Smayda A Special Meeting of the Common Council held Monday, March 26, 2018 called for six o'clock in the evening in the Mayor's Conference Room, Mayor Roach presiding and the following members present: Mr. Brasch, Mr. Kirkpat- rick, Mr. Krolian, Mr. Martin. This Special Meeting was for the purpose of considering a resolution in relation to a request submitted on behalf of Ferncliff Lodge BPO Elks, regarding a request for a waiver of the thirty (30) day notification requirement set forth in Section 64(2)(a) of the New York Alcoholic Beverage Control Law on a liquor license application; and to discuss Capital Projects: C5509, Led Street Light Improvements; W5508, Replace/Reconstruct Water Lines; C5510 Public Safety Exterior Rehabilitation; and to entertain a motion to enter into executive session for the purpose of discussing labor settlements and the sale of the Franklin Avenue Surface Parking Lot. Communication from the City Clerk. 612 COMMON COUNCIL MINUTES March 26, 2018 Mr. Martin moved that it/they be filed and spread in full upon the minutes. Mr. Brasch seconded the motion. Carried. TO THE HONORABLE MAYOR AND MEMBERS OF THE COMMON COUNCIL Attached please find a communication submitted on behalf of Ferncliff Lodge BPO Elks, requesting a waiver of the thirty (30) day notification requirement set forth in Section 64(2) (a) of the New York Alcoholic Beverage Control Law. The following resolution is submitted for your approval. RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS WAIVING THE THIRTY (30) DAY NOTIFICATION REQUIREMENT SET FORTH IN THE NEW YORK ALCOHOLIC BEVERAGE CONTROL LAW IN REGARD TO AN APPLICATION FOR A LIQUOR LICENSE, SUBMITTED ON BEHALF OF FERNCLIFF LODGE 367 BPO ELKS OF WHITE PLAINS. WHEREAS, by correspondence to the City Clerk delivered via email and dated March 5, 2018, from The Law Office of Stacy L. Weiss, representing Ferncliff Lodge 367 BPO Elks of White Plains, pursuant to the New York Alcoholic Beverage Control Law, requesting from the Common Council of the City of White Plains, a waiver of the thirty (30) day notification requirement to the Municipality for a liquor license in a established premises located at 1 Minerva Place; and WHEREAS, the Applicant further states that it would be a hardship to be unable to operate the facility by requiring the for the 30 day notification period to the City of White Plains to expire; and WHEREAS, the Applicant attached a properly executed application to the New York State Liquor Authority for a renewal of a liquor license,; and WHEREAS, the City of White Plains, pursuant to State of New York, Executive Department, Division of Alcoholic Beverage Control, New York State Liquor Authority regulations, determined that the aforementioned procedure is appropriate; now, therefore be it RESOLVED, that the Applicant's request for a waiver of said thirty (30) day notification period is hereby granted. March 26, 2018 COMMON COUNCIL MINUTES 613 Mr. Brasch seconded the motion. Carried - 5 - 0. Absent: Mrs. Hunt-Robinson and Mrs. Lecuona. The Special Meeting continued with discussion of the following Capital Projects: Capital Projects: C5509, Led Street Light Improvements; W5508, Replace/Reconstruct Water Lines; C5510 Public Safety Exterior Rehabilitation. Mr. Martin moved to enter into executive session for the purpose of discussing labor settlements and the sale of the Franklin Avenue Surface Parking Lot. Mr. Brasch seconded the motion. Carried. Mr. Martin moved to resume the Special Meeting. Mr. Brasch seconded the motion. Carried. On motion of Council President Martin, seconded and duly carried, the Common Council adjourned the meeting.
