MINUTES OF CITY OF WHARTON CITY COUNCIL REGULAR MEETING JUNE 09, 2025 Mayor Tim Barker declared a Regular Meeting duly open for the transaction of business at 7: 00 P. M. at City Hall, 120 E. Caney Street, Wharton, TX. Councilmember Burnell Neal led the opening devotion, and Mayor Tim Barker led the Pledge of Allegiance. Councilmembers present were: Mayor Tim Barker, Councilmembers Terry Freese, Burnell Neal, Steve Schneider, Russell Machann, Larry Pittman, and David Voulgaris. Councilmember absent was: None. Staff members present were: City Manager, Joseph R. Pace; City Secretary/ Assistant City Manager, Paula Favors, CPM, TRMC, MMC; City Attorney, Paul Webb; Finance Director, Joan Andel; Director of Planning and Development, Gwyn Teves, CPM, Assistant to the City Manager, Brandi Jimenez; Police Chief, Terry David Lynch, and Public Works Director, Roderick Semien. Visitors present were: Beth Evans, Susie Carlson, Joe Zimmerman, and Colby Primeaux with the Wharton Journal Spectator. Roll Call and Excused Absences. Public Comments. Mayor Tim Baker called for Public Comments. Wharton Moment. Mayor Tim Baker called for the Wharton Moment. Review and Consider: The first item on the agenda was to review and consider the reading of the minutes from the regular meetings held on May 12, 2025, and May 27, 2025, and special meeting held May 6, 2025. After some discussion, Councilmember Russell Machann moved to approve the reading of the minutes from the regular meetings held on May 12, 2025, and May 27, 2025, and the special meeting held on May 6, 2025. Councilmember Steve Schneider seconded the motion. All voted in favor. The second item on the agenda was to review and consider a request from Ms. Beth Evans to host a Juneteenth Soul Food and R& B Community Feast on June 21, 2025, at Guadalupe Park for the following: A. City funding and/ or grant to cover logistics ( stage, permits, sanitation, marketing). City of Wharton City Council Regular Meeting Minutes- June 09, 2025 Page 2 of 4 B. Use of public space and resources ( Police, EMS, Waste Disposal). C. Promotional support through City communication channels. D. Permission to use a flatbed trailer as a stage for the DJ on the park property. E. Permission to have vendors. F. Waive the City of Wharton Ordinance to allow DJ music and live performances. G. Waive the City of Wharton Alcohol Ordinance to allow public alcohol consumption but not sale. H. Waive all local permit fees. I. Provide one ( 1) dumpster. J. Provide twelve ( 12) trash barrels and trash bags to help keep the park area clean. Ms. Beth Evans presented a request to host a Juneteenth Soul Food and R& B Community Feast on June 21, 2025, at Guadalupe Park from 10: 00 a. m. to 8: 00 p. m. After some discussion, Councilmember Burnell Neal moved to approve the aforementioned items B., D., E., F., G., H., I., and J. Councilmember Russell Machann seconded the motion. All voted in favor. The third item on the agenda was to review and consider a request from Trecon Investments Corp for replat of Wm. Kincheloe, Block 58A for subdivision. Director of Planning & Development Gwyn Teves presented a request from Trecon Investments Corp for a replat of Wm. Kincheloe, Block 58A for a subdivision. Mrs. Teves stated that the Planning Commission met on Monday, June 2, 2025, and voted to approve this item and to recommend the item to the City Council for a final decision. After some discussion, Councilmember Terry Freese moved to approve the request from Trecon Investments Corp for replat of Wm. Kincheloe, Block 58A for subdivision. Councilmember Steve Schneider seconded the motion. All voted in favor. The fourth item on a resolution of the Wharton City Council accepting a proposal for Tax Increment Reinvestment Zone ( TIRZ) Consultant Services and authorizing the Mayor of the City of Wharton to execute all documents related to said contract. Finance Director Joan Andel stated Municap had submitted an Administrative Services Agreement for specialized services in the administration of the Tax Increment Reinvestment Zone ( TIRZ). Mrs. Andel said the City Staff had reviewed the agreement and feels it was necessary to outsource these services to Municap due to the complexity of the TIRZ and to ensure we are in compliance with all necessary reporting aspects. After some discussion, Councilmember Burnell Neal moved to approve City of Wharton Resolution No. 2025- 40, which read as follows: CITY OF WHARTON RESOLUTION NO. 2025- 40 A RESOLUTION OF THE WHARTON CITY COUNCIL ACCEPTING A PROPOSAL FOR TAX INCREMENT REINVESTMENT ZONE ( TIRZ) CONSULTANT SERVICES AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID CONTRACT. City of Wharton City Council Regular Meeting Minutes- June 09, 2025 Page 3 of 4 WHEREAS, The Wharton City Council wishes to accept a proposal between the City of Wharton and Municap, Inc. for Tax Increment Reinvestment Zone( TIRZ) Consultant Services; and, WHEREAS, The Wharton City Council and Municap, Inc. wishes to be bound by the conditions as set forth in the agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. The Wharton City Council hereby accepts a proposal between the City of Wharton and Municap, Inc., for the Tax Increment Reinvestment Zone ( TIRZ) Consultant Services. Section II. The Wharton City Council hereby approves to authorize the Mayor of the City of Wharton to execute the agreement. Section III. The City of Wharton and Municap, Inc. are hereby bound by the conditions as outlined in the agreement. Section IV. That this resolution shall become effective immediately upon its passage. All voted in favor. The fifth item on the agenda was to review and consider the appointments, resignations, and vacancies to the City of Wharton Boards, Commissions, and Committees: A. Resignations. The sixth item on the agenda was to review and consider the City Council Boards, Commissions, and Committee Reports: A. Finance Committee meeting held May 27, 2025. After some discussion, no action was taken. Executive Session 1. City Council may adjourn into an Executive Session in accordance with Sections 551. 074 of the Local Government Code, Revised Civil Statutes of Texas. Final action, decision, or vote, if any with regard to any matter considered in Executive Session shall be made in Open Meeting. Discussion: A. City Manager's Evaluation. Mayor Tim Barker moved the meeting into Closed Session at 7: 09 p. m. Return to Open Session 1. Action on items discussed in Executive Session: A. City Manager's Evaluation. Mayor Tim Barker moved the meeting back into Open Session at 7: 14 p.m. Mayor Tim Barker called for a motion. No motion was made. There being no further discussion, Councilmember David Voulgaris moved to adjourn. All voted in favor.
