Minutes Woodbury City Council Wednesday, January 24, 2024 Pursuant to the due call and notice thereof, a regular meeting was duly held virtually and at the Woodbury City Hall, 8301 Valley Creek Road, on the 24th day of January 2024. Call to Order Mayor Anne Burt called the meeting to order at 7:37 p.m., and she welcomed those attending the meeting both in person and virtually. Mayor Burt explained that members of the public may attend the meeting in person and may also join the meeting using a computer, tablet, or smartphone. She stated public comments will be accepted during the meeting both in person and virtually. Virtual questions should be submitted via the online Q&A feature within the virtual meeting link. Questions regarding the meeting will also be taken between the hours of 8:00 a.m. to 4:30 p.m. via email at council@woodburymn.gov or at 651-714-3524. Questions received after 4:30 p.m. will be responded to in the next three to seven business days. Pledge to Flag Audience, staff, and Council pledged allegiance to the flag of the United States of America. Roll Call Upon roll call the following were present: Mayor Anne Burt, Councilmembers: Kim Wilson, Steve Morris, and Jennifer Santini. Absent: Andrea Date Others Present: Kevin Sandstrom, City Attorney; Clinton Gridley, City Administrator; Janelle Schmitz, Community Development Director; Angela Gorall, Assistant City Administrator; and Chris Hartzell, Engineering Director. Special Order of Business A. Swearing in of New Firefighter Nicholas Berg 1. Oath –Mayor Burt and New Firefighter Nicholas Berg Mayor Burt presided over the swearing in of Firefighter Nicholas Berg after which their badge was pinned on by a family member or other important person in his life. B. Swearing in of New Police Officers Nicholas Wegner and Tsha Vang 1. Meaning of the Badge - Public Safety Director Jason Posel Public Safety Director/Police Chief Jason Posel shared the meaning of the badge and called Nicholas Wegner and Tsha Vang forward. 2. Oath - Mayor Burt and New Officers Nicholas Wegner and Tsha Vang Mayor Burt presided over the swearing in of Police Officers Nicholas Wegner and Tsha Vang, after which they each had their badges pinned on by a family member or other important person in their life. Open Forum The Open Forum is a portion of the Council meeting where a maximum of three persons will be allowed to address the Council on subjects, which are not a part of the meeting agenda. Persons wishing to speak must complete a sign-up sheet prior to the start of the meeting. Give the sign-up sheet to any staff person. Speakers are limited to three minutes each. The Council will listen attentively to comments but, in most instances, will not respond at the meeting. Typically, replies to the concerns expressed will be made via letter or phone call within a week. Consent Agenda All items listed under the consent agenda are considered to be routine by the City Council and will be enacted by one motion and an affirmative vote by roll call of a majority of the members present. There will be no separate discussion of these items unless a Councilmember or citizen so requests, in which event, the items will be removed from the consent agenda and considered a separate subject of discussion by the Council.  City Council Meeting Minutes Wednesday, January 24, 2024 Item A Approval of Council Minutes – January 10, 2024 Mayor Burt moved to strike language from the Mayor’s welcome portion of the meeting, within the January 10, 2024 and all future meeting minutes related to complying with social distancing parameters. Renew twenty-six (26) interim conditional use permits as listed in Council Letter 24-19; and 2. Not renew the one interim conditional use permit listed in Council Letter 24-19. Item C 1. To adopt the following resolution Resolution 24-19 Resolution of the City of Woodbury, Washington County, Minnesota adopting change of address from 3666 Oxford Drive to 3668 Oxford Drive. 2. To adopt the following resolution Resolution 24-20 Resolution of the City of Woodbury, Washington County, Minnesota adopting change of address from 4930 Wild Canyon Drive to 1690 Wild Ridge Court South. Item D To adopt a motion establishing the following high priorities for the 2024 AAP:  Housing serving 30% - 50% of AMI small- and large-related households;  Housing serving 51% - 80% of AMI small- and large-related households;  Housing serving seniors earning between 30% and 80% of AMI; and  Park and public facility improvements. Item E To adopt the following resolution Resolution 24-21 Resolution of the City of Woodbury, Washington County, Minnesota authorizing use of Trunk Water and Sanitary Sewer Fund for the update to the Northeast Area Alternative Urban Area-wide review (AUAR). Item F To adopt the following resolution Resolution 24-22 Resolution of the City of Woodbury, Washington County, Minnesota establishing a bid date of February 15, 2024, for the Woodbury Water Treatment Plant Pipelines Utility Locating Services project. Item G Approval to Appoint Election Judges – March 5, 2024 Presidential Nomination Primary Election. This item was removed the Consent Agenda and moved to the Discussion portion of the meeting. Item H Reclassification of Destination Marketing Manager Position. This item was removed the Consent Agenda and moved to the Discussion portion of the meeting. Item I To adopt a motion approving the revised 2024 City Council meeting schedule to include the February 14, 2024 workshop meeting as listed in Council Letter 24-26. Item J The abstract of bills includes payments made from the operating or project budgets for expenses of the city. The expenditures are from all funds of the city. Any purchased contracts requiring signature of the mayor and City Administrator is hereby approved. Staff recommends approval of the abstract of bills for January 5, 2024 in the amount of $1,861,981.32 and January 12, 2024 in the amount of $4,830,574.59. Page 2 of 5  City Council Meeting Minutes Wednesday, January 24, 2024 Mayor Burt noted that she would like to pull Item 6A, Approval of Council Minutes – January 10, 2024, to address the standard Covid language at the top of the minutes that state “members of the public may attend the meeting but will be required to comply with social distancing parameters” as those standards are no longer used. She suggested to delete that language moving forward. Councilmember Morris moved, seconded by Councilmember Wilson, to approve the Consent Agenda items with the exception of Items 6A which was approved via a separate motion under consent, and 6G and 6H which are moved to the Discussion portion of the meeting. Approval to Appoint Election Judges – March 5, 2024 Presidential Nomination Primary Election. Mayor Burt asked Councilmember Wilson if she pulled the item because she is an election judge. Councilmember Wilson replied yes and would be abstaining from the vote. Councilmember Morris moved, seconded by Councilmember Santini, To adopt the following resolution Resolution 24-23 Resolution of the City of Woodbury, Washington County, Minnesota appointing election judges for the March 5, 2024 Presidential Nomination Primary Election. Voting via voice: Kim Wilson – abstain Andrea Date – absent Steve Morris – aye Jennifer Santini – aye Anne Burt – aye Consent Agenda Item 6H. Reclassification of Destination Marketing Manager Position. Councilmember Wilson stated she pulled this item for discussion and that she would be voting differently. Councilmember Morris moved, seconded by Councilmember Santini, To adopt the following resolution Resolution 24-24 Resolution of the City of Woodbury, Washington County, Minnesota reclassifying the Destination Marketing Manager Position. Discuss Proposed Changes to the December 13, 2023 City Council Meeting Minutes Page 3 of 5  City Council Meeting Minutes Wednesday, January 24, 2024 Mayor Burt explained that this item was discussed at the previous City Council meeting and it was recommended that someone proposed different language to the minutes. Councilmember Wilson added that Councilmember Morris was going to verify her proposed language. She pointed out the amendment would be on page 6 of the minutes, last sentence of the last paragraph. She added that during that meeting, there was a discussion on a possible censure of anyone who the Council felt violated the code of ethics. She noted that it was important to include the discussion regarding Councilmember Morris’ suggestion that there would be a discussion or a formal censure. She stated it is important to include it in the minutes because the code of ethics does not include anything about censuring or discussion. That way, it would be in writing that a discussion could also be an option. Councilmember Wilson clarified that on the last sentence of the paragraph, she would like it to read “Due to having a code of ethics, it can allow the public or a member of the Council to raise concern if they believe a guideline has not been followed, Council could have a discussion or an official censure.” Councilmember Morris stated that he has had an opportunity to re-watch the Council meeting and noted his appreciation for having more formal protocols in place to make it easier to follow along in the meeting. He expressed his understanding of Councilmember Wilson’s comments of wanting to include the language in the minutes. He noted that the minutes are not verbatim transcripts but are meant to both generalize comments and record positions. He stated that he would make a motion to amend the minutes to include the minutes but explained that he did not add the portion of having a discussion because Mayor Burt had suggested that, while he suggested having a formal censure and agreed with Mayor Burt’s comments. Councilmember Morris moved, seconded by Councilmember Wilson, to amend Page 6, last sentence of the last paragraph, just before Karen Bauman addresses the Council, to include “can allow for the public or member of Council to raise a concern if they believe the guidelines or code had not been followed and could be by censure or by discussion if the Council decides” of the December 13, 2023 City Council minutes.
