The meeting wasopened at 6 PM. Dirksexplainedthatthe applicantswerenot present. Staffhad informed
them thattheirattendancewasnot required. Dirksread the hearingstatement.
Scholetzkygavethe staffreportforCU 25-02. Shestated thatthe locationforthis application is 24435-
24505 NESandyBlvd, the applicantis MWH Kiewit.The application is for Conditional Usefor an industrial
Service Use for material storage associated with the Bull Run filtration facility. The site zoning is
Commercial/lndustrial mixed use. There are no residential lands in the general vicinity ofthe property. The
site is close to Troutdale airport. The site containsa structure thatwould have indoorstorageand there
would be externalstorageas well. The applicantprovided theirapplicationon 7/21/25, it wasconsidered
completeon 9/16/25, andthe publicnoticewentouton 9/16/25. There wasonecomment receivedfrom the
Portof Portland regardingcraneheight. Scholetzkyshared thatdueto the proximityofthe propertyto
Troutdale airport, if there weresubstantiallytail cranes (over 100ft), thattheywould needto have a
discussion about proper noticing and lighting/other requirements associated with the FAA. That is for the
applicantto followup on iftheywill havethoseon site.
Scholetzkythen reviewedthe ConditionalUse ReviewCriteria in section 620.040, Thecriteria is
predominantlyaboutthe compatibilityofthis industrialservice usewithsurrounding uses in the areaofthe
project. This is a pretty substantialsite at4 acres. There is some existing landscapingto the north andeast.
The site size is largeenough thatthere is enough bufferbetweenthe proposed storage areasand other
surrounding uses. There arevery compatibleusessurroundingthe site. Theotherconditional use criteria
haveto do with whatkindofeffects allowingthis projectwould haveon other uses. Staffhave indicated
there is very little, if any, effect on the surrounding uses as there are other industrial-related uses
surrounding the site. The transportation ofthose materials will not affect the surrounding uses, Multnomah
county is the transportation service provider for Sandy Blvd. and they were comfortable with this project
moving forward. As for water, sanitary, sewer, waste management, police and fire protection, all of these
services were found to be adequate for the proposal, and no comments were received from other agencies.
There are no residential landswithinat least a halfmile so there would be minimal impactsforresidential

lands due to the geographical distance. The proposal doesn't include any waste related use categories so
that is not applicable.
Scholetzkyadvisedthatthestaffrecommendationto planningcommission is approval ofprojectwiththe
followingconditions:
. Approval expires when this indoor/outdoor storage is no longer needed for the Bull Run facility.
. ExpirationofApproval. This approvalexpireswhenthe IndustrialService Use is no longer
operational, oroperationscan no longerbedefinedas an IndustrialServiceperSection 710.300.
Tan inquiredaboutthe crane and whyit was not included as a conditionofapproval. Scholetzkyexplained
that crane requirements are not mandated as conditions of approval; rather, it is the responsibility of the
businessto managecompliance, whilethe city's role is to inform the applicantof any relevant
requirements. Tan also asked aboutthe expirationofthe approval. Jensenrespondedthat if a new
operator takes over, they will need to go through the approval process again, Mott raised a question
regarding the crane and its 75-foot height. The Commission then discussed the varying crane height limits
referenced by the FAAand the reasonsfor thosedifferences. Mottsubsequentlyclosed the hearing.
Upon motion byJensento approve CD 25-02, a Conditional UseApplicationfortemporarystorageofpipe
and electrical equipmentpriorto shipmentto the Bull Run Filtration Facility, the PlanningCommissionfinds
that the application meets the required findings for a conditional use, subject to the conditions of approval
to assure compliance with City standards, seconded by Mott and passing 3-0, DR 25-02 was approved.
CITY FILECU 25-03: APPOLLORECOVERY SERVICES LLC
Dirks read the hearing statement. Scholetzky presented the staff report for the property located at 23845
NE SandyBlvd, submitted byApollo RecoveryServices.The parcel is in the samegeneralvicinityasthe
previous application and also nearthe TroutdaleAirport, The application is a land use reviewrequestto
allowvehiclestorageand towingoperations. No newbuildingsare proposed, and all activitieswill occurin
the northern portion ofthe site. The property is surrounded by industrial uses and has limited street
frontagealong SandyBlvd.
The application was received on August 13, 2025, deemed complete on September 16, 2025, and public
noticewas issuedthe sameday. A Conditional Use (CD) reviewis required becausevehicleand towing
storageis classifiedas an industrial use. The site spans approximately 14 acres,with mostoperations
occurring awayfrom Sandy Blvd, minimizing visibility. Surrounding properties have similar industrial uses
and paved surfaces. Sinceno newbuildingsare proposed, there are no anticipatedimpacts related to
landscapingorsetbacks. Staffdetermined thatexisting landscapingis sufficient.
Multnomah County, the review authority for NE Sandy Blvd, submitted documentation indicating no
concerns with the proposal. The applicant noted that vehicle transport would occur multiple times daily, and
the Countydid not raise any issues regardingtraffic.
Regarding public services-water, sanitary sewer, storm sewer, fire, and police, there will be no utility
infrastructureon site. The applicantidentifiedtwoexisting gatesalong the panhandleextendingto Sandy

Blvd. This site is served by Gresham Fire and Emergency Services, which recommended that any locked
gates be equipped with Knox boxes or Gresham-approved locks to ensure emergency access during off-
hours.
The proposal is notexpectedto havesignificantadverseeffectson residentialzoneareas, with minimal
impacts related to noise, glare, odor, or litter. The proposed conditional usedoes notfall underthewaste
category.
Staffrecommendedthatthe Planning Commissionapprove the applicationwiththreeconditionsof
approval:
. Approved Use: Any changes to the industrial service use will require a new conditional use
review.
. GateAccess:The twogates providing accessto SandyBlvd must be reviewed and approved by
Gresham Fire. Proofofcompliance must be submittedwithin 30 daysofthedecision'sissuance.
This documentation is required for Business License approval.
. Expiration of Approval: The approval will expire when the industrial service use is no longer
operational or when operations no longer meet the definition of an industrial service under Section
710.300.
Tan askedwhetherthe site wasalreadyin use priorto the planning process. Dirksconfirmedthat it was,
noting thatconfusion mayhave arisen dueto the neighboringsite also being used forstorage. He stated
that the applicant did a good job offollowing through with the process and participating in the hearing, the
city had indicatedto them thatif theyfollowedthrough, therewould not be punitive measures until afterthe
hearing.
ChairMottopened the floorfordiscussion.CommissionerFoxstated thatshe had reviewedthe materials,
had no questions, and appreciatedthe staffs recommendations. CommissionerJensensupportedthe
report and proposed approvalwith the recommendedconditions.
Upon motion by Jensen, to approve CD 25-03, a Conditional UseApplicationforshort-term vehiclestorage,
the planning commission finds that the application meets the required findings for a conditional use, subject
to the conditionsofapproval to assurecompliancewith City standards,seconded by Mott and passing3-0,
DR25-03wasapproved.
OTHER BUSINESS:
Dirksshared that Chick-fil-Awassupposedto open in a coupleofweeks, butthatdoesn'tlook likely.
Maybeit will happen in November.The County restriped WoodVillageBlvd from the Chick-fil-Adriveway
south to Glisan, it is betterthan it was before, The City is goingto do a trafficcountbeforethey start
business, but the contractorhadto connectto waterand sewer. Itwould be bestto getthe count after
construction hasstopped. Thegoal is to find a momentof normal trafficconditions,then do anothertraffic
count a while after Chick-fil-A opens. The city is hoping for a 4-way stop at Wood Village Blvd, the County
has askedforthe trafficcountas partofthatprocess.

Dirks introduced the next topic: fire and emergency services, including the potential levy. He noted that an
email was sent earlier today with proposed dates for a community conversation on the issue. The City
intends to meet with board and commission members, before it goes to the greater public. Review the
suggested dates and share your availability. Dirks also mentioned that work on the Climate-Friendly and
Equitable Communities (CFEC) code is still in progress.
Dirksstated thatanotherconditional use application may be submitted beforethe end oftheyear, although
it is expected to be minor. Mott asked about Fish4Ever, Dirks confirmed that the business received its
Certificate of Occupancy in April. The City has since informed the owners that the space must operate as a
storefront ratherthan as a storagefacility. They havebeen askedto providean officialopeningdateand
regular operating hours; otherwise, the City may need to consider enforcement action. Jensen asked if
there was anything more about the food carts, Dirks shared that the approval on that expired 2 years ago.
The County was requiring a full traffic impact analysis, causing it to fail. Dirks said that there is not a lot in
the works at the moment, butthat is beingseen regionallyas well.
