WOODS CROSS CITY COUNCIL MEETING SEPTEMBER 3, 2024 The minutes of the Woods Cross City Council meeting held September 3, 2024, at 6:30 P.M. in the Woods Cross City Hall located at 1555 South 800 West, Woods Cross, Utah. COUNCIL MEMBERS PRESENT: Ryan Westergard, Mayor Wally Larrabee Julie Checketts Gary Sharp Jessica Kelemen Matt Terry STAFF PRESENT: Bryce Haderlie, City Administrator Annette Hanson, City Recorder Dan Schultz, Assistant Chief of Police Johnny Filler, Public Works Curtis Poole, Community Development Director Brian Passey, Finance Director PUBLIC ATTENDANCE: LeGrande Blackley Breeann Wright Gina Strack Ashleigh Young Lorene Kamalu INVOCATION: Ryan Westergard PLEDGE OF ALLEGIANCE: Jessica Kelemen DAVIS COUNTY ANIMAL CARE 2024 The Mayor gave the floor to Davis County Commissioner Lorene Kamalu and Ms. Ashleigh Young from the Davis County Animal Shelter. They gave a presentation on the pet crisis in the state of Utah and the need for a new animal shelter. They said that Animal Care of Davis County is committed to promoting responsible pet ownership and compassionate animal care by fulfilling three goals: to serve and educate our community, to find homes for our homeless pets, and to support public safety. They went on to say that to provide the much needed services it was time to build a new animal shelter. They said there has been a significant amount of animals who have entered the shelters, and the numbers continue to rise. They said they are trying very hard to get the new building up and going but with the new building they are asking for a small tax increase that would amount to about $12 a year or about a $1 a month. They said there has not been an increase in animal care for the county for quite some time. Following the information given, Council Member Checketts asked if the building was being built. Ms. Young said it has not been started yet, but they are locating the new building on the site where they are currently located because that was the most cost effective choice. The Mayor and Council thanked Commissioner Kamalu and Ms. Young for their presentation and for being a partner with the city in taking care of the animals in the county. Commissioner Kamalu updated the Council on where the dispatch consolidation was and the reasons why they are doing the consolidation. It was noted and that will work for more efficiency to consolidate dispatch. OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING SEPTEMBER 3, 2024 PAGE 2 It was also noted there is a state agency involved and there is an audit that will be happening which will dictate what the next step will be in the consolidation process. She said the Sherriff feels strongly there should be a consolidation of dispatch to be more efficient. CONSIDERATION TO APPROVE MINUTES The Mayor called for the review of the minutes for the City Council meeting held 08/06/24 and for the Truth in Taxation meeting and the City Council meeting held 08/20/24. Following the review of the minutes, Council Member Terry made a motion to approve the minutes of 8/06/24 and 08/20/24 as written with Council Member Checketts seconding the motion and all voted in favor of the motion through a roll call vote. RATIFY CASH DISBURSEMENTS The Mayor then called for the ratification of the cash disbursements for the time period of 8/09/24-8/21/24. Council Member Kelemen made a motion to ratify the cash disbursements for the time period of 8/09/24- 8/21/24 with Council Member Sharp seconding the motion and all voted in favor of the motion through a roll call vote. PUBLIC COMMENT The Mayor then opened the meeting to comments from the public that would take less than two or three minutes. Mr. Clark Burbidge addressed the Commission and said he has lived in city for 20 years and his property abuts the Hatch Howard property. He said he is concerned about tree waste that remains on the property. He said he is concerned about it being a fire hazard and the dead branches lean up against his fence and he said he feels like something needs to be done to take care of it. Mr. Burbidge said he had spoken with family members of the Howard family, and he said they may try to burn it. He said there had been some discussion about there being an open burn. He said he wrote a letter to express his concern about having a fire in that field and said it would be very dangerous to have a fire being so close to the homes in the area and there would also be a lot of smoke. He said he wanted to express the financial and responsible kinds of actions that should be taken to protect the citizens. The Mayor said the Community Development Director had looked into this matter. The Community Development Director, Mr. Poole, said he had spoken with the Fire Marshall, and he said the fire had been considered but that it was not going to take place for safety reasons. Mr. Poole said the Howard family understood they needed to get permits in order to proceed with that type of resolution. Mr. Burbidge said he is very concerned and takes this sort of thing very seriously. He said he just wanted to give his input, and he appreciated the Council listening to his concerns and comments. OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING SEPTEMBER 3, 2024 PAGE 3 Council Member Checketts asked Mr. Poole if the county would need to inform the city if someone applied for a permit for this type of action and Mr. Poole said he did not know but he would find out. The City Administrator said the city would be hiring a new Code Enforcement Officer and if Mr. Burbidge wanted to get his contact information to Mr. Poole, he would then get it to the new Code Enforcement Officer who can follow up on the matter. There were no further public comments, and the Mayor closed the public comment period. LAND USE TABLE AND DEFINITIONS DISCUSSION The Mayor gave the floor to Mr. Poole. He noted that city code currently lists permitted and conditional land uses within the individual zoning chapters. He said that to find what zone a particular land use is allowed; a search needs to be made through each of the zoning chapters. He noted this can be difficult for residents, developers, and staff to navigate. He also said this is complicated when the same land uses are referred to differently in the individual chapters, and a search option of the code is not available. He said there are also subjective and confusing standards for approving certain land uses. Mr. Poole went on to say the staff had discussed the proposed amendments with the Planning Commission and on August 14, 2024, the Commission held a public hearing, and has forwarded their recommendation for approval of the following amendments: • Deleting all land use references and definitions from the residential, commercial, mixed use, industrial, airport, and cannabis chapters. • Creating a land use table under Chapter 28, Supplementary Regulations, and renaming the chapter Land Use and Supplementary Regulations. • Removing all subjective land use approval language from the individual zoning chapters where the Planning Commission must make a determination of whether a land use is similar to or compatible with surrounding properties and land uses, or whether the use emits noise, radiation, fumes, smoke, vapors, vibrations, intermittent light, or similar effects. • Cleaning up varying references to the same land use. • Adding a few uses not currently in City Code: o Automotive Oil Change Specialty Store o Beverage Shops with Drive Up Window o Electric Charging Station o Light Commercial Flex Manufacturing o Kennels o Pet Services • Amending permitted and conditional land uses allowed in individual zones. • Moving all deleted definitions from the individual chapters to Chapter 2, Definitions. OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING SEPTEMBER 3, 2024 PAGE 4 • Adding new definitions to clarify uses: o Light Commercial Flex Manufacturing o Personal Services o Pet Services • Removing the numbering in the Definitions chapter. • Amend “shall not” to “shall” in 12-28-114, (f)(2), so the code will read, “No sign shall exceed 18 square feet in size,” instead of “No sign shall not exceed 18 square feet in size.” • Removing the reference to the maximum number of units in a townhome building. The current code refers to limits of both six and eight units per building. The Commission agreed the site would limit the number of units in a building and wanted to provide developers with additional flexibility. • Grammatical edits. Following the information given by Mr. Poole, the Council said they liked the direction Mr. Poole is going with these changes. They discussed the changes in having the added flexibility with the number of townhome units that would be considered for developments. We will miss his many skills, broad knowledge, and interesting and entertaining stories! WELCOME ROBERT GLASS Robert Glass is the newest member of the public works team. Robert comes from North Salt Lake where he previously worked with Danny and Sam. He has many years of experience and will be a huge asset to the team. OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING SEPTEMBER 3, 2024 PAGE 5 AUGUST STREETS TASKS: • Pothole 1500 South filled twice • Garbage cans • 1500 S 420 W asphalt Patch • 1500 S 950 W asphalt Patch • Mountain View asphalt • Asphalt Patches on 1935 S • Replaced a few school signs • Signs on 1500 S island, R/R tracks • Put plow truck together • Streetlight survey • Submitted repair 40+ requests • Decommissioned 2 trucks for surplus • Storm drain check/cleaning AUGUST PARKS TASKS: • New playground @ Argyle • Tree trimming • Sprinkler repairs • Fertilization of parks • Planted trees on the hillside @ Morningside • Repaired drip irrigation @ Morningside • Rocked hillside @ Mountain View • Hauled 75 yards of rock • Painted over graffiti @ Mountain View • 11 playground inspections • Field dragging • Assisted in Night Out Against Crime • Signs out for Emergency Prep Fair • Repaired swing @ Mountain View • Gopher battling • Sprayed properties (weeds) • Sprayed for wasps ONGOING CONSTRUCTION PROJECTS • Mill and overlay. o Paving on 1800 S, 1400 S, and 2025 S is complete. o Project cost increased due to water leaks. ▪ Paving over older waterlines (25-year-old lines) is a known risk of causing waterline breaks. • Road Markings have been repainted. Utilities need to be raised. Will occur next year. o Mast and Arms still at powder coaters. They are backlogged. o Signs still need to be installed. BEAUTIFICATION AUGUST • Morningside Park o Replace dead trees and install rock. • Spray Weeds • Argyle Acres low spots along fence line filled. IN THE WORKS • West Legacy Trail concerns • Post Asphalt, JUB and County are close to finalizing a plan and reimbursing the City • Development Review Committee • Grant Applications o Part of the WFRC Safe Sidewalks for America plan development. o Sitting in on the new Davis County Active Transportation Plan group. • CDBG grants for road/utility repairs to continue. • BRIC and Earmarks grant applications for Aquifer concerns and Subsidence assistance. • Reuse Plan application is still in process at the State Engineer’s office. • Citizen Connect is up and running for Residents to submit work orders directly into Elements. PROJECTS NOT LISTED ON PREVIOUSLY • 1425 W 2600 S Traffic Light Under Construction • NSL will be doing some work as part of their 400 W (1425 W) road work to accommodate the FedEx triple trucks better to make the Southeast corner turn without going into oncoming traffic • 1100 W 2100 S to 2600 S Widening o In the environmental plan phase. Working with property owners. • Transportation Master Plan RFP • In progress • Parks and Recreation Master Plan Update o Was presented to the Council in August. • FRA inspections completed in April. • Most deficiencies have been completed; we are still waiting on Union Pacific and UTA permit approvals for some of the other cities. The Mayor and Council congratulated Sparky on his retirement and welcomed Mr. Robert Glass as the newest water employee. Council Member Checketts thanked the public works department for fixing the “no outlet” sign she inquired about at the last meeting. OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING SEPTEMBER 3, 2024 PAGE 7 CITY ADMINISTRATOR REPORT/ACTION ITEM REPORT The Mayor gave the floor to the City Administrator who noted the following for the City Council: 1. Property tax rate and budget documents have been submitted to the County and State in compliance with State Law. 2. Working with staff, contract consultants, and refineries on the State Engineers letter regarding the Woods Cross water reuse application. The Friends of the Great Salt Lake submitted a letter during the public comment process and the City is preparing a response and request for approval with requested support from the refineries and other partners in the area. 3. Staff is working with the audit firm to complete the 2024 annual financial audit. 4. Staff responded to a number of citizen concerns regarding a possible burn in an agricultural zone within the city limits. It proved to be a rumor. 5. Staff responded to media reports regarding a possible homeless shelter in North Salt Lake City. Information is still be gathered by North Salt Lake City staff that was not aware of a private entity making an offer to purchase the site and requesting financial support from Davis County and the State of Utah. No applications have been submitted to North Salt Lake for the project. 6. Staff working with a citizen that applied for the CDBG funded foundation repair to verify if they qualify for the grant. 7. Staff is collaborating on the RFP document for a website upgrade. 8. Bryce met with Mark Bell to review the current list of legal projects and discuss the upcoming RFP for legal services. QUESTIONS/DIRECTION TO THE CITY ADMINISTRATOR OR STAFF Council Member Checketts asked what the plan for Day of Service was and it was noted that there were several options, and the Council chose the option to pick up popsicles from LaCee and deliver them to residents that are working on various project throughout the community. The City Administrator said there was a list of projects that were given for community participation, and it would be available for the Council so they could hand out the popsicles. The Council thanked Mr. Poole for the help with the information for Mr. Burbidge. The Mayor said he had an email from a resident that said he would like to know how to deal with a rat problem in his area. The Mayor said he was unaware of this problem. It was noted the rats follow the squirrels in the area. Mr. Poole said it is hard to follow the source. He said it could be a chicken coop that is not being taken care of. The Mayor said he would get more information to see if it is one property or if it is a bigger problem and where it might be coming from and get that information to staff. COUNCIL REPORTS The Mayor noted there would be a Public Hearing for the South Davis Recreation District regarding district fee updates. He said the hearing would be held on Monday, September 9, 2024, during the District’s scheduled board meeting at approximately 6:00 P.M. in meeting room A at 550 N 200 W Bountiful, Utah OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING SEPTEMBER 3, 2024 PAGE 8 and also via zoom link. The Mayor noted the hearing is to allow comments regarding updated fee changes and new fees proposed by the South Davis Recreation District for fiscal year 2024. He said copies of the proposed fees can be obtained in person at the South Davis Recreation Center, on the Utah Public Notice website or by requesting a copy. The Mayor also noted the South Davis Metro Fire District will be holding Fire Prevention Week September 3-5 in North Salt Lake, Centerville, and Bountiful from 6:00-8:00 P.M. Council Member Checketts said she had sent an email regarding burning in the city. She said the aftermath of burning can be a big problem with health issues. The City Administrator said burning is not allowed and information can be given to the South Davis Metro Fire Agency to help make sure neighbors are not burning when they should not be doing so. It was noted that police officers can work with the fire department if burning issues may come up. Mr. Poole also said that air quality is also something that should be taken into consideration. Council Member Checketts also said that wind should be taken into consideration. There was also discussion on whether recreational fire pits are allowed but there was a question of what else might be being burned. Council Member Sharp also noted that he has a neighbor that has an outdoor recreational fire pit, and the smoke has become a problem from him using the fire pit. Council Member Terry reported on the Davis Mosquito Abatement District and said there has been some Davis County pools that had tested positive for West Nile Virus but there have been no human cases reported yet. He said that Davis County contributes over half of state tested pools and they have their own lab, so they test very often. He said the numbers may seem high, but Davis County finds more because they test so often. He said we have been fortunate there have been no human cases so far. Council Member Sharp said he did not attend the last Planning Commission meeting, so he had nothing to report from their meeting. Council Member Larrabee noted that there is published data required by cities by the legislature from haulers and local governments to be reported once a year on recycled material such as total tonnage and what is being recycled. He said Woods Cross is very good at recycling and should have been given a $5100 credit because of the recycling that is being done by the city. He said there should be credits shown monthly. Council Member Larrabee said that Wasatch Integrated has been in existence for forty years now and the district is celebrating by getting shirts. He also said that WasteCon is coming up in October. He also said in October they would be adding an enhanced cardboard sorter and another baler. He said cardboard is getting more expensive and now “dirty” cardboard is allowed to be recycled. He also said there was an education specialist that was hired last year, and she has been very helpful with getting information to the schools and other places. The City Administrator said that he had received information that city was going to get a credit from Wasatch Integrated for recycling. OFFICIAL MINUTES WOODS CROSS CITY COUNCIL MEETING SEPTEMBER 3, 2024 PAGE 9 The Mayor then noted he had been sent an invitation to attend the Utah Airport Operators Association Conference, and he said he was unable to go. He said someone else could go to get the information they will be giving out. The Mayor also said the fire district board met to do interviews for the new fire chief. He said they had chosen a new chief but he was not sure if it had been made public yet so he would wait to let them know who it was when it was formally announced. The Mayor said there would be an open house for Chief Stone in the next few weeks. The Mayor then noted that Council Member Kelemen would be moving, and he and the Council are sad she is leaving, and they would miss her input and viewpoint, and they had enjoyed working with her. The Mayor and Council thanked Council Member Kelemen for all of her hard work and all of her service to the community. Council Member Kelemen said this would be her last meeting before she moves, and she was going to miss this experience. She said she would miss working with the Council and they were all such great people. The City Administrator said he had looked into what needs to be done to replace the open seat for an outgoing City Council member. He noted he would need to have a resignation letter to be able to start the process of getting a new Council Member. The Mayor and Council discussed how the process would go and that there would be 30 days after the resignation of a Council Member to replace them. The City Administrator talked to the Council about the time frame and how the process might go to fill the Council Member seat. ADJOURNMENT There being no further business before the City Council, Council Member Kelemen made a motion to adjourn the meeting at 8:35 P.M.
