BOARD OF ADJUSTMENT Regular Meeting DATE: November 2, 2022 TIME: 5:00 p.m. PLACE: City Council Chambers, City Hall PRESENT: Buege, Breza, Conway, Krofchalk, Murphy, Slavey ABSENT: Sanchez Acting Chairman Murphy called the meeting to order at 5:00 p.m. The minutes from the Board’s October 19, 2022, meeting was approved unanimously upon motion by and seconded by . All were in favor of approving the minutes. Acting Chairman Murphy opened the public hearing and read the petition: Petition No. 22-24-V, Justin Ewert Justin Ewert - City Code Sections: 43.02.23 and 43.02.24 which list lot dimension standards and site dimension standards. Applicant is seeking to add a single occupancy unit to an existing duplex. No modifications to the existing building envelope are proposed. The variances needed are as follows: 43.02.23 • Frontage – 70’ required; 50’ proposed • Lot Area – 9,000 square feet required; 6,500 square feet proposed 43.02.24 • Front Yard – 25’ required, 20’ proposed • Side Yard – 12’ required; 0’ and 18’ proposed • Rear Yard – 45’ required; 38’ proposed Property is described as R-2 zoning, Sect-22 Twp-107 Range-007 BAKER & BOLCOMS ADD Lot-007 Block-001, or at 713 West Fifth. There being no one else who desired to speak, Acting Chairman Murphy closed the public hearing and opened it up for discussion. BOARD OF ADJUSTMENT MINUTES November 2, 2022 PAGE 2 The Board went through the variance finding questions as considered by Staff. 1) Is the variance in harmony with the purpose and intent of the ordinance? The intent of the ordinances in question is to promote larger lots for multi- family uses and uniform setbacks in Winona that space buildings on their respective lots with more space between them. The existing ordinance language does not reflect expanded multi-family use of existing buildings which is prevalent in Winona. 2) Is the variance consistent with the Comprehensive Plan? The variance does not affect the land use as dictated in the Comprehensive Plan. The Comprehensive Plan’s future Land Use map designates this property as Traditional Neighborhood which will continue to allow the expanded residential use in its proposed format. The proposed lot dimensions and site dimensions for the property are the same as existing and will continue to persist. 3) Does the proposal put property to use in a reasonable manner? The R-2 zoning district encourages residential uses consistent with the comprehensive plan’s land use designation in this area, which is Traditional Neighborhood. The ongoing and proposed use of the property is a reasonable use of the property. 4) Are there unique circumstances to the property not created by the landowner? 5) Will the variance, if granted, retain the essential character of the locality? The surrounding area is a mix of residential and business uses. The proposed use of the building as a triplex will not alter the existing character of the locality which features converted existing structures in a mixture of single family and multi-family. 6) Are there other considerations for the variance request besides economics? If the findings of questions 3-5 are affirmative this criterion is satisfied. BOARD OF ADJUSTMENT MINUTES November 2, 2022 PAGE 3 made a motion to approve the variance requests with a second by . The motion passed unanimously. Petitioner was informed that there was a 10-day appeal period during which no action could be taken on the petition.
