REGULAR MEETING
October 9, 2012
Board present: Alderman Trapp-present, Alderman Roggensees-present, Alderman Hemphill-present, Mayor
Keltner-present, Alderman Vincent-present and Alderman Simmons –present. Alderman Johnson was not present.
Staff present: City Clerk, Dale Duvall; CFO, Karen Robson; City Administrator, Nicholas Heatherly; Director of
Development, Randy Brown Police Chief Tom McClain , Officer Bob Bell and Police Reserve, Bill Lingenfielser .
City Attorney Ken Reynolds was also present.
Citizens in attendance: Ryan Jeepson, Jim Vaughn, Jared Rasmussen of Olsson Engineering, Mindy Latham,
Barbara Farmer, Lucille Murray, Ed Welsh, Officer Mike Muhlenbruch, Crystal Muhlenbruch, Grace Muhlenbruch
and Officer Clint Heimbach and his wife.
Call to Order
Mayor Tom Keltner called the meeting to order at 7:00 pm.
Roll Call
The City Clerk called the roll call. Alderman Trapp-present, Alderman Roggensees-present, Alderman Hemphill-
present, Mayor Keltner-present, Alderman Johnson----, Alderman Vincent-present and Alderman Simmons-present.
Agenda Amendments/Approval of Agenda
Motion made by Alderman Simmons and seconded by Alderman Vincent to approve the agenda. Alderman
Vincent-Aye, Alderman Johnson--- Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye
and Alderman Hemphill-Aye. All votes aye. Motion carried.
Approve the minutes of the regular meeting on September 10, 2012
Motion made by Alderman Vincent and seconded by Alderman Simmons. Alderman Vincent-Aye, Alderman
Johnson---, Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-
Aye. All votes aye. Motion carried.
Approve the minutes of the special meeting on September 24, 2012
Motion made by Alderman Simmons and seconded by Alderman Vincent to approve the minutes. Alderman
Vincent-Aye, Alderman Johnson---, Alderman Simmons-Aye, Alderman Trapp-Abstained, Alderman Roggensees-
Aye and Alderman Hemphill-Aye. Four votes aye. One abstention due to absence. Motion carried.
Ceremonial Matters – The Police Chief swore in Officer Heimbach and Officer Muhlenbruch .
Citizen Input
Lucille Murray asked about what the City had planned for the replacement of the cub cadet that had been used to
help her in doing the landscaping for the City. The City Administrator stated that there is money in the 2013 park
fund budget, not necessarily for that, but that options are being looked into. Lucille Murray also stated that the
mulch that was at the recreation building is now at the soccer field. The City Administrator stated that he would find
out about it from the parks department. Alderman Roggensees and Alderman Vincent asked that Lucille‘s request be
accommodated.
Financial Report
a. September Outstanding Invoices- Motion made by Alderman Simmons and seconded by Alderman
Roggensees to approve the invoices. Alderman Vincent-Aye, Alderman Johnson---, Alderman Simmons-
Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Aye. All votes aye.
Motion carried.
Questions for the City Administrator Alderman Vincent asked about the progress on the Mill St project.
The City Administrator told him that the city clerk and himself were working on it and it is just been a matter of
time constraints.

AN ORDINANCE approving municipal code amendments to Title I, GOVERNMENT CODE, ARTICLE II,
Section 110.090, ORDER OF BUSINESS, of the Municipal Code of the City of Willard.
First read was conducted by the City Clerk.

Discussion/Vote- Motion made by Alderman Simmons and seconded by Alderman Vincent for approval.

Roggensees-Aye and Alderman Hemphill-Aye. All votes aye.
2013 Budget (1st Reading)
AN ORDINANCE adopting a budget for the City of Willard, Missouri, for the Fiscal Year January 1, 2013,
through December 31, 2013.
First read was conducted by the City Clerk.
Citizen Input- None
Discussion/Vote- The City Administrator briefly discussed the updated 2013 budget. Motion made by
Alderman Vincent and seconded by Alderman Simmons for approval. Alderman Vincent-Aye, Alderman
Johnson---, Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman
Hemphill-Nay. Four votes aye. One vote nay. Motion passes.
Waterworks and Sewer Rates Ordinance (2nd Reading)
AN ORDINANCE approving municipal code amendments to Section 705.070, Section 710.230, and Section
710.460, of the Municipal Code of the City of Willard pertaining to the Waterworks System and Sewer Use and
Sewer Rates.
First Reading: 09-10-2012 Second Reading: 10-09-2012

Second read was conducted by the City Clerk.

Discussion/Vote- Alderman Vincent stated that he does not like the fact that there is no actual date listed for
shut offs. Motion was made by Alderman Hemphill and seconded by Alderman Roggensees to approve the
second read. Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye, Alderman Hemphill-
Aye, Alderman Vincent-Nay and Alderman Johnson---. Four votes aye. One vote nay. Motion carried.
2012 Waterline Improvement Project Ordinance (1st and 2nd Reading)
A SPECIAL ORDINANCE ACCEPTING the bid of Turner Excavating in the amount of $346,728.00 for
Construction of Water Line Improvements in the City of Willard and authorizing the Mayor on behalf of the
City of Willard, to execute an agreement between the City of Willard and Turner Excavation, LLC to provide
said improvements and authorizing progress payments to be made to the Contractor, and amending the
Fiscal Year 2012 Budget in the amount of $190,000.00, and declaring an emergency.

2012 Mid-Missouri Loan Renewal Ordinance (1st and 2nd Reading)
AN ORDINANCE AUTHORIZING the Mayor, or his designee, to execute a renewal of a loan between the City
of Willard and Mid-Missouri Bank, Willard Location, for the purpose of completing capital improvements and
street repairs, and declaring an emergency.

Discussion/Vote-The City Administrator explained that this loan has been a yearly renewal for the last two
years and that this time it is for a three(3) year period. Alderman Hemphill asked if staff had shopped for lower
interest rates and the City Administrator stated that if the Board so instructed, that it would be done. The
Administrator explained that this ordinance needed approval due to the date of renewal. There is no prepayment
penalty, so if a better option is found and approved by the Board, there will be no extra costs to the City. The
Board asked for staff to shop for lower interest rates for this loan. Motion was made by Alderman Vincent and
seconded by Alderman Simmons to approve the first read. Alderman Simmons-Aye, Alderman Trapp-Aye,
Alderman Roggensees-Aye, Alderman Hemphill-Aye, Alderman Vincent-Aye and Alderman Johnson---. All
votes aye. Motion carried.
Second read was conducted by the City Clerk.

Aye, Alderman Vincent-Aye and Alderman Johnson---. All votes aye. Motion carried.
Discussion/Vote on the proposed preliminary plat for the ATM Commercial Subdivision
The City Administrator went over the plat of the proposed ATM Commercial subdivision. The Board was told that
Planning and Zoning Commission had approved recommendation to the Board. The City Administrator told the
Board that MoDOT has only completed the traffic studies for phase 1 of the project. Phase 2 would need to be
completed before submitting plans for that area. Motion was made by Alderman Hemphill and seconded by
Alderman Simmons to approve the preliminary plat. Alderman Simmons-Aye, Alderman Trapp-Aye, Alderman
Roggensees-Aye, Alderman Hemphill-Aye, Alderman Vincent-Aye and Alderman Johnson---. All votes aye.
Motion carried.
Adjourn Meeting- Motion was made by Alderman Simmons and seconded by Alderman Hemphill to adjourn the
meeting. Alderman Simmons--Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye, Alderman Hemphill-Aye,
Alderman Vincent-Aye and Alderman Johnson---. All votes aye. Motion carried.
