Minutes Woodbury City Council Tuesday, November 10, 2020 Pursuant to the due call and notice thereof, a regular meeting was duly held virtually and at the Woodbury City Hall, 8301 Valley Creek Road, on the 10th day of November 2020. Call to Order Mayor Anne Burt called the meeting to order at 7:30 p.m. Mayor Burt welcomed those listening and attending. She said members of the public may attend the meeting but will be required to comply with social distancing parameters as determined by the City. Members of the public may also join the meeting using a PC, Mac, iPad, iPhone or Android device. Public comments will be accepted during the meeting both in person and by using the link to the virtual meeting to join the meeting and then submit your questions via the online Q&A feature within the meeting. Questions regarding the meeting will also be taken between the hours of 8:00 a.m. to 4:30 p.m. via email council@woodburymn.gov or call 651-714-3524 and leaving a voicemail message. Special Order of Business A. A Day of Thanksgiving Proclamation Mayor Burt read the proclamation and proclaimed Thursday, November 26, 2020 as Thanksgiving Day in the City of Woodbury. B. Small Business Saturday Proclamation Mayor Burt read the proclamation and proclaimed Saturday, November 28, 2020 as Small Business Saturday in the City of Woodbury. Open Forum The Open Forum is a portion of the Council meeting where a maximum of three persons will be allowed to address the Council on subjects, which are not a part of the meeting agenda. Persons wishing to speak must complete a sign-up sheet prior to the start of the meeting. Give the sign-up sheet to any staff person. Speakers are limited to two minutes each. The Council will listen attentively to comments but, in most instances, will not respond at the meeting. Typically, replies to the concerns expressed will be made via letter or phone call within a week. Consent Agenda All items listed under the consent agenda are considered to be routine by the City Council and will be enacted by one motion and an affirmative vote by roll call of a majority of the members present. There will be no separate discussion of these items unless a Councilmember or citizen so requests, in which event, the items will be removed from the consent agenda and considered a separate subject of discussion by the Council. Item A Approval of Council Minutes – October 28, 2020 Item B To adopt the following resolution Resolution 20-207 Resolution of the City of Woodbury, Washington County, Minnesota approving the amendment to the 2020 budget for the Parks Pavement Maintenance Project North Bluffs Trail Addition. Item C To adopt the following resolution Resolution 20-208 City Council Meeting Minutes Tuesday, November 10, 2020 Resolution of the City of Woodbury, Washington County, Minnesota fulfilling federal expenditure requirements of the Coronavirus Relief Fund by utilizing the public safety presumption method. Item D To adopt the following resolution Resolution 20-209 Resolution of the City of Woodbury, Washington County, Minnesota establishing a public improvement hearing date of December 9, 2020 for the 2021 Roadway Rehabilitation Project. Item E To adopt the following resolution Resolution 20-210 Resolution of the City of Woodbury, Washington County, Minnesota authorizing acceptance of the University of Minnesota Resilient Communities Partnership and executing Memorandum of Understanding and Letter of Understanding with the University of Minnesota. Item F To adopt the following resolution Resolution 20-211 Resolution of the City of Woodbury, Washington County, Minnesota authorizing acceptance of a grant from the University of Minnesota and approval as host site for a Community Forestry Corps member for 2020-2021 program year. Item G To adopt the following resolution Resolution 20-212 Resolution of the City of Woodbury, Washington County, Minnesota approving the License to Use Real Property Agreement between the City of Woodbury and Washington County granting permission to the City to install and maintain a warning siren on a County parcel. Item H To adopt a motion authorizing transmittal of the attached draft comment letter to Washington County regarding their Draft Capital Improvement Plan 2021-2025. Item I 1. To adopt the following ordinance Ordinance 1987 Ordinance of the City of Woodbury, Washington County, Minnesota providing that the City Code be amended by amending Chapter 27 – Environmental Management, Division 3 – Stormwater Management, Sections 27-25 through 27-28; 2. To Authorize staff to publish the Summary of Ordinance 1987 Amending Chapter 27 – Environmental Management, Division 3 – Stormwater Management, Sections 27-25 through 27-28; and 3. To adopt the following ordinance Ordinance 1988 Ordinance of the City of Woodbury, Washington County, Minnesota providing that the City Code be amended by amending Chapter 23 – Water, Sewers and Sewage Disposal, Article II – Municipal Water and Sewer Systems, Division 1 – Districts Generally, Section 23-19. Item O To adopt the following resolution Resolution 20-217 Resolution of the City of Woodbury, Washington County, Minnesota certifying delinquent Utility Bills to the 2021 property taxes. Item P To adopt the following resolution Resolution 20-218 Resolution of the City of Woodbury, Washington County, Minnesota appointing Brian Clark to the position of Accountant II effective November 16, 2020. Item Q The abstract of bills includes payments made from the operating or project budgets for expenses of the city. The expenditures are from all funds of the city. Any purchased contracts requiring signature of the mayor and City Administrator is hereby approved. Staff recommends approval of the abstract of bills for October 23, 2020 in the amount of $1,705,223.71 and October 30, 2020 in the amount of $988,222.16. Councilmember Date moved, seconded by Councilmember Scoggins, to approve the Consent Agenda items. Voting via voice: Andrea Date – aye Amy Scoggins – aye Steve Morris – aye Jennifer Santini – aye Anne Burt – aye Open Forum – Continued Michael Chauss addressed the Council concerning an item on the November 10, 2020 Council Workshop session. He indicated that he was not able to stay for the workshop meeting and wanted to address a discussion item on the workshop agenda entitled 2021 Legislative Initiatives and in particular related to the City of Woodbury’s comments associated with the City of Woodbury opposition related to mandatory targets for affordable housing. He asked the Council why the City was in opposition to the mandatory targets. City Administrator Clinton Gridley said the Council just completed a Housing and Redevelopment Authority meeting in which the City is submitting a second affordable housing bonding application. Woodbury has one of the highest levels of affordable housing in the metropolitan for a suburb. However, the City does not want to get into a situation where the Metropolitan Council is dictating the City’s housing plan. The Metropolitan Council has created some expectations that are better left to the community. Mr. Gridley suggested calling Community Development Coordinator Karl Batalden for more detailed information. Councilmember Morris added that the City is very supportive of affordable housing, but is concerned about retaining local control. Page 3 of 9 City Council Meeting Minutes Tuesday, November 10, 2020 Public Hearings A. PetSuites, Amended Planned Unit Development and Site and Building Plan, Project No. 03-2020-004017 Mayor Burt declared the public hearing open and recognized Community Development Director Janelle Schmitz to give the background. Ms. Schmitz presented the application from Kimley Horn on behalf of Hogan Real Estate for an amended Planned Unit Development and Site and Building Plan for a new pet boarding building located in the Woodbury Lakes Planned Unit Development. The Applicant is proposing to construct a one-story 11,000 square foot pet boarding building with a 2,000 square foot outdoor play area to the north of the building. The property is located north of Hudson Road in between the existing Ethan Allen and Duluth Trading Company buildings. The property is zoned B-3 Planned Shopping Center District and is guided as Places to Shop on the Land Use Plan. The applicant is proposing to amend the Planned Unit Development to allow for animal boarding with an outdoor run within the development. Since the Planned Unit Development was approved in 2004, animal boarding businesses have evolved into being located adjacent to retail uses. The use is a fit in this location due to low traffic generating uses adjacent to the proposed building and the ability to locate the outdoor play yard on the north side of the building away from any residential uses and adjacent to the freeway. PetSuites will offer services every day of the week with no animals allowed outside from 7:00 p.m. to 7:00 a.m. The animals will be supervised at all times. The applicant is proposing to utilize the existing access point from Hudson Road into the site for primary vehicle access. There is also a loop around the north side of the site that provides access from other parts of Woodbury Lakes and is the primary access for deliveries. For retail/animal boarding facilities, the Zoning Ordinance requires one stall per 185 square feet, or 59 stalls. Within the property lines there are 37 stalls existing. Within the overall parking area there are 252 stalls available for the three buildings. Based on the existing and proposed building square footages, 241 stalls are required. Prior to the issuance of a building permit, the applicant shall provide or create a cross parking agreement with both adjacent parcels. The Zoning Ordinance requires commercial buildings to be constructed with 65 percent Class I materials which includes brick, glass and stone. The applicant is proposing to construct the PetSuites building out of 71 percent Class I materials with brick to match the Ethan Allen building making up the majority of the materials. The outdoor play space will be contained using a masonry wall to match the building and the outdoor shade component will utilize neutral colors to also blend in with the building. Much of the landscaping was installed in 2006 with the construction of the two existing buildings. The applicant is proposing to add three trees, four arborvitae and six karl forester grasses to bolster the existing landscaping and soften the trash enclosure. Prior to the issuance of a building permit, the applicant shall update the landscape plan to show “pet tolerant” plantings/rock beds on either side of the building and parking lot medians. Trisha Sieh, Kimley-Horn and Associates, Inc., said they had been looking for a site for some time and thought this would be a really great addition to the Woodbury community. Planning Commission Member John Jarrett said the Planning Commission reviewed the application at its November 2, 2020 meeting and recommended approval of the PetSuites Amended Planned Unit Development and Site and Building Plan by a 6-0 vote. Ms. Schmitz added that the final two conditions were added based on the Planning Commission’s feedback. Councilmember Scoggins moved, seconded by Councilmember Date, to close the public hearing. Voting in Favor: Date, Scoggins, Morris, Santini, Burt Absent: None Mayor Burt opened opportunity for discussion and questions from the Council. Councilmember Date asked how the applicant settled on the location. She also asked if staff had received feedback from the other recently added pet boarding facilities. Mike Leonard, Hogan Real Estate, said he was not involved in the beginning, but his understanding is that they were directed to the site by staff. Ms. Schmitz said one of the reasons staff felt it was a good site is because the adjacent uses are low in traffic. She explained that staff often works with applicants looking for potential sites to review vacant parcels in the city that may meet the project specifications. Councilmember Date asked if staff followed up with Ethan Allen and Duluth Trading Company for input. Ms. Schmitz said yes, they were notified as part of the neighborhood meeting process. Planning Commission Member Jarrett added that they had both been notified and there were no concerns. Page 4 of 9 City Council Meeting Minutes Tuesday, November 10, 2020 Councilmember Scoggins moved, seconded by Councilmember Santini, to adopt a motion approving the PetSuites Planned Unit Development (PUD) and Site and Building Plan, Project No. 03-2020-00417 subject to the conditions as outlined in Council Letter 20- 274: 1. All conditions of the original Planned Unit Development shall remain in full force and effect. 2. This approval does not include signs. A separate sign permit is required for all proposed signage. The outdoor shade component shall utilize design and color to match the building, corporate identity and signage will not be permitted. No signage shall be allowed on the play area wall, including banners or temporary signage. 3. Final landscaping plan shall be approved by staff prior to the issuance of a building permit. 4. Prior to the issuance of a building permit, the Applicant shall update the landscaping plan to include “pet tolerant” plantings or rock beds adjacent to the main entry and parking lot medians. 5. Prior to the issuance of a building permit, a landscape financial security shall be submitted in accordance with the Zoning Ordinance. 6. Prior to the issuance of a building permit the Applicant shall provide the cross-parking access agreement with both adjacent parcels. 7. All areas of the site, where practical, shall be sodded and maintained. 8. All ground mounted mechanical equipment shall be hidden from view with materials that match the materials and colors used on the building. 9. Any future trash enclosures shall utilize wooden gates and shall be constructed on three (3) sides using the same materials and patterns used on the building. The location shall be approved by the Planning Division. 10. Any new freestanding light fixtures shall not exceed 25 feet in height measured from grade to the top of the fixture. The fixtures shall be shoebox style, with lighting type to match the existing lights. 11. Prior to the application of building materials, the Applicant shall construct sample material mock-ups on-site. The mock-ups shall be approved by the Planning staff. 12. The Applicant shall be financially responsible for 100 percent of all storm sewer, sanitary sewer and water main area and connection charges applicable to the property. 13. Heavy duty silt fence and adequate erosion control around the entire construction site shall be required and maintained by the Developer during construction to ensure that sediment and stormwater does not leave the project site. 14. All disturbed boulevards shall be restored with sod. 15. All sanitary sewer, watermain and storm sewer facilities installed to accommodate the site are private and shall be the Developer’s responsibility for the design, installation, maintenance, repair, replacements, operation, protection, etc. All utility inspections shall be coordinated with the City’s Building Inspections Division. 16. The Developer shall be responsible for protecting the proposed on-site storm sewer infrastructure and components and any existing storm sewer from exposure to any and all stormwater runoff, sediments and debris during all construction activities. Temporary stormwater facilities shall be installed to protect the quality aspect of the proposed and existing stormwater facilities prior to and during construction activities. Maintenance of any and all temporary stormwater facilities shall be the responsibility of the Developer. 17. Prior to the issuance of a building permit final drainage, utility, and stormwater plans shall be approved by the Engineering Department. 18. Prior to the issuance of a building permit, the Developer shall provide a snow removal and storage plan detailing how snowfalls will be accommodated on site. Snow storage cannot be stored in required parking stalls. 19. Prior to issuance of a building permit, the Applicant shall submit a plan identifying placement of no less than four (4) inches of an acceptable topsoil mix as determined by the Planning staff. 20. Prior to installation of sod, the Applicant shall provide written verification that a minimum of four (4) inches of topsoil has been placed throughout the site. Prior to installation of the sod, the City shall inspect and approve the placement of the topsoil in writing. 21. Prior to the issuance of a building permit the Applicant shall provide a construction staging plan that shows how circulation will be maintained to the existing buildings. 22. If directed by the City, the property owner shall provide a pet waste receptacle near the main entrance. The location shall be approved by the City prior to installation. Approving CDBG-CV-3 Amendment to 2019 Annual Action Plan Mayor Burt declared the public hearing open and recognized Community Development Coordinator Karl Batalden to give the background. Page 5 of 9 City Council Meeting Minutes Tuesday, November 10, 2020 Mr. Batalden explained that Woodbury has been a recipient of federal Community Development Block Grant dollars since 2010. The funds can be used for a broad range of housing, public facilities, public services uses and more. The CARES Act created supplemental Community Development Block Grant dollars known as CDBG-CV to be used to plan for, prepare for, and prevent the spread of COVID- 19. The first round of CDBG-CV funds were issued to local non-profits as grants following a Request for Proposal process and August 12, 2020 resolution. CDBG-CV-2 dollars were awarded around the country on a competitive basis, but none were received in Woodbury. CDBG-CV-3 allocated $241,668 to Woodbury in September. The U.S. Department of Housing and Urban Development requires that Woodbury plan for CDBG-CV-3 as part of the 2019 Annual Action Plan. Given that this is a substantial amendment, a public hearing following a 30-day comment period is required. No comments were received during the comment period. Staff proposed that the CDBG-CV-3 funds be allocated as follows: $238,000 grant to the Washington County Community Development Agency to provide income-qualified Woodbury homeowners with emergency housing assistance and $3,668 for administration of the program. Councilmember Santini moved, seconded by Councilmember Scoggins, to close the public hearing. Mayor Burt thought it was really great news that this money is coming from the federal government to help our local homeowners and residents in the community. She asked Mr. Batalden to explain some of the challenges with the first $91,000 and why the City had decided to award this most recent funding allocation to the Washington County Community Development Agency. Mr. Batalden explained that the first round of grants went to the local non-profits. However, the administrative regulations have been so complicated that the non-profits still have not been able to receive the money. The biggest challenge is that it is overlaid with the requirement to prepare for and prevent the spread of COVID-10 and had become an administrative burden for the non-profits as well as City staff. The Washington County Community Development Agency has an up-and-running program and would be able to use the funds in a matter compliant with federal regulations. Councilmember Santini asked if the Council would get a report back on how the funds were used. Mr. Batalden said in September 2021 there would be a public hearing reviewing a document called the CAPER. The CAPER is an annual performance report submitted to the U.S. Department of Housing and Urban Development. Another earlier opportunity is March 2021. There would be a public hearing connected to the upcoming year’s expenditures. Staff normally includes as part of the background and context section information in terms of how dollars were spent. Councilmember Santini moved, seconded by Councilmember Date, To adopt the following resolution Resolution 20-219 Resolution of the City of Woodbury, Washington County, Minnesota approving an Amendment to the 2019 Annual Action Plan investing federal CDVG-CV-3 dollars. Vacate Portion of Right of Way on Brookview Road Mayor Burt declared the public hearing open and recognized Engineering Director Chris Hartzell to give the background. Mr. Hartzell explained that Brookview Road will be terminating east of Settlers Ridge Parkway at the Spancil Hill and North Bluffs housing developments. The portion of the current road, east of the termination point will become part of the Spancil Hill development as part of the approved plat. The prescriptive right of way covering that portion of the road has been requested to be vacated by Washington County as part of the plat recording process. The vacation of the public right of way will be conditional upon the recording of the Spancil Hill final plat. Mayor Burt moved, seconded by Councilmember Santini, to close the public hearing. Issuance and Sale of General Obligation Bonds, Series 2020A Jason Aarsvold, Ehlers Inc., shared a quick overview of Ehlers and what they did as public finance advisors. He said the proposed issuance of debt has two purposes. The first is to refinance the Series 2010A bonds and the second is the annual issuance of bonds for 2020 street improvement projects. Together the total proposed aggregate principal amount is $7,500,000. The bonds will be sold as a competitive sell on December 9, 2020 and closing on December 30, 2020. City Administrator Clinton Gridley asked if Mr. Aarsvold had a feel of the market for what range the bond might receive. Mr. Aarsvold said it had been around 1% for 15-year debt. Councilmember Santini asked if the Series 2010A bonds had 11 more years. Mr. Aarsvold said he believed that is correct. Councilmember Morris moved, seconded by Councilmember Date, To adopt the following resolution Resolution 20-221 Resolution of the City of Woodbury, Washington County, Minnesota providing for the issuance and sale of General Obligation Bonds, Series 2020A, to be issued in the proposed aggregate principal amount of $7,500,000 and setting December 9, 2020 as the sale date for the bond issue. Transportation Report (2nd meeting of the month, May-October) No items scheduled Administrative Report City Administrator Clinton Gridley said in terms of economic development the City had $9.3 million worth of added value for the month of October. That is continued strong growth process in the City despite national challenges. The Carver Lake Park parking lot is now open. Mr. Gridley wished Police Officer Tony Ofstead and Detective Yvette Hammond the best in their retirements from the Police Department. Mr. Gridley gave a verbal update of upcoming City meetings.
