RESOLVED, that the proposed amendment to Chapters 100 and 112 of the Village Code
concerning the placement and operation of wireless telecommunication facilities within the
Village of Williamsville, is hereby adopted as Local Law 1 of 2019.
ETU #1
WHEREAS, the Historic Preservation Commission, on November 27, 2018, adopted a
resolution indicating its intent to recommend that the property located at 5429 Main Street,
Williamsville, New York (“5429 Main Street” or the “Property”) be designated a local landmark
pursuant to Chapter 47 of the Village Code; and
WHEREAS, the Historic Preservation Commission held a public hearing on the proposed
designation of the Property as a local landmark on January 8, 2019, and, following that
hearing, at which it heard from all interested persons, including the property owner, and based
upon its own investigation, the Historic Preservation Commission adopted a resolution
recommending that the Property be designated a local landmark on the basis that the Property
“embodies the distinctive characteristics of a type, a period or a method of construction” as
provided in Section 47-4(A)(2) of the Village Code; and
WHEREAS, more specifically, as set forth in a memorandum adopted by the Historic
Preservation Commission dated on January 8, 2019, the Historic Preservation Commission found
that the Property, which consists of a brick building originally constructed in 1932 with a brick
addition, and a new “mid-century modern” commercial façade fronting both portions of the
building, constructed between 1952 and 1956. In its current configuration, the Historic
Preservation Commission found that the Property represents a distinctive, and, for the Village
of Williamsville, rare, example of a mid-century modern commercial structure; and
WHEREAS, the Village Board held a public hearing on the proposed designation of the
Property on January 14, 2019, continued on March 11, 2019 and March 25, 2019, during which
it heard from all interested persons, including the property owner and members of the Historic
Preservation Commission; and
WHEREAS, the property owner submitted various materials in opposition to the
proposed designation, including a Building Integrity Report prepared by Brian Knight
Research, dated March 21, 2019, which concludes that the Property lacks architectural
integrity and is not representative of either early or mid-twentieth century commercial
architecture; and
WHEREAS, the Village Board has duly considered all of evidence submitted to it in
connection with the proposed designation of the Property in light of the criteria for
landmark designation set forth in Section 47-4(A) of the Village Code; and
WHEREAS, the Village Board finds that, notwithstanding the various changes that have been
made to the Property since its original construction, the Property has, on the whole, retained its
architectural integrity dating from the 1950s era reconfiguration and represents an important
example of mid-century modern commercial architecture worthy of preservation as part of the
Village’s commercial streetscape, for the reasons set forth in the January 8, 2019 Historic
Preservation Commission memorandum;
NOW, THEREFORE, BE IT RESOLVED, that the property located at 5424 Main Street,
Williamsville, New York is hereby designated a Historical Landmark pursuant to Chapter 47 of
the Village Code.
