MINUTES OF THE WHITEFISH BAY
BOARD OF APPEALS
Wednesday, January 8, 2019
A meeting of the Whitefish Bay Board of Appeals was held in the
Whitefish Bay Village Hall, 5300 North Marlborough Drive, Whitefish
Bay, Wisconsin on January 8, 2019.
Pursuant to law, written notice of this meeting was published on the
official Village website and posted on the three public bulletin boards.
Present were: Chairman - Mark Johnson. Members: Leon Flagg, Sean
Finnigan, Dustin Uebelacker & Mike Kelley. Village Inspector – Joel
Oestreich.
The Chairman called the meeting to order at 6:15 P.M.
CASE NO. 1 – 4958 N. Larkin St. – Christopher Carr
Request for a Special Exception for the proposed placement of an air
conditioner that does not meet Code. The homeowners were present to
explain the request while the Board reviewed the submitted site plans
and pictures. Neighbors in attendance: Steve & Lynn Schley from
4950 N. Larkin were present. After further discussion, Dustin
Uebelacker made a motion to table the Special Exception as
applied for. Leon Flagg raised the suggestion that the case be
heard no later than the March meeting and no fee would be
required. Dustin amended his motion to include the time frame
and no additional fee. Leon Flagg seconded. A vote was taken and
unanimously passed. (5-0)
CASE NO. 2 – 1012 E. Sylvan Ave. – Andrew & Jennifer Irwin
Request for a Special Exception for a proposed new garage size that
does not meet Code. The homeowner & Scott Davis, the architect, were
present to explain the request while the Board reviewed the submitted
pictures, plans, survey and letter from Leigh Anne Staley-1017 E.
Lexington Blvd. No neighbors in attendance. The Village Inspector was
asked to explain the differences between a Variance & Special Exception
as they pertain to this case along with the Code regarding garages.
After further discussion, Leon Flagg made a motion to table the
Special Exception as applied for, that it be heard no later than the
March meeting and no additional fee. Dustin Uebelacker
seconded. A vote was taken and unanimously passed. (5-0)
The BOA meeting minutes from December 11, 2018 were reviewed.
Leon Flagg made a motion to approve the minutes from the
meeting as submitted. Dustin Uebelacker seconded. A vote was
taken and passed. (5-0)
With no other matters to discuss, Sean Finnigan made a motion to
adjourn. Mike Kelley seconded. A vote was taken and passed.
(5-0) The meeting adjourned at 7:20 p.m.
