SEVERABILITY; PROVIDING FOR CONFLICTS; AND PROVIDING FOR AN
EFFECTIVE DATE.

RESOLUTION NO. 2021-003
A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE WILTON
DRIVE IMPROVEMENT DISTRICT APPROVING, CONFIRMING,
IMPOSING AND LEVYING SPECIAL ASSESSMENTS FOR FISCAL
YEAR 2022; PROVIDING FOR SEVERABILITY; PROVIDING FOR
CONFLICTS; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Wilton Drive Improvement District (the “District”) is a dependent special
district of the City of Wilton Manors, Florida, (the “City”) established pursuant to Ordinance No.
2014-011 (the “Ordinance”); and
WHEREAS, on May 23, 2017, the City Commission adopted Resolution No. 2017-055
authorizing the District to assess and impose non-ad valorem assessments pursuant to the provisions
of Chapter 197, Florida Statutes, upon real property within the District not to exceed the sum of
$100,000 for each of the Fiscal Years 2018 through 2024; and
WHEREAS, on December 14, 2015, the Board of Supervisors of the District (the “District
Board”) held a public hearing and thereafter adopted Resolution No. 2015-001 declaring its intent to
use the Uniform Method for collecting such non-ad valorem assessments upon properties within the
District boundaries to fund the costs of marketing, promotion, event based and administrative services
(the “Improvements and Services”) in order to serve and enhance the value, use and enjoyment of the
benefited properties within the District; and
WHEREAS, on July 8, 2021, the District Board adopted Resolution No. 2021-002 and found
that it was in the best interest of the District to pay a portion of the costs of the Improvements and
Services by imposing, levying and collecting non-ad valorem assessments (the “Assessments”)
pursuant to the Florida Constitution, Chapters 189 and 197, Florida Statutes, the Ordinance and other
provisions of Florida law (collectively, “Florida Law”); determined that the benefits accrue to the real
property subject to the Assessments, the amount of those benefits, the method of apportionment of
the Assessments, and that the Assessment will be made in proportion to the benefits received; and
approved and adopted the Fiscal Year 2022 Final Assessment Roll (the “Final Assessment Roll”)
identifying each of the properties proposed to be assessed and the amount to be assessed against each
property; and declared the public hearing on September 13, 2021 at 5:30 p.m.; and
WHEREAS, on September 13, 2021, the District Board held the duly advertised public
hearing to receive public comments on the Fiscal Year 2022 Budget and Assessment Roll; and
WHEREAS, the Board now desires to levy the Assessments set forth therein; and
WHEREAS, on September _13_, 2021, the City Commission will adopt the Final Fiscal Year
2022 Budget, which included the Fiscal Year 2022 Budget of the District.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the Wilton
Drive Improvement District:

Section 1: This Resolution is adopted pursuant to the provisions of Florida Law. All
capitalized terms not otherwise defined herein shall have the meaning ascribed thereto in the Initial
Resolution.
Section 2: The Total Parcel Assessment for Fiscal Year 2022 is $100,000. Such Total
Parcel Assessment, which shall be paid by Assessments levied on all assessable real property within
the District deriving a benefit from Improvements and Services, is hereby approved.
Section 3: The Assessments for the Improvements and Services on the assessable lots
and parcels in the District benefited by the Improvements and Services, all as specified in the Final
Assessment Roll, are hereby approved, confirmed and levied.
Section 4: If any section or any part of any section of this Resolution shall be declared
invalid or unconstitutional, the validity, enforceability and effect of any other section or part of any
section of this resolution shall not thereby be affected or impaired unless it clearly appears that such
other section or part of any section of this resolution is wholly or necessarily dependent upon the
section or part of any section so held to be invalid or unconstitutional.
Section 5: In the event of a conflict between the provisions of this Resolution and the
provisions of any other resolution of the District, the provisions of this Resolution shall prevail.
Section 6: This Resolution shall take effect immediately upon the adoption.
