MINUTES OF CITY OF WHARTON CITY COUNCIL REGULAR MEETING MARCH 10, 2025 Mayor Tim Barker declared a Regular Meeting duly open for the transaction of business at 7: 00 P. M. at City Hall 120 E. Caney Street Wharton, TX. Councilmember Burnell Neal led the opening devotion, and Mayor Tim Barker led the pledge of allegiance. Councilmembers present were: Mayor Tim Barker, and Councilmembers Terry Freese, Burnell Neal; Steve Schneider, Larry Pittman, and Russell Machann. Councilmember absent was: David Voulgaris. Staff members present were: City Manager, Joseph R. Pace; City Secretary/ Assistant City Manager, Paula Favors, CPM, TRMC, MMC; City Attorney, Paul Webb; Finance Director, Joan Andel; Director of Planning and Development, Gwyn Teves, CPM, Public Works Director, Roderick Semien; Police Chief, Terry David Lynch, and Assistant to the City Manager, Brandi Jimenez. Review and Consider: The first item on the agenda was to review and consider the reading of the minutes from the regular meetings held February 10, 2025, and February 24, 2025, and special meeting held February 10, 2025. After some discussion, Councilmember Russell Machann moved to approve the reading of the minutes from the regular meetings held February 10, 2025, and February 24, 2025, and special City of Wharton City Council Regular Meeting Minutes- March 10, 2025 Page 2 of 15 meeting held February 10, 2025. Councilmember Terry Freese seconded the motion. All voted in favor. The second item on the agenda was to review and consider a request from Mr. Eric Muegge on behalf of OJS Investments LLC & Millennium Trust Company LLC to replat a 4. 51 Ac Tract of Martin Allen League, Abstract 1, for sale. Director of Planning & Development Gwyn Teves presented a copy of a request from Mr. Eric Muegge on behalf of OJS Investments LLC & Millennium Trust Company LLC to replat a 4. 51 Ac Tract of Martin Allen League, Abstract 1, for sale. Director Teves stated the Planning Commission met and discussed the request on March 6, 2025, and recommended City Council consider approving it. After some discussion, the Councilmember Russell Machann moved to approve the request from Mr. Eric Muegge on behalf of OJS Investments LLC & Millennium Trust Company LLC to replat a 4. 51 Ac Tract of Martin Allen League, Abstract 1, for sale. Councilmember Terry Freese seconded the motion. All voted in favor. The third item on the agenda was to review and consider a resolution by the City of Wharton, Texas, (" city") regarding the application of CenterPoint Energy Resources Corp., Texas Division, to increase rates under the Gas Reliability Infrastructure Program; suspending the effective date of this rate application for forty- five days; authorizing the City to continue to participate in a coalition of cities now known as the " Alliance of CenterPoint Municipalities- TCUC;" determining that the meeting at which the resolution was adopted complied with the Texas Open Meetings Act; making such other findings and provisions related to the subject; and declaring an effective date. City Manager Joseph R. Pace stated that on or about February 18, 2025, CenterPoint Energy Resources Corp., Texas Division (" CenterPoint") filed for an increase in gas utility rates under the Gas Reliability Infrastructure Program (" GRIP") and proposed increases in the monthly customer charges for all retail customer classes. City Manager Pace said the City had a special responsibility to exercise due diligence with regard to rate increases of monopoly utilities that operate within its boundaries and it was necessary to suspend the effective date for the increase in rates for forty- five days so that the City can assure itself that the data and calculations in CenterPoint' s rate application are correctly done. City Attorney Paul Webb stated he had reviewed all documents and recommended that the City Council approve said resolution. After some discussion, Councilmember Terry Freese moved to approve City of Wharton Resolution No. 2025- 14, which read as follows: CITY OF WHARTON RESOLUTION NO. 2025- 14 A RESOLUTION BY THE CITY OF WHARTON, TEXAS, (" CITY") REGARDING THE APPLICATION OF CENTERPOINT ENERGY RESOURCES CORP., TEXAS DIVISION, TO INCREASE RATES UNDER THE GAS RELIABILITY INFRASTRUCTURE PROGRAM; SUSPENDING THE EFFECTIVE DATE OF THIS RATE APPLICATION FOR FORTY- FIVE DAYS; AUTHORIZING THE CITY TO CONTINUE TO PARTICIPATE IN A COALITION OF CITIES NOW KNOWN AS THE ALLIANCE OF CENTERPOINT MUNICIPALITIES- TCUC;" DETERMINING THAT City of Wharton City Council Regular Meeting Minutes- March 10, 2025 Page 3 of 15 THE MEETING AT WHICH THE RESOLUTION WAS ADOPTED COMPLIED WITH THE TEXAS OPEN MEETINGS ACT; MAKING SUCH OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS THAT: Section 1. That the statements and findings set out in the preamble to this resolution are hereby in all things approved and adopted. Section 2. The City suspends the requested effective date by CenterPoint for forty- five days pursuant to the authority granted the City under Section 104. 301 of the Texas Utilities Code to allow the City to review the data and calculations that provide the basis for CenterPoint' s proposed increase in rates. Section 3. The City shall continue to act jointly with other cities that are part of a coalition of cities now known as the Alliance of CenterPoint Municipalities (" ACM") — Texas Coast Utilities Coalition. Section 4. The City authorizes the law firm of Herrera Law & Associates, PLLC, to act on its behalf in connection with CenterPoint' s application to increase rates. Section 5. To the extent allowed by law, CenterPoint is ordered to pay the City' s reasonable rate case expenses incurred in response to CenterPoint' s rate increase application within 30 days of receipt of invoices for such expenses to the extent allowed by law. Section 6. The meeting at which this resolution was approved was in all things conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. Section 7. All voted in favor. The fourth item on the agenda was to review and consider the Wharton Little League Field Repairs: A. Resolution: A resolution of the Wharton City Council approving the repairs at the Wharton Little League Field and authorizing the Mayor of the City of Wharton to execute all documents related to said repairs. B. Resolution: A resolution of the Wharton City Council approving Coastline Welding for repairs at the Wharton Little League Field and authorizing the Mayor of the City of Wharton to execute all documents related to said repairs. Public Works Director Roderick Semien stated the City Staff received quotes for services to conduct the following repairs at the Wharton Little League Field: 1. Repair remaining hurricane damages: A. Replace the missing tin sheets of metal in the women' s restroom and bleachers where tin sheets are missing. B. Replace the missing siding on the storage building and rebuild the roof on one set of bleachers located at the tee ball field. 2. Seek a certified welder to repair the bleachers' structure between the tee ball field and the main field. Director Semien stated it was stated in the lease agreement that it was the Little League Organization' s responsibility for the repairs and not the City' s. After some discussion, no action was taken. The fifth item on the agenda was to review and consider a resolution of the Wharton City Council authorizing and ratifying the emergency repairs of an 8- inch sewer line on Third Street through Ram Rod Utilities, LLC, and authorizing the City Manager of the City of Wharton to execute all documents related to said repairs. Public Works Director Roderick Semien stated that on February 17, 2025, the Water Department observed a sewer leak underneath the Santa Fe Trail. Director Semien said the leak was identified as an 8- inch sewer line located under the old railroad bridge on Third Street and due to the emergency and the sensitivity of the Santa Fe Trail, the City Staff contacted Ram Rod Utilities, LLC, to repair the 8- inch sewer main. He said that after further inspection, it was concluded that the pipe was salvageable and that the installation of 150 feet of City of Wharton City Council Regular Meeting Minutes- March 10, 2025 Page 6 of 15 cured- in- place pipe ( CIPP) was needed and the estimated repairs were $ 31, 500 from Ram Rod Utilities, LLC, CIPP. After discussion, some Councilmember Terry Freese moved to approve City of Wharton Resolution No. 2025- 15, which read as follows: CITY OF WHARTON RESOLUTION NO. 2025- 15 A RESOLUTION OF THE WHARTON CITY COUNCIL AUTHORIZING AND RATIFYING THE EMERGENCY REPAIRS OF AN 8- INCH SEWER LINE ON THIRD STREET THROUGH RAM ROD UTILITIES, LLC, AND AUTHORIZING THE CITY MANAGER OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID REPAIRS. WHEREAS, Emergency Repairs were needed on an 8- inch sewer line that was leaking on Third Street under the old railroad bridge due to the sensitivity of the Santa Fe Trail; and, WHEREAS, The City of Wharton engaged the services of Ram Rod Utilities, LLC to repair the fl- inch sewer line that involved the installation of 150 feet of cured- in-place pipe( CIPP); and, WHEREAS, The total cost of the repairs was in the amount of$ 31, 500. 00; and, WHEREAS, The Wharton City Council ratifies the emergency repairs through Ram Rod Utilities LLC for the 8- inch sewer line on Third Street and wishes to authorize the City Manager of the City of Wharton to execute all documents. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. The Wharton City Council hereby approves and authorizes the City Manager of the City of Wharton to execute all documents related to said ratification for the emergency repairs of the 8- inch sewer line on Third Street. The sixth item on the agenda was to review and consider an ordinance amending the City of Wharton Code of Ordinances, Chapter 82 Traffic, Article II.— Operation of Vehicles, Sec. 82- 53. Speed Limits, providing that a violation of the ordinance or any part of the code as adopted hereby shall constitute a penalty upon conviction of a fine; providing for severability and setting an date. effective Chief of Police Terry David Lynch presented a copy of the amended City of Wharton Code of Ordinances, Chapter 82 Traffic, Article II.— Operation of Vehicles, Sec. 82- 53. Speed Limits to include the following: Sec. 82- 53. Speed limits-- Specific streets and highways. FM 1301. 5) From a point at its intersection of U. S. 59 Business, Richmond Road, to a point 9, 482 feet West, a distance of approximately 1. 796 of a mile, to be 40 miles per hour. Chief Lynch stated it was the recommendation to set the speed limit for the FM 1301 extension to 40 miles per hour. After some discussion, Councilmember Burnell Neal moved to approve the City of Wharton Ordinance No. 2025- 04, which read as follows: CITY OF WHARTON ORDINANCE NO. 2025- 04 AN ORDINANCE AMENDING THE CITY OF WHARTON CODE OF ORDINANCES, CHAPTER 82 TRAFFIC, ARTICLE II. —OPERATION OF VEHICLES, SEC. 82- 53. — SPEED LIMITS, PROVIDING THAT A VIOLATION OF THE ORDINANCE OR ANY PART OF THE CODE AS ADOPTED HEREBY SHALL CONSTITUTE A PENALTY UPON CONVICTION OF A FINE; PROVIDING FOR SEVERABILITY AND SETTING AN EFFECTIVE DATE. BE IT ORDAINED by the City Council of the City of Wharton, Texas that the City of Wharton Code of Ordinances, Chapter 82 Traffic, Article II. —Operation of Vehicles, Sec. 82- 53. — Speed Limits shall read as follows: ARTICLE II. Penalty Clause Except as otherwise provided in this chapter, any person found guilty of intentionally, knowingly or recklessly violating any provision of this article and upon conviction thereof in the municipal court shall be fined in accordance with the terms of Section 1- 5 of the Code of Ordinances of the City of Wharton, Texas. Severability If any court of competent jurisdiction rules that any section, subsection, sentence, clause, phrase, or portion of this ordinance is invalid or unconstitutional, any such portion shall be deemed to be a separate, distinct, and independent provision, and any such ruling shall not affect the validity of the remaining portions hereof. The seventh item on the agenda was to review and consider a resolution of the Wharton City Council establishing a Consultant Selection Committee and developing evaluation criteria for the selection of a firm to conduct a Compensation Study for all job positions. City Secretary Paula Favors stated that in the current budget, the City allotted a Compensation Survey to be conducted for all personnel positions and a full review of all job descriptions. Mrs. Favors said the study was expected to create a fair, equitable, and market- competitive total compensation system that complies fully with all applicable laws and regulations to establish a long- term employee recruitment plan, in addition to assisting with the retention of current employees. She said it would include an examination of the City' s current compensation system covering approximately 100 full-time positions and provide recommendations for compensation policies, procedures, and overall philosophy. City Secretary Favors stated a Consultant Selection Committee was needed to be able to review the Request for Proposals ( RFPs) received and the Committee would consist of the Human Resource Director, HR Generalist, and the Finance Director. After some discussion, Councilmember Russell Machann moved to approve the City of Wharton Resolution No. 2025- 16, which read as follows: CITY OF WHARTON RESOLUTION NO. 2025- 16 A RESOLUTION OF THE WHARTON CITY COUNCIL ESTABLISHING A CONSULTANT SELECTION COMMITTEE AND DEVELOPING EVALUATION CRITERIA FOR THE SELECTION OF A FIRM TO CONDUCT A COMPENSATION STUDY FOR ALL JOB POSITIONS. WHEREAS, The Wharton City Council wishes to establish a Consultant Selection Committee for the selection of a Compensation Study firm and provide recommendations to the City Council; and, WHEREAS, The Wharton City Council wishes the Consultant Selection Committee to consist of the Finance Director, the Human Resource Director, and the HR Generalist; and, WHEREAS, The Wharton City Council wishes for this Committee to exist until a recommendation is presented to the City Council; and, WHEREAS, The Wharton City Council wishes to establish the criteria for the selection of the consulting firm as per Attachment A. City of Wharton City Council Regular Meeting Minutes- March 10, 2025 Page 10 of 15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS, as follows: Section I. The eighth item on the agenda was to review and consider a resolution of the Wharton City Council authorizing staffto create a Utility Relocation Plan and coordinate with private utilities and public utilities and authorizing the Mayor of the City of Wharton to execute all documents related to said plan. Director of Planning and Development, Gwyn Teves stated the City of Wharton, in partnership with the United States Army Corps of Engineers( USACE), had plans to continue with Phase 2 and Baughman Slough of the Wharton Flood Reduction Project, and as part of the project, it was necessary to create and implement a public and private utility relocation plan. Director Teves said that as part of the reimbursement requirements for USACE, it was necessary to have the City Council provide a resolution authorizing the City Staff to begin utility relocation efforts. After some discussion, Councilmember Russell Machann moved to approve the City of Wharton Resolution No. 2025- 17, which read as follows: CITY OF WHARTON RESOLUTION NO. 2025- 17 i City of Wharton City Council Regular Meeting Minutes- March 10, 2025 Page 11 of 15 A RESOLUTION OF THE WHARTON CITY COUNCIL AUTHORIZING STAFF TO CREATE A UTILITY RELOCATION PLAN AND COORDINATE WITH PRIVATE UTILITIES AND PUBLIC UTILITIES AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID PLAN. WHEREAS, The City of Wharton, in partnership with the United States Army Corps of Engineers USACE), has plans to continue with Phase 2 and Baughman Slough of the Wharton Flood Reduction Project; and, WHEREAS, Multiple private and public utilities have been shown to be in conflict with the construction design and will require relocation; and, WHEREAS, The Wharton City Council wishes to authorize City Staff to create and implement a utility relocation plan and coordinate with all impacted private and public utilities; and, WHEREAS, The Wharton City Council wishes to authorize the Mayor of the City of Wharton to execute all documents related to said plan. Resolution: A resolution ofthe Wharton City Council accepting the Special Warranty Deed from Wharton 55, LLC for Drainage & Detention Reserve and Park Reserve within Wharton Lakes Subdivision and authorizing the Mayor of the City of Wharton to execute the deed. B. Resolution: A resolution of the Wharton City Council authorizing the Mayor of the City of Wharton to execute a Maintenance Agreement with the Wharton Lakes Homeowners Association per the development agreement authorized by the Wharton City Council. Director of Planning & Development Gwyn Teves stated Wharton Lakes had completed Phase 1 and was ready to turn over the 14. 2661- acre Drainage & Detention Reserve and the 0. 4030- acre Park Reserve to the City per the Development Agreement authorized by the City Council on November 15, 2022. Director Teves said the Development Agreement also details in Section 7. 3( b) thereof that Wharton Lakes Homeowners Association, Inc., a Texas corporation ( the HOA"), " shall maintain and operate the open spaces, common areas, right-of-way irrigation systems, detention areas, right- of-way landscaping, screening walls and any other common improvements or appurtenances in the benefitted residential portions of the Property not maintained and operated by the City. Mrs. Teves presented a copy of the draft Maintenance Agreement outlining the responsibilities of the HOA and the City for properties. City Attorney Paul Webb stated he had reviewed both agreements and had no objections. After some discussion, Councilmember Russell Machann moved to approve City of Wharton Resolution No 2025- 18 and City of Wharton Resolution No. 2025- 19, which read as follows: CITY OF WHARTON RESOLUTION NO. 2025- 18 A RESOLUTION OF THE WHARTON CITY COUNCIL ACCEPTING THE SPECIAL WARRANTY DEED FROM WHARTON 55, LLC FOR DRAINAGE & DETENTION RESERVE AND PARK RESERVE WITHIN WHARTON LAKES SUBDIVISION AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE THE DEED. WHEREAS, Wharton 55, LLC has completed construction of Phase 1 and, per the Development Agreement authorized by the Wharton City Council on November 15, 2022, is deeding over the Drainage& Detention Reserve and Park Reserve; and, WHEREAS, The property is a 14. 2661- acre Drainage & Detention Reserve and 0. 4030- acre Park Reserve; and, WHEREAS, The City of Wharton wishes to accept said parcels from Wharton 55, LLC; and, City of Wharton City Council Regular Meeting Minutes- March 10, 2025 Page 13 of 15 WHEREAS, The Wharton City Council wishes to authorize the Mayor of the City of Wharton to execute the deed. WHEREAS, The Wharton City Council wishes to authorize a Maintenance Agreement with the Wharton Lakes Homeowners Association per the Development Agreement authorized by the Wharton City Council; and, WHEREAS, The City of Wharton and Wharton Lakes Homeowners Association wish to be bound by the conditions set forth in said agreement; and, WHEREAS, The Wharton City Council wishes to authorize the Mayor of the City of Wharton to execute the agreement; and, City of Wharton City Council Regular Meeting Minutes- March 10, 2025 Page 14 of 15 WHEREAS, The Wharton City Council wishes this resolution to become effective immediately upon its passage. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS, THAT: Section 1. The Wharton City Council hereby authorizes the Mayor of the City of Wharton to execute a Maintenance Agreement with the Wharton Lakes Homeowners Association. Section 2. The City of Wharton and the Wharton Lakes Homeowners Association are hereby bound by the conditions set forth in the agreement. Section 3. That this resolution shall become effective immediately upon its passage. PASSED, APPROVED, and ADOPTED this 1 Oth day of March 2025.
