for the Relocation of the Yuma County Fairgrounds
Authorize the City Administrator to negotiate and execute a contract
for Professional Services to Complete a Feasbility Study & Project
Assessment for the Relocation of the Yuma County Fairgrounds to the
following firms beginning with the first firm listed. If negotiations for
fees and services are successful with the selected consultant, as
determined by the City, a contract for service will be prepared. In the
event that negotiations for fees or services are not successful, the City
will terminate those negotiations in writing and begin negotiations with

revise A.R.S.§ 42-6106 to grant an Intergovernmental Public

3. O2015-065 Amend and Restate: (1) Phase Two Component Development and
Disposition Agreement; (2) Phase Two Land and Improvements
Lease; (3) Partial Assignment of Master Developer's Interest; (4)
Fourth Amendment of Master Development and Disposition
Agreement; and (5) Authorize an Eight-Year Abatement of the
Government Property Lease Excise Tax on the Riverfront
Development Phase Two Improvements
Approve and authorize the City Administrator to: (1) execute an
amended and restated Yuma Pivot Point Phase Two Component
Development and Disposition Agreement that will include (2) an
amended and restated 42-year Phase Two Land and Improvements
Lease, (3) an amended and restated partial assignment of the Master
Developer's interest in the described Phase Two Property, (4) a fourth
amendment to the Master Development and Disposition Agreement,
and (5) authorize abatement of the government property lease excise
tax (GPLET) for a period of eight years on the Phase Two
Improvements, a 64 unit apartment complex and a 4500 square foot
restaurant, to be constructed by the developer, deeded to the City,
and then leased back from the City to the developer.

1. O2016-001 Acquisition of Easement: 2454 W. 5th Street
Authorize the acquisition of approximately 530 square feet of real
property, located at 2454 W. 5th Street, by gift, dedication, easement,
purchase or through the exercise of the power of eminent domain in
order for the City to complete the re-routing of underground water

Arizona Avenue
Approve an ordinance declaring certain described rights-of-way and a
remnant parcel located at 2024 S. Arizona Avenue (upon final
acquisition), surplus for City use, authorize the vacating of the surplus
rights-of-way to the adjacent City-owned property, and authorize
conveyance of the surplus right-of-way, the remnant parcel, and the
adjacent City-owned property on Arizona Avenue in the Mesa Heights
Neighborhood to the Housing Authority of the City of Yuma subject to

3. O2016-003 Vacate Surplus Right-of-Way By Recorded Deed Upon Payment of
Purchase Price
Declare certain described right-of-way surplus for City use, authorize
the vacating of the surplus right-of-way to the adjacent property owner
through the recording of a deed upon the payment of the purchase
price, and in the alternative, vacate the right-of-way to the City and
authorize the sale of the surplus right-of-way with the sale of the
adjacent parcel (previously declared surplus and authorized for sale
by Ordinance No. O2013-38). This ordinance affects the rights-of-way
at three locations:

VII. SUMMARY OF CURRENT EVENTS
This is the City Administrator’s opportunity to give notice to the City Council of current events
impacting the City. Comments are intended to be informational only and no discussion, deliberation
or decision will occur on this item.
VIII. CALL TO THE PUBLIC
Members of the public may address the City Council on matters that are not listed on the City Council
agenda. The City Council cannot discuss or take legal action on any matter raised unless it is
properly noticed for discussion and legal action. At the conclusion of the Call to the Public, individual
members of the City Council may respond to criticism made by those who have addressed the City
Council, may ask staff to review a matter or may ask that a matter be placed on a future agenda. All
City Council meetings are recorded and videotaped.
IX. EXECUTIVE SESSION
An Executive Session may be called during the public meeting for the purpose of receiving legal
advice for items on this agenda pursuant to A.R.S. Section 38-431.03 A (1, 3, 4 and/or 7) and the
following items:
A. Discussion, consultation with and/or instruction to legal counsel regarding the Riverfront

Assignment and Assumption of Yuma Riverfront Development Sublease Agreement (Hotel
