Smayda A Special Meeting of the Common Council held Monday, June 27, 2016, called for six o'clock in the evening in the Mayor's Conference Room. Mayor Roach presiding and the following members present: Mrs. Hunt Robinson, Mr. Kirkpatrick, Mr. Krolian, Mrs. Lecuona, Mr. Martin and Mrs. Smayda. ________ This Special Meeting was called to discuss: Capital Projects in relation to On-Street Meter Replacement; Miscellaneous Street Reconstruction; Salt Storage Building; Turnure Park Improvements; Rolling Stock Acquisition Heavy Duty Vehicles 2016-17; Library Improvements First Floor; City Wide IT Infrastructure Replacement/Enhancements; a proposed amendment to the Sign Ordinance; a presentation on the proposed redevelopment of property located at 52 North Broadway; to entertain a motion to enter into executive session for the purpose of discussing collective bargaining negotiations pursuant to Article 14 of the Civil Service Law; and to consider legislation in relation to a Stipulation of Agreement between the City of White Plains and Local 456 International Brotherhood of Teamsters and the authorization of a Collective Bargaining Agreement with respect to same. ________ Council President Kirkpatrick moved to take items four through six out of order. Councilman Martin seconded the motion. TO THE MEMBERS OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS Dear Council Members: In accordance with the authority granted to the Chief Executive Officer under the Taylor Law, Civil Service Law �200 et seq., representatives of the City and the Local 456, I.B.T., have entered into a stipulation of agreement, which extends the collective bargaining agreement that expired on June 30, 2015, for three years. Submitted herewith for your consideration is an ordinance, which approves and ratifies the aforementioned agreement. Sincerely, ____ Thomas M. Roach Mayor Dated: June 27, 2016 (For the Special Meeting of the Common Council on June 27, 2016) ________ Councilman Martin offered the following ordinance and asked unanimous consent to move its adoption, "Ordinance approving and ratifying the Stipulation of Agreement entered into June 27, 2016, between the negotiating representatives of the City of White Plains and Local 456, I.B.T., authorizing the Mayor to direct the Commissioner of Finance to start payments under the Agreement, and authorizing the Mayor to enter into a Collective Bargaining Agreement containing the terms of the June 27, 2016 Agreement." AN ORDINANCE APPROVING AND RATIFYING THE STIPULATION OF AGREEMENT ENTERED INTO JUNE 27, 2016 BETWEEN THE NEGOTIATING REPRESENTATIVES OF THE CITY OF WHITE PLAINS AND LOCAL 456, I.B.T., AUTHORIZING THE MAYOR TO DIRECT THE BUDGET DIRECTOR TO MAKE THE NECESSARY TRANSFERS FROM THE RESERVES FOR FINANCING TO FUND THE INCREASED PAYMENTS UNDER THE AGREEMENT, AUTHORIZING THE MAYOR TO DIRECT THE COMMISSIONER OF FINANCE TO START PAYMENTS UNDER THE AGREEMENT, AND AUTHORIZING THE MAYOR TO ENTER INTO A COLLECTIVE BARGAINING AGREEMENT CONTAINING THE TERMS OF THE JUNE 27, 2016 AGREEMENT. WHEREAS, representatives of the City of White Plains (the "City"), and Local 456, I.B.T. (the "Union"), have reached a tentative agreement to extend the prior collective bargaining agreement which covered the period July 1, 2011 through June 30, 2015, upon the same terms and conditions, except as specifically modified in the June 27, 2016 Stipulation of Agreement entered into between the negotiating representatives of the City and Union, for four years from July 1, 2015, up to and including June 30, 2018; and WHEREAS, the Union has ratified the tentative agreement; and WHEREAS, the spirit of the agreement calls for the City to implement the terms of the agreement as soon as possible. NOW, THEREFORE, the Common Council of the City of White Plains hereby ordains and enacts as follows: Section 1. The Stipulation of Agreement entered into June 27, 2016, by and between representatives of the City and the Union, and set forth below, is hereby ratified and approved by the Common Council: STIPULATION OF AGREEMENT made and entered into this 27th day of June, 2016 ("the 2015-2018 Agreement"), by and between the negotiating representatives for the City of White Plains and Local 456, I.B.T. ("the Union"). WHEREAS, the parties have engaged in negotiations in good faith in an effort to arrive at a successor collective bargaining agreement to the one that expired on June 30, 2015; and WHEREAS, the parties have arrived at a tentative agreement. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereby stipulate and agree as follows: 1. The provisions of this Stipulation are subject to ratification by the Union's membership by no later than midnight on June 27, 2016, and ratification and approval by the Common Council. 2. The respective negotiating committees' representatives agree to recommend this Stipulation for ratification/approval. 3. A copy of this original document has been furnished to representatives of the City and the Union. 2. All proposals not covered herein made by either party during the course of the negotiations will be deemed dropped. 5. Article VI(A) (Wages) . For all employees hired on or before June 30, 2016: Effective July 1, 2015, each step on the salary schedule will be increased by 2%. Effective July 1, 2016, each step on the salary schedule will be increased by an additional 2%. Effective July 1, 2017, each step on the salary schedule will be increased by an additional 2%. 6. Article VI(A) (Wages) . The salary schedule for all employees hired on or after July 1, 2016 is attached as Appendix "A." 7. Article X(A)(1)(b)(1) (Health Insurance Retirees) . Add: "Employees hired before July 1, 1995, who retire on or after the complete ratification and approval of the 2015-2018 Agreement and who are otherwise eligible to receive health insurance benefits in retirement from the City, shall continue to be entitled to maintain the level of health insurance benefits (individual or family) enjoyed by the employee at the time of retirement and to have the City contribute 100% of the appropriate percentage of premiums charged by the New York State Empire Health Insurance Program under any of the health insurance programs the City makes available to its employees. 8. Article X(A)(5) (Welfare Fund) . Effective July 1, 2015, the City's contribution will be increased by an additional $40 per employee per year. Effective July 1, 2016, the City's contribution will be increased by an additional $40 per employee per year. Effective July 1, 2017, the City's contribution will be increased by an additional $40 per employee per year. 9. Article XXI (Random Drug and Alcohol Testing) (New) . Effective upon the complete ratification and approval of the 2015-2018 Agreement, all employees not subject to Commercial Drivers' License ("CDL") testing shall be subjected to random drug and alcohol testing consistent with 49 CFR Part 40, Procedures for Transportation Workplace Drug and Alcohol Testing Programs, regardless of whether they hold a then valid CDL. 10. The Mayor is hereby authorized to direct the Budget Director to make the necessary transfers from Reserves for Financing to fund the increased payments required by, or resulting from, the June 27, 2016 Stipulation of Agreement between the negotiating representatives of the City and the Union set forth above. Section 3. The Mayor is hereby authorized to direct the Commissioner of Finance to begin making payments under the June 27, 2016 Stipulation of Agreement between the negotiating representatives of the City and the Union set forth above. Section 4. The Mayor is hereby authorized to enter into a collective bargaining agreement with the Union which agreement shall be based upon the June 27, 2016 Stipulation of Agreement set forth above. Section 5. This ordinance shall take effect as of July 1, 2015. Councilman Kirkpatrick seconded the motion.
