Minutes Woodbury City Council Wednesday, October 28, 2020 Pursuant to the due call and notice thereof, a regular meeting was duly held virtually and at the Woodbury City Hall, 8301 Valley Creek Road, on the 28th day of October 2020. Call to Order Mayor Anne Burt called the meeting to order at 7:30 p.m. Mayor Burt welcomed those listening and attending. She said members of the public may attend the meeting but will be required to comply with social distancing parameters as determined by the City. Members of the public may also join the meeting using a PC, Mac, iPad, iPhone or Android device. Public comments will be accepted during the meeting both in person and by using the link to the virtual meeting to join the meeting and then submit your questions via the online Q&A feature within the meeting. Questions regarding the meeting will also be taken between the hours of 8:00 a.m. to 4:30 p.m. via email council@woodburymn.gov or call 651-714-3524 and leaving a voicemail message. Pledge of the Flag Audience, staff, and Council pledged allegiance to the flag of the United States of America. Roll Call Upon roll call the following were present: Mayor Anne Burt, Councilmembers: Andrea Date, Amy Scoggins, Steve Morris, and Jennifer Santini. Absent: None Others Present: Kimberlee K. Blaeser, City Clerk; Kristin Seaman, Environmental Resources Specialist; Christopher Hartzell, Engineering Director; and Clinton Gridley, City Administrator. Special Order of Business A. Koins for K-9s Proclamation Mayor Burt read the proclamation and declared November 20, 2020 through December 20, 2020 Koins for K-9s Month in the City of Woodbury. Voting in Favor: Date, Scoggins, Morris, Santini, Burt Absent: None Donna Smith-Stafford, founder of Koins for K-9s, thanked the Council for the opportunity. She shared a little of the history of the fund. She said this year would be a little different. There will still be collection boxes in about 20 businesses who requested them. There is also an online donation fund with a donor who generously agreed to match up to $7,500 in donations. She thanked the Council and the community for the support. Police Officer Stoffel said he is the newest K9 handler at the unit. He introduced Ruby who turned two at the end of June. He shared about Ruby’s training and thanked Ms. Stafford and the community for their support. Mayor Burt asked where the public could find the collection boxes. Ms. Stafford said the most common businesses were liquor stores and gas stations. B. 2020 Source Water Protection Recognition John Frietag, Minnesota Department of Health, said the Minnesota Department of Health and the Minnesota Rural Water Association recognize the city of Woodbury for its efforts to protect community drinking water sources. Woodbury was a finalist for the 2020 Source Water Protection Award in the large systems category. Since Woodbury’s Wellhead Protection Plan was first approved in 2002, the city has undertaken many projects to protect its drinking water supply and encourage conservation, including creating water efficiency programs for homeowners and commercial irrigators. The city has also put forth significant effort to incorporate drinking water protection and efficiency in its policies and strategic initiatives. In a letter to the city, Minnesota Commissioner of Health Jan Malcom commended Woodbury. “Through its initiatives and strategic partnerships, the city of Woodbury has become a leader and fine example for other communities in the state as they seek to safeguard their sources of drinking water,” Commissioner Malcom said. Minnesota Department of Health and the Minnesota Rural Water Association work with public water suppliers and other stakeholders  City Council Meeting Minutes Wednesday, October 28, 2020 to develop and implement protection plans that include efforts to prevent contamination of the drinking water source. Prevention is used as the first step in protecting public health and is increasingly important as Minnesota faces threats to water quality. Open Forum The Open Forum is a portion of the Council meeting where a maximum of three persons will be allowed to address the Council on subjects, which are not a part of the meeting agenda. Persons wishing to speak must complete a sign-up sheet prior to the start of the meeting. Give the sign-up sheet to any staff person. Speakers are limited to two minutes each. The Council will listen attentively to comments but, in most instances, will not respond at the meeting. Typically, replies to the concerns expressed will be made via letter or phone call within a week. Consent Agenda All items listed under the consent agenda are considered to be routine by the City Council and will be enacted by one motion and an affirmative vote by roll call of a majority of the members present. There will be no separate discussion of these items unless a Councilmember or citizen so requests, in which event, the items will be removed from the consent agenda and considered a separate subject of discussion by the Council. Item A Approval of Council Minutes – October 14, 2020 Item B To extend the project approvals for The Grove (Dominium), Project No. 29-2019-00361 subject to the conditions as listed in Council Letter 20-248. 1. All conditions of the original approval shall remain in full force and effect. 2. The extension shall expire on October 28, 2021 unless a building permit has been issued or an additional time extension has been granted. Item C To adopt the following resolution Resolution 20-193 Resolution of the City of Woodbury, Washington County, Minnesota authorizing the janitorial services contract with Vanguard Cleaning Systems in the amount of $199, 596.12. Item D To adopt the following resolution Resolution 20-194 Resolution of the City of Woodbury, Washington County, Minnesota authorizing a contract with Bolton & Menk, Inc., for engineering consulting services for the 2022 Roadway Rehabilitation Project, preparation of preliminary reports and amending the 2020 Adopted Budget. Item E To adopt the following resolution Resolution 20-195 Resolution of the City of Woodbury, Washington County, Minnesota authorizing acceptance of the extension of 3M Settlement Community Grant Agreement #150889 through June 30, 2022 for $15,000 from the Minnesota Pollution Control Agency and Approving Associated 2020 Budget Amendment. Item F To adopt the following resolution Resolution 20-196 Resolution of the City of Woodbury, Washington County, Minnesota authorizing the Woodbury Public Safety Department to accept Toward Zero Deaths (TZD) Traffic Safety Enforcement Grant from the Minnesota Department of Public Safety, Office of Traffic Safety. Item G 1. To adopt the following resolution Resolution 20-197 Resolution of the City of Woodbury, Washington County, Minnesota authorizing the purchase of group medical insurance from the Public Employee Insurance Program (PEIP) and amending the City contribution toward the employee group medical insurance program. 2. To adopt the following resolution Resolution 20-198 Resolution of the City of Woodbury, Washington County, Minnesota authorizing the City to self-fund dental insurance benefits, hiring HealthPartners as the administrative service organization and maintaining the City contribution toward the Employee Group Dental Insurance Program. To adopt the following resolution Resolution 20-200 Resolution of the City of Woodbury, Washington County, Minnesota authorizing the purchase of life and long-term disability insurance from Cigna. 5. To adopt the following resolution Resolution 20-201 Resolution of the City of Woodbury, Washington County, Minnesota authorizing the purchase of short-term disability advice-to-pay administrative services from Cigna. 6. To adopt the following resolution Resolution 20-202 Resolution of the City of Woodbury, Washington County, Minnesota authorizing the purchase Flexible Spending Account (FSA), Health Reimbursement Arrangement/Voluntary Employee Benefits Association (HRA/VEBA) and Health Savings Account (HSA) Administrative Services. 7. To adopt the following resolution Resolution 20-203 Resolution of the City of Woodbury, Washington County, Minnesota authorizing the offering of voluntary supplemental insurance from AFLAC and voluntary vision insurance from EyeMed Vision Care. Item H To adopt the following resolution Resolution 20-204 Resolution of the City of Woodbury, Washington County, Minnesota appointing Brad Metcalf to the position of Public Service Worker – Utilities effective November 16, 2020. Item I To adopt the following resolution Resolution 20-205 Resolution of the City of Woodbury, Washington County, Minnesota appointing Nickolas Kaase and Mitchell Randall to the position of Public Service Worker – Streets effective October 29, 2020. Item J To schedule a meeting to canvass City office election results on Thursday, November 12, 2020 at 6:00 p.m. The meeting will be held virtually with all members of the City Council participating via telephone or other electronic means. Item K The abstract of bills includes payments made from the operating or project budgets for expenses of the city. The expenditures are from all funds of the city. Any purchased contracts requiring signature of the mayor and City Administrator is hereby approved. Staff recommends approval of the abstract of bills for October 9, 2020 in the amount of $793,061.32 and October 16, 2020 in the amount of $1,499,156.72. Wellhead Protection Plan Update, Authorize Submittal of Plan Update to Minnesota Department of Health Mayor Burt declared the public hearing open and recognized Environmental Resources Specialist Kristin Seaman to give the background. Ms. Seaman explained the City has completed and is actively implementing a Wellhead Protection Plan in accordance with Minnesota Rules Chapter 4720 and Minnesota Department of Health requirements. In 2018 the City began the process to update this plan with the addition of Well 19. Wellhead protection is a means of safeguarding public water supply wells by preventing specific contaminants from entering the area that contributes water to the wellfield over a specific period of time. These plans are updated every 10 years or when a new well is installed. Wellhead protection plans consist of two parts. The first part of the Wellhead Protection Plan includes a delineation of the capture zones of the aquifer that contribute water to wells and an assessment of well vulnerability. This delineation produces the Drinking Water Supply Management Area. City Code, Chapter 27 Section 8, identifies restrictions for land uses in proximity to existing or future well sites in an effort to protect the quality of the groundwater resource. The second part of the Wellhead Protection Plan involves the creation of goals, objectives, an action plan, evaluation program, and contingency plan. As the water system grows, and areas around wells develop and redevelop, it is the City’s responsibility to continue to update the Wellhead Protection Plan. Additionally, future modeling may show that Woodbury’s Drinking Water Supply Management Area extends into other municipalities or that Drinking Water Supply Management Areas of other municipalities extend further into Woodbury. This overlap is already occurring with the City of Cottage Grove and is likely to increase. As more jurisdictions share water supply capture zones, more collaboration will be required to secure safe drinking water. Additionally, the City will continue to restrict land use and stormwater infiltration practices around wells to ensure safe drinking water and encourage programs such as abandoned well sealing and storage tank and pipeline management. Ms. Seaman explained the public hearing process and said there was a sixty-day community review from August 5 through October 5, 2020. Mayor Burt asked when the last time the plan was updated. Ms. Seaman answered the last update occurred in 2016 just before Well 18 was installed. Councilmember Santini moved, seconded by Councilmember Date, to close the public hearing. It is a seven-month leadership program that identifies, trains and supports placement of dynamic leaders of color and underrepresented communities onto publicly appointed boards and commissions in the Twin Cities. Mr. Sorrell will be the second participant that the City has sponsored to attend. Mr. Gridley mentioned the new quarterly construction report that is now being included in the City Administrator’s Report. He also shared updates on solar gardens, City communications and Eagle Valley Golf Course. Mr. Gridley gave a verbal update of upcoming City meetings. Neighborhood Meeting 1.
