March 14, 2023 Upon motion byRios-Campos,secondedbyAmend andpassing5-0,the ConsentCalendarwasapproved. PUBLICHEARINGFY2023-24CITYBUDGET Reeser presented the R'24 City budget. Significantfeatures ofthe budget include no change to personnel, all operating budgets have revenue in excess ofoperating costs, multi-year reserve appropriations in the capitalsinkingfund, payingdownfuture PERScostsandcommunityengagementactivities.The budgetis smallerthan lastyearasseveral projectswerecompleted. Modificationsfrom proposedto approved bythe budget committee included adding funds for park lighting, park restroom, graveling driveways and towing, trash canson Halsey,thesouth gatewaysign andfacilitysitesecurity.Additionalrecommendationsinclude rolling the PERSsideaccount, theSCADAupgradeproject, the utilityrate model studyandthesewer CCTVproject. The PERSbuydownhasnotoccurredaswearewaitingforinterestratesto stabilize. The SCADAupgrade project is scheduled to be completed in November and the utility rate model study will not be completed until fall. The bidderfor the sewer CCTV project withdrew, so the project will be re-scoped andbid nextfiscalyear. Rios-Camposaskedif moremoneywill be neededforthesewerCCTVproject City Council Minutes May 23, 2023 | Page 1 Dirks responded that the project will be rescoped as needed to keep the project under the $200, 000 allocation. Reesernotedthatothermodificationsincludea $60,000transferinfromthe URAforpark restroom, trash can on Halsey and landscaping additions. The PlayEast IGAwas updated resulting in an additional $12,000. Well 3 hasbeen havingsomeelectrical and motorissues, so an additional$70,000is proposed to review the entire facility. The operating budget has increased this year by 10. 8% and revenues are up 11.6%, resulting in a netoperatingmarginincrease. The public hearing was opened. The public hearing was closed. Upon motion by Rios-Campos, seconded by Tan and passing 5-0, Resolution 14-2023 Receipt of State Shared Revenue was approved. Upon motion byAmend, secondedbyRios-Camposand passing5-0, Resolution 15-2023CityBudget Adoption FY 23-24 as amended and excluding financial support for PtayEast Recreation was approved. CouncilorRios-Camposrecusedhimself. Upon motion by dark, secondedbyTanand passing4-0, Resolution 15-2023wasamendedto include financial support for PlayEast Recreation. Upon motion by Tan, seconded by dark and passing 5-0, Resolution 16-2023 Levying and Categorizing Ad Valorem Taxes FY 23-24 was approved. ORDINANCE3-2023:PSYLOCIBINLANDUSEREGULATIONS Dirks presented the psylocibin land use regulations ZDC 23-01. Statewide ballot measure 109 was adopted andpassedin WoodVillageby55%.Thisuse is onlyauthorizedata licensedfacilityundercare. Mostof the regulations are managed at the state level; however, the measure allows cities to add some additional regulations. The proposed regulation would add this use as conditional in the commercial, town center and manufacturingzones, 1000ft from parks,schoolsandothermarijuanaor psylocibinlocationslikethe marijuana regulations. Unlike marijuana, psilocybin use does not include retail sales. The Planning Commissionrecommendedthe proposedcodeforadoption. Rios-Campos asked for a visual context ofwhere one could be located under the proposed code, Dirks responded available locations would include the town center, the strip mall on the 238th I I and the verywestern edgeofthe neighborhoodcommercialzone. Tan asked what concerns the Planning Commission had with the different uses potentially next to each other. Dirksrespondedthe PlanningCommissionjustfelt morecomfortablewiththisrestrictionto start, notingthat it could be changed in the future. City Council Minutes May 23, 20231 Page 2 Amend understandstheirconcerns, butone isa counselingcenteradministeringthe drugswhiletheother isforrecreationdmgsales.Thisis one ofthe besttreatmentsforclinicaldepression. Rios-Campos noted that there aren't many locations where one could be placed. Dirksnotedthatthe Councildoesnot haveto gowiththe recommendationfrom the PlanningCommission. darknoted hewouldliketo gowiththecautiousapproachfornowas recommendedbythe Planning Commission. Tan askedifanyoneis interestedin locatinga facility. Dirksrespondedtherewasan enquiryinJanuary,butnothingsince. Dirks clarified that if Council did nothing, the use would be permitted where medical or manufacturing is currently allowed. The proposed code just adds a few conditions to the use. Miner noted there wassupport from Council to move this forward. He had concerns initially, butfurther research revealed howimportant this is to people medically. Ifwesupport the concept, it doesn't make sense to put restrictions or barriers in the way. Amendaskedifthe code isformanufacturingor medicaluse. Dirksrespondedit isforboth.Thebusinesswouldhaveto gothroughthe state'sprocessand submita land use compatibility statement following a conditional use approval underthe proposed code. The application would need to address the criteria in the code including time, place, and manner restrictions. Amendaskedwhatwouldhappenifa businesslocatedhereandin thefuture citizensvoted to notallow psilocybin businesses. Dirksrespondedthatanyexistingbusinesseswouldremain, itwouldjust preventadditionalones. Rios-Campos noted there are already a lot ofsteps forthis type of business, and we shouldn't be adding additional barriers. Miner asked what the process would be if this code is not adopted. Dirks responded it would be staffapproved based on the underlying land use and not reviewed by the Planning Commission. Not adopting this code does not prohibitthe use and adopting the code adds some additional process and restrictions. Tan asked if this code is more restrictive than the states. Dirks responded that this code is more restrictive because it includes 1000ft distance from parks and specifies hours of operation. Rios-Campos asked ifthe Planning Commission would be able to set the hours during review ifthe code is adopted. Dirks responded they could within reason. The public hearing was opened. Upon motion bydarkto adoptOrdinance3-2023as recommendedbythe PlanningCommission, secondedbyTan, and notpassing2-3, Ordinance3-2023PsilocybinLandUse Regulationsfailed. DIRECTOR OF PUBLICWORKS REPORT Dirks presented the public works director report. This week is Public Works Week, and the luncheon is tomorrowatthe Fairviewpublicworksbuilding.The newbarbequesin theparkhavebeen useda lot since theywereinstalled,andtheparkimprovements arealmostfinished.The splashpad hasalsogotten a lotof use. The electricity is back on in the restrooms and they have been painted. Chipotle is still doing groundwork. The landowner will build the shell and the tenant is working on their plans. There has been more interestinthe ByWaycommercialcenter, includinga daycare.Therewere29 codeenforcement cases in April. Staff is looking at getting seasonal or temporary groundskeeping labor Rios-Camposaskedifwehaveaskedany landscapebusinessesfora quote. Dirks responded it is difficult to get any landscape businesses to respond. darkasked ifthevalvecanworkon Glisanis beingdone byGresham. Dirks responded that a grind and overlay is planned for Glisan from 242nd to east of 223rd. Gresham is managing the project and the public works crew is working on the valve cans to make sure they are level whenthe roadworkiscomplete. The project is plannedforthissummer. NorthofAratatherewasa full stream of water which had chlorine residual, but no leak was detected. It's some other source with a chlorine residual. DIRECTOR OF FINANCE REPORT Reeser presented the finance director's report. Revenues will come in over budget for this year. The LGIP interestis still increasing. CITYMANAGERREPORT DirkspresentedtheAPPupdate.Tree planningin the parkistentativelyscheduledfornextweek. Multnomah County is looking at redoing the bioswales and we talked to them about adding trees. Miner asked whatthe issue is with the bioswales. Dirks responded that a third party reviewed the bioswales and determined they are not optimal and should be redone for better long-term management and maintenance. Dirksaddedthatthe NiteOutwill includeseveral infoboardsandtriviacardsforcommunityengagement. We are also buying a snow cone machine for community engagement use in the park.
