CITY OF WILLARD
BOARD OF ALDERMAN
SPECIAL MEETING
April 22, 2013
7:00 p.m.
Board present: Alderman Trapp-present, Alderman Roggensees-present, Alderman Hemphill-present,
Mayor Forshee-present, Alderman Vincent-present and Alderman McDonald –present. Alderman
Johnson was absent.
Staff present: City Clerk, Dale Duvall; Director of Public Works, Justin Reaves and Director of
Development, Randy Brown.
City Attorney, Ken Reynolds was also present.
Citizens in attendance: Dave Gardner.
Call to Order
Mayor Forshee called the meeting to order at 7:00 pm.
Roll Call
The City Clerk called the roll call. Alderman Trapp-present, Alderman Roggensees-present, Alderman
Hemphill-present, Mayor Forshee-present, Alderman Johnson---, Alderman Vincent-present and
Alderman McDonald-present.
The City Clerk announced that Agenda Approval needed to be added to the agenda.
Approval of Agenda
Motion made by Alderman Hemphill with a second by Alderman Trapp to approve the agenda. Alderman
Trapp-Aye, Alderman Roggensees-Aye, Alderman Hemphill-Aye, Alderman Johnson---, Alderman
McDonald-Aye and Alderman Vincent-Aye. All votes aye. Motion carried.
Discussion of Monthly Work Sessions
The City Clerk spoke to the Board and explained the reasoning behind work sessions. She explained that
it allows the Board to meet in an open forum setting. The meeting is posted. A quorum is not necessary to
conduct the meeting and no votes are taken. The public is invited and it basically gives the Board an
opportunity to discuss future agenda items together as a Board. The City Clerk stated that this also will
help to remove the potential for sunshine law violations of Board members speaking with each other
outside of a posted meeting about city business. Alderman Hemphill asked the City Attorney if the
sunshine law statement was valid and the City Attorney stated that it is definitely a possibility and that the
work session will alleviate that risk. The City Clerk informed that Board that per their schedules that she
had been given, Monday was the best night for meetings and so she proposed the 4th Monday of the
month at 7 p.m. The Board agreed to that and the City Attorney stated that no motion was needed for this
item.
Appointment of Alderman Trapp to Planning and Zoning as the Board Representative
The City Clerk told the Board that she had looked into the state statutes regarding changing the
membership requirement on the Planning and Zoning Commission to a minimum of 5members, instead of
the current 7 members. The states statue requires a minimum of 7 members and so there does need to be a
Board representative at this time due to a lack of members.
Alderman Vincent volunteered to take over the position for Alderman Trapp. Motion made by Alderman
Hemphill with a second by Alderman Roggensees to approve the appointment of Alderman Vincent as
the Board representative for the Planning and Zoning Commission for the 4/2013-4/2014 term.
Alderman Trapp-Aye, Alderman Roggensees-Aye, Alderman Hemphill-Aye, Alderman Johnson---,
Alderman McDonald-Aye and Alderman Vincent-Aye. All votes aye. Motion carried.
Adjourn Open Session
Motion made by Alderman Roggensees with a second by Alderman Vincent to adjourn the open session,
to go into closed session pursuant to section 610.020 #(3)Personnel and that the Board of Aldermen shall
stand adjourned at the end of the closed session. Alderman Trapp-Aye, Alderman Roggensees-Aye,
Alderman Hemphill-Aye, Alderman Johnson---, Alderman McDonald-Aye and Alderman Vincent-Aye.
All votes aye. Motion carried.
Adjourn Closed Session
Motion made by Alderman Hemphill with a second by Alderman Roggensees to adjourn the closed
session. Alderman Trapp-Aye, Alderman Roggensees-Aye, Alderman Hemphill-Aye, Alderman Johnson-
--, Alderman McDonald-Aye and Alderman Vincent-Aye. All votes aye. Motion carried.
