1 July 22, 2024 CITY OF WYANDOTTE REGULAR CITY COUNCIL MEETING A Regular Session of the Wyandotte City Council was held in Council Chambers and via Virtual Telecommunication methods, due to COVID-19 in accordance with Wayne County Local Public Health Department “Guidance for Meetings of Governmental Bodies” and PA228 of 2020, using the Zoom Audio platform, on Monday, July 22, 2024 and was called to order at 7:00pm with Honorable Mayor Robert A. DeSana presiding. The meeting began with the Pledge of Allegiance followed by roll call. Present: Mayor Robert A. AFFHOLTER By Councilperson Shuryan supported by Councilperson Stec BE IT RESOLVED that the citizen communication received from J. Affholter regarding ordinance to allow chickens be received and referred to the building & engineering department for review and report back on August 26, 2024. Motion unanimously carried. 2024-222 SCHEDULE BUDGET HEARING – 2024 TAX RATE TO SUPPORT 2025FY By Councilperson Shuryan supported by Councilperson Stec WHEREAS the Deputy Treasurer/Assistant Finance Director has filed a copy of the communication relative to the 2025 Fiscal Year Operating Budget and Corresponding Operating Tax Millage Rate; NOW, THEREFORE, BE IT RESOLVED that this Council shall hold a Budget Hearing, in accordance with Public Act 40 of 1995, in the Council Chambers of the Wyandotte City Hall, 3200 Biddle Avenue, Wyandotte, on July 30, 2024, at 5 pm BE IT FURTHER RESOLVED that the City Council will act on the 2024 operating millage rate pursuant to Public Act 75 of 1991, at the July 30, 2024, Council meeting after the closure of required Budget Hearing. Motion unanimously carried. 2024-223 HIRING: FULL-TIME CASHIER: COLLECTIONS CLERK – A. CUPPARI By Councilperson Shuryan supported by Councilperson Stec RESOLVED BY THE CITY COUNCIL that Council acknowledges receipt of the communication from the Human Resource Specialist regarding the hiring of a Full-Time Cashier/Collection Clerk -Class Code 27A at the 27th District Court and CONCURS with the recommendation therein and hereby declares said position vacant and authorizes the filling of such vacancy and FURTHER, RESOLVED BY THE CITY COUNCIL that the Council approves the hiring of Autumn Cuppari as a Full-Time Cashier/Collection Clerk at Class Code 27A within the 27th District Court contingent on successful completion of a pre-employment physical, drug screen and background check. Motion unanimously carried. 2024-224 HIRING: FULL-TIME CLERK TYPIST I: ENG. DEPT. – G. MICKEL By Councilperson Shuryan supported by Councilperson Stec RESOLVED BY THE CITY COUNCIL that Council acknowledges receipt of the communication from the Human Resource Specialist regarding the hiring of a Full-Time Clerk Typist I - Class Code 27C for the Engineering and Building Department; AND CONCURS with the recommendation therein and hereby declares said position vacant and authorizes the filling of such vacancy and FURTHER, RESOLVED BY THE CITY COUNCIL that the Council approves the hiring of Ginger Mickel as a Full-Time Clerk Typist I at Class Code 27C within the Engineering and Building Department effective July 29, 2024. PROFESSIONAL SERVICES AGREEMENT FOR ARCHITECTURAL/ENGINEERING SERVICES By Councilperson Shuryan supported by Councilperson Stec BE IT RESOLVED that City Council concurs with the Municipal Services Commission authorizing the General Manager to sign a professional services agreement with Sidock Group, Inc. for professional architecture and engineering services for 3663 11th Street in conformance with the City of Wyandotte professional services procurement procedures in an amount not to exceed $134,000.00, as recommended by WMS management. Motion unanimously carried. 2024-226 BROWNFIELD PLAN NO. 24 DEVELOPMENT & REIMBURSEMENT AGREEMENT – MCKINLEY SCHOOL By Councilperson Shuryan supported by Councilperson Stec WHEREAS, the City Council approved Brownfield Plan Number 24 for the McKinley School Residential Redevelopment on Monday, December 18th, 2023; and WHEREAS, the Wyandotte Brownfield Redevelopment Authority approved the Development and Reimbursement Agreement for Brownfield Plan Number 24 on Tuesday, June 18th, 2024; NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby approves the Development and Reimbursement Agreement for Brownfield Plan Number 24; and BE IT FURTHER RESOLVED, that the City Council hereby authorizes the Mayor and City Clerk to sign and execute the agreement. Motion unanimously carried. 2024-227 SAD #954 – DOWNTOWN INFRASTRUCTURE PROJECT By Councilperson Shuryan supported by Councilperson Stec WHEREAS, it has been determined by this Council to be advisable and necessary to grade and pave eight (8) public parking lots located in the Central Business District hereinafter described, in the City of Wyandotte, and to pay all or a part of the cost thereof by special assessment on the lots, parts of lots, and parcels of land abutting thereon as well as benefiting therefrom, excepting from said assessment, the improvement expense attributable to alley and street intersection, City-owned land, owner occupied single family dwellings, owner occupied multi-family rental dwellings will be assessed in that proportion that the property is used for purposes other than that of the owner occupying same in comparison to the total assessable portion of the entire property, and other property not assessable by law, the expense of which, together with any improvement expenses remaining after the aforesaid assessment, shall be defrayed from the General Fund of the City; and WHEREAS, the time and place having been fixed for the hearing of objections to the proposed grading and paving of the following public alley in the City of Wyandotte, and to pay part of the cost thereof, to- wit: Parking Lot #2: Lots 44 thru 47, both inclusive, Block 32, Eureka Iron and Steel Works ReSubdivision of Block 32 in the City of Wyandotte in T. 3 S., R. 11 E., Wayne Co., Michigan, as recorded in Liber 22 of Plats, Page 49, Wayne County Records Parking Lot #3: Lots 56 thru 58, both inclusive, Block 32, Eureka Iron and Steel Works ReSubdivision of Block 32 in the City of Wyandotte in T. 3 S., R. 11 E., Wayne Co., Michigan, as recorded in Liber 22 of Plats, Page 49, Wayne County Records. RESOLVED FURTHER, that the Finance Department is directed to prepare an assessment roll pursuant to the City Charter requirements. The amount thereof may be divided into not more than fifteen (15) installments, one of which shall be collected each year, at such times as the council shall determine, with annual interest at a rate not exceeding six (6) per cent per annum, but the whole assessment after confirmation may be paid to the city treasurer at any time in full, with the accrued interest thereon, provided that no interest shall be charged until thirty (30) days after confirmation. AND BE IT FURTHER RESOLVED that each assessment levied against real property will be due in full upon any transfer in any matter of property. Motion unanimously carried. 5 July 22, 2024 2024-228 SHOW CAUSE HEARING – 1757 4TH STREET By Councilperson Shuryan supported by Councilperson Stec WHEREAS, a hearing has been held in the Office of the City Engineer in the Department of Engineering and Building, 3200 Biddle Avenue, Wyandotte, Michigan on May 30, 2024, and the property owner or other interested parties have been given the opportunity to show cause, if any they had, why the structure at 1757 4th Street, has not been maintained, repaired, or demolished in accordance with the City's Property Maintenance (PM) Ordinance; AND WHEREAS, the Hearing Officer has filed a report of these findings with the Council; NOW, THEREFORE BE IT RESOLVED, that the Council shall hold a public hearing in accordance with Section PM-107.7 Council Action, of the Wyandotte Property Maintenance Code, in the Council Chambers at City Hall, 3200 Biddle Avenue, Wyandotte on Monday, September 16, 2024, at 7:00 p.m., at which time all interested parties shall have the opportunity to show cause as to why the structure has not been brought up to code or demolished or why the City should not have the structure demolished and removed at 1757 4th Street, Wyandotte, Michigan Tax Id No. 57-007-10-0036-303; AND BE IT FURTHER RESOLVED that the City Clerk shall give notice of said hearing ten (10) days before the hearing by certified mail, return receipt requested, and first-class mail, in accordance with the provisions of Section PM-107.4 of the Property Maintenance Ordinance. Motion unanimously carried. 2024-229 SALE OF FORMER 622 8TH STREET By Councilperson Shuryan supported by Councilperson Stec RESOLVED BY THE MAYOR AND COUNCIL that the communication from the City Engineer regarding the City-owned property located at former 622 8th Street is hereby received and placed on file; AND BE IT FURTHER RESOLVED that the Council concurs with the recommendation to sell the property known as the former 622 8th Street to Ms. D'Herin in the amount of $10,000.00; AND BE IT FURTHER RESOLVED that if the Purchaser(s), Ms. D'Herin does not undertake development within six (6) months, or complete construction within one (1) year, it will result in the Seller’s right to repurchase property, including any improvements to one ($1.00) dollar. A condition will be placed on the Deed that will include this contingency; NOW THEREFORE, BE IT RESOLVED that the Mayor and City Clerk are hereby authorized to execute the Offer to Purchase Real Estate for the property known as the former 622 8th Street, between Ms. D'Herin and the City of Wyandotte for $10,000 as presented to the Council. Motion unanimously carried. 2024-230 DEMOLITION OF FIRE DAMAGED STRUCTURE AT 905 6TH STREET By Councilperson Shuryan supported by Councilperson Stec RESOLVED BY THE CITY COUNCIL that the communication from the City Engineer regarding the structures at 905 6th Street, Wyandotte is received and placed on file; AND BE IT RESOLVED that Council authorizes the acceptance of Pizzo Development Group, LLC's proposal in the amount of $9,400 to demolish said home and garage at 905 6th Street, which shall be paid from Insurance Escrow, Account #701-000-278-000. Motion unanimously carried. 2024-231 CLOSED SESSION REQUEST By Councilperson Shuryan supported by Councilperson Stec RESOLVED that the City Attorney expressed a desire to meet in closed session to discuss pending litigation, in accordance with Section 15.268c of PA 267 of 1976. THEREFORE, BE IT RESOLVED that this Body will meet in closed session immediately following the regularly scheduled Council meeting for the above-stated purpose only.
