ROACH MAYOR TO THE HONORABLE MEMBERS OF THE COMMON COUNCIL OF THE CITY OF WHITE PLAINS The Capital Projects Board, as part of the FY 2023-2024 Capital Improvement Program has recommended a capital project to add a new play element and wheelchair accessible playground equipment at Delfino Park. The Common Council adopted an ordinance authorizing the establishment of Capital Project No. C5640 entitled “Delfino Park Playground Equipment”, on April 1, 2024 in the amount of $140,000. Community Development is funding the cost of the playground equipment ($60,000) which increases the total cost of the project to $200,000. Submitted herewith is legislation which would authorize the Mayor to direct the Commissioner of Public Works to enter into various contracts to undertake the project. Eighty percent ($285,000) of this cost will be provided by NYS Department of Transportation Marchiselli Program funds and the remaining $71,250 will be the City’s contribution. Project will be for the design and construction of ADA compliant sidewalk access ramps along Greenridge Avenue between Maple Avenue and Prescott Avenue. The current code states “The amount of deposit, and minimum amount thereof, noted above, shall be doubled when such work, or any part thereof, is to be performed in front of property in a district other than the R1-30, R1-20, R1-12.5, R1-7.5, R1-5, and R2-4 districts...” Some permit fees for sidewalk repairs, when imposed, are based on a percent of the deposit. Doing away with the doubling of the deposit fees in those areas where a doubling of the deposit fee is currently required would reduce the permit fees in those areas by fifty percent. Hopefully, this reduced permit fee would provide an incentive for property owners to fix or replace defective sidewalks adjoining their property. To that end, the proposed amendment will create a uniform $25 deposit per square foot for sidewalk repairs in all districts throughout the city. Respectfully submitted, Stefania A. NYPA, currently headquartered at 123 Main Street, White Plains, is the country’s largest State power organization, with 16 generating facilities and more than 1,400 circuit-miles of transmission lines. It works with state and local entities, including Regional Economic Development Councils, the Empire State Development Corporation, the New York State Economic Development Power Allocation Board, and other local and regional economic development organizations to encourage businesses to locate and expand in the state and to create and retain jobs. NYPA is a national leader in promoting energy efficiency, the development of clean energy technologies and electric vehicles. Its energy services projects are found throughout New York State, saving money and megawatts while helping to reduce greenhouse gas emissions. The Property The Property consists of approximately 3.74 acres and is located in the TD-1 (Transit Development 1) District of the City (the “TD-1 District”). It is bounded on the north by Barker Avenue, on the east by Cottage Place, on the south by Hamilton Avenue, and on the west by Martin Luther King Jr. Boulevard. The Property was formerly improved with the 170,000 square foot “White Plains Mall” which has now been demolished. The Property is a commercial condominium known as the “Hamilton Green Condominium” (the “Condominium”) consisting of two (2) units – “Unit 1” and “Unit 2” – and common areas to facilitate the construction and financing of the redevelopment of the Property in two (2) phases. Unit 1 of the Condominium is owned by Hamilton Green I Partners, LLC, whose managing member is RX Hamilton Investor, LLC, a related entity of RXR Realty. Unit 2 of the Condominium is owned by S-WD/WP LLC whose managing member is Hamilton Green II Partners, LLC, a related entity of the Cappelli Organization. Recent History of the Project As currently approved, the Project consists of the development of 860 residential dwelling units in four (4) buildings ranging in height from 150 feet to 280 feet, 956 parking spaces, and approximately 85,400 square feet of retail and restaurant space to be constructed in two phases - Phase 1 on Unit 1 of the Condominium (the “Unit 1 Property”) and Phase 2 on Unit 2 of the Condominium (the “Unit 2 Property”). Phase 1 of the Project includes: 1) construction of 477 residential dwelling units in two (2) buildings to be known as 25 Cottage Place and 5 Cottage Place; 2) construction of approximately 35,491 square feet of non-residential space (comprised of office, retail, and restaurant); 3) brownfield cleanup of the Unit 1 Property; 4) construction of a below-grade parking structure containing approximately 559 parking spaces to accommodate all improvements to be constructed on the Unit 1 Property (such parking includes excess parking that will serve Unit 2); 5) construction of the loading area which is located in a common area of the Condominium which will serve the improvements on both the Unit 1 Property and the Unit 2 Property; and 6) all utilities required to serve Phase 1 of the Project. In addition, Phase 1 includes the creation of approximately 37,248 square feet of publicly accessible open space at grade on the Unit 2 Property, which is intended to remain until such time as construction of Phase 2 commences. 1687892_2 0027035-029 Honorable Thomas M. Roach, Mayor September 27, 2024 and Members of the Common Council Page 3 Phase 2 of the Project includes: 1) construction of 390 residential dwelling units in two buildings to be known as 220 Hamilton Avenue and 20 Barker Avenue; 2) brownfield cleanup of the Unit 2 Property; and 3) construction of all remaining Project components, including the parking spaces required for the improvements to be constructed on the Unit 2 Property, and the remainder of the utilities to serve Phase 2 of the Project. Most recently, on August 6, 2023, the Common Council granted amended site plan approval to permit certain minor modifications to the Project, including: modification to the exteriors of the Phase 1 buildings from a conventional curtain wall system to Dynamic Smart Glass; the addition of an indoor pool on the second floor between the two buildings on the Unit 1 Property; relocation of 19 dwelling units from 5 Cottage Place to 25 Cottage Place; and a modification to the configuration of the below grade parking structure. Construction of Phase 1 of the Project on the Unit 1 Property is well underway, and the building known as 25 Cottage Place is scheduled to open before the end of 2024 and 5 Cottage is scheduled to open by June of 2025. The Current Application The Applicant is seeking amended CDP approval and amended site plan approval from the Common Council for certain modifications to Phase 2 of the Project which are intended to accommodate a change in the previously approved use of the building to be located at 220 Hamilton Avenue from primarily residential use to office use which will serve as the headquarters for NYPA. The proposed office building has been designed to be all electric and energy efficient, and will improve the aesthetics, quality, and energy efficiency of the Project and we are seeking to achieve LEED V.4 and V.4.1 Gold Certification. In addition, the Applicant also intends to seek funding to construct the building to be located at 20 Barker Avenue as for sale affordable condominiums containing 156 affordable units. This building is intended to satisfy the affordable housing requirement for the entire development site, including the 56 affordable dwelling units required for Phase 1. This would result in 100 additional affordable dwelling units on the Property which would be in excess of the required number of affordable units for the entire Project. The proposed modifications to the Project which are shown in greater detail on the enclosed drawings are described as follows: 1) The addition of approximately 270,000 square feet of office space to the planned 27,822 square feet of office space Project in the building at 220 Hamilton Avenue. As now proposed, the building at 220 Hamilton Avenue will contain approximately 297,105 square feet of office space (in lieu of the 7.435 square feet of office space in Phase 1 and 20,387 square feet of office space in Phase 2);. 2) Construction of the building at 20 Barker Avenue as an affordable condominium development containing 156 affordable dwelling units; 3) The addition of a new ingress/egress to the parking structure on Martin Luther King Boulevard which will serve the proposed office building; 4) The addition of a new ingress/egress to the parking structure on Barker Avenue which will serve the residential units on Unit 2; 1687892_2 0027035-029 Honorable Thomas M. Roach Common Council, City of White Plains 255 Main Street White Plains, New York 10601 Re: Court Street Residences 23-29 Quarropas Street and 112-122 Court Street White Plains, New York Dear Mayor Roach, We represent 23 Quarropas LLC (the “Applicant”) with respect to the proposed Court Street Residences development. Court Street Residences consists of approximately 146,000 s.f. at the corner of Quarropas and Court Street. The project will include a 14-story building that will contain 141 affordable rental apartments for low-income seniors. As part of the residential portion of the development, approximately 12,000 square feet will be dedicated to a combination of amenity and social services spaces. In addition, the ground floor and the second floor of the project will include 7,383 square feet of office and clinic space for the new headquarters for the LOFT: Lesbian & Gay Community Services Center Inc, a not-for-profit organization serving the lesbian, gay and transgender community in Westchester County and beyond (the “Project”). Entities of HANAC, Inc. and Monadnock Development, LLC (23 Quarropas LLC) will be jointly developing the property and will be responsible for the long-term ownership once the building is completed. The building will be divided into two leasehold condominium units with one of the units for the exclusive use by the LOFT and the other unit for the residential component. 23 Quarropas LLC has a 65-year lease with the County of Westchester (the “County”) with options to extend with the condition to maintain affordability. The subject property consists of four separate tax lots totaling approximately .55 acres and is currently improved as a 31,800 square foot parking lot (Section 125.83, Block 4, lots 2, 3, 4 and 5). All four tax lots are owned by the County of Westchester. There are ongoing discussions with the Applicant and the City of White Plains (the “City”) regarding the Project’s tax obligations and/or the negotiation of a potential PILOT agreement. The LOFT is currently operating out of 252 Bryant Avenue and has a very long history of being in White Plains. The LOFT is excited to move its headquarters closer to transportation options and to expand its operations in order to meet its patrons’ needs. Enclosed as part of our application are the following documents and studies: 1) Site Plan Application; 2) Full Environmental Assessment Form Part 1; 3) Traffic Impact Study; and 4) Site Plan and architectural renderings prepared by SLCE. The Project is zoning compliant with the use and bulk regulations but for the necessary off- street parking spaces. The Project proposes 48 onsite parking spaces. The Applicant will be seeking a parking waiver/payment in lieu of parking for 24 spaces. However, we do not anticipate that parking will be an issue given the typical programming calendar for the LOFT activities and the anticipated parking needs for the seniors living in the residences. In addition, we are working on scheduling a meeting with the City to further discuss the ability of site improvements to handle stormwater runoff and the existing capacity to meet the increase in demands for water and wastewater treatment. Our engineers are working to design the stormwater management system so that there is no net increase in runoff leaving the site. The engineers plan to attenuate the 1-, 10- and 100-year storm events so that there is no net increase in runoff flows leaving the site. We also working to schedule a meeting with the White Plains Building and Fire Departments to ensure the project will be up to code. Furthermore, the Applicant is coordinating a meeting with local union leaders to develop a Project Labor Agreement. We reached out the Department of Public Works and they requested additional information. We believe that the proposed site plans submitted provide an accurate representation of what the Project will encompass, how it will complement downtown White Plains, and how it serves a clear need for the residents of White Plains and the County. As the Property is currently improved as a parking lot, there will be no increase in impervious surface from the proposed redevelopment.
