A RESOLUTION
DECLARATION OF DISASTER EMERGENCY (COVID-19)
WHEREAS, on March 12, 2020, the COVID-19 virus threatens to cause injury, damage, and suffering to the persons of
the City of York; and
WHEREAS, the COVID-19 virus has the potential to endanger the health, safety and welfare of a substantial number of
persons residing in the City of York, and threatens to create problems greater in scope than the City may be able to resolve
through traditional measures; and
WHEREAS, emergency management measures are required to reduce the severity of this disaster and to protect the
health, safety and welfare of affected residents and the community at large in the City of York; and
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of York, Pennsylvania, that pursuant to the
provisions of Section 7501 of the Pennsylvania Emergency Management Services Code (35 PaCS 7501), as amended,
Council hereby proclaims the existence of a disaster emergency in the City of York;
BE IT FURTHER RESOLVED, the City of York Emergency Management Coordinator and response team is hereby
directed to coordinate the activities of the emergency response, to take all appropriate action needed to alleviate the effects
of this disaster, to aid in restoration of essential public services, and to take any other emergency response action deemed
necessary to respond to this emergency; and
BE IT FURTHER RESOLVED, that City Directors, in coordination with Administrative Staff, of the City of York are
hereby authorized to act, under the Mayor's or designee's direction, as necessary to meet the current and ongoing demands
of this emergency, namely: City departments may implement emergency assignments without regard to procedures
required by other laws, except mandatory constitutional requirements, pertaining to performance of public work, entering
into contracts, incurring obligations, employment of temporary workers, rental of equipment, purchase of supplies and
materials, and expenditures of public funds; and
BE IT FURTHER RESOLVED, that the provisions of any regulatory ordinance prescribing procedures for the conduct
of City business, or the orders, rules and regulations of any City department, if strict compliance with the provisions of
any ordinance, statute, order, rule or regulation would in any way prevent, hinder, or delay necessary action in coping
with this emergency is hereby suspended; and
BE IT FURTHER RESOLVED, that the City of York Bureau of Health is authorized to suspend or waive any provision
of law or regulation which the City of York Bureau of Health is authorized by law to administer or enforce, for such
length of time as may be necessary to respond to this emergency.
