MINUTES OF CITY OF WHARTON CITY COUNCIL REGULAR MEETING MARCH 14, 2022 Mayor, Tim Barker declared a Regular Meeting duly open for the transaction of business at 7: 00 P. M. at City Hall 120 E. Caney Street Wharton, TX. Councilmember, Russell Machann, led the opening devotion and Mayor, Tim Barker led the pledge of allegiance. Councilmember' s present were: Mayor, Tim Barker, and Councilmembers, Terry Freese; Alice Heard- Roberts; Steve Schneider; Russell Machann; and Don Mueller. Councilmember absent was: Clifford Jackson. Staff members present were: City Manager, Joseph R. Pace; City Attorney, Paul Webb; Finance Director, Joan Andel; Secretary, Paula City Favors, TRMC, CPM, MMC; Assistant to the City Manager, Brandi Jimenez; Director of Planning and Development, Gwyn Teves; Police Chief, Terry David Lynch; EMS Director, Christy Gonzales, Airport Manager, David Allen; and Public Works Director, Anthony Arcidiacono. Roll Call and Excused Absences. After some discussion, Councilmember, Russell Machann, moved to excuse Councilmember, Clifford Jackson. Councilmember, Don Mueller, seconded the motion. All voted in favor. Public Comments. Mayor, Tim Barker, called for Public Comments. No comments were given. Wharton Moment. City Manager, Joseph R. Pace, congratulated Airport Manager, David Allen, on winning the Texas Department of Transportation General Aviation Division' s Airport Manager of the Year award. Review and Consider: City of Wharton City Council Regular Meeting Minutes- March 14, 2022 Page 2 of 13 The first item on the agenda was to review and consider reading of the minutes from the regular meetings held January 10, 2022, and January 24, 2022. City Manager, Joseph R. Pace, presented a copy of the minutes from the regular meetings held January 10, 2022, and January 24, 2022. After some discussion, Councilmember, Russell Machann moved to approve the minutes from the regular meetings held January 10, 2022, and January 24, 2022. Councilmember, Don Mueller, seconded the motion. All voted in favor. The second item on the agenda was to review and consider a request from Mr. James Perez to hold a Scholarship Fundraiser at Riverfront Park on March 19, 2022. City Manager, Joseph R. Pace, presented a copy of the request by Mr. James Perez to hold a Scholarship Fundraiser at Riverfront Park on March 19, 2022, from 10: 00 a. m. to 4: 00 p. m. After some discussion, Councilmember, Terry Freese, moved to approve the request from Mr. James Perez to hold a Scholarship Fundraiser at Riverfront Park on March 19, 2022. Councilmember, Alice Heard- Roberts, seconded the motion. All voted in favor. The third item on the agenda was to review and consider a request from Mr. James Perez of Just Do It Now, Inc., for a Just Do It Now & Restoration City Crawfish Boil Fundraiser on April 2, 2022, for the following: 1. Close Houston Street between Milam Street and Caney Street from 6: 00 p. m. on April 1, 2022, until 12: 00 p.m. on April 3, 2022; close Polk Street from Milam Street to Hawes Street from 12: 00 p. m. until 10: 00 p. m.; close Polk Street from Milam Street to Caney Street on April 2, 2022, from 10: 00 a. m. to 10: 00 p. m.; close Caney Street from Houston Street to Polk Street from 8: 00 a.m. to 10: 00 p.m. 2. Closure of Guffey Park from 10: 00 a.m. to 10: 00 p. m. 3. Provide two ( 2) generator light plants for safety and cleanup after the event. 4. Allow open containers for alcohol on City property pursuant to the map attached and coordinated with Wharton Police Department. 5. Waive all local permit fees. 6. Provide waste containers and trash bags for the day. 7. Pay Wharton Police Officers to provide security for the event. 8. Display signage of 2nd Annual Crawfish Festival advertisement on Highway 59 Billboard. 9. Allow the sale of alcohol in Guffey Park. City Manager, Joseph R. Pace, presented a copy of the request from Mr. James Perez of Just Do It Now, Inc., for the Just Do It Now& Restoration City Crawfish Boil Fundraiser on April 2, 2022. City Manager, Joseph R. Pace, stated Mr. Perez was requesting to allow open containers and the sale of alcohol in Guffey Park pending TABC approval ofhis application for the event. After some discussion, Councilmember, Don Mueller, moved to approve the afore mentioned items 1., 2., 4., 5., 6., 8., and 9., with the request that Mr. Perez request funds from the Wharton Chamber of Commerce for items 3. And 7. Councilmember, Russell Machann, seconded the motion. Councilmember, Alice Heard- Roberts, voted against the motion. The motion passed. The fourth item on the agenda was to review and consider a request from Chief of Police, Terry Lynch, regarding the 4th Annual Cops ` n Rodders Car Show for the following: 1. Waive all fees associated with renting the Wharton Civic Center. 2. Allow participants and spectators to utilize restroom facilities in the Civic Center. 3. Allow the potential use of food trucks. 4. Allow the consumption of alcoholic beverages on the outdoor premises of the Civic Center. 5. Allow the Police Department to close the roadway of University Street from Fulton Street to the entrance of the Department of Human Services Driveway, prior to and throughout the duration of the event. ( 8: 00 a. m. — 4: 00 p. m.) 6. Use of the blue trash cans and liners from the Parks Department. 7. Have the street sweeper sweep the parking area of the Civic Center on April 29, 2022. 8. Should it rain, allow the potential fallback day on May 1, 2022. City Manager, Joseph R. Pace, presented a copy of a memorandum from Chief Lynch to him regarding the 4th Annual Cops ` n Rodders Car Show on April 30, 2022, at the Wharton Civic Center. After some discussion, Councilmember, Russell Machann, moved to approve the request from Chief Lynch to him regarding the 4th Annual Cops ` n Rodders Car Show on April 30, 2022, at the Wharton Civic Center. Councilmember, Terry Freese, seconded the motion. All voted in favor. The fifth item on the agenda was to review and consider a resolution of the Wharton City Council approving a VOCA Grant-Victim' s Assistance Officer for the Wharton Police Department for one year and authorizing the Mayor of the City of Wharton to execute all documents related to said grant. City Manager, Joseph R. Pace, presented a copy of a memorandum from ChiefTerry Lynch to him regarding the VOCA Grant- Victim' s Assistance Officer for the Wharton Police Department. Police Chief Lynch stated the Wharton Police Department had reapplied for the Victim' s Assistance Officer position through the H- GAC Governor' s Victim' s Assistance Grant program and the Department was approved four years ago for the position and were currently operational, having appointed Officer Melissa Huggins in that position. Chief Lynch said the grant term was for one year( FY2023) and this grant renewal request would be presented to H- GAC for final approval in the amount of$ 89, 062. 00 in FY2023. After some discussion, Councilmember, Terry Freese, moved to approve City of Wharton Resolution No. 2022- 26, which read as follows: CITY OF WHARTON RESOLUTION NO. 2022- 26 A RESOLUTION OF THE WHARTON CITY COUNCIL APPROVING A VOCA GRANT- VICTIM' S ASSISTANCE OFFICER FOR THE WHARTON POLICE DEPARTMENT FOR ONE YEAR AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID GRANT. City of Wharton City Council Regular Meeting Minutes- March 14, 2022 Page 4 of 13 WHEREAS, The City of Wharton finds it in the best interest of the citizens of the City of Wharton, that the Victim Assistance Officer be operated for the 2023 Fiscal Year; and, WHEREAS, The Wharton City Council agrees that in the event of loss or misuse of the Office of the Governor funds, the Wharton City Council assures that the funds will be returned to the Office of the Governor in full; and, WHEREAS, The Wharton City Council designates Mayor Tim Barker as the grantee' s authorized official. The authorized official is given the power to apply for, accept, reject, alter or terminate the grant on behalf of the applicant agency. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. That the Wharton City Council hereby authorizes the Mayor of the City of Wharton to execute, on behalf of the City of Wharton, all documents related to said grant. Section II. The sixth item on the agenda was to review and consider a resolution of the Wharton City Council approving an agreement for Medical Director Services between Dr. Jeff Gubbels and the City of Wharton and authorizing the Mayor of the City of Wharton to execute all documents related to said agreement. City Manager, Joseph R. Pace, presented a copy of the draft agreement and resolution for Medical Director Services between the City of Wharton and Dr. Jeff Gubbels. EMS Director, Christy Gonzales, stated the current contract expired on April 30, 2022. Mrs. Gonzales said the proposed agreement would be for a two-year period beginning May 1, 2022 and ending on April 30, 2024. After some discussion, Councilmember, Alice Heard- Roberts, moved to approve City of Wharton Resolution No. 2022- 27, which read as follows: City of Wharton City Council Regular Meeting Minutes- March 14, 2022 Page 5 of 13 CITY OF WHARTON RESOLUTION NO. 2022- 27 A RESOLUTION OF THE WHARTON CITY COUNCIL APPROVING AN AGREEMENT FOR MEDICAL DIRECTOR SERVICES BETWEEN DR. JEFF GUBBELS AND THE CITY OF WHARTON AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID AGREEMENT. WHEREAS, The City of Wharton wishes to authorize the Mayor of the City of Wharton to execute an agreement between Dr. Jeff Gubbels and the City of Wharton for Medical Director Services for the Emergency Medical Service( EMS) Department; and, WHEREAS, The City of Wharton and Dr. Jeff Gubbels wish to be bound by the conditions as set forth in the agreement; and, WHEREAS, The Wharton City Council and Dr. Jeff Gubbels wish the agreement to become effective on May 1, 2022; and, WHEREAS, The Wharton City Council wishes this resolution to become effective immediately upon its passage. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. That the Wharton City Council hereby authorizes the Mayor of the City of Wharton to execute, on behalf of the City of Wharton, the Medical Director Services Agreement with Dr. Jeff Gubbels for the City of Wharton Emergency Medical Services( EMS) Program. Section II. That the City of Wharton and Dr. Jeff Gubbels are hereby bound by the conditions as set forth in the agreement which shall commence on May 1, 2022 and will expire on April 30, 2024. All voted in favor. The seventh item on the agenda was to review and consider Wharton Regional Airport: A. Resolution: A resolution of the Wharton City Council authorizing the Mayor of the City of Wharton to submit a Letter of Intent for the City of Wharton' s participation in the Texas Department of Transportation Aviation Division Capital Improvement Program by submitting an application for funding to be used to construct a new security/ game fence at the Wharton Regional Airport. B. Resolution: A resolution of the Wharton City Council authorizing the Mayor of the City of Wharton to submit a Letter of Intent for the City of Wharton' s participation in the Texas Department of Transportation Aviation Division Capital Improvement Program by submitting an application for funding to be used for a Crack Fill, Seal and Restripe Program at the Wharton Regional Airport. City Manager, Joseph R. Pace, stated the Wharton Regional Airport Board met on February 15, 2022, and voted to recommend to the City Council to consider participating in the Texas Department of Transportation ( TxDOT) Aviation Division Capital Improvement Program ( CIP) by applying for funding to construct a new security/game fence and a Crack Fill, Seal and Restripe Project at the airport. Airport Manager, David Allen, stated the participation would require the City of Wharton to submit a Notice of Intent (NOI) to TxDOT Aviation. After some discussion, Councilmember, Terry Freese, moved to approve City of Wharton Resolution No. 2022- 28 and 2022- 29, which read as follows: CITY OF WHARTON RESOLUTION NO. 2022- 28 A RESOLUTION OF THE WHARTON CITY COUNCIL AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO SUBMIT A LETTER OF INTENT FOR THE CITY OF WHARTON' S PARTICIPATION IN THE TEXAS DEPARTMENT OF TRANSPORTATION AVIATION DIVISION CAPITAL IMPROVEMENT PROGRAM BY SUBMITTING AN APPLICATION FOR FUNDING TO BE USED TO CONSTRUCT A NEW SECURITY/ GAME FENCE AT THE WHARTON REGIONAL AIRPORT. WHEREAS, The Wharton City Council wishes for certain improvements to be conducted at the Wharton Regional Airport; and, WHEREAS, Said improvements would include the construction of a new security/ game fence at the Wharton Regional Airport; and, WHEREAS, To fund the costs for said project, the Wharton City Council wishes to participate in the Texas Department of Transportation Aviation Division, Capital Improvement Program, which is a 90% federal/ 10% local cost share program; and, City of Wharton City Council Regular Meeting Minutes- March 14, 2022 Page 7 of 13 WHEREAS, The Wharton City Council wishes to authorize the Mayor of the City of Wharton to submit a Notice of Intent to participate in said program. City Manager, Joseph R. Pace, presented a copy of the request from the Wharton Swim Team and a draft agreement for use of the Wharton Municipal Swimming Pool. The nineth item on the agenda was to review and consider a request from Mr. Russ Baird to address the City Council regarding water services at the 200 & 300 Blocks of West Milam Street. Pace, presented a copy of the request from Mr. Russ Baird to address the City Council regarding water services at the 200 & 300 Blocks of West Milam Street. The Public Works Committee will meet on Monday, March 14, 2022 and will formulate a recommendation for City Council consideration. The tenth item on the agenda was to review and consider a request from Mr. Russell Baird to address the City Council regarding Downtown Wharton. City Manager, Joseph R. Pace, presented a from Mr. Russell Baird to address the City Council regarding Downtown Wharton. After some discussion, Councilmember, Terry Freese, moved to table the item until Mr. Baird could first seek possible assistance through the Wharton Economic Development Corporation. Councilmember, Russell Machann, seconded the motion. All voted in favor. The eleventh item on the agenda was to review and consider a request from the Wharton County Farmer' s Market for an extension of a placement of an off-premises outdoor advertising display sign. City Manager, Joseph R. Pace, presented a copy of an application to Request Placement of an Off-Premises Outdoor Advertising Display Sign from the Wharton County Farmer' s Market. City Manager Pace stated the City of Wharton Code of Ordinances Chapter 66 Signs and Advertising Section 66- 30 Exempt Signs stated that these signs may be displayed for two weeks prior and during the event with written approval by the City Manager. Ms. Marchelle Pettibone, stated however, the Wharton County Farmer' s Market was requesting that the sign be placed on Alabama Road and Boling Highway from April 4, 2022, to June 21, 2022, and September 26, 2022, to December 20, 2022. Ms. Pettibone said the Farmer' s Market did confirm that permission was granted from the Wharton Independent School District. After some discussion, Councilmember, Terry Freese, moved to approve the request from the Wharton County Farmer' s Market for an extension of a placement of an off-premises outdoor advertising display sign, if the school district approved. Councilmember, Russell Machann, seconded the motion. All voted in favor. The twelfth item on the agenda was to review and consider Pay Request No. 2 and final from Chief Solutions for the construction of sanitary sewer cleaning and televising. City Manager, Joseph R. Pace, presented a copy of Pay Request No. 2. Public Works Director, Anthony Arcidiacono, stated this was the final pay request from Chief Solutions for the construction of sanitary sewer cleaning and televising in the amount of$ 852. 80. After some discussion, Councilmember, Terry Freese, moved to approve Pay Request No. 2 from Chief Solutions for the construction of sanitary sewer cleaning and televising in the amount of$ 852. 80. Councilmember, Steve Schneider, seconded the motion. All voted in favor. The thirteenth item on the agenda was to review and consider a resolution of the Wharton City Council approving a Facilities Extension Agreement with CenterPoint Energy for utility service relocations at Harrison Lane for the Wharton FM 1301 Extension Project and authorizing the Mayor of the City of Wharton to execute the agreement. City Manager, Joseph R. Pace, stated the City of Wharton had been working with CenterPoint Energy on utility relocations for the FM 1301 Extension Project. Director of Planning & Development, Gwyn Teves, stated that most relocation costs had been covered under the existing franchise agreement with the City and the only electrical City of Wharton City Council Regular Meeting Minutes- March 14, 2022 Page 11 of 13 relocation that was still pending and was not covered by the franchise agreement due to the area being outside the area of the current franchise agreement was at Harrison Lane. Mrs. Teves said the relocation of those facilities per CenterPoint Energy' s estimate would be $ 82, 409. 44. After some discussion, Councilmember, Russell Machann, moved to approve City of Wharton Resolution No. 2022- 31, which read as follows: CITY OF WHARTON RESOLUTION NO. 2022- 31 A RESOLUTION OF THE WHARTON CITY COUNCIL APPROVING A FACILITIES EXTENSION AGREEMENT WITH CENTERPOINT ENERGY FOR UTILITY SERVICE RELOCATIONS AT HARRISON LANE FOR THE WHARTON FM 1301 EXTENSION PROJECT AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE THE AGREEMENT. WHEREAS, The Wharton City Council wishes to authorize CenterPoint Energy to relocate electrical utilities at Harrison Lane for the Wharton FM 1301 Extension Project; and, WHEREAS, The Wharton City Council and CenterPoint Energy wishes to be bound by the terms and conditions as outlined in the agreement; and, WHEREAS, The Wharton City Council wishes to approve the City Staff to remit payment to CenterPoint Energy in the amount of$ 82,409.44 for the cost to relocate the services; and, WHEREAS, The Wharton City Council wishes to authorize the Mayor of the City of Wharton to execute all documents related to said agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. That the Wharton City Council hereby approves the Facilities Extension Agreement between the City of Wharton and CenterPoint Energy for the relocation of electrical utilities at Harrison Lane for the Wharton FM 1301 Extension Project. Section II. The Wharton City Council hereby approves the City Staff to remit payment in the amount of$82,409.44 to CenterPoint Energy to provide the service. Section III. That the City of Wharton and CenterPoint Energy are hereby bound by the terms and conditions as set forth in the agreement. Section IV. The Wharton City Council hereby authorizes the Mayor to execute all documents related to the change order. Section V.
