The rezoning will facilitate the subdivision of the property to bring an existing single family home into compliance with the required lot area regulations. On January 28, 2019, the Planning Commission voted unanimously to recommend approval with the following findings: 1. The rezoning is in -line with the Comprehensive Plan future land use designation for the subject property. 2. Since original zoning in 1960, properties around 2015 Garvin Heights Road have been re -zoned to low density residential or continued agricultural use. 3. The proposed change will not have an undue (excessive)impact on health, safety, and welfare of the community because there is no proposed development for 2015 Garvin Heights Road. Given these findings, approval of the request is recommended. In consideration of this matter, the following alternatives are available to Council: 1. Approve the request as submitted. Under this option, a motion to introduce the attached ordinance for adoption should be made. 2. Deny the request. Under this option, Council will need to state on the record findings supporting the denial of the request. 3. Modify the request. 4. No, potential uses of the R -R zoning would not impose "undue hardship" on surrounding properties. 4. Would the public interest be better served if rezoning was considered within another area? No, rezoning to rural residential best serves the public's interest because it is a consistent residential continuation with adjacent zoning and with the Comprehensive Plan's Limited Residential designation for the area in question. 5. Could the rezoning be construed as being spot zoning? Spot zoning occurs if one of the following tests are met: A. The rezoninq action results in benefits which are only enjoyed by the petitioner The rezoning does not solely benefit the petitioner. This is because rezoning of the area in question is required for any kind of limited residential use as designated in the Comprehensive Plan. The limited residential land use classification also continues the low-density residential uses that are developing near the property. B. The rezoninq is considered to be arbitrary, capricious, or unreasonable The proposed rezoning fits with surrounding zones and is in concert with the Comprehensive Plan. Thus, the rezoning is not arbitrary, capricious, or unreasonable. C. Rezoning is not consistent with goals and objectives of the Comprehensive Plan. PLANNING COMMISSION 3. Rezoning the area in question to R -R is in accordance with this designation. GENERAL PUBLIC CORRESPONDANCE There has been no correspondence with the general public regarding this application. RECOMMENDATION In summary, the analysis has concluded that: 1. No error or oversight was made in the original AG /NR zoning of the area in question. 2. Adjacent land uses are changing to low-density residential and also maintaining a mix of agricultural warranting rezoning of the R -R area in question. 3. Potential uses of the R -R zoning would not impose "undue hardship on surrounding properties. 4. Rural Residential, limited residential rezoning is the correct designation for the area in accordance with adjacent zoning and the Comprehensive Plan. 5. Because the proposed rezoning is supported by the Comprehensive Plan's designation for the area as limited residential, the proposed rezoning should not be misconstrued as spot zoning. Given the above staff conclusions, approval of this request is recommended. In consideration of this matter, the following alternatives are available to the Commission: 1. Recommend approval of the request, as submitted. 2. Recommend denial of the request and direct staff to draft a resolution of denial. If denial is recommended, specific reasons for denial shall be given. These reasons should pertain to the potential uses of the proposed zone. 3. Recommend modification of the request. 4. SUMMARY OF REQUESTED ACTION: Dear Councilmembers, Hope Harbor is requesting to hold a Donut Run around Sinclair Park on May 25, 2019, from 8:00 a.m. to 12:00 p.m. I have made reservations with the Parks & Recreation department. We are also requesting to close 7th Street between Kansas Street and Liberty Street and Kansas and Liberty from Broadway to 7th Street from 7:00 a.m. until 11:00 a.m. so that we can have the run done on the street. The race is 0.1 K and they are planning for at least 50 runners. Last year we had 140 - hoping for almost 200+this year. The run will start at Liberty and 7th Street. The runners will head west on 7th to Kansas Street, then turn north on Kansas and stop about half way down the block. The runners will get a donut at the end line. We are requested assistance from the Police Reserves, and to have street barricades placed at the intersections of Kansas and Broadway, Liberty and Broadway, Kansas and 7 and Liberty and 7th. The nature of the area has changed since those limited time parking areas were installed from 1983 to 1986. The area now is more residential and the 20 hour parking ordinance may be more appropriate with the current uses. The designation is specifically required for grant applications seeking funding generated from the Clean Water and Land Legacy Amendment. The Parks and Recreation Department is proposing the Sugarloaf Area, Garvin Heights Park and Bluffside Park be regionally designated. Further we would propose the Bluff Traverse Trail System be regionally designated as well. The Bluff Traverse Master Plan that was adopted by the City Council on January 07, 2019, highlights and justifies regional significance of these areas and trail system. The application process we are proposing, to achieve the regional designation, does not require a City of Winona funding allocation. Staff recommends designating the Sugarloaf Area, Garvin Heights Park, and Bluffside Park as well as the Bluff Traverse Trail System as regionally significant. The application documents will refer the parks and trail system as `The Bluff Traverse.' If Council concurs a motion to approve the attached resolution and direct staff to submit an application to the Greater Minnesota Regional Parks and Trail Commission would be in order. The Bluff Traverse fits the criteria for this grant. The Winona Parks and Recreation Department will apply for development of the eastern section of the Bluff Traverse in and around the Sugarloaf area. The Winona Parks and Recreation Department is proposing submitting a grant application in the amount of 00. 149, 000. The funds would cover the development of trail segments S1, S2, H1, H7, and 15, as well as a trail signage and site amenities outlined in the Bluff Traverse Master Plan. A map of the area with details on the trail segments from the Bluff Traverse Master Plan are attached and enlarged for your review. The grant operates through a reimbursement process and requires a 25% match. If awarded the City would need to fund the entire award and then be reimbursed 75% of that award, upon completion of the project. If awarded we will come back to Council with the required grant agreement and further details on funding options. We are requesting, due to the reimbursement process, that the Council approve $37, 00250. be allocated from the Facility Fund to meet the 25% match requirement. If Council concurs a motion to approve the attached resolution and direct staff to submit an application to the Minnesota Department of Natural Resources would be in order. Deparouient Approval: I City Manager Approvval:  RESOLUTION WHEREAS the City of Winona supports the grant application made to the Minnesota Department of Natural Resources for the Federal Recreational Trail Program. The application is to develop 1.9 miles of trail within the Bluff Traverse as well as additional signage and site amenities within the Bluff Traverse; and WHEREAS, the City of Winona recognizes that it has secured $37,250 in local five percent (25 %)cash cash matching funds for this project and must provide a twenty - match. NOW THEREFORE BE IT RESOLVED if the City of Winona is awarded a grant by the Minnesota Department of Natural resources, the City of Winona agrees to accept the grant award, and may enter into an agreement with the State of Minnesota for the above referenced project. Date No: 5 City Manager 02119119 1 Item: Project FINE Welcoming Statement No. 5.3 SUMMARY OF REQUESTED ACTION: Project FINE, a nonprofit that welcomes immigrants and refugees and helps them integrate into the community, invites organization and community leaders to make a "Commitment to Welcome." The idea for this project arose from extensive listening sessions Project FINE conducted with area immigrants and refugees that revealed challenges and resistances to inclusion, ranging from discrimination to social isolation. Project FINE hopes that organizations, businesses, community leaders and others make this commitment in ways uniquely meaningful to their organizations and communities. Additionally, they are offering a challenge to those who sign on to invite others to do the same. Participating businesses, organizations, and groups will be recognized by Project FINE, and honored as part of ongoing efforts building a community for immigrants and refugees in the Winona area and region where all are welcomed, respected and valued.
