CITY OF WILLARD BOARD OF ALDERMEN REGULAR MEETING December 9, 2013 Board present: Alderman Trapp-present, Alderman Roggensees--present, Alderman Hemphill-present, Alderman McDonald-present, Alderman Vincent-present, Alderman Hood present and Mayor Forshee- present. Staff present: City Clerk, Dale Duvall; Director of Development, Randy Brown; Community Services Director, J.C. Loveland; Finance Officer, Carolyn Halverson; Chief of Police, Tom McClain; and Reserve Officer, Bill Lingenfielser. City Attorney Ken Reynolds was present. Citizens in attendance: Jim Vaughn, Bradley Mowell, Mike and Jace Becker. Pledge of Allegiance The Pledge of Allegiance was led by Mayor Forshee. Call to Order Mayor Forshee called the meeting to order at 7:00 pm. Roll Call The City Clerk called the roll call. Alderman Trapp-present, Alderman Hemphill-present, Alderman Vincent-present. Alderman McDonald-present, Alderman Roggensees---, Alderman Hood and Mayor Forshee-present. Agenda Amendments/Approval of Agenda Motion made by Alderman Vincent and seconded by Alderman McDonald to approve the agenda. Alderman Vincent-Aye, Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees---, Alderman Hood and Alderman Hemphill-Aye. All votes aye. Motion carried. Approve the minutes of the regular meeting on November 4, 2013 Motion made by Alderman Hemphill and seconded by Alderman Hood to approve the minutes. Alderman Vincent-Aye, Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees---, and Alderman Hemphill-Aye. Alderman Hood-Abstained. All votes aye. Motion carried. Alderman Roggensees arrived at 7:04 p.m. Citizen Input None Financial Report October 2013 Financial Statements- Motion made by Alderman Vincent and seconded by Alderman McDonald to approve the statements. Alderman Vincent-Aye, Alderman Hood--Aye Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Nay. Five votes aye. One vote nay. Motion carried. October 2013 Budget Summaries–Informational Only. No vote taken. Year to Date Report Summaries- Informational Only. Alderman Vincent-Aye, Alderman Hood—Abstained, Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Aye. Five votes aye. One abstention. Motion carried. November 2013 Outstanding Invoices- Motion made by Alderman Hood and seconded by Alderman Roggensees to approve the invoices. Alderman Vincent-Aye, Alderman Hood—Aye, Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Nay. Five votes aye. One vote nay. Motion carried. Questions for the Department Heads The department heads gave their reports-no questions from the Board. The Public Works Director announced that due to the weather that water bills will be estimated this month. Public Hearing to consider citizen comments to the proposed amendments to the Land Development Regulations Chapter 400: Article X. Signs. The City Attorney opened the hearing for public comments and there was none. The hearing was closed. Bill No. 13-61 Ordinance No.: 131209 Sign Amendment Ordinance (1st and 2nd Reading) AN ORDINANCE APPROVING A MUNICIPAL CODE AMENDMENT TO TITLE IV. LAND USE CHAPTER 400: LAND DEVELOPMENT REGULATIONS, ARTICLE X. SIGNS; SECTIONS: 400.840, 400.850, 400.860, 400.870, 400.880, 400.910, 400.920, 400.930, 400.940, 400.950 AND 400.970 OF THE MUNICIPAL CODE OF THE CITY OF WILLARD, MO. First read was conducted by the City Clerk Motion made by Alderman Trapp and seconded by Alderman Vincent to approve the first reading. Alderman Vincent-Aye, Alderman Hood-Aye, Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Aye. All votes aye. Motion carried. Second read was conducted by the City Clerk Discussion/Vote: Motion made by Alderman Vincent and seconded by Alderman Trapp to approve the second reading. Bill No. 13-62 Ordinance No. 131209A Land O’ Frost Sponsorship Contract Ordinance (1st and 2nd Reading) Authorizing the Mayor on behalf of the City of Willard, to execute an agreement between the City of Willard and Land O’ Frost, Inc. to accept Land O’ Frost as the exclusive jersey sponsor for the Willard Parks and Recreation 2014 sports programs. First read was conducted by the City Clerk Discussion/Vote: Motion made by Alderman Roggensees and seconded by Alderman Hemphill to approve the first reading. Bill No. 13-63 Ordinance No.: 131209B Amendments to the Business License Ordinance (1st and 2nd Reading) AN ORDINANCE APPROVING THE AMENDMENTS TO THE CITY OF WILLARD MUNICIPAL CODE BOOK; CHAPTER 605: BUSINESS REGULATIONS First read was conducted by the City Clerk Discussion/Vote: Motion made by Alderman Hemphill and seconded by Alderman Trapp to approve the first reading. Alderman Vincent-Aye, Alderman Hood-Aye, Alderman McDonald-Aye, Alderman Trapp- Aye, Alderman Roggensees-Aye and Alderman Hemphill-Aye. All votes aye. Motion carried. Bill No. 13-64 Ordinance No.: 131209D 2013 Budget Amendment (1st and 2 Reading) AN ORDINANCE TO AUTHORIZE PASSAGE, ENFORCEMENT AND UTILIZATION OF THE 2013 BUDGET AMENDMENT First read was conducted by the City Clerk Discussion/Vote: The Board discussed in length their concern that the General Fund is having to transfer $190,000 to the Park Fund. Alderman Roggensees asked why the capital improvement sales tax that was projected for the Parks fund was not met, but the projected amount for the General Fund was met. There was question as to whether the sales tax was dispersed correctly. After discussion without much resolve a Motion was made by Alderman McDonald seconded by Alderman Hood to approve the first reading. Alderman Vincent-Aye, Alderman Hood-Aye, Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Nay. Five votes aye. One vote nay. Motion carried. Second read was conducted by the City Clerk Motion made by Alderman Roggensees and seconded by AldermanTrapp to approve the second reading. Alderman Vincent-Aye, Alderman Hood-Aye, Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Nay. Five votes aye. One vote nay. Motion carried. 12-09-13 BOA Minutes Page 3 of 4 Bill No. Ordinance No.: Updates to the Willard Aquatic Center Fees (1st Reading) AN ORDINANCE APPROVING THE 2014 WILLARD PARKS AND RECREATION PRICE UPDATE FOR THE WILLARD AQUATIC CENTER. First read was conducted by the City Clerk Discussion/Vote: Motion made by Alderman Roggensees and seconded by Alderman Hemphill to approve the first reading. Alderman Vincent-Aye, Alderman Hood-Aye, Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Aye. All votes aye. Motion carried. Discussion/Vote for the destruction of records according to the State retention schedule Discussion/Vote: The City Clerk spoke with the Board about the list of documents that she was requesting to be destroyed. Alderman Hemphill stated that he was fine with the destruction of all of the documents except the audio tapes. Motion made by Alderman Hemphill and seconded by Alderman Hood to approve the destruction of all records listed except the audio tapes.. Alderman Vincent-Aye, Alderman Hood-Aye, Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill-Aye. All votes aye. Motion carried New Business The Board discussed and agreed on moving the Board meetings to the 4th Monday of the month and the work study to the 2nd Monday of the month. This is to allow the finance Officer more time to prepare the financials. This is to begin in February. Old Business There was no old business Adjourn meeting Motion made by Alderman Roggensees and seconded by Alderman McDonald to close the open session. Alderman Vincent-Aye, Alderman Hood--Aye, Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill- Aye. All votes aye. Motion carried. Open meeting adjourned at 9:35 p.m. Closed Session Motion made by Alderman Vincent and seconded by Alderman Hood to go into closed session pursuant to Section 610.021(#1) Legal, and (#2) Real Estate and (#13) Personnel. Alderman Vincent-Aye, Alderman Hood--Aye, Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill- Aye. All votes aye. Motion carried. Motion made by Alderman McDonald and seconded by Alderman Hood to close the closed session, open the open session and close the open session. Alderman Vincent-Aye, Alderman Hood-Aye, Alderman McDonald-Aye, Alderman Trapp-Aye, Alderman Roggensees-Aye and Alderman Hemphill- Aye. All votes aye. Motion carried.
