BOARD OF ADJUSTMENT
Regular Meeting
DATE: August 3, 2022
TIME: 5:00 p.m.
PLACE: City Council Chambers, City Hall
PRESENT: Breza, Buege, Conway, Krofchalk, Murphy, Sanchez, Slavey
ABSENT: None
Chairman Sanchez called the meeting to order at 5:00 p.m.
The minutes from the Board’s July 6, 2022 meeting were approved unanimously
upon motion by Travis Buege and seconded by Aaron Slavey. All were in favor of
approving the minutes.
Chairman Sanchez opened the public hearing and read the petition:
Petition No. 22-14-V and 22-15-V, Andrew Loos
Andrew Loos – City Code Sections 43.02.23, 43.02.24, 43.03.22, and 43.03.72
which list lot dimension standards, site dimension standards, parking, and use
specific standards. Applicant is seeking to relocate a dwelling with four 5
bedroom units and renovate it into a dwelling with eight 1 bedroom units. The
variances needed are as follows:

• Frontage – 75’ required; 55’ proposed
• Lot Area – 12,000 square feet required; 8,250 proposed
43.02.24
• Front Yard – 10’ required, 0’ proposed
• Side Yard – 12’ required; 6’ proposed
43.03.22
• Parking spaces required 12; 11 proposed
43.03.72
• Number of units limited to 4; 8 proposed
Property is described as B-1 zoning, Sect-26 Twp-107 Range-007 SANBORNS
ADDITION Lot-006 Block-018 N ½ and Sect-26 Twp-107 Range-007
SANBORNS ADDITION Lot-006 Block-018 N 28' OF S ½, or at 512 and 516
Center Street.

Also, the following property:
Property is described as B-1 zoning, Sect-26 Twp-107 Range-007 SANBORNS
ADDITION Lot-006 Block-018 S 2' & N 50' LOT 7 or at 520 Center Street.
Andy Loos, stated that he is seeking the variances to move two buildings he
owns to the subject properties. The buildings need to be moved because of the
Winona State Foundation dormitory project.
Jon Krofchalk asked if the petitioner would consider adding a central driveway
between the two buildings. Mr. Loos responded that he preferred to keep the
existing southerly driveway because of costs and vehicle circulation among
adjacent properties.
Tom Conway asked if the petitioner would consider 6 one-bedrooms and 1 two-
bedroom unit in order to reduce the number of variances needed. Mr. Loos
responded that he preferred to stick with the proposal for 8 one bedrooms for
cash flow purposes.
Nichole Jorgenson, 517 Lafayette Street asked if the proposal would limit access
to her property in the rear. It was noted that access to 517 Lafayette currently
goes across adjoining properties and that an easement would be needed to
maintain the access. An easement is not proposed for this project.
Carlos Espinosa noted that he had received a call from Bill Squires at 508 Center
in support of the project.
There being no one else who desired to speak, Chairman Sanchez closed the
public hearing and opened it up for discussion.
Tom Conway asked if the petitioner would move the northerly building further
away from the property line to eliminate the need for the variance on that side.
Mr. Loos stated that he would like to maintain the proposed green space
between the buildings. Mr. Conway asked if Mr. Squires was concerned about
the building being so close to his property. Mr. Espinosa responded that he was
not concerned about this.
The Board went through the variance finding questions as considered by Staff
1) Is the variance in harmony with the purpose and intent of the
ordinance?
Yes, improves property values.
2) Is the variance consistent with the Comprehensive Plan?
Yes, traditional neighborhood next to the university.

3) Does the proposal put property to use in a reasonable manner?
Yes, given location next to the university.
4) Are there unique circumstances to the property not created by the
landowner?
Yes, construction of the WSU dormitory which requires the existing
building to be moved or demolished.
5) Will the variance, if granted, retain the essential character of the
locality?
Yes, this is a student area next to the university.
6) Are there other considerations for the variance request besides
economics?
If the findings of questions 3-5 are affirmative this criterion is satisfied.
Jon Krofchalk made a motion to approve the variance requests with a second by
Travis Buege. The motion passed unanimously
Petitioner was informed that there was a 10-day appeal period during which no
action could be taken on the petition.
Adjournment
There being no further business to come before the Board, the meeting was
adjourned at 5:55 p.m.
