SPECIAL SESSION AT 5:15 PM
1) Call to Order
Deputy Mayor Sweeney called the meeting to order. Councilors present were Qunell, Caltabiano,
Sweeney, Feury, Davis, and Norton. Mayor Muhlfeld was absent. Staff present was Acting City
Manager/City Clerk Howke, Finance Director Gospodarek, and Planning and Building Director Taylor.
2) Interviews – Vacant Boards and Committees
City Council interviewed Michael Hein for the Impact Fee Advisory Committee.

4) Appointment
Appointments were made during the regularly scheduled Council meeting proceeding the Work Session
and are noted in the minutes.
5) Adjournment
Deputy Mayor Sweeney adjourned the Special Session at 5:30pm and opened the Work Session.

1) CALL TO ORDER
Deputy Mayor Sweeney called the meeting to order. Councilors present were Qunell, Feury, Caltabiano, and
Davis. Mayor Muhfeld and Councilor Norton were absent. City Staff present were, Acting City
Manager/City Clerk Howke, Finance Director Gospodarek, Planning and Building Director Taylor, Public
Works Director Workman, Parks and Recreation Director Butts, Police Chief Kelch, Senior Planner
Compton-Ring, Planner Loring Human Resources Director Baccaro (virtually). Approximately 10 people
were in the audience and 1 attended virtually.
2) PLEDGE OF ALLEGIANCE
Deputy Mayor Sweeney asked Nathan Dugan to lead the audience in the Pledge of Allegiance.
3) COMMUNICATIONS FROM THE PUBLIC– (This time is set aside for the public to comment on items that are
either on the agenda, but not a public hearing or on items not on the agenda. City officials do not respond during these comments
but may respond or follow-up later on the agenda or at another time. The mayor has the option of limiting such communications
to three minutes depending on the number of citizens who want to comment and the length of the meeting agenda)
Nathan Dugan, 937 Kalispell Avenue, Shelter WF President, addressed the letter that is on the agenda from
Shelter WF. The letter is proposing a potential ADU ordinance that could expand on what is in place. At the
January 2nd meeting, Council discussed reversing the current ADU ordinance. That concerned Shelter WF as
an organization. They don’t want to see the city go backwards. Going backwards has negative impacts in
terms of staff time that can be used better doing other things rather than bringing forward another ordinance.
He provided an example of a way to potentially improve on the program. There might be some concern about
it not being legal based on the bill that got rid of inclusionary zoning. He thinks that it is not inclusionary
zoning. He doesn’t think that it would have a very high likelihood of being challenged, since it would be
adding a significant amount of housing and affordable housing.
Richard Hildner, 104 5th Street, complimented Public Works Director Workman’s crew for the good work
they have done on clearing snow. He encourages the Council to have city staff reexamine the permitting
process and requirements for neighborhood block parties. His also shared concern that the United States
Postal Service failure to shovel the sidewalks on Fourth Street and along Baker Avenue. He is in the process
of preparing a petition and stand outside the door of the Post Office to get the Postmaster to shovel the
sidewalk. There is a gentleman, who is legally blind, that lives at the Whitefish Manor. He walks to work, at
The Wave, using his white cane. He is forced to walk in the street on 4th Street from Lupfer Avenue to Baker
Street, because of the snow on the sidewalk. The Postal Services should be required to shovel the walk in a
timely fashion, the same as the rest of us must do.
4) COMMUNICATIONS FROM VOLUNTEER BOARDS
Councilor Qunell announced the Whitefish Community Development Board (WCDB) will hold their first
meeting on Thursday, January 18th. There will be a work session prior to the meeting discussing the Vision
Whitefish 2045, Growth Policy update.
Deputy Mayor Sweeney reported that the Park Board is interested in examining the regulations and
requirements for block parties. It was brought to their attention on Halloween, Columbia Avenue is wall to
wall with children for three to five hours. Traffic to be moving up and down including large trucks. It seems

there should be a way for those kinds of activities to be allowed to close the streets. The Park Board is willing
and interested in something like that.
5) CONSENT AGENDA (The consent agenda is a means of expediting routine matters that require the Council’s action.
Debate does not typically occur on consent agenda items. Any member of the Council may remove any item for debate. Such items
will typically be debated and acted upon prior to proceeding to the rest of the agenda. Ordinances require 4 votes for passage –

Councilor Qunell made a motion, seconded by Councilor Davis to approve the Consent Agenda. The
motion carried.
6) PUBLIC HEARINGS (Items will be considered for action after public hearings) (Resolution No. 07-33 establishes a 30-
minute time limit for applicant’s land use presentations. Ordinances require 4 votes for passage – Section 1-6-2 (E)(3) WCC))
a) Resolution No. 24-04; A Resolution to annex and incorporate within the boundaries of the City
of Whitefish by petition and consent of property owner approximately 1.21 acres of land known
as 26 East Lakeshore Court in Section 14, Township 31 North, Range 22 West, in Whitefish,
Montana, and zone the property to WSR (Suburban Residential) subject to one condition
(WAR 24-01) (p.162)
Planner Nelson Loring presented his staff report that is provided in the packet on the website. The subject
property is currently under construction and may be subject to impact fees upon connecting to city sewer
services. Construction of the home began with the intent to connect to city sewer by was constructed in the
county and was not subject to building inspections. As a condition of approval, the property owner/developers
must pay an annexation surcharge, set forth in Resolution No. 24-03, as determined by the City, prior to the
City recording the resolution with the Flathead County Clerk and Recorder. The construction will not be
inspected by the City of Whitefish Building Inspectors, since the construction occurred prior to annexing into
the corporate limits of Whitefish.
The public hearing was advertised in the paper. No written public comment was received.
Deputy Mayor Sweeney opened the Public Hearing.
Tyler Schefter, Malmquist Construction, the applicant’s representative, attended virtually. He stated the
intent for annexation is to connect to the sewer system that the city provides on East Lakeshore Court. He
stated the original reason the structure was built within the county was a timeline issue and timing of
construction beginning prior to winter. It is easier to build within the county and no reason not to at the time.
He also stated he had concerns that the petition to annex was submitted November 21st, and the intent to
annex was adopted on January 2nd, along with the resolution to establish the Annexation Surcharge.
Public Works Director Workman state that Mr. Schefter submitted a valuation report prior to the meeting.
As stated in the staff report, Resolution No. 24-03, the surcharge is based on the valuation of the project.
Director Workman stated the Annexation Surcharge is approximately $25,000.
Mr. Schefter also stated he had concerns that the petition to annex was submitted November 21 st, and the
intent to annex was adopted on January 2nd, along with the resolution to establish the annexation surcharge.

He didn’t know if that would be considered ‘grandfathered’ or if they are still subject to the annexation
surcharge.
There being no further public comment, Deputy Mayor Sweeney closed the Public Hearing and turned the
matters over to the Council for their consideration.
Councilor Feury made a motion, seconded by Councilor Caltabiano to approve Resolution No. 24-04.
Councilor Feury stated that he finds it odd that somebody would start construction on the lake before they
had a sewer hookup of any kind. While Mr. Schefter stated they had space for a leche field not sure it would
be permittable at this point given the proximity to the lake. By passing the Annexation Surcharge, means you
pay when you come in what you would have paid if you were in the city. The motion carried.
RESOLUTION NO. 24-04
A Resolution to annex and incorporate within the boundaries of the City of Whitefish by petition and
consent of the property owner approximately 1.21 acres of land known as 26 E Lakeshore Court in
Section 14, Township 31 North, Range 22 West, in Whitefish, Montana, and zone the property to
WSR (Suburban Residential) subject to one condition.
WHEREAS, Robert and Merry Bailey have filed a Petition for Annexation with the City Clerk
requesting annexation and waiving any right of protest to annexation as the sole owner of real property
representing 50% or more of the total area to be annexed. Therefore, the City Council will consider
this petition for annexation pursuant to the statutory Annexation by Petition method set forth in
Title 7, Chapter 2, Part 46, Montana Code Annotated; and
WHEREAS, prior to filing the Petition for Annexation, the owners/developers began
construction on the property without connection to a septic system or private well;
WHEREAS, because the owners/developers began construction prior to annexation, the City
did not collect building permit fees and did not have an opportunity to, and did not, conduct regular
inspections of the construction; and
WHEREAS, pursuant to Resolution No. 24-03, the owners/developers are required to pay an
annexation surcharge due to beginning construction without connection to a septic system or private
well prior to petitioning for annexation; and
WHEREAS, services to the annexed area will be provided according to the City of Whitefish
Extension of Services Plan, amended by the City Council by Resolution No. 21-21, as required by
and in conformity with §§ 7-2-4610 and 7-2-4732, MCA, available at the Office of the City Clerk;
and
WHEREAS, the herein described property is within the City of Whitefish’s Urban Growth
Boundary, the City has current and future capacity to serve the property and development, and the
owners/developers will pay all costs to extend the municipal sewer and water service to the property;
and
WHEREAS, it is the Whitefish City Council’s decision to consider this petition for annexation
pursuant to the statutory annexation by petition method set for in Title 7, Chapter 2, Part 46 of the
Montana Code Annotated; and

WHEREAS, pursuant to § 7-2-4211(2), MCA, the City shall include the full width of any
public streets or roads, including the rights of way, that are adjacent to the property being annexed;
and
WHEREAS, because the proposed City zoning district WSR (Suburban Residential)
authorizes land uses comparable to the land uses authorized by Flathead County zoning, § 76-2-303,
MCA, authorizes the City to conduct the hearing on the annexation in conjunction with the hearing
on the zoning of the proposed annexation; and
WHEREAS, on January 2, 2024, the City Council approved the resolution of intent to annex
and rezone the property; and
WHEREAS, the City, pursuant to §§ 76-2-303 and 7-1-4127, MCA, published in a newspaper
of general circulation in the City of Whitefish, at least once a week for two successive weeks on
December 27, 2023 and January 3, 2024, a notice that a resolution of annexation will appear on the
City Council agenda for the regular meeting scheduled for January 16, 2024, at 7:10 p.m. and, at that
meeting, the City will hold a public hearing and thereafter vote to either approve, or deny the
requested annexation and zoning; and
WHEREAS, at its regular meeting held January 16, 2024, the City Council reviewed a written
report from staff, received an oral report, invited public comment, and thereafter voted in favor of the
requested annexation and zoning; and
WHEREAS, it is in the best interests of the City, and its inhabitants, to annex and zone the
subject property WSR (Suburban Residential) subject to one condition: (1) The owners/developers
must pay the annexation surcharge set forth in Resolution 24-03, as determined by the City, prior to
the City recording this Resolution with the Flathead County Clerk and Recorder, thereby finalizing
annexation of the property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Whitefish, Montana, as follows:
Section 1: The City of Whitefish adopts the recitals set forth above, and the findings in
Staff Report WAR 24-01, as findings of fact.
Section 2: It is hereby determined by the Whitefish City Council to be in the best interest
of the City of Whitefish, and the inhabitants thereof, as well as the current and future inhabitants of
the area to be annexed described herein, that the area be annexed into the City of Whitefish, and that
the corporate boundaries of the City of Whitefish be extended to include the boundaries of the area
legally described below, and to apply City zoning (WSR) to said property:
Lot 6 of First Addition to Whitefish Lake Summer Homes Amended in Section 14, Township
31, Range 22 in Whitefish, Montana, according to the map or plat thereof on file, and of record
in the office of the county Clerk and Recorder of Flathead County, Montana.
Including the full width of any public streets or roads, including the rights-of-way, that are
adjacent to the property being annexed.
Section 3: The following conditions must be satisfied in order to maintain the status of
the above described property in the City and to retain eligibility to utilize municipal water and sewer
service: (1) The owners/developers must pay the annexation surcharge set forth in Resolution 24-03,

as determined by the City, prior to the City recording this Resolution with the Flathead County Clerk
and Recorder, thereby finalizing annexation of the property.
Section 4: The minutes of the City Council meeting of the City of Whitefish, Montana,
shall incorporate this Resolution.
Section 5: This Resolution shall take effect immediately upon its adoption by the City
Council and the signing of the Deputy Mayor thereof.

21 West, in Whitefish, Montana, and zone the property to WCR (Country Residential District),
based on the findings of fact in the staff report and a condition to require engineering plans for
the sewer main extension must be approved by the City of Whitefish and Department of
Environmental Quality. The sewer main must be extended to the easter edge of the property

Lawrence Evans, applicant, stated the County will not approve septic unless the city denies sewer.
There not being any further public comment, Deputy Mayor Sweeney closed the Public Hearing and turned
the mattes over to the Council for their consideration.
Councilor Caltabiano made a motion, seconded by Councilor Qunell to approve the request of
annexation as presented by staff, Resolution No. 24-05. The motion carried.
RESOLUTION NO. 24-05
A Resolution to annex and incorporate within the boundaries of the City of Whitefish by petition and
consent of the property owner approximately 1.003 acres of land known as Tract 5D, addressed as
485 Armory Road in Section 33, Township 31 North, Range 21 West, in Whitefish, Montana, and
zone the property to WCR (Country Residential District), based on the findings of fact in the staff
report and a condition to require engineered plans for the sewer main extension must be approved by

WHEREAS, on January 2, 2024, the Whitefish City Council approved the resolution of intent
to annex and rezone the property; and
WHEREAS, the City Council of the City of Whitefish held a public hearing at its regularly
scheduled meeting on January 16, 2024, at 7:10 p.m. at Whitefish City Hall, 418 E. 2 nd Street,
Whitefish, Montana, and thereafter voted to annex the area described in the Petition for Annexation
and apply City zoning, WCR (Country Residential District), to said area; and
WHEREAS, pursuant to § 76-2-303, MCA, the City conducted the hearing on the annexation
in conjunction with the hearing on the zoning of the proposed annexation; and
WHEREAS, it is been determined that it is in the best interests of the City that the following
is a condition of annexation;
1. Engineered plans for the sewer main extension must be approved by the City of Whitefish and
Department of Environmental Quality. The sewer main must be extended to the eastern edge of the
property.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Whitefish, Montana, as follows:
Section 1: The City of Whitefish adopts the recitals set forth above as findings of fact.
Section 2: It is hereby determined by the Whitefish City Council to be in the best interest
of the City of Whitefish, and the inhabitants thereof, as well as the current and future inhabitants of
the area to be annexed described herein, that the area be annexed into the City of Whitefish and it is
hereby declared by the City of Whitefish that its corporate boundaries shall be extended to include
the boundaries of the area legally described below and the City zoning WCR (Country Residential
District), shall be applied to said property:
A tract of land in Southwest Quarter of the Northwest Quarter of Section 33, Township 31
North, Range 21 West, P.M.M., and more particularly described as follows:
Commencing at the West Quarter corner of Section 33, Township 31, North, Range
21 West, P.M.M., thence
North 81º23’23” East, a distance of 1351.43 feet from said West Quarter
Corner to a point on the West line of the Southeast Quarter of the Northwest
Quarter of said Section 33, and being North 00º27’52” East, a distance of
177.60 feet from the Southwest corner thereof and being the True Point of

7) COMMUNICATION FROM PLANNING AND BUILDING DIRECTOR
a) Consideration of a request from Eric Sikola for a Lake and Lakeshore Protection Permit to
repair a concrete wall foundation of existing boat house with helical piers and concrete pad,
located at 1492 Barkley Lane (WLP 23-32) (p.204)
Planner Nelson Loring presented his staff report that is provided in the packet on the website. The applicant
is proposing to install four helical piers to replace two concrete foundation walls for an existing boathouse.
The Lakeshore Protection Committee recommended denial. The Committee is not satisfied with the estimate
provided. Nonconforming boathouses can not be repaired if destroyed 90% or more based on the market
value of the structure.
Deputy Mayor Sweeney addressed Cate Walker, Northwest Design Studio. She stated the application is for
the completion of the repair of the structure. It is existing on the property and has been since 1980. It is a
non-conforming structure and the city planners have recommended approval of the application. The owner
is making every attempt to have these repairs approved through the proper channels and does not wish to
make any adjustments to the nature or use of the structure. The foundation walls have horizontal cracks which
extend through the walls. During the application process, they consulted with Eclipse Engineering who
provided structural recommendation options for supporting the boat house to be as mindful of the lake and
lakeshore as possible. The most noninvasive option of the repair was selected and that is the helical piers. In
using the helical piers in lieu of traditional concrete foundations or sonotubes it is limiting the disturbance to
the lakeshore protection zone. The proposed repairs will have little if any impact on the water quality or
habitat of the lake. Nor will they have any visual impact to the shoreline. The lakeshore committees primary
concern was pertaining to the validity of the cost estimate she has requested and provided an itemized
estimate of service from the contractor for reference. She asks the Council to evaluate the application for its
intent to repair an existing structure to promote safety and limit impact to the lake shore protection zone.
Councilors Feury and Qunell asked if a permit was pulled for the work that was already completed. Ms.
Walker stated she was not contacted when that work was completed, and she is not aware of a permit
application.
Councilor Feury made a motion, seconded by Councilor Davis to approve WLP W23-32. Councilor
Feury stated based on regulations, this meets the 90% threshold easily. The structure is in good shape other
than the foundation. It is not decrepit and falling apart. He is disappointed with a photo that was included in
the packet and staff should investigate the work that was done without a permit. The motion carried.
8) COMMUNICATIONS FROM PUBLIC WORKS DIRECTOR
a) Consideration of approval awarding the Engineering Contract for Safe Streets for All Safety
Plan (p.236)
Public Works Director Craig Workman presented his staff report that is provided in the packet on the website.
Councilor Davis made a motion, seconded by Councilor Caltabiano to approve the awarding of the
engineering for Safe Streets for All Safety Plan to Robert Peccia and Associates as presented by staff.
The motion carried.
9) COMMUNICATION FROM POLICE CHIEF
a) Consideration to approve School Resource Officer Program Agreement between the City and
Whitefish School District (p.268)

Police Chief Bridger Kelch presented his staff report that is provided in the packet on the website.
Councilor Caltabiano made a motion, seconded by Councilor Qunell to approve the School Resource
Officer Program Agreement between the City and the Whitefish School District. The motion carried.
10) COMMUNICATIONS FROM ACTING CITY MANAGER

Acting City Manager Howke reminded the Council the deadline to register for the G-402 NIMS course is
January 18th.
c) Consideration of approval to award a Consultant Contract for the FY24 Wage Market Study

Acting Manager Howke presented Human Resources Director Bacarro’s staff report that is provided in the
packet. Director Bacarro attended virtually to answer any questions.
Councilor Feury made a motion, seconded by Councilor Qunell to authorize the City Manager to
negotiate and execute a contract with Communications and Management Services, LLC (CMS) for the
FY24 Wage Market Study project.
11) COMMUNICATIONS FROM MAYOR AND CITY COUNCILORS
a) Consideration of appointment to volunteer boards and committees not made during the Special
Session proceeding tonight’s meeting.
Councilor Qunell made a motion, seconded by Councilor Davis to appoint Michael Hein to the Impact
Fee Advisory Committee as the member-at-large.
b) Letter from Shelter WF regarding ADUs in Whitefish (p.283)
Council chose to wait until the courts figure out the injunction.
Council Comments
Councilor Davis stated the design process was started on the Snowlot/Depot Park Townhomes project is a
thoughtful design and has gone through a very good community process to establish what our needs are. At
the time the budget presented to the Council was the Housing Authority needed $3 million and a piece of
land. The Council agreed there was a significant community need. The townhomes will be affordable to the
average person in town, which is what we needed. A couple years go by, and the cost of construction has
changed drastically. It is of no surprise to him that we are having this conversation now that the original
budget is no longer viable. There is not enough money to build the 100 AMI average townhomes that we had
anticipated we would get out of this. Every affordable housing project in the United States probably has this
problem. The cost of construction has gone up everywhere. He is remiss not to mention that he does think
we are in a little bit of a tough situation because this project has already started. This conversation would
have been better a year ago when we could have changed the path of this project. What do we do now? We

started with 100 AMI, that translates to around $300,000 a townhome. Now it is $450,000 a townhome. If
we get the community land trust donation, it comes to $400,000 townhome, which is 135 AMI. That is still
unaffordable to a significant percentage of the community. He is feeling like we are stuck in a situation where
we don’t have a lot of great options here. The project is underway, it is a good project that is badly needed.
The proposal we have is not meeting the AMI targets that we wanted. We are where we are, and we have to
decide what to do. A $400,000 townhome of that size, type and location is not available anywhere in this
town. There are people who would love to buy a $400,000 townhome in this community that would not
otherwise be able to do so. There is some benefit that comes with it even though it is not as much as what we
would have liked. He needs some time to think about it.
Councilor Feury mentioned the city garbage webpage should have notices about garbage. He would like to
request Republic Services to notify resident of their holidays and put it on the website. People need to know
changes in service. He asked if the slip lane on the south side of the viaduct can be sanded. He reminded the
community, when the river freezes, please have your kids be careful. The river looks good today, but when
it warms up to 35 degrees it won’t be good.
Deputy Mayor Sweeney stated we had a work session earlier on Whitefish Housing for the Depot Park
Townhomes. Council agreed to wait as a collective to absorb all the information and consult with our City
Manager before any decision is made or direction back to staff or the Whitefish Housing Authority.
