to authorize the Mayor of the City of Wharton to execute the agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS that: Section I. The City of Wharton hereby approved the City of Wharton' s participation in the Failure to Appear Program. Section II. The Mayor of the City of Wharton is hereby authorized to execute a revised Interlocal Cooperation Contract with the Texas Department of Public Safety to implement the program Section III: That this resolution shall be come effective immediately upon its passage. The fourth item on the agenda was to review and consider a resolution ofthe Wharton City Council approving a contract with Cintas for employee uniforms and other supplies through U.S. Communities Purchasing Agency and authorizing the City Manager of the City of Wharton to execute all documents relating to said contract. City Manager Andres Garza, Jr. presented a memorandum to him from Public Works Director John Plaia regarding a contract with Cintas for employee uniforms and other supplies. City Manager Garza stated that in 2010 the City of Wharton signed a contract with G & K Services and they had recently been bought out by Cintas which operates under the U.S. Communities Purchasing Agency. He said the City of Wharton was a member of U. S. Communities Purchasing Agency. After some discussion, Councilmember City of Wharton City Council Regular Meeting Minutes- February 10, 2020 Page 4 of 14 Alice Heard-Roberts moved to approve City of Wharton Resolution No. 2020- 10, which read as follows: CITY OF WHARTON RESOLUTION NO. 2020- 10 A RESOLUTION OF THE WHARTON CITY COUNCIL APPROVING A CONTRACT WITH CINTAS FOR EMPLOYEE UNIFORMS AND OTHER SUPPLIES THROUGH U.S. COMMUNITIES PURCHASING AND AUTHORIZING THE CITY MANAGER OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATING TO SAID CONTRACT. WHEREAS, The City of Wharton has in the past received services from G & K Services for employee uniforms and other supplies; and, WHEREAS, G& K Services has recently been bought out by Cintas; and, WHEREAS, Cintas is a vendor through U.S Communities Purchasing Agency; and, WHEREAS, The City Council of the City of Wharton has determined that is in the best interest to enter into an agreement with Cintas for employee uniforms and other supplies. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. That Cintas is a vendor through the U.S. Communities Purchasing Agency. Section II. That the City of Wharton hereby approves a contract with Cintas to provide uniform services and other supplies through U.S. Communities Purchasing Agency. Section III. That the City Manager is hereby authorized to sign any documents relating to the aforementioned contract. Section VI. That this resolution shall become effective immediately upon its passage. The fifth item on the agenda was to review and consider a resolution of the Wharton City Council authorizing the purchase of a Foreign Object and Debris( FOD) Sweeper for the Wharton Regional Airport and authorizing the City Manager to execute all documents related to said purchase. City Manager Andres Garza, Jr. presented a memorandum to him from Airport Manager David Allen regarding the purchase of a FOD Sweeper for the Wharton Regional Airport. Mr. Allen stated that two quotes were received and they were as follows: 1. The FOD Control Corporation- FOD Razor Airport Runway Sweeper Duplex 7, 995. 00 2. Myslik, Inc.- DFB- I 6GF Ultimate Duplex FOD Boss System 13, 300.00 Mr. Allen stated it was his recommendation that the City Council consider approving the Myslik, Inc.-DFB- I6GF Ultimate Duplex FOD Boss System in the amount of$ 13, 300, which he felt was the best value of the two. After some discussion, Councilmember Russell Machann moved to approve City of Wharton Resolution No. 2020- 11, which read as follows: CITY OF WHARTON RESOLUTION NO. 2020- 11 A RESOLUTION OF THE WHARTON CITY COUNCIL AUTHORIZING THE PURCHASE OF A FOREIGN OBJECT AND DEBRIS ( FOD) SWEEPER FOR THE WHARTON REGIONAL AIRPORT AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS RELATED TO SAID PURCHASE. WHEREAS, Proposals were received for the FOD Sweeper for the Wharton Regional Airport; and, WHEREAS, Myslik, Inc. was deemed the best lowest qualified bidder in the amount of 13, 300. 00; and, WHEREAS, The Wharton City Council wishes to award an agreement to Myslik, Inc. for the FOD Sweeper at the Wharton Regional Airport in the amount of$ 13, 300.00; and, WHEREAS, The City of Wharton and Myslik, Inc. wish to be bound by the conditions as set forth in the agreement; and, WHEREAS, The Wharton City Council wishes to authorize the City Manager of the City of Wharton to execute the agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. The sixth item on the agenda was to review and consider the Texas Department of Emergency Management Hazard Mitigation Grant Program DR 4332 City of Wharton Community Safe Room Phase I: A. Resolution: A resolution of the Wharton City Council approving a Grant Agreement the Texas Department of Emergency Management ( TDEM) with through its Hazard Mitigation Grant Program ( HMGP) for the City of Wharton Community Safe Room Phase I and authorizing the Mayor to execute all documents relating to said agreement. B. Resolution: A resolution of the Wharton City Council approving the establishment of a Checking Account for the HMGP DR 4332 Hurricane Harvey City of Wharton ec Community Safe Room with Prosperity Bank and authorizing the Mayor, City Manager and Finance Director as the signatories. C. Resolution: A resolution of the Wharton City Council approving an agreement between the City of Wharton and Wharton Independent School District for the TDEM HMGP DR 4332 City of Wharton Community Safe Room Phase I and authorizing the Mayor of the City of Wharton to execute all documents relating to said agreement. City Manager Andres Garza, Jr. stated the City of Wharton submitted to the Texas Department of Emergency Management ( TDEM) through its HMGP DR 4332 Hurricane Harvey, a grant application for the City of Wharton Community Safe Room in partnership with WISD. City Manager Garza said TDEM had approved the grant application Phase I in the amount of 446, 863. 00 ($ 335, 147. 25 federal cost share and $ 111, 715. 75 local cost share) for the first phase City of Wharton City Council Regular Meeting Minutes- February 10, 2020 Page 7 of 14 identified in the grant application. Community Development Director Gwyn Teves stated the City would have to open a new checking account with Prosperity Bank for the HMGP DR 4332 Hurricane Harvey City of Wharton Safe Room Project. Mrs. Teves said the City would enter into an agreement with the Wharton Independent School District for the Texas Department of Emergency Management Hazard Mitigation Grant Program DR 4332 City of Wharton Community Safe Room Phase I. The seventh item on the agenda was to review and consider a resolution of the Wharton City Council authorizing the submission of an application to the State Infrastructure Bank Transportation Loan Program through Texas Department of Transportation for the FM 1301 and Railroad Overpass Project and authorizing the Mayor of the City of Wharton to execute all documents related to said submission. City Manager Andres Garza, Jr. stated the Ci City Staff had met with representatives from the State Infrastructure Bank Transportation Loan Program through Texas Department of Transportation for the FM 1301 and Railroad Overpass Project. City Manager Garza said the City Staff wished to submit an application to the State Infrastructure Bank Transportation Loan Program. Community Development Director Gwyn Teves stated the Finance Committee had meet and were recommending the City Council consider approving the application. After some discussion, Councilmember Russell Machann moved to approve City of Wharton Resolution No. 2020- 15, which read as follows: CITY OF WHARTON RESOLUTION NO. 2020 - 15 A RESOLUTION OF THE WHARTON CITY COUNCIL AUTHORIZING SUBMISSION OF AN APPLICATION TO THE STATE INFRASTRUCTURE BANK TRANSPORTATION LOAN PROGRAM THROUGH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THE FM 1301 EXTENSION AND RAILROAD OVERPASS PROJECT AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID SUBMISSION. City Manager Andres Garza, Jr. stated bids were received for the HMGP DR 4269 Warning Siren System on January 30, 2020 and a total of two bids were received as follows: 1. Crosspoint Communications 166, 299. 37 2. Wolfenson Electric, Inc. 178, 844. 00 Community Development Director Gwyn Teves stated it was the recommendation of BEFCO Engineering, Inc. to award the bid to Wolfenson Electric, Inc. She stated that Crosspoint Communications' submitted scope of work was in direct conflict with the proposed scope of work in the bid package, making it nonresponsive. After some discussion, Councilmember Terry Freese moved to approve City of Wharton Resolution No. 2020- 16, which read as follows: CITY OF WHARTON RESOLUTION NO. 2020- 16 A RESOLUTION OF THE WHARTON CITY COUNCIL AWARDING A CONTRACT FOR THE HMGP DR 4269 WARNING SIREN SYSTEM AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID CONTRACT. Councilmember Terry Freese seconded the motion. All voted in favor. The tenth item on the agenda was to review and consider the City Manager Travel Reimbursement. City Manager Andres Garza, Jr. presented his request for travel reimbursement. After some discussion, Councilmember Alice Heard- Roberts moved to approve the City Manager travel reimbursement request. Councilmember Clifford Jackson seconded the motion. All voted in favor. The eleventh item on the agenda was to review and consider the City Manager Employment Agreement. City Attorney Paul Webb stated he was in the process of working on a draft Employment Agreement for City Manager Andres Garza, Jr and would present it at a future meeting. After some discussion, no action was taken. The twelfth item on the agenda was to review and consider appointments and resignations to the City of Wharton Boards, Commissions and Committees: 1. Appointments: A. Building Standards Commission. B. Mayor' s Committee on People with Disabilities. C. Plumbing and Mechanical Board. After some discussion, no action was taken. The thirteenth item on the agenda was to review and consider the City Council Boards, Commissions and Committee Reports: A. Wharton Economic Development Corporation meeting held December 16, 2019. B. Wharton Economic Development Corporation meeting held January 15, 2020. C. Finance Committee meeting held January 27, 2020. D. Wharton Economic Development Corporation meeting held January 27, 2020.
