Minutes, Village of Lynbrook, November 18, 2024 A regular meeting of the Board of Trustees was held on Monday, November 18, 2024 at 7:00 P.M. in the Village Hall: Present: Mayor Alan C. Beach Deputy Mayor Michael Hawxhurst Trustee Ann Marie Reardon Trustee Robert Boccio Trustee Michael Habert Village Administrator John Giordano Village Attorney Thomas Atkinson It was moved by Trustee Reardon, seconded by Trustee MINUTES – 10/21/24 RES. #259-2024 Boccio, to accept the Minutes of October 21, 2024 as submitted and place on file. Motion carried, Trustee Hawxhurst abstaining and Trustee Habert absent, all others voting “Aye”. Chief Bien reported on recent Fire Department activities. FIRE DEPARTMENT REPORT Polly Talbott, President of the Chamber of Commerce CHAMBER OF COMMERCE REPORT reported on upcoming events in the Village. Jeff Greenfield, Chairman of the Mayor’s Golf Committee PRESENTATION – MAYOR’S GOLF COMMITTEE reported on the success of the outing and presented a donation to the American Legion of $2,500, VFW in the amount of $3,500, and $35,000 to the Community Chest, and advised that next year’s outing will be held August 11, 2025 at the Inwood Country Club. Rina Beach, Chairwoman of the Community Chest, thanked the Committee. It was moved by Trustee Reardon, seconded by Trustee P.D. – HOLIDAY LIGHT TOUR – 12/10/24 Boccio, to approve a request from Chris McCardle to conduct a RES.#260-2024 Holiday Light Community Walking Tour on December 10, 2024 at 7:00 PM. Motion carried, all voting “Aye”. It was moved by Trustee Reardon, seconded by Trustee REQUEST – SENIOR CITIZEN CLUB – 11/15/24 Boccio, to table a request from the Lynbrook Recreation RES.#261-2024 Department to utilize the Lynbrook Village Senior Bus to transport members of the Senior Citizens Club to a luncheon at Frank’s Steak House in Rockville Centre on Wednesday, November 15, 2024. Motion carried, all voting “Aye”. Page 1 of 7 Minutes, Village of Lynbrook, November 18, 2024 It was moved by Trustee Boccio, seconded by Trustee AMEND VEHICLE & TRAFFIC CODE Habert, to rescind Resolution #234-2023 establishing parking – ALICE COURT restrictions on Alice Court. Motion carried, all voting “Aye”. It RES.#262-2024 was moved by Trustee Habert, seconded by Trustee Reardon, that the Board of Trustees declare itself as Lead Agency and that a Negative Declaration be issued for this action as it has no significant adverse impact on the environment pursuant to the New York State Environmental Quality Review Act. Motion carried, all voting “Aye”. It was moved by Deputy Mayor Hawxhurst, seconded by PUBLIC HEARING – L.L. 3 OF 2024 – FRONT YARD SETBACK– 11/18/2024 Trustee Boccio, to open the Public Hearing at 7:24 PM to consider RES. #263-2024 the enactment of Local Law 3 of 2024 to amend Village Code, Section 252-55(N), entitled “General Requirements”, by adding the requirement that front yard setback area are to be covered with grass and/or plantings, with the exception of a driveway leading directly to a garage and a walkway leading to the entranceway of the residence. The Mayor read the proposed Local Law and asked for comments. The following individuals spoke: Jeff Greenfield 112 Merrick Road After no further comments, it was moved by Trustee Reardon, seconded by Trustee Boccio, to close the Hearing at 7:32 PM and enact the local law. Motion carried, all voting “Aye”. It was moved by Trustee Boccio, seconded by Trustee Reardon, that the Board of Trustees declare itself as Lead Agency and that a Negative Declaration be issued for this action as it has no significant adverse impact on the environment pursuant to the New York State Environmental Quality Review Act. Motion carried, all voting “Aye”. It was moved by Trustee Habert, seconded by Trustee PUBLIC HEARING – SIDEWALK ASSESSMENTS Reardon, to open a Public Hearing at 7:32 PM to consider the RES.#264-2024 repair and construction of sidewalk violations in the Village pursuant to Section 212.1 of the Village Code as follows: 141 President St 54-04-6B Mayor Beach asked if anyone wished to comment. After no further comments were heard, it was moved by Trustee Boccio, seconded Page 2 of 7 Minutes, Village of Lynbrook, November 18, 2024 by Deputy Mayor Hawxhurst, to close the Public Hearing at PUBLIC HEARING – SIDEWALK ASSESSMENTS 7:33PM and to authorize the Village to repair the sidewalks in CONT’D violation; and to assess the properties for such repair costs. Motion carried, all voting “Aye”. It was moved by Mayor Beach, seconded by Trustee DECISION – SPECIAL USE PERMIT – 831 SUNRISE HIGHWAY Boccio, to approve an application heard at a September 23, 2024 RES.#265-2024 Public Hearing for a Special Use Permit from 831 Sunrise LLC to use their basement area for underground parking at 831 Sunrise Highway to accommodate a new medical facility tenant to occupy the vacant building subject to five conditions as follows: 1. The underground parking garage must be used for both doctors and staff and fully occupied prior to using any outside patient parking spaces. 2. Exam rooms limited to 15, but can only make minor square foot changes to the existing exam rooms if necessary for medical equipment sizes. 3. Actual use grossly contradicts the testimony in regards to the number of patients or staffing, the Mayor and Board may require the applicant to apply to the Board for modification of the granted Special Use. 4. Approval of the Special Use limited to Applicant. 5. Future subdivision to condominiums to be prohibited. Motion carried, all voting “Aye”. It was moved by Trustee Reardon, seconded by Trustee PERSONNEL – DEPARTMENT OF PUBLIC WORKS – A. EURIPIDE Boccio, to table hiring Antonio Euripide as DPW Part-Time Winter RES.#266-2024 Laborer. Motion carried, all voting “Aye”. It was moved by Trustee Habert, seconded by Trustee PERSONNEL – POLICE DEPARTMENT – A. VOULGARIS Reardon, to approve the request to hire the following individual as RES.#267-2024 a School Crossing Guard for the Police Department: Anastasia Voulgaris $20.00 per hour subject to Nassau County Civil Service approval. Motion carried, all voting “Aye”. It was moved by Deputy Mayor Hawxhurst, seconded by AUTHORIZATION – TASER GRANT RES. #274-2024 Trustee Reardon, to authorize the Mayor to sign the NYS Division of Criminal Justice, Byrne SCIP Grant, Taser Grant in the amount of $188,000. Motion carried, all voting “Aye”. It was moved by Trustee Reardon, seconded by Trustee AUTHORIZATION – STOP DWI GRANT Boccio, to authorize the Mayor to sign a Nassau County Stop DWI RES.#275-2024 Grant in the amount of $4,000 per year for 5 years. It was moved by Trustee Habert, seconded by Deputy AUTHORIZATION – BROADWAY STOREFRONT DESIGNER Mayor Hawxhurst, to table the review of proposal from BFJ RES. #276-2024 Planning and Vision Accomplished for the Design and Implementation of the NCCD Storefront Grant for 93-105 Broadway. Motion carried, all voting “Aye”. It was moved by Trustee Reardon, seconded by Trustee RELAXED PARKING – THANKSGIVING – Habert, to waive the overnight parking restrictions effective, HANUKKAH/CHRISTMAS – NEW Wednesday, November 27, 2024 to Monday, December 2, 2024 for YEARS RES.#277-2024 the Thanksgiving holiday and Tuesday, December 24, 2024 to Wednesday, January 1, 2025 for the Hanukkah/Christmas/New Years holiday. Motion carried, all voting “Aye”. It was moved by Trustee Reardon, seconded by Trustee REQUEST – CHRISTMAS TREE SALES – VULCAN COMPANY Boccio, to approve the request from Vulcan Chemical & Hose RES. #278-2024 Company to hold their Christmas Tree sales beginning November 29 – December 24, 2024. Motion carried, all voting “Aye”. It was moved by Deputy Mayor Hawxhurst, seconded by REQUEST – FD – WOUNDED WARRIOR PROJECT – 12/12/24 – Trustee Reardon, to grant permission to the Fire Department to use 12/14/24 the Fire Chief Vehicles and Fire Department Vehicles numbered RES.#279-2024 42-12, 42-13 and 426-1 for their annual trip to Fort Belvoir, Virginia to distribute donated items to our wounded veterans on December 12-14, 2024. Motion carried, all voting “Aye”. Motion carried, all voting “Aye”. The Mayor thanked the Town of Hempstead for recognizing Police Officers Mark Bamonte, Joseph Depperman and Ryan White for their heroism. It was moved by Trustee Boccio, seconded by Trustee BILLS Reardon, that the bills listed on the Abstract of Audited Voucher #6, General Fund - $1,146,826.76, Capital Fund - $3,000.00, Trust and Agency - $10,135.16, Electronic Transfer - $68,298.65, all be paid as soon as same have been duly audited by the majority. Motion carried, all voting “Aye”. GOOD AND WELFARE It was moved by Trustee Reardon, seconded by Trustee SECOND SESSION Boccio, to adjourn to the conference room for a continuation of the meeting. Motion carried, all voting “Aye”. The Board reviewed proposals received from its RFP of EV RFP – EV CHARGER RES.#281-2024 Charging Stations and heard a presentation from the high bidder Frank O’Connor of XLR8 America. After a lengthy discussion it was moved by Deputy Mayor Hawxhurst, seconded by Trustee Boccio, to approve a contract with XLR8 America subject to review by the Village Attorney and location in Parking Field No. 8. Motion carried, all voting “Aye”. It was moved by Trustee Boccio, seconded by Trustee Reardon, that the Board of Trustees declare itself as Lead Agency and that a Negative Declaration be issued for this action as it has no significant adverse impact on the environment pursuant to the New York State Environmental Quality Review Act. Motion carried, all voting “Aye”. At the request of the Recreation Director, it was moved by STAFFING – RECREATION RES.#282-2024 Trustee Habert, seconded by Trustee Reardon, to hire Giovanna Cerino and Hana DeSilva as Part-Time Recreation Attendants. Motion carried, all voting “Aye”. Page 6 of 7 Minutes, Village of Lynbrook, November 18, 2024 It was moved by Trustee Boccio, seconded by Trustee TREE LIGHTING – 12/14/24 RES.#283-2024 Habert, to close Hempstead Avenue from Merrick Road to Peninsula Blvd on Saturday, December 14, 2024 to accommodate the annual Holiday Tree Lighting ceremony, and allow participation by the Rockville Centre Choral Society. Motion carried, all voting “Aye”. It was moved by Deputy Mayor Hawxhurst, seconded by ATLANTIC AVE. WALKTHROUGH RES.#284-2024 Trustee Boccio, to direct the Village Attorney to amend the Easement Agreement with MCMN Atlantic LLC, 25 Atlantic Ave as necessary to clarify which improvements are to be undertaken by the owner for the new walkthrough prior to its use by the Village.
