SUBJECT: BOA Application Considerations for 2/3/21 Meeting
Applicant: Samantha and Jon Berhow – 361 Minnesota St.
Considerations related to Board of Adjustment Variance Criteria are provided
below:
1) Is the variance in harmony with the purpose and intent of the
ordinance?
The subject parcel is zoned R-2. Considering the small size of the property,
addition of a small parking area in the front of the house increases the
practical usability of the property. Thus the variance would help to secure the
most appropriate use of the land and conserve and protect property and
property values.
2) Is the variance consistent with the Comprehensive Plan?
The Comprehensive Plan designates this parcel for general residential use –
which isn’t changing as a result of the variance
3) Does the proposal put property to use in a reasonable manner?
Given the small size of the property and garage, and the location of the
existing garage, the addition of a small parking area adjacent to the driveway
is reasonable.
4) Are there unique circumstances to the property not created by the
landowner?
The small size of the property restricts options for parking to be located in
another area.
5) Will the variance, if granted, retain the essential character of the
locality?
Adjacent to the subject property is a multi-family residential property which
has a large area of parking in the side yard. Thus, the addition of a small
parking area in the front yard of the subject parcel is similar to the character
of the area.
6) Are there other considerations for the variance request besides
economics?
If the findings of questions 3-5 are affirmative this criterion is satisfied.
