MINUTES OF CITY OF WHARTON CITY COUNCIL REGULAR MEETING FEBRUARY 23, 2026 Mayor Tim Barker declared a Regular Meeting duly open for the transaction of business at 7: 00 P. M. at City Hall, 120 E. Caney Street, Wharton, TX. Councilmember Russell Machann led the opening devotion, and Mayor Tim Barker led the pledge of allegiance. Councilmembers present were: Mayor, Tim Barker, and Councilmembers Terry Freese, Russell Machann, Burnell Neal, Steve Schneider, Larry Pittman, and David Voulgaris. Councilmember absent was: None. Staff members present were: City Manager, Joseph R. Pace; City Attorney, Paul Webb; Finance Director, Joan Andel; City Secretary, Paula Favors, TRMC, CPM, MMC; Assistant to City Manager, Brandi Jimenez; Police Chief, Terry David Lynch; and Public Works Director, Roderick Semien. Visitors present were: Sandy Sanders with the Pilot Club of Wharton; Sarah Hudgins with ARC of Wharton, and Susie Carlson. Roll Call and Excused Absences. All members were present. Public Comments. Mayor Tim Barker called for Public Comments. No comments were given. Wharton Moment. Mayor Tim Barker called for Wharton Moments. 1. Councilmember Russell Machann stated the 1071h Wharton Chamber of Commerce banquet would take place on Tuesday, February 24, 2026. 2. Police Chief Terry David Lynch congratulated Lt. Jason Barker on his graduation from the Law Enforcement Management Institute of Texas ( LEMIT). 3. City Manager Joseph R. Pace congratulated Police Chief Terry David Lynch on receiving his official paper degree from Texas A& M. Review and Consider: The first item on the agenda was to review and consider the City of Wharton Financial Report for January 2026. Finance Director Joan Andel presented the City of Wharton Financial Report for January 2026. After some discussion, Councilmember Russell Machann moved to approve the City of Wharton Financial Report for January 2026. Councilmember Steve Schneider seconded the motion. All voted in favor. City of Wharton City Council Regular Meeting Minutes- February 23, 2026 Page 2 of 15 The second item on the agenda was to review and consider amending the City of Wharton Municipal Election 2026: An Ordinance amending City of Wharton Ordinance No. 2026- 01 stating a City Officers Election to be held as a joint election with Wharton County Elections Department for the purpose of electing positions of councilmembers; providing for the date, time, and place of the election and early voting. City Secretary Paula Favors stated the City of Wharton' s contract with Wharton County for Election Service did not reflect the correct dates due to the San Jacinto Holiday. Mrs. Favors said that there would not be Early Voting on Tuesday, April 21 st, 2026. She said the Elections Administrator, Marsha Barbee, informed the City that she contacted the Secretary of State ( SOS), who stated that, for entities that have already signed their Election Agreement, an amendment could be made. City Secretary Favors stated that it was the City Staff s recommendation for the City Council to consider amending the contract, with the only change on page 5 regarding the San Jacinto holiday. After some discussion, Councilmember Terry Freese moved to approve the City of Wharton Ordinance 2026- 02 and 2026- 02b, which read as follows: CITY OF WHARTON, TEXAS ORDINANCE NO. 2026- 02 AN ORDINANCE AMENDING CITY OF WHARTON ORDINANCE NO. 2026- 01 STATING A CITY OFFICERS ELECTION TO BE HELD AS A JOINT ELECTION WITH WHARTON COUNTY ELECTIONS DEPARTMENT FOR THE PURPOSE OF ELECTING POSITIONS OF COUNCILMEMBERS; PROVIDING FOR THE DATE, TIME, AND PLACE OF THE ELECTION AND EARLY VOTING. BE IT ORDAINED by the City Council of the City of Wharton, Texas: Amended Early Voting Dates The early voting by personal appearance for the above- designated election shall take place on the following dates: Mon. All voted in favor. The third item on the agenda was to review and consider a resolution of the Wharton City Council accepting a deed of gift from BRM3 Interests, L. P., and authorizing the Mayor of the City of Wharton to execute all documents related to said deed. City Secretary Paula Favors stated that the City Staff was contacted by Mr. Robert R. Vineyard on behalf of BRM3 Interests, L. P., to inquire about donating a lot to the City. Mrs. Favors said Mr. Vineyard advised that he had received several letters regarding the weedy lot and that maintaining it was a burden since he does not reside in town. Mrs. Favors said that he wished to donate the property to the City. She said the request was forwarded to City Attorney Paul Webb for a title search and concurrence on the advantages of accepting the donation. City Attorney Webb stated the lot abuts another City of Wharton lot and City of Wharton City Council Regular Meeting Minutes- February 23, 2026 Page 5 of 15 Phase 2 of the levee and would provide future access off S. East Ave. to the City' s properties. After some discussion, Councilmember David Voulgaris moved to approve City of Wharton Resolution No. 2026- 14, which read as follows: CITY OF WHARTON RESOLUTION NO. 2026- 14 A RESOLUTION OF THE WHARTON CITY COUNCIL ACCEPTING A DEED OF GIFT FROM BRM3 INTERESTS, L.P. AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID DEED. WHEREAS, BRM3 Interests, L. P. wishes to donate a 0. 1674- acre tract of land, known as Lot 9, Block 59, Wharton, Wharton County, Texas, to the City of Wharton; and, WHEREAS, The City of Wharton wishes to accept said parcel from BRM3 Interests, L.P.; and, WHEREAS, The Wharton City Council wishes to authorize the Mayor of the City of Wharton to execute all documents related to said deed. All voted in favor. City of Wharton City Council Regular Meeting Minutes- February 23, 2026 Page 6 of 15 The fourth item on the agenda was to review and consider a resolution of the Wharton City Council approving Amendment No. 3 extending the lease agreement between the City of Wharton and ARC of Wharton for a new 10- year term lease period beginning November 1, 2027, and authorizing the Mayor of the City of Wharton to execute the agreement. The City Secretary presented a copy of a letter from ARC President Sarah Hudgins requesting renewal of the lease agreement between the City of Wharton and ARC of Wharton. Mrs. Favors stated the renewal was for an additional ten ( 10) years, and after that term, it would be until one party requests termination of the lease with one ( 1) year' s notice. After some discussion, Councilmember Terry Freese moved to approve the City of Wharton Resolution No. 2026- 15, which read as follows: CITY OF WHARTON RESOLUTION NO. 2026- 15 A RESOLUTION OF THE WHARTON CITY COUNCIL APPROVING AMENDMENT NO. 3 EXTENDING THE LEASE AGREEMENT BETWEEN THE CITY OF WHARTON AND ARC OF WHARTON FOR A NEW 10- YEAR TERM LEASE PERIOD BEGINNING NOVEMBER 1, 2027, AND AUTHORIZING THE MAYOR OF THE CITY OF WHARTON TO EXECUTE THE AGREEMENT. WHEREAS, The City of Wharton and ARC of Wharton entered into a lease agreement; and, WHEREAS, The lease agreement is due to terminate on October 31, 2027; and, WHEREAS, The City of Wharton and ARC of Wharton hereby wish to extend the lease agreement as per Section 15 of the original lease for an additional ten( 10) year period beginning November 1, 2027; and, WHEREAS, The Wharton City Council wishes to approve the lease agreement extension; and, WHEREAS, The Wharton City Council wishes to authorize the Mayor of the City of Wharton to execute the agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. That the Wharton City Council hereby approves the lease agreement Amendment No. 3 extension for an additional ten( 10) year period with ARC of Wharton. Section II. That the City Council of the City of Wharton hereby authorizes the Mayor of the City of Wharton to execute the amendment to the afore- mentioned lease agreement. Section III. That this resolution shall become effective immediately upon its passage. The fifth item on the agenda was to review and consider a resolution of the Wharton City Council authorizing and ratifying the emergency repairs of a sewer pipe on South Cloud and Burleson Street through Ram Rod Utilities, LLC, and authorizing the City Manager of the City of Wharton to execute all documents related to said repairs. Public Works Director Roderick Semien stated that on February 10, 2026, the Public Works Department was contacted about a sinkhole near the corner of South Cloud Street and West Burleson Street. Director Semien said that after an investigation, it was determined that the sinkhole resulted from a broken clay sewer pipe. He said the Water Department attempted numerous times to locate the section of pipe to tie in, but was unsuccessful, and it was decided to contact Ram Rod Utilities to replace the entire line due to its failedintegrity. Director Semien stated the total cost of the repairs was $ 42, 532. 25. After some discussion, Councilmember Terry Freese moved to approve the City of Wharton Resolution No. 2026- 16, which read as follows: CITY OF WHARTON RESOLUTION NO. 2026- 16 A RESOLUTION OF THE WHARTON CITY COUNCIL AUTHORIZING AND RATIFYING THE EMERGENCY REPAIRS OF A SEWER PIPE ON SOUTH CLOUD AND BURLESON STREET THROUGH RAM ROD UTILITIES, LLC, AND AUTHORIZING THE CITY MANAGER OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID REPAIRS. WHEREAS, Emergency repairs were needed on a sewer pipe on South Cloud and Burleson Street after the discovery of a sinkhole; and, WHEREAS, The City of Wharton engaged the services of Ram Rod Utilities, LLC to repair the sewer pipe; and, WHEREAS, The total cost of the repairs was in the amount of$ 42, 532. 25; and, City of Wharton City Council Regular Meeting Minutes- February 23, 2026 Page 8 of 15 WHEREAS, The Wharton City Council ratifies the emergency repairs through Ram Rod Utilities LLC for the sewer pipe on South Cloud and Burleson Street and wishes to authorize the City Manager of the City of Wharton to execute all documents. The sixth item on the agenda was to review and consider a resolution of the Wharton City Council authorizing and ratifying the emergency repairs of a pump at Well # 1 and Well # 3 on Alabama Street and authorizing the City Manager of the City of Wharton to execute all documents related to said repairs. Public Works Director Roderick Semien stated that on January 20, 2026, a routine inspection at 1015 N. Alabama St. found inefficiencies in the booster pumps at Wells # 1 and # 3. Director Semien said that after further inspection, the pumps' internal components were worn out and unable to perform their intended function, and to restore the booster pump to its original specs, the following purchases were required. Precision Pump Systems Assembly Kit 11, 500. 00 Pumps of Houston, Inc. Check Valve 1, 964. 00 Director Semien requested that the City Council consider ratifying the purchase of the pump system assembly kit and the check valve. After some discussion, Councilmember Russell Machann moved to approve City of Wharton Resolution No. 2026- 17, which read as follows: CITY OF WHARTON City of Wharton City Council Regular Meeting Minutes- February 23, 2026 Page 9 of 15 RESOLUTION NO. 2026- 17 A RESOLUTION OF THE WHARTON CITY COUNCIL AUTHORIZING AND RATIFYING THE EMERGENCY REPAIRS OF A PUMP AT WELL 01 AND WELL# 3 ON ALABAMA STREET AND AUTHORIZING THE CITY MANAGER OF THE CITY OF WHARTON TO EXECUTE ALL DOCUMENTS RELATED TO SAID REPAIRS. WHEREAS, Emergency repairs were needed on a pump at Well# 1 and Well# 3 on Alabama Street; and, WHEREAS, The total cost of the repairs was in the amount of$ 13, 464. 00; and, WHEREAS, The Wharton City Council ratifies the emergency repairs for the pump at Well# 1 and Well # 3 on Alabama Street and wishes to authorize the City Manager of the City of Wharton to execute all documents. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. The Wharton City Council hereby approves and authorizes the City Manager of the City of Wharton to execute all documents related to said ratification for the emergency repairs of the pump. The seventh item on the agenda was to review and consider the Wharton Police Department Annual Contact Report for 2025. Chief of Police Terry David Lynch presented a copy of the memorandum dated February 6, 2026, from him to City Manager Joseph R. Pace, submitting the City of Wharton 2025 Annual Contact Report( Racial Profiling Report) in accordance with Senate Bill 1074. After some discussion, Councilmember Terry Freese moved to approve the Wharton City of Wharton City Council Regular Meeting Minutes- February 23, 2026 Page 10 of 15 Police Department Annual Contract Report for 2025. Councilmember Russell Machann seconded the motion. All voted in favor. The eighth item on the agenda was to review and consider a request from Chief of Police Terry Lynch regarding the 8th Annual Cops ` n Rodders Car Show for the following: A. Waive all fees associated with renting the Wharton Civic Center. B. Allow participants and spectators to utilize restroom facilities in the Civic Center. C. Allow the use of food trucks/vendors and waive permit fees. D. Allow the consumption of alcoholic beverages on the outdoor premises of the Civic Center. E. Allow the Police Department to close the roadway of University Street from Fulton Street to the entrance of the Department of Human Services Driveway prior to and throughout the duration of the event( 8: 00 a. m. — 4: 00 p.m.). F. Use of the blue trash cans and liners from the Parks Department. G. Have the street sweeper sweep the parking area of the Civic Center on April 24, 2026. H. Should it rain, allow the potential fallback day on April 26, 2026. Chief Lynch presented a request regarding the 7th Annual Cops `n Rodders Car Show on April 25, 2026, at the Wharton Civic Center. After some discussion, Councilmember Russell Machann moved to approve the aforementioned items A. through H. Councilmember Larry Pittman seconded the motion. All voted in favor. The ninth item on the agenda was to review and consider a request from Chief of Police Terry David Lynch regarding the Touch- A-Truck event for the following: A. Use of Riverfront Park without fees. B. Clean the park restrooms before the event. C. Road Closure of 100 East Elm Street at South Fulton Street to 300 East Elm Street at South Resident Street. D. Use of City barricades. E. Allow the use of food trucks/ vendors and waive permit fees. F. Have the Street Sweeper sweep the area on March 13, 2026. Chief Lynch presented a request to hold the Touch- A-Truck event on Saturday, March 7, 2026. After some discussion, Councilmember Terry Freese moved to approve the aforementioned items A. through F. Councilmember Larry Pittman seconded the motion. All voted in favor. The tenth item on the agenda was to review and consider the Texas Water Development Board Water Supply 1 and Infrastructure Grant Consultant Selection Committee for Administration and Engineering Services: A. Resolution: A resolution of the Wharton CityCouncil authorizingg thee C i Ty Staff to issue Requests for Qualifications ( RFQ) for engineering services, establishing a consultant selection committee, and developing evaluation criteria for the selection of engineering City of Wharton City Council Regular Meeting Minutes- February 23, 2026 Page 11 of 15 services for the Texas Water Development Board Water Supply and Infrastructure Grant WSIG). B. Resolution: A resolution of the Wharton City Council authorizing the City Staff to issue Requests for Proposals ( RFP) for administrative services, establishing a consultant selection committee, and developing evaluation criteria for the selection of administrative services for the Texas Water Development Board Water Supply and Infrastructure Grants WSIG) for grant application and management. City Secretary Paula Favors stated that the Texas Water Development Board( TWDB) had opened a grant funding opportunity for Water Supply and Infrastructure, and that the City had several project needs that would be eligible for the funding. Mrs. Favors said it was the City Staff s recommendation that the City Council authorize the City Staff to issue requests for proposals RFP) for administrative services and requests for qualifications (RFQs) for engineering services related to the Texas Water Development p Board Water SupplyY and Infrastructure Grant and establish consultant selection committees for both administrative services and engineering services for the program. After some discussion, Councilmember Russell Machann moved to approve City of Wharton Resolution No. 2026- 18 and 2026- 19, which read as follows: CITY OF WHARTON RESOLUTION NO. 2026- 18 A RESOLUTION OF THE WHARTON CITY COUNCIL AUTHORIZING THE CITY STAFF TO ISSUE REQUESTS FOR QUALIFICATIONS ( RFQ) FOR ENGINEERING SERVICES AND ESTABLISHING A CONSULTANT SELECTION COMMITTEE AND DEVELOPING EVALUATION CRITERIA FOR THE SELECTION OF ENGINEERING SERVICES FOR THE TEXAS WATER DEVELOPMENT BOARD WATER SUPPLY AND INFRASTRUCTURE GRANT ( WSIG). WHEREAS, The Wharton City Council wishes to authorize City Staff to issue Requests for Qualifications ( RFQ) for Engineering Services for the Texas Water Development Board Water Supply and Infrastructure Grant( WSIG); and, WHEREAS, The Wharton City Council wishes to establish a Consultant Selection Committee for the Texas Water Development Board Water Supply and Infrastructure Grant WSIG) and provide recommendations to the entire City Council; and, WHEREAS, The Wharton City Council wishes the Consultant Selection Committee to consist of the Finance Director, the Public Works Director, and the Director of Planning& Development; and, WHEREAS, The Wharton City Council wishes for this Committee to exist until a recommendation is forwarded to the entire City Council; and, WHEREAS, The Wharton City Council wishes to establish the criteria of selection of the consulting firm as per Attachment A. City of Wharton City Council Regular Meeting Minutes- February 23, 2026 Page 12 of 15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. That the Wharton City Council hereby authorizes City Staff to issue Requests for Qualifications ( RFQ) for Engineering Services for the Texas Water Development Board Water Supply and Infrastructure Grant( WSIG). Section II. That the Wharton City Council hereby establishes the City Council Consultant Selection Committee. Section III. That the Wharton City Council Consultant Selection Committee will consist of the Finance Director, the Public Works Director, and the Director of Planning & Development. Section IV. That the criteria as set forth in Attachment A are hereby approved. Section V. CITY OF WHARTON, TEXAS By: TIM BARKER Mayor ATTEST: PAULA FAVORS City Secretary CITY OF WHARTON RESOLUTION NO. 2026- 19 A RESOLUTION OF THE WHARTON CITY COUNCIL AUTHORIZING THE CITY STAFF TO ISSUE REQUESTS FOR PROPOSALS ( RFP) FOR ADMINISTRATIVE SERVICES AND ESTABLISHING A CONSULTANT SELECTION COMMITTEE AND DEVELOPING EVALUATION CRITERIA FOR THE SELECTION OF ADMINISTRATIVE SERVICES FOR THE TEXAS WATER DEVELOPMENT BOARD WATER SUPPLY AND INFRASTRUCTURE GRANTS ( WSIG) FOR GRANT APPLICATION AND MANAGEMENT. City of Wharton City Council Regular Meeting Minutes- February 23, 2026 Page 13 of 15 WHEREAS, The Wharton City Council wishes to authorize the City Staff to issue Requests for Proposals ( RFP) for Administrative Services for the Texas Water Development Board Water Supply and Infrastructure Grant( WSIG); and, WHEREAS, The Wharton City Council wishes to establish a Consultant Selection Committee for the Texas Water Development Board Water Supply and Infrastructure Grant WSIG) and provide recommendations to the entire City Council; and, WHEREAS, The Wharton City Council wishes the Consultant Selection Committee to consist of the Public Works Director, Finance Director and the Director of Planning & Development; and, WHEREAS, The Wharton City Council wishes for this Committee to exist until a recommendation is forwarded to the entire City Council. WHEREAS, The Wharton City Council wishes to establish the criteria of selection of the consulting firm as per Attachment A. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHARTON, TEXAS as follows: Section I. That the Wharton City Council hereby authorizes City Staff to issue Requests for Proposals ( RFP) for Administrative Services for the Texas Water Development Board Water Supply and Infrastructure Grant( WSIG). Section II. That the Wharton City Council hereby establishes the City Council Consultant Selection Committee. Section III. The Wharton City Council Consultant Selection Committee will consist of the Public Works Director, Finance Director, and the Director of Planning & Development. Section IV. That the criteria as set forth in Attachment A are hereby approved. Section V.
