CITY OF WILLARD BOARD OF ALDERMAN REGULAR MEETING May 14, 2012 Board present: Alderman Trapp-present, Alderman Roggensees-present, Alderman Hemphill- present, Mayor Keltner-present, Alderman Vincent-present, Alderman Simmons-present and Alderman Johnson present. Staff present: City Clerk, Dale Duvall; CFO, Karen Robson; City Administrator; Nicholas Heatherly; Director of Development, Randy Brown; Parks and Recreation Director, Kevin McDonald, Public Works Director Justin Reaves, Willard Police Chief, Tom McClain; and Willard Reserve Officer, Bill Lingenfielser. City Attorney Ken Reynolds was also present. Call to Order Mayor Tom Keltner called the meeting to order at 7:00 pm. Roll Call The City Clerk called the roll call. Agenda Amendments/Approval of Agenda Motion made by Alderman Simmons and seconded by Alderman Hemphill to approve the agenda. Approve the Minutes of the Regular Meeting on April 9, 2012 Motion made by Alderman Simmons and seconded by Alderman Roggensees to accept the minutes from the meeting on 4-9-2012 with the noted change. Alderman Vincent-Aye, Alderman Johnson--Aye, Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Aye. All votes aye. Motion carried. Approve the Minutes of the Special Meeting on April 23, 2012 Motion made by Alderman Vincent and seconded by Alderman Simmons to accept the minutes from the special meeting on 4-23-2012. Alderman Vincent-Aye, Alderman Johnson-Aye, Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Abstained and Alderman Hemphill-Aye. Five votes aye. One abstention due to absence. Ceremonial Matters-None 05-14-12 BOA Minutes Page 1 of 6 Citizen Input Wendell Forshee addressed the Board regarding a neighborhood sign for the Fox Creek Subdivision that the residents have been trying to get approved by the Board. Ruby Cox spoke to the Board regarding the sign also an issue that she has with flooding at her residence, asking the Board to use money from the Capital Improvement tax to fix the problem. Jim Vaughn publicly thanked Lucille Murray for all the work that she does on landscaping throughout the City. Mr. Vaughn then stated that he isn’t happy with the manner in which the Board is running the City. Mr. Vaughn also asked why the financials are not included in the agenda packets. Financial Report 1st Quarter Financial Statements- Motion made by Alderman Simmons and seconded by Alderman Trapp to approve the statements. Alderman Vincent-Aye, Alderman Johnson-Aye, Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Aye. All votes aye. Motion carried. April Outstanding Invoices- Motion made by Alderman Vincent and seconded by Alderman Roggensees to approve the invoices. April Utility Adjustment Report- Motion made by Alderman Simmons and seconded by Alderman Johnson to approve the adjustment report. Report from the City Administrator The City Administrator addressed the issue of the City mowing the right-of-ways. The Mayor reminded them that at the budget meetings earlier in the year that the issue was discussed and it that it had been explained that due to finances, the mowing would need to be done less frequently. The City Administrator then discussed the monthly budget statement with the Board. Ordinance approving an agreement between the City of Willard and Combined Ozarks Multi-jurisdictional Enforcement Team (COMET) (2nd Reading) Bill NO.#12-23 ORDINANCE #120514 1st Reading 04-09-2012 2nd Reading 05-14-2012 AUTHORIZING the Mayor, on behalf of the City of Willard, to execute an agreement between the City of Willard and the Combined Ozarks Multi-jurisdictional Enforcement Team (COMET) and for the Willard Police Department to participate as a member agency in COMET. Ordinance amending Chapter 205.070 (2nd Reading) Bill NO.#12-24 ORDINANCE #120514A 1st Reading 04-09-2012 2nd Reading 05-14-2012 AN ORDINANCE approving municipal code amendments to Title II, Public Health Safety and Welfare, Chapter 205, Animal Regulations, Article I, General Provisions, Section 205.070, Limitation of Number of Dogs or Cats, of the Municipal Code of the City of Willard. Second read was conducted by the City Clerk. Citizens Input-Brad Downing asked how many dogs and cats are allowed pr household in the City. The City Administrator stated that in R-1 with less than 5 acres, 3 of each are permitted per household. Wendell Forshee asked if the City has a leash law for dogs and cats. Ruby asked who handles problems with animals during the after hours and weekends. Discussion/Vote- Alderman Hemphill stated that the reason this ordinance had been amended was due to a lack of clarity in the verbiage in relation to the number of animals allowed per household. Alderman Roggensees spoke of the increasing number of dogs running around the neighborhoods in the City without a leash. Motion was made by Alderman Hemphill and seconded by Alderman Trapp to approve the second read. Ordinance accepting the Intergovernmental agreement between the City of Willard and Greene County (2nd Reading) Bill NO.#12-25 ORDINANCE #120514B 1st Reading 04-09-2012 2nd Reading 05-14-2012 AUTHORIZING the Mayor on behalf of the City of Willard, to execute an intergovernmental agreement between the City of Willard and Greene County to provide asphalt overlay services. Motion carried. 05-14-12 BOA Minutes Page 3 of 6 Ordinance approving the Intergovernmental agreement between the City of Willard and the Springfield-Greene County OEM (Office of Emergency Management) (1st and 2nd Reading) Bill NO.#12-26 ORDINANCE #120514C 1st Reading 05-14-2012 2nd Reading 05-14-2012 AUTHORIZING the Mayor, on behalf of the City of Willard, to execute an agreement between the City of Willard and the County of Greene and the Springfield- Greene County Office of Emergency Management to provide disaster mitigation and pre-disaster preparedness services for the City of Willard, and declaring an emergency. First read was conducted by the City Clerk. Citizens Input-None. Discussion/Vote-Motion was made by Alderman Johnson and seconded by Alderman Simmons to approve the first read. Ordinance rezoning from C-1 to C2 for 307 E. Proctor Rd. (1st Reading) AMENDING the Willard Land Use Regulations, Section 400.380A, City of Willard Zoning Map, by rezoning parcel #880726402025, as shown in the records of the Greene County Assessor’s office, known locally as 307 Procter Road, which is also identified as Lot 1 of the Re-plat of the Jerry’s General Store Subdivision of the City of Willard. First read was conducted by the City Clerk. Citizens Input –None Discussion/Vote- The City Administrator explained the difference between C-1 zoning allowances in comparison to C-2. This was in response to Alderman Hemphill’s request. Motion was made by Alderman Simmons and seconded by Alderman Roggensees to approve the first read. Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye, Alderman Hemphill-Aye, Alderman Vincent-Aye and Alderman Johnson-Aye. All votes aye. Motion carried. Ordinance for the Freedom Bank final plat (1st Reading) 05-14-12 BOA Minutes Page 4 of 6 AUTHORIZING the acceptance of the public streets and easements to the City of Willard as shown on the Preliminary Plat of ATM Square, generally located in the southeast corner of State Hwy AB and State Hwy 160, upon the applicant filing and recording a final plat that substantially conforms to the preliminary plat; and authorizing the City Clerk to sign the final plat upon compliance with the terms of this ordinance. (Planning and Zoning Commission and staff recommend that the Board of Aldermen accept the public streets and easements) First read was conducted by the City Clerk. Citizen Input-None Discussion/Vote- Motion was made by Alderman Johnson and seconded by Alderman Simmons to approve the first read. Discussion of Ordinance # 091214 (Seat Belts)-This item was put on the agenda per Alderman Simmons request. After discussion among the Board, a MOTION was made by Alderman Simmons and seconded by Alderman Hemphill to rescind Ordinance #091214 and only enforce the seat belt ordinance as a secondary law. Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye, Alderman Hemphill-Aye, Alderman Vincent-Aye and Alderman Johnson-Aye. All votes aye. Motion carried. The new ordinance will be brought to the Board in June. Discussion of signage for subdivisions-This item was put on the agenda per Alderman Roggensees’s request. The City Administrator explained the sign ordinance in relation to neighborhood signs. One sided signs, breakaway signs and changing the ordinance were all discussed. Alderman Hemphill and Alderman Roggensees will bring pictures of what the Fox Creek Subdivision homeowners is wanting to the next Board meeting. Discussion of fence regulations-Alderman Roggensees’s discussed a letter that he had received by a citizen questioning the City informing him that he could not build his fence in the utility easement. The Mayor spoke of the need to enforce all of the ordinances. The Aldermen spoke of enforcing the ordinance and sending a letter to those who are not in compliance by having their fence in an easement. Discussion of the future pedestrian crossing at Hwy 160 and Hunt Rd. - This item was put on the agenda per Alderman Roggensees’s request. Alderman Roggensees asked for a completion timeline as well as the cost to the City. The stop light is projected to be in the process and possibly to be completed by the end of 2013. The cost and timeline for the pedestrian crossing is not known yet. There are many factors involved. Alderman Roggensees asked about the possibility of having sidewalks installed on Hunt Rd. The City Administrator and the Mayor commented that sidewalks on a few streets in Willard are something that is also being looked into. The City Administrator also explained that grants are difficult to get for sidewalks due to the necessary matching amount. Discussion of the possibility of holding quarterly closed meetings for personnel Issues - This item was put on the agenda per Alderman Roggensees request. Alderman Roggensees’s stated that he would like to have quarterly closed session meetings to discuss personnel issues. The legality was discussed of doing so and the City Administrator told the Board that he is always available if there are concerns that come up regarding employees. 05-14-12 BOA Minutes Page 5 of 6 Discussion of staff training- This item was put on the agenda per Alderman Roggensees’s request. Alderman Roggensees asked for follow up to the Board when staff attends training sessions. He also suggested that training logs be kept. Discussion regarding the City population signs-This item was put on the agenda per Alderman Roggensees’s request. Alderman Roggensees asked for staff to please get the City population sign updated. The City Administrator informed the Board that he has been working on it with MoDOT. Discussion of possible reduction of speed limits in residential neighborhoods-This item was put on the agenda per Alderman Hemphill’s request. Alderman Hemphill asked what the process was for getting speed limits changed in subdivisions. The Mayor informed him that it takes a petition signed =by the homeowners in the subdivision to get the process in motion. Old Business-Alderman Hemphill asked when the bidding process for the City’s insurance begins. There was a discussion of how to find the lowest rate and it was decided amongst the Board to go with quotes from three (3) insurance brokers.
