CITY COUNCIL SPECIAL MEETING
NOVEMBER 18, 2019
Mayor Tim Barker declared a Regular Meeting duly open for the transaction of business at 7: 00
P. M at City Hall 120 E. Caney Street Wharton, TX. Councilmember Russell Machann led the
opening devotion and Mayor Tim Barker led the pledge of allegiance.
Councilmember' s present were: Mayor Tim Barker and Councilmembers Terry Freese,
Alice Heard-Roberts, Clifford Jackson, Russell Machann,
Don Mueller and Steve Schneider.
Councilmember absent was: None.
Staff members present were: City Manager Andres Garza, Jr, City Attorney Paul Webb,
Finance Director Joan Andel, City Secretary Paula Favors,
TRMC, CPM, MMC, Assistant to the City Manager
Brandi Jimenez, and Community Development Director
Gwyn Teves.
Visitors present were: Ernest J. Macha, Rosemary Rust, and Cindy Hernandez.
Roll Call and Excused Absences. All Councilmembers were present.
Public Comments. Mayor Tim Barker called for Public Comments. No comments were given.
Wharton Moment. No comments were given.
Public Hearing
Mayor Tim Barker opened the Public Hearing at 7: 01 p.m.
1. Public Hearing: Proposed annexation to enlarge and extend the boundary limits of said city
for areas in the City of Wharton' s Extra-Territorial Jurisdiction( ETJ) for Annexation:
An annexation measured from the southwestern corner of the intersection of US 59 and
FM 1161 consisting of a 14. 508 acre tract and the TxDOT right of way of US 59 and
including approximately 10 acres at the northwest corner of the 380 acre property southeast
of US 59 and FM 1161. The southernmost boundary line of the annexation is the northern
most line of the area annexed in City of Wharton Ordinance No. 2019- 25 and north of
Ponderosa Road. The Northernmost line of the annexation is 1, 200 feet north of the
northern most line of the area annexed in the City of Wharton Ordinance No. 2019- 25 and
south of FM 1161. To include any adjacent areas which will be considered by the Wharton
City Council for annexation into the City of Wharton' s corporate City limits.

Mr. Ernest J. Macha stated that it was his wish that they City Council consider to not do anything
that would hinder the Hungerford Municipal Utility District ( MUD). Mr. Macha said the MUD
was doing a good job and to please leave that part of Hungerford alone. City Manager Andres
Garza, Jr. stated that the City would be looking into ways to partner with the MUD in the upcoming
months.
There being no further discussion, Mayor Tim Barker closed the Public Hearing at 7: 05 p.m.
Adjournment. There being no further discussion, Councilmember Don Mueller moved to
adjourn. Councilmember Clifford Jackson seconded the motion. All voted in favor.
The meeting adjourned at 7: 06 p. m.

November 18, 2019 at 7:00 PM at the Wharton City Hall, 120 East Caney Street, Wharton, Texas,
at which time the following subjects will be discussed to-wit:

I, the undersigned authority, do hereby certify that the above Notice of Meeting of the
Special City Council Meeting is a true and correct copy of said Notice and that I posted a true and
correct copy of said Notice on the bulletin board, at City Hall of said City or Town in Wharton,
Texas, a place convenient and readily accessible to the general public at all times, and said Notice
was posted on November 14, 2019 at 4:30 p.m. and remained so posted continuously for at least
72 hours preceding the scheduled time of said Meeting.
