Agenda
BOARD OF APPEALS ZONING
CALENDAR NO AGENDA 7:00 P.M. MARCH 7, 2018
Z-2017-13 Marianina Corp./ Frank Codella, 34 East Post Road, SBL 130.27-2-4. Application
for a new convenience store. A review of the drawings prepared by Norman
DiChiara Architect, dated June 6, 2017, indicates the construction of a new 990
square foot accessory convenience store building to replace the existing smaller
one. The premises are located in the B-3 Zone where a motor vehicle service
station is a special permit use per Section 5.1 Use Regulations. The approving
agency for such special permit is the Board of Appeals. The proposed
convenience store building accessory to the existing service station will require an
amendment to the special permit.
Z-2018-5 White Plains Hospital Center, 34 East Post Road, SBL 130.27-2-4.
Application to Appeal the December 18, 2017 determination of the Commissioner
of Buildings for an amendment to a special permit for a service station to allow
construction of a convenience store.
Z-2018-4 Dr. Ira Kotler, 10 Old Mamaroneck Road, SBL 130.36-8-5. Application for
change of tenancy. A review of your building permit application and attached
floor plan indicates the present first floor suite is an office space for physician and
dentist under a Special Permit Use. The office suite is located in a Multi-Family
Residential Dwelling in the RM-0.35 Zone. Unable to sell the space to another
physician or dental practice, the applicant requests a use variance in order to offer
the space to be used as a Business or Professional Office of professional persons,
which is not a permitted use in this Zone.
Z-2018-6 CJ Developers LLC, 32 Independence Street, SBL 125.72-4-23. Application
for garage conversion. A review of Drawing A-1 dated January 3, 2018, prepared
by Stephen Marchesani, R.A., indicates the proposed conversion of the existing
attached garage into habitable space. The conversion to a master bedroom will
eliminate one parking space and result in violation of Section 8.6.1.4 of the White
Plains Zoning Ordinance which limits parking in the front yard. Specifically,
parking is prohibited in the front yard unless it is immediately contiguous to and
an extension of a garage which is integral with the residence. The premises are
located in the R2-4 Zone and are legally existing non-conforming with respect to
main building coverage, lot area, frontage and side yard setbacks. The proposed
conversion will require the following area variances:
Required Existing Proposed Variance
1. Required off street parking 2 2 1 1
2. Section 8.6.1.4 of White Plains Zoning Ordinance
Z-2018-7 White Plains Healthcare Properties, 120 Church Street, SBL 125.67-3-1.
Application for a retaining wall. A review of drawings RW-1.0 to RW-6.0 dated
September 1, 2017 and SRW design calculations dated October 16, 2017,
prepared by ERS, indicate the construction of a segmented retaining wall (SRW)
along the easterly property line. The wall exceeds the height limits of Section
4.4.16 of the White Plains Zoning Ordinance for nearly half its length. In
addition, the vehicle guard constructed on top of the wall along the access
driveway of the neighboring property is solid and not of 3/4 open construction.
Therefore, the applicant requests a variance of Section 4.4.16 for the retaining
wall.
Z-2018-11 Saber Chauncey, WP, LLC, 70-106 Westchester Avenue, SBL 126.61-3-11-14
26-29. Application for new development. A review of the above referenced
application and drawings submitted on behalf of Saber Chauncey WP, LLC, for
special permits to construct a mixed use development indicates that the proposed
building adjacent to Westchester Avenue has a 5'-0" setback. Per the Zoning map
of the City of White Plains there is a 15'-0" special building setback along this
block. According to Section 4.4.12 of the White Plains Zoning Ordinance, no
building, structure or parking lot shall be located therein. Therefore, the applicant
requires a 10'-0" variance to the special building setback.
NEW APPLICATIONS NO APPEARANCE
Z-2018-8 Ms. Nancy Skor-Ressler, 4 Mileview Avenue, SBL 130.20-18-14.
Application for an addition. A review of drawings A-1 through A-20 with latest
date of January 31, 2018 prepared by Kent Johnsson Architect, indicates the
proposed construction of a front yard and rear yard addition along with
a second story addition over the existing first story. The applicant previously
received an area variance for this work on December 8, 2016, but it expired by
limitation when no work was started. The property is located in the R1-12.5 Zone
and is legally non conforming with respect to lot area, lot frontage, main building
coverage, one side yard and combined two side yard setback. The proposed
addition will require the following area variances:
Required Existing Proposed Variance
1. One Side Yard Setback(South) 20'-0" 7.5' 7.5' 12.5'
One Side Yard Setback(North) 20'-0" 19.3' 19.3' 0.7'
2. Main Building Coverage 18% 18.6% 23.2% 5.2%
3. Combined Coverage 40'-0" 26.8' 26.8' 13.2'
Z-2018-9 Mr. Michael Guglielmo, 94 Beverly Road, SBL 131.17-7-55. Application
for an addition. A review of drawings T-1, D-1, N-1 and A-1 to A-4 with latest
date of May 5, 2017 prepared by Joseph DiSisto, P.E. and certified unchanged and
current by his letter dated February 9, 2018, indicates a two(2) story rear yard
and one (1) story side yard addition to the existing one family dwelling.
The property is located in the R1-5 Zone. The proposed additions will
require the following area variances:
Required Existing Proposed Variance
1. One Side Yard 7'-0" 21'-10 ½ " *1'-10 ½ " 5'-1 ½"
2. Rear Yard 25'-0" 29'-0" 22'-0" 3'-0"
* Measured to edge of eave since Section 4.4.14.2 limits eaves to be
no closer than 4'-0" to lot line.
Z-2018-10 Ms. Rachel Federman, 27 Linda Avenue, SBL 130.12-8-1. Application
for an addition. A review of drawings A-1, A-3 and A-4 dated February 6, 2018,
prepared by Jacob J. Goldberg Architects, indicates a partial second floor addition
over existing first floor. The property is located in the R1-5 Zone and is legally
existing non-conforming with respect to the front yard setback. The proposed
second story addition will require the following area variance:
Required Existing Proposed Variance
1. Front Yard 25'-0" 15.1' 18.2' 6.8'
Z-2018-12 Ms. Amy Glass, 134 Hillair Circle, SBL 138.09-11-9.1 Application for
an addition. A review of drawings A1 to A8, with revision date of
February 6, 2018, prepared by Hamlin Goldreyer Architects, indicates a proposed
partial second story addition over the existing one story portion of the dwelling.
The property is located in the R1-20 Zone and is existing legally non-conforming
with respect to side yard setbacks. The proposed addition will increase this non-
conformity and will therefore require the following area variances:
Required Existing Proposed Variance
1. One Side Yard Setback 20'-0" 16.26' 16.26' 3.74'
2. Combined Two Side Yard Setback 40'-0" 37.26' 37.26' 2.74'
