Smayda The Special Meeting of the Common Council called for Monday, January 28, 2013, at six o'clock in the evening in the Mayor's Conference Room, Municipal Building. Mayor Roach presiding and the following Members present: Mr. Boykin, Mr. Kirkpatrick, Mr. Krolian, Mrs. Lecuona, Mr. Martin and Mrs. Smayda. ________ The Special Meeting was called to consider ordinances in relation to the employment of Special Counsel to provide services relating to land use matters, in an amount not to exceed $15,000, the initiation of an action to recoup funds expended or to be expended from the City's Self Insurance Fund, and a resolution regarding applications for the City to execute as landlord, to permit the White Plains Performing Arts Center to sell alcoholic beverages at performances, and to discuss the Housing Choice Voucher Program (Section 8). ________ Communication received from Corporation Counsel. Mrs. Smayda moved that it/they be filed and spread in full upon the minutes. Mrs. Lecuona seconded the motion. Carried. TO THE HONORABLE MAYOR AND MEMBERS OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS Submitted herewith for your consideration is an ordinance authorizing the Corporation Counsel to employ Carried. TO THE HONORABLE MAYOR AND MEMBERS OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS Submitted herewith for your consideration is an ordinance authorizing the Corporation Counsel to employ special counsel to provide services relating to land use matters, in an amount not to exceed $15,000. ____ John G. Callahan Corporation Counsel Dated: January 23, 2013 (For the Common Council Special Meeting of January 28, 2013) ________ Mrs. Smayda offered the following ordinance and asked unanimous consent to move its adoption, "Ordinance of the Common Council of the City of White Plains authorizing the Corporation Counsel to employ Special Counsel relating to land use matters." Unanimous consent granted. Mrs. Smayda moved adoption of the ordinance. AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS AUTHORIZING THE CORPORATION COUNSEL TO EMPLOY SPECIAL COUNSEL RELATING TO LAND USE MATTERS. The Common Council of the City of White Plains hereby ordains and enacts as follows: Section 1. The Corporation Counsel is hereby authorized to employ special counsel to provide services in connection with land use matters. The total amount payable for these services shall not exceed $15,000, including reasonable disbursements. Section 2. In order to provide funding for the above professional services, the Mayor is hereby authorized to direct the Budget Director to make the following transfer: TRANSFER FROM: A0002-9.990 Reserve for Financing TRANSFER TO: A011-4.004 Consultants Section 3. This ordinance shall take effect January 25, 2013. Mr. Martin seconded the motion. TO THE HONORABLE MAYOR AND MEMBERS OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS Submitted herewith for your consideration is an ordinance authorizing the Corporation Counsel to initiate an action to recoup funds expended or to be expended from the City's Self Insurance Fund and to employ special counsel to provide legal services for said purpose. Funds for this purpose are available in the Self Insurance Fund FY 2012-13 Budget. ____ John G. AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS AUTHORIZING THE CORPORATION COUNSEL TO INITIATE AN ACTION TO RECOUP FUNDS EXPENDED OR TO BE EXPENDED FROM THE CITY'S SELF INSURANCE FUND AND TO EMPLOY SPECIAL COUNSEL FOR SAID PURPOSE. The Common Council of the City of White Plains hereby ordains and enacts as follows: Section 1. The Corporation Counsel is hereby authorized to initiate an action to recoup funds expended or to be expended from the City's Self Insurance Fund and to employ special counsel for said purpose. The total amount payable for these services shall not exceed $50,000, including reasonable disbursements. Section 2. The Commissioner of Finance is hereby authorized to expend sufficient funds to pay for the above professional services from the Self Insurance Fund FY 2012-13 Budget. Section 3. The ordinance shall take effect immediately. Mr. Martin seconded the motion. To the Honorable Mayor and Members of the Common Council of The City of White Plains: At the request of the White Plains Performing Arts Center, the Common Council previously authorized the Mayor to execute New York State Liquor Authority Special Event Permit Applications to sell and serve alcoholic beverages during certain performances during the month of December 2012 held in space owned by the City at 11 City Place. Such applications require the authorization of the landlord of the space where the sale of alcoholic beverages will take place The White Plains Performing Arts Center has requested that they be authorized to apply to the New York State Liquor Authority for Special Event Permit Applications to sell and serve alcoholic beverages during future performances to be held at the theater. Submitted for your consideration is an ordinance which authorizes the Mayor, on behalf of the City as landlord to execute such applications to allow the White Plains Performing Arts Center to sell and serve liquor at all future performances. ____ John G. Callahan Corporation Counsel Dated: January 25, 2013 (for the January 28, 2013 meeting of the Common Council) ________ Mrs. Smayda offered the following resolution and moved its adoption. RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE APPLICATIONS, AS LANDLORD, TO ALLOW THE WHITE PLAINS PERFORMING ARTS CENTER TO SELL ALCOHOLIC BEVERAGES AT THE PERFORMING ARTS CENTER IN THE CITY CENTER AT 11 CITY PLACE IN CONNECTION WITH THEIR PERFORMANCES. WHEREAS, the White Plains Performing Arts Center, located in space owned by the City of White Plains in the City Center at 11 City Place, had previously requested that they be authorized to apply to the New York State Liquor Authority for two Special Event Permit Applications to sell and serve alcoholic beverages during certain performances during the month of December 2012; and WHEREAS, such applications require the authorization of the landlord of the space where the sale of alcoholic beverages will take place; and WHEREAS, the Common Council adopted a resolution on December 3, 2012 finding that such applications would be in the best interests of the City; and WHEREAS, the White Plains Performing Arts Center has requested that they be authorized to apply to the New York State Liquor Authority for two Special Event Permit Applications to sell and serve alcoholic beverages during future performances; and WHEREAS, the Common Council finds that allowing such applications would continue to be in the best WHEREAS, the White Plains Performing Arts Center has requested that they be authorized to apply to the New York State Liquor Authority for two Special Event Permit Applications to sell and serve alcoholic beverages during future performances; and WHEREAS, the Common Council finds that allowing such applications would continue to be in the best interests of the City; NOW THEREFORE BE IT RESOLVED, that The Mayor is hereby authorized to execute, on behalf of the City as landlord, New York State Liquor Authority Alcoholic Beverage Control Special Event permit applications to allow the White Plains Performing Arts Center to sell and serve liquor at all future performances to be held in the space owned by the City of White Plains at 11 City Place in White Plains; and be it further RESOLVED, that this resolution shall be effective January 25, 2013. Mr. Martin seconded the motion. Carried. ________ The Special Meeting continued with a discussion of the Housing Choice Voucher Program (Section 8). The Mayor granted the privilege of the floor to Mack Carter, White Plains Housing Authority. ________ On motion of Council President Smayda, seconded and duly carried, the Common Council adjourned the meeting. ________ Anne M.
