MINUTES OF CITY OF WHARTON CITY COUNCIL REGULAR MEETING JANUARY 13, 2025 Mayor, Tim Barker, declared a Regular Meeting duly open for the transaction of business at 7: 00 P. M. at City Hall 120 E. Caney Street Wharton, TX. Councilmember, Russell Machann, led the opening devotion and Mayor, Tim Barker, led the pledge of allegiance. Councilmember' s present were: Mayor, Tim Barker and Councilmembers, Terry Freese; Russell Machann; Burnell Neal; Steve Schneider; Larry Pittman, and David Voulgaris. Councilmember absent was: None. Staff members present were: Assistant City Manager, Paula Favors, City Attorney, Paul Webb; Finance Director, Joan Andel; City Secretary, Director of Planning and Development, Gwyn Teves, CPM; Building Official, Claudia Velasquez; Public Works Director, Roderick Semien, and Emergency Management Coordinator, Lt. Ben Guanajuato. Visitors present were: Joan G. Hawes; Susie Carlson; Jason Stavena, and Colby Primeaux with the Wharton Journal Spectator. Roll Call and Excused Absences. All Councilmembers were present. Public Comments. Mayor, Tim Barker, called for Public Comments. No comments were made. Wharton Moment. Mayor, Tim Barker, called for the Wharton Moment. Assistant City Manager, Paula Favors, stated Police Chief, Terry David Lynch, and Assistant to the City Manager, Brandi Jimenez, were attending the swearing in ceremony of outgoing SGT. Stephen Jimenez as he was appointed as the second Police Chief ever for Van Vleck Independent School District. Mrs. Favors congratulated Police Chief Jimenez on his new appointment. Review and Consider: The first item on the agenda was to review and consider the reading of the minutes from the regular meeting held December 9, 2024. After some discussion, Councilmember, Russell Machann, moved to approve the reading of the minutes from the regular meeting on December 9, 2024. Councilmember, Steve Schneider, seconded the motion. All voted in favor. Finance Director, Joan Andel, presented the City of Wharton Financial Report for November 2024. Councilmember, Russell Machann, moved to approve the City of Wharton Financial Report for November 2024. Councilmember, David Voulgaris, seconded the motion. All voted in favor. The third item on the agenda was to review and consider a request from Mr. James Perez, President of the Wharton County Hispanic Chamber of Commerce, regarding a Cinco de Mayo Celebration on Saturday, May 3, 2025, and assistance for the following: A. Close Houston Street between Milam Street and Burleson Street on Saturday, May 3, 2025, from 8: 00 a.m. to Sunday, May 4, 2025, 12: 00 a.m. B. Close Fulton Street between Milam Street and Burleson Street on Saturday, May 3, 2025, from 8: 00 a.m. to Sunday, May 4, 2025, 12: 00 a.m. C. Waive the City of Wharton Noise Ordinance to allow DJ Music and live performances. D. Waive the City of Wharton Alcohol Ordinance to allow public alcohol consumption in the Monterey Square Area only. E. Waive all local permit fees. F. Provide one ( 1) roll- off dumpster. G. Provide twelve ( 12) trash barrels and trash bags to help keep the Downtown Area clean. H. Provide barricades for the above- mentioned street closures. I. Advertise the celebration on the 1- 69 Digital Billboard. Assistant City Manager, Paula Favors, presented a copy of the request from Mr. James Perez, President of the Wharton County Hispanic Chamber of Commerce, regarding a Cinco de Mayo Celebration on Saturday, May 3, 2025. Mrs. Favors stated Mr. Perez made his request to the Commissioner' s Court for approval to hold the event at the Monterey Square and to use the electrical breakers on Fulton Street, as both belong to the County. After some discussion, Councilmember, Burnell Neal, moved to approve aforementioned items A. through 1. Councilmember, Russell Machann, seconded the motion. All voted in favor. The fourth item on the agenda was to review and consider a request from Ms. Kelli Wright- Nelson on behalf of Matagorda County Women' s Crisis Center, Inc. to replat 620 N. Fulton St., Wharton, Block 30, Lot 26 & 27 for replat for commercial redevelopment. a Director of Planning & Development, Gwyn Teves, presented a copy of the request from Ms. Kelli Wright-Nelson to address the Council regarding a replat at 620 N. Fulton St., Wharton, Block 30, Lot 26 & 27 for a replat for commercial redevelopment. Mrs. Teves stated the Planning Commission met on January 6, 2025, and was recommending that the City Council approve the replat. After some discussion, Councilmember, Terry Freese, moved to approve the request from Ms. Kelli Wright-Nelson on behalf of MatagordaCounty Women' s Crisis Center, Inc. to replat 620 N. Fulton St., Wharton, Block 30, Lot 26& 27 for a replat for commercial redevelopment. Councilmember, Burnell Neal, seconded the motion. Director of Planning & Development, Gwyn Teves, presented a request from Mr. Jason Stavena to address the Council regarding a variance for a Hay Permit for multiple properties not registered under single ownership. Mrs. Teves stated the Planning Commission met on January 6, 2025, and was recommending that the City Council approve the variance. After some discussion, Councilmember, Terry Freese, moved to approve the request from Mr. Jason Stavena to address the Committee regarding a variance for a Hay Permit for multiple properties not registered under single ownership. Councilmember, Burnell Neal, seconded the motion. All voted in favor. The sixth item on the agenda was to review and consider a request from Ms. Joan Hawes to address the Council regarding a variance for a Hay Permit for multiple properties not registered under single Director of Planning & ownership. Development, Gwyn Teves, presented a request from Ms. Joan Hawes to address the Council regarding a variance for a Hay Permit for multiple properties not registered under single ownership. Mrs. Teves stated the Planning Commission met on January 6, 2025, and was recommending that the City Council approve the variance. After some discussion, Councilmember, Russell Machann, moved to approve the request from Ms. Joan Hawes to address the Council regarding a variance for a Hay Permit for multiple properties not reg isteredistered under single ownership. Councilmember, Larry tyPit tman, seconded the motion. All voted in favor. The seventh item on the agenda was to review and consider an ordinance of the City of Wharton, Texas, finding that the portion of Wells Street located between Ogden Street and the former Santa Fe Railroad Right- of-Way within the City of Wharton is not necessary for public use as a thoroughfare; providing for the vacation, abandonment, and closure of the street; and releasing any and all public right, title, and interest and save except any required easements. Planning & Development Director, Gwyn Teves, presented a copy of a memorandum from her regarding the abandonment of a portion of Wells Street. Mrs. Teves stated the Planning Commission met on Monday, January 6, 2025, and recommended that the City Council approve the request for abandonment of the portion of Wells Street between Ogden Street and the former Santa Fe Railroad Right- of-Way. After some discussion, Councilmember, Russell Machann, requested adjoining property owners be contacted and their response given to the City Council before any action be taken. Councilmember, David Voulgaris, seconded the motion. All voted in favor. The eighth item on the agenda was to review and consider a resolution of the Wharton City Council authorizing the submission of a grant application for the Texas Department of Transportation 2025 TA Set- Aside Program Call for Projects and authorizing the Mayor of the City of Wharton to execute all documents relating to said application. Director of Planning & Development, Gwyn Teves, stated that on January 3, 2025, the Texas Department of Transportation ( TxDOT) announced a statewide Call for Projects under the Transportation Alternatives Set-Aside( TA Set- Aside) Program for population areas of 200, 000 or less. Mrs. Teves said the TA Set- Aside Program provides funding to construct various alternative transportation projects that improve mobility for non-motorized users and mitigate congestion by providing transportation options and i City of Wharton City Council Regular Meeting Minutes- January 13, 2025 Page 4 of 12 to school. safe routes She said the City had applied for and received funding under this program in 2009, 2012, 2020, and 2023 for numerous sidewalk improvements throughout the City. Director Teves stated the City was also eligible for Transportation Development Credits for the 2025 cycle, which could allow for up to 100% funding eligibility and it was the request of the Staff to authorize the submission of the preliminary application. After some discussion, Councilmember, Terry Freese, moved to approve City of Wharton Resolution No. 2025- 01, which read as follows: CITY OF WHARTON RESOLUTION NO. 2025- 01 A RESOLUTION OF THE WHARTON CITY COUNCIL AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION FOR THE TEXAS DEPARTMENT OF TRANSPORTATION 2025 TA SET-ASIDE PROGRAM CALL FOR PROJECTS AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATING TO SAID APPLICATION. WHEREAS, The Texas Department of Transportation administers the federally funded TA Set- Aside Program, which provides opportunities for non- traditional transportation- related activities; and, WHEREAS, Projects submitted under this program should go above and beyond standard transportation activities and be integrated into the surrounding environment in a sensitive and creative manner that contributes to the livelihood of the communities, promotes the quality of the environment, provides safe routes to school, and enhances the aesthetics of roadways; and, WHEREAS, The Texas Department of Transportation has announced the 2025 Program Call for candidate enhancement projects for the TA Set- Aside Program; and, WHEREAS, The Wharton City Council wishes to submit an application to the Texas Department of Transportation for sidewalk additions that would include the creation of safe routes to school and ADA-compliant pedestrian accessibility in Wharton in accordance with the State of Texas regulations; and, WHEREAS, The Wharton City Council wishes to agree to provide the required local match at 20% or greater of the total project cost, including being responsible for all non- federally fundable items and 100% of cost overruns if determined ineligible for the 2025 Transportation Development Credits; and, WHEREAS, The Wharton City Council wishes to authorize the Mayor of the City of Wharton to execute all documents related to said application. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS that: City of Wharton City Council Regular Meeting Minutes- January 13, 2025 Page 5 of 12 Section I. The above- listed project, if selected for the TA Set- Aside Program funding by the Texas Department of Transportation, will be placed in the appropriate Transportation Improvement Program for the City of Wharton. Section II. The City of Wharton, Texas, fully supports and authorizes the submission of an application for funding through the Texas Department of Transportation TA Set- Aside Program with the specific goal of sidewalk construction that would include the creation of safe routes to school and ADA-compliant pedestrian accessibility for ADA compliance in Wharton in accordance with the State of Texas regulations. Section III. The City of Wharton feels strongly that the proposed project demonstrates the City of Wharton' s desire to provide safe, ADA- compliant pedestrian routes in Wharton. Section IV. The Cityof Wharton PP supports funding this p J project as described in the 202 5 TA Set- Aside Nomination Form ( including the construction budget, the department' s 15% administrative cost, and the required local match) and is willing to commit to the project' s development, implementation, construction, maintenance, management, and financing. The City of Wharton is willing and able to enter into an agreement with the department by resolution or ordinance should the project be selected for funding. Section V. The Mayor of the City of Wharton is hereby authorized to execute all documents related to said application. Section VI. That this resolution shall become effective immediately upon its passage. The ninth item on the agenda was to review and consider a resolution of the Wharton City Council acceptingg the grant for to- car cameras through H- GAC for the Wharton Police Department and authorizing the Mayor of the City of Wharton to execute all documents related to said grant. Cityof Wharton arto i City Council Regular Meeting Minutes- January 13, 2025 Page 6 of 12 Emergency Management Coordinator, Lt. Ben Guanajuato, stated the Wharton Police Department applied for a grant through the Governor' s Office— Criminal Justice Division to replace the current in- car cameras. Lt. Guanajuato said this grant was funneled through HGAC under the Criminal Justice Grant ( JAG) Program and the cameras the Police Department currently had were nearing the end of life. He said the new cameras were vastly improved, enhancing operability and improving officer safety and accountability. Lt. Guanajuato stated the Police Department was awarded the grant and needed the Council to accept the grant which included purchasing ten( 10) in- car cameras, a new server, maintenance, and warranty, totaling $ 104, 180. 00. After some discussion, Councilmember, Russell Machann, moved to approve City of Wharton Resolution No. 2025- 02, which read as follows: CITY OF WHARTON RESOLUTION NO. 2025- 02 A RESOLUTION OF THE WHARTON CITY COUNCIL ACCEPTING THE GRANT FOR IN- CAR CAMERAS THROUGH H-GAC FOR THE WHARTON POLICE DEPARTMENT AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID GRANT. WHEREAS, The City of Wharton City Council approved a resolution on February 12, 2024, authorizing the submission of a grant for ten ( 10) in-car cameras through H- GAC; and, WHEREAS, The City of Wharton was awarded the grant funding for the ten ( 10) in-car cameras; and, WHEREAS, The Wharton City Council wishes to accept said grant; and, WHEREAS, The Wharton City Council wishes to authorize the Mayor of the City of Wharton to execute all documents related to said grant acceptance. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. That the Wharton Council hereby accepts the grant for in-car cameras through H- GAC for the Wharton Police Department. Section II. That the Wharton City Council hereby authorizes the Mayor of the City of Wharton to execute, on behalf of the City of Wharton, all documents related to said grant acceptance. Section III. That this resolution shall become effective immediately upon its passage. The tenth item on the agenda was to review and consider a resolution of the Wharton City Council authorizing the name change of the Program Director for the FY 2025 SB 224 Catalytic Converter Grant through the Motor Vehicle Prevention Authority for the Wharton Police Department and authorizing the Mayor of the City of Wharton to execute all documents related to said name change. Emergency Management Coordinator, Lt. Ben Guanajuato, stated that on November 12, 2024, the Wharton City Council approved the resolution to submit an application for the FY 2025 SB 224 Catalytic Converter Grant through the Motor Vehicle Prevention Authority for the Wharton Police Department. Lt. Guanajuato said that at the time of approval, Lieutenant Lance Bothell was the designated Program Director, however, Lt. Bothell had retired, and a new Program Director was required for this grant. He said that the City Staff recommended him as the new Program Director. After some discussion, Councilmember, Larry Pittman, moved to approve City of Wharton Resolution No. 2025- 03, which read as follows: CITY OF WHARTON RESOLUTION NO. 2025- 03 A RESOLUTION OF THE WHARTON CITY COUNCIL AUTHORIZING THE NAME CHANGE OF THE PROGRAM DIRECTOR FOR THE FY 2025 SB 224 CATALYTIC CONVERTER GRANT THROUGH THE MOTOR VEHICLE PREVENTION AUTHORITY FOR THE WHARTON POLICE DEPARTMENT AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID NAME CHANGE. WHEREAS, The City of Wharton City Council wishes to authorize the name change of the Program Director for the FY 2025 SB 224 Catalytic Converter Grant through the Motor Vehicle Prevention Authority for the Wharton Police Department; and, WHEREAS, Lance A. Bothell, Lieutenant, to Ben Guanajuato, Lieutenant; and, WHEREAS, The Wharton City Council wishes to authorize the Mayor of the City of Wharton to execute all documents relating to the said name change. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS: SECTION I. The Wharton City Council hereby approves the name change of the Program Director for the FY 2025 SB 224 Catalytic Converter Grant through the Motor Vehicle Prevention Authority for the Wharton Police Department. SECTION II. The City designates Ben Guanajuato, Lieutenant, as the Program Director Officer for this grant. SECTION III. That this resolution shall become effective immediately upon its passage. The eleventh item on the agenda was to review and consider a resolution of the Wharton City Council authorizing and ratifying the purchase of a Stepp SPHD Dump Style Hot Box for the Public Works Department from Kinloch Equipment and Supply through the BuyBoard Cooperative Purchasing Program and authorizing the City Manager of the City of Wharton to execute all documents related to said purchase. Public Works Director, Roderick Semien, stated that on December 19, 2024, it was discovered that the City had a remaining balance of$ 150,000 to spend through the American Rescue Plan Act ( ARPA) funds. Director Semien said this fund City of Wharton City Council Regular Meeting Minutes- January 13, 2025 Page 9 of 12 had a deadline spending date of December 31, 2024, and if not spent, it would have been returned to the Office of Development Programs to be reallocated. He said that after discussions with the Finance Department, a decision was made to allocate the remaining ARPA funds to the Public Works Department for the Capital Improvement Plan. Director Semien stated two specific items identified for this allocation were the Stepp SPHD Dump Style Hot Box, and the Vactor Trailer Series RamJet Sewer Cleaner mounted on a trailer sourced from Kinloch Equipment & Supply and since the deadline for spending the remaining funds was December 31, 2024, and there would not be another City Council meeting before the deadline, Mayor Barker was contacted for guidance. Director Semien said he instructed the Staff to proceed with the purchase and ensure that this item was added to the agenda for the City Council on January 13, 2025, for ratification. After some discussion, Councilmember, Terry Freese, moved to approve City of Wharton Resolution No. 2025- 04, which read as follows: CITY OF WHARTON RESOLUTION NO. 2025- 04 A RESOLUTION OF THE WHARTON CITY COUNCIL AUTHORIZING AND RATIFYING THE PURCHASE OF A STEPP SPHD DUMP STYLE HOT BOX FOR THE PUBLIC WORKS DEPARTMENT FROM KINLOCH EQUIPMENT AND SUPPLY THROUGH THE BUYBOARD COOPERATIVE PURCHASING PROGRAM AND AUTHORIZING THE CITY MANAGER OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID PURCHASE. WHEREAS, The City of Wharton still had a remaining balance from the American Rescue Plam Act( ARPA) Funds; and, WHEREAS, The said fund had a deadline of December 31, 2024; and, WHEREAS, The City of Wharton Public Works Department purchased a Stepp SPHD Dump Style Hot Box from Kinloch Equipment and Supply through the BuyBoard Cooperative Purchasing Program; and, WHEREAS, The total cost of the equipment was in the amount of$ 60, 262. 50; and, WHEREAS, The Wharton City Council ratifies and approves the purchase of a Stepp SPHD Dump Style Hot Box from Kinloch Equipment and Supply through the BuyBoard Cooperative Purchasing Program in the amount of$60, 626. 50 and wishes to authorize the City Manager of the City of Wharton to execute all documents. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. The Wharton City Council hereby ratifies and authorizes the City Manager of the City of Wharton to execute all documents related to the purchase of a Stepp SPHD City of Wharton City Council Regular Meeting Minutes- January 13, 2025 Page 10 of 12 Dump Style Hot Box from Kinloch Equipment and Supply through the BuyBoard Cooperative Purchasing Program in the amount of$60,262.50. WHEREAS, The City of Wharton still had a remaining balance from the American Rescue Plam Act( ARPA) Funds; and, WHEREAS, The said fund had a deadline of December 31, 2024; and, WHEREAS, The City of Wharton Public Works Department purchased a Vactor Trailer Series RamJet Sewer Cleaner Mounted on a Trailer from Kinloch Equipment and Supply through the BuyBoard Cooperative Purchasing Program; and, WHEREAS, The total cost of the equipment was in the amount of$89,946.00; and, WHEREAS, The Wharton City Council ratifies and approves the purchase of a Vactor Trailer Series RamJet Sewer Cleaner Mounted on a Trailer from Kinloch Equipment and Supply through the BuyBoard Cooperative Purchasing Program in the amount of 89, 946. 00 and wishes to authorize the City Manager of the City of Wharton to execute all documents. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section 1. The Wharton City Council hereby ratifies and authorizes the City Manager of the City of Wharton to execute all documents related to the purchase of a Vactor Trailer Series RamJet Sewer Cleaner Mounted on a Trailer from Kinloch Equipment and Supply through the BuyBoard Cooperative Purchasing Program in the amount of 89, 946. 00.
