CALL TO ORDER Summary: Toby Scott called the meeting to order at 6:04 pm. Members and staff introduced themselves. 2. AGENDA CHANGES Summary: None. 3. APPROVAL OF November 18, 2020 MINUTES Summary: Members reviewed the minutes of November 18, 2020. ACTION: Rowles made a motion to approve the minutes of November 18, 2020. Emerson seconded and all were in favor. The motion passed unanimously. 4. GENERAL PUBLIC COMMENT Summary: None. 5. OLD BUSINESS Summary: Ben Cavin brought up unregulated buoys. City should still have an interest. He called Mayor and City Manager, but didn’t receive call back. Toby suggested Ben call Fish Wildlife and Parks or else get a petition of lakefront property owners and present it to the City Council. Taylor suggested Ben bring it up at a City Council meeting and see if the Council or mayor wishes to address it. Ben liked that idea. 6. NEW BUSINESS A. WLP 21-W01– Custer Summary: The applicants are proposing to add a 100’ dock at 350 Dakota. Planner Osendorf summarized her staff report noting a couple of key points, no dock there currently. They included the water depth profile that was part of the application that showed the necessity of needing a dock at 100’. The proposed 796 sq ft dock will not exceed the allowed constructed area of 960 sq ft. Recommendation: Staff is recommending the approval of the requested lakeshore construction permit with the 13 conditions listed in the report. Page 1 of 2 Lakeshore Protection Committee January 13, 2021 Ben Cavin asked whether about buoy in shallows at end of Glendale, and if 2.8 feet is adequate for a boat to be safe. Tara stated properties around it have similar issues with depth. Toby stated he looked at properties on either side with same issues. Dave of Whitefish Lake Services spoke on behalf of the applicant. He stated Chuck Martin and other properties nearby have similar conditions. He stated that its mostly an issue after August 15th, but fine early season. He stated they measured any time after August 15th, per the regulations. Ben is concerned about a boat running aground, and wanted that addressed before he would vote on this. Dave of Whitefish Lake Services stated he was not aware of any buoys in that area marking hazards. All buoys there are private. He stated shallow rocky area by Solberg’s property has the safety buoys for the last 18 years, and they are ¾ of a mile from this location. Toby stated that it is a regulation issue, not a buoy issue, and we will be voting on regulations. ACTION: Emerson made a motion to approve WLP 21-W01 with the 13 conditions. Schuber seconded and the motion approved 4-1, Cavin opposed. This will go to City Council along with the comments as a consent agenda item on February 1st. 8. STAFF COMMENTS Summary: Tara mentioned two variances that were coming, possibly next month. 9. BOARD COMMENTS Summary: All members said they would be around Feb 10th.
