Smayda A Special Meeting of the Common Council held Tuesday, December 20, 2016, called for six o'clock in the evening in the Municipal Building, 255 Main Street, in the Mayor's Conference Room, Mayor Roach presiding and the following members present: Mr. Kirkpatrick, Mr. Krolian, Mrs. Lecuona, Mr. Martin and Mrs. Smayda. Absent: Mrs. Hunt Robinson. This Special Meeting was called to consider a communication from the Mayor in relation to a discussion of appointments to City Court, and to entertain a motion to enter into executive session for the purpose of discussing the qualifications of certain individuals for appointment to the position of City Court Judge. Communication received from the Mayor. Council President moved that it be filed and spread in full upon the minutes. Councilwoman Lecuona seconded the motion. 2218 COMMON COUNCIL MINUTES December 20, 2016 Carried - 6 - 0. Absent: Mrs. Hunt-Robinson TO THE HONORABLE MEMBERS OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS As of January 5, 2017, there will be a vacancy in the Office of City Court Judge due to the expiration of the term of the Honorable Jo Ann Friia. There has also been another vacancy in the Office of City Court Judge due to the retirement of Judge Barbara A. Leak. I appointed a Judicial Review Committee to review and report on the qualifications of candidates for these two positions and to make recommenda- tions to the Mayor and the Common Council. In a recent communication, the Committee presented its adopted report. The report of this Committee and its recommendations are based upon personal interviews and a review of the qualifications of all candidates who appeared before the Committee. At this time. I am recommending that a Special Meeting of the Common Council be held on December 20, 2016, for the purpose of discussing these appointments. _______________________________________ Thomas M. Councilwoman Lecuona seconded the motion. Carried - 6 - 0. Absent: Mrs. Hunt-Robinson. Council President Kirkpatrick moved to resume the Special Meeting. Councilwoman Lecuona seconded the motion. Carried - 6 - 0. Absent: Mrs. Hunt-Robinson. Council President Kirkpatrick moved to nominate the Honorable Jo Ann Friia as City Court Judge. Councilwoman Lecuona seconded the motion. Carried. 6 - 0. Absent Mrs. Hunt-Robinson December 20, 2016 COMMON COUNCIL MINUTES 2219 The Mayor asked if there were other nominations, and there being none, the Mayor asked for a motion to close the nominations. Council President Kirkpatrick moved that the nominations be closed. Councilwoman Lecuona seconded the motion. Carried 6 - 0. Absent: Mrs. Hunt-Robinson. Council President Kirkpatrick moved to appoint the Honorable Jo Ann Friia to the White Plains City Court as City Court Judge for a term of ten years, effective January 6, 2017. Councilwoman Lecuona seconded the motion. Adopted by the following role call vote: Mr. Kirkpatrick, Mr. Krolian, Mrs. Lecuona, Mr. Martin, Mrs. Smayda and the Mayor - 6 - 0. Absent: Mrs. Hunt-Robinson. Council President Kirkpatrick moved to nominate Elizabeth Shollenberger as City Court Judge. Councilwoman Lecuona seconded the motion. Carried - 5 - 0. Mayor Roach stated that he wished to recuse himself in relation to this matter as the nominee had served a role in his campaign and he wished to recuse out of an abundance of caution. Absent: Mrs. Hunt-Robinson. The Mayor asked if there were any other nominations from the floor and there being none, asked for a motion to close the nominations. Council President Kirkpatrick moved that the nominations be closed. Councilwoman Lecuona seconded the motion. Carried 5 - 0. Mayor Roach had recused himself and Mrs. Hunt-Robinson was absent. Council President Kirkpatrick moved to appoint Elizabeth Shollenberger to the White Plains City Court as City Court Judge to a term of ten years, effective January 1, 2017. Councilwoman Lecuona seconded the motion. Carried 4 - 0. Mayor Roach had recused himself, Councilwoman Smayda abstained, and Mrs. Hunt-Robinson was absent. 2220 COMMON COUNCIL MINUTES December 20, 2016 On motion of Council President Kirkpatrick, seconded and duly carried, the Common Council adjourned the meeting.
