4. I am interested in combining 351 W Mark Street and 355 W Mark Street into one
lot. Variance is needed due to 355 W Mark Street side lot distance being 5 feet
from property line. The current code is 8 feet for single family homes. The
existing house is approximately 5 feet from the side lot property line. We cannot
meet the 8 foot requirement without extreme alterations to the property.

SUBJECT: BOA Application Considerations for 1 /02/20 Meeting
Applicant: Ted Wedul —351 & 355 West Mark
Considerations related to Board of Adjustment Variance Criteria are provided
below:
1) Is the variance in harmony with the purpose and intent of the
ordinance?
The intent of the ordinance is to provide adequate distance between
dwellings and adjoining lots. The setback is based on the number of units on
a property and the height of the dwelling units. The existing building at 355
West Mark is compliant with Lots of Record standards of 10% of the width of
the lot strictly for single family residences.
2) Is the variance consistent with the Comprehensive Plan?
The variance does not affect the land use as dictated in the Comprehensive
Plan. The Comprehensive Plan's future Land Use map designates this
property as Traditional Neighborhood, which promotes medium density
residential housing (1-4 units)and the associated accessory structures that
go along with that.
3) Does the proposal put property to use in a reasonable manner?
The R -2 zone allows for medium densi ty dwellings,
s, including two-family
dwellings, located in the core of the City.
4) Will the variance, if granted, retain the essential character of the
locality?
The surrounding properties are also located in R -2 zones and are
occasionally closer than the side yard setbacks required in R -
2 zoning
district.
