BOARD OF APPEALS ZONING CALENDAR NO AGENDA 7:00 P.M. SEPTEMBER 2, 2015 Z-2015-8 Mr. Victor Caceres, 18-20 West Post Road, SBL 130.26-11-6. Application for change of occupancy. A review of drawings A-1 to A-4 dated November 7, 2014 prepared by DeVita Architects, AIA indicates a proposed change of occupancy. The premises are located in the B-3 Zone where the proposed restaurant is a Special Permit Use. The Planning Board is the approving agency but the proposed use is dimensionally non- conforming with respect to off street parking. Therefore, the following area variance is required prior to submission to the Planning Board for Special Permit approval: Required Existing Proposed Variance 1. Required Off Street 21 5 5 16 Parking Space Z-2015-17 Mr. Stephen Mezzo, 905 North Street, SBL 131.19-4-3. Application A fence with Pergola. A review of the survey and literature submitted with the application dated May 11, 2015, indicates the proposed installation of a six foot (6') high fence with entrance Pergola. The proposed fence is to be installed along the side lot line fronting North Street. Section 4.4.16 of the White Plains Zoning Ordinance states in part, that fence height shall not exceed four feet (4') when located in any required yard abutting a street. Therefore, an area variance is requested. Z-2015-20 Mr. Steven Fugarino, 12 Elmwood Road, SBL 138.10-18-5. Application for an in-ground swimming pool. A review of drawing A-1, dated March 13, 2015, prepared by Max Parangi Architects, indicates the proposed installation of an in-ground pool. Currently, a six (6') foot high fence encloses the side and rear yards. The proposed plan indicates that the existing six foot fence will be within 25'-0" of the pool edge for approximately 50% of the pool perimeter. The remaining fence enclosing the pool will be a new 4'-0" high fence designed to meet the New York State Residential Code. Since this deviates from Section 4.4.24.7 of the Zoning Ordinance for pool fencing, an area variance is requested in order to comply with the Special Permit. A review of the survey prepared by Richard Spinelli and dated January 16, 2012, indicates the location of current improvements, buildings and structures to the parcels that comprise the above referenced property. The premises are located in the R1-30 Residential Zone where the nursery is a legally non-conforming business. Additional concrete block bin structures, for material storage, were constructed by the previous owner on a parcel that was not part of the original property that comprised the legally non-conforming nursery use. Therefore, the applicant is requesting a use variance for expansion of use into the subsequently obtained residential parcel. Z-2015-22 Mr. & Mrs. Mariano Rivera, 425 Ridgeway, SBL 131.14-10-1.1. Application for a new one family. A review of drawings A-001.00 to A-016.00 and A-020.00 to A-024.00 dated July 15, 2015, prepared by Annunziata & Villani Design Consultants, indicates a proposed new one (1) family dwelling. The property is located in the R1-12.5 Zone. Per Section 5.3, Schedule of Dimensional regulation and footnote “u", the new dwelling will require the following area variances: Required Existing Proposed Variance 1. All Building Coverage 8,000 s.f. – 11,757 s.f. 3,757 s.f. 2. Main Building Coverage 5,000 s.f. – 5,720 s.f. 720 s.f. 3. Maximum Height - Feet 30' 0” 35' 2" 5' 2" NEW APPLICATIONS NO APPEARANCE Z-2015-23 Douglas Hirshon & Jerusha Coltof, 14 Grandview Avenue, SBL 130.12-6-6. Application for an addition. A review of the drawings A-1 and A-2 dated July 2, 2015, prepared by Wile Associates, indicates a one (1) story rear yard addition. The premises are located in the R1-5 Zone and the existing dwelling is legally non-conforming with respect to side yard setbacks. The proposed addition will increase the non- conformity and will require the following area variance: Required Existing Proposed Variance 1. A review of the drawings SP-1 dated June 10, 2015 and A-1, A-2 dated June 15, 2015, prepared by High Point Engineering, indicates the proposed conversion of three(3) automotive service bays into a convenience store. The premises are located in the B-3 Zone where a motor vehicle service station is a Special Permit Use per Section 5.1, Use Regulations. The approving agency for such Special Permit is the Board of Appeals. The proposed convenience store is an accessory to the existing service station and will require an amendment to the Special Permit.
