Zanesville City Council Meeting Monday, March 26, 2018 ZANESVILLE CITY COUNCIL MEETING – MONDAY, MARCH 26, 2018 The Zanesville City Council met in regular session at 7:00 p.m. on Monday, March 26, 2018 in the City Council Chambers, 401 Market Street, Zanesville, Ohio. Mr. Vincent led those present in the Lord’s Prayer and the Pledge of Allegiance to the Flag. The following members of Council answered Roll Call: Mrs. Gentry, Mrs. Norman, Miss Bradshaw, Ms. Gildow, Mrs. Osborn, Mr. Sharrer, Mr. Foreman, Mr. Roberts, Mr. Baker, and Mr. Vincent. APPROVAL OF MINUTES Mrs. Osborn moved to accept the minutes as printed, seconded by Mr. Roberts. Motion carried. COMMUNICATIONS, REPORTS, AND RESOLUTIONS Communication from Mayor Jeff Tilton - Civil Service Board reappointment – Mayor Tilton is hereby recommending the reappointment of Mr. Don Wietmarschen to the Civil Service Commission. Mr. Wietmarschen’s term will expire March 31, 2024. Ms. Gildow moved to receive and concur with the Mayor, seconded by Miss Bradshaw. All present were in favor. None were opposed. Motion carries. Communication from Mayor Jeff Tilton - Design Review Board appointment – Mayor Tilton is hereby recommending the appointment of Brian Addis to the Design Review Board. Mr. Addis will replace Theresa Kanavel completing the unexpired term ending on December 31, 2018. Mr. Roberts moved to receive and concur with the Mayor, seconded by Miss Bradshaw. All present were in favor. None were opposed. Motion carries. Resolution No. 18-40 – Introduced by Council – A Resolution requesting the Ohio Department of Transportation (ODOT) preclude Lash Paving, Inc. from being awarded any further paving bids within the City of Zanesville, Ohio. Mr. Roberts moved for first reading, seconded by Mr. Foreman. Mr. Roberts: This was discussed at Public Service several times and Lash was the contractor that executed the paving jobs on 146 and 60 last year. Mr. Vincent: We have all heard of lots of problems. Is there anything else? We are at first reading so all in favor of first reading signify by saying aye. All were in favor. None were opposed. Motion carries. Resolution No. 18-41 – Introduced by Council – A Resolution exempting Zanesville City Schools from Civil Service Laws. Mr. Sharrer moved to waive the readings and it was seconded by Mr. Roberts. Mr. Vincent: Is there any discussion on waiving? Mr. Sharrer: We do have one amendment. In the fourth whereas we need to replace Zanesville City School District with City of Zanesville. Mr. Sharrer moved and it was seconded by Mrs. Osborn to make this amendment. All present were in favor of the amendment. None were opposed. Motion carries. We are now at Resolution 18-41 as amended. Mr. Sharrer moved to waive the readings. Miss Bradshaw seconded the motion. Mr. Sharrer moved for first reading, seconded by Mr. Foreman. Mr. Vincent: Is there any discussion? Hearing none, all in favor of first reading signify by saying aye. All were in favor except Mr. Baker and he abstained. None were opposed. Motion carries. Ordinance No. 18-43 – Introduced by Council – An Ordinance authorizing the City Auditor to pay the invoice of Vehicle Maintenance Department using 2018 money for 2017 invoices and declaring an emergency. Mr. Roberts moved to waive the readings and it was seconded by Mr. Baker. Roll call vote on waiving of the readings. 9 Ayes 0 Nays Motion carries. Mr. Sharrer moved for passage, seconded by Mrs. Osborn. Roll call vote for passage. 9 Ayes 0 Nays Motion carries. Ordinance is passed. Ordinance No. 18-44 – Introduced by Council – An Ordinance authorizing the proper City official to dispose of surplus property. Mr. Foreman moved for first reading, seconded by Miss Bradshaw. Ms. Gildow: A comment that this was discussed at some length in the Ways & Means Committee meeting and it seems noteworthy to mention that all of these items have either exhausted their useful life or are no longer needed for the City and that this seems like the most efficient and compliant way to dispose of surplus property. Mr. Vincent: Is there any further discussion? We are at first reading so all in favor of first reading signify by saying aye. All were in favor. None were opposed. Motion carries. Ordinance No. 18-45 – Introduced by Council – An Ordinance amending Ordinance 18- 22, and declaring an emergency. Ordinance No. 18-46 – Introduced by Council – An Ordinance declaring various City properties as surplus and authorizing the Zanesville Community Improvement Corporation, acting as the agent of the City of Zanesville, Ohio, to negotiate the disposal of certain city owned property for economic development purposes. Mr. Baker moved for first reading, seconded by Mrs. Gentry. Mr. Vincent: Is there any discussion? Mr. Baker: The Community Development Committee took a look at this last week and there were no objections on this. The only concern, actually, is what would happen to these five properties as far as the clear cutting of timber off some of them for economic development. The CIC would take a look at that on a parcel by parcel basis. Mr. Vincent: Is there any further discussion? Hearing none, all in favor of first reading signify by saying aye. All were in favor. ORDINANCES FOR ACTION Ordinance No. 18-32 – Introduced by Council – An Ordinance authorizing the Public Service Director to apply for an OPWC (Ohio Public Works Commission) Grant and Zero Interest Loan and execute contracts in connection with the Round 33 State Issue 1 Program, if approved. Mr. Roberts moved for second reading, seconded by Mr. Baker. Mr. Vincent: Is there any discussion? Hearing none, all in favor of second reading signify by saying aye. All were in favor. Mr. Sharrer moved for second reading, seconded by Mrs. Osborn. Mr. Vincent: Is there any discussion? Hearing none, all in favor of second reading signify by saying aye. All were in favor. None were opposed. Motion carries. Ordinance No. 18-35 – Introduced by Council – An Ordinance establishing the annual salary and benefits for the Public Safety Director of the City of Zanesville. Mr. Roberts moved for second reading, seconded by Mr. Sharrer. Mr. Vincent: Is there any discussion? Hearing none, all in favor of second reading signify by saying aye. All were in favor. None were opposed. Motion carries. Ordinance No. 18-36 – Introduced by Council – An Ordinance authorizing the proper City official to file a grant application for the certain improvements to the Zanesville Municipal Airport. Mr. Roberts moved to waive the readings and it was seconded by Mr. Baker. Mr. Roberts: The deadline for this application is 5-1-2018 so we need to get the application submitted. Ordinance is passed. Ordinance No. 18-38 Amended – Introduced by Council – An Ordinance authorizing the Public Service Director to execute a Pre-Annexation Agreement. Ordinance No. 18-27 Amended – Introduced by Council – An Ordinance declaring the Mayor’s recommendation to establish a Revitalization District in downtown Zanesville, in accordance with ORC 4301.81, and declaring an emergency. Mr. Roberts moved for third reading and passage, seconded by Mrs. Osborn. Roll call vote for passage. 9 Ayes 0 Nays 1 Abstention Mr. Baker Motion carries. Ordinance is passed. Ordinance No. 18-29 – Introduced by Council – An Ordinance authorizing the expenditure of funds relating to the Lock #10 Canal Trail project. Mr. Roberts moved to postpone this ordinance until the April 9th meeting, seconded by Mr. Baker. Mr. Vincent: All in favor of postponing this Ordinance signify by saying aye. All were in favor. None were opposed. Motion carries. TRAFFIC ORDERS None MISCELLANEOUS AND UNFINISHED BUSINESS Mayor Tilton said first of all he is pleased to announce the City received great news last week that the State of Ohio has submitted two of our low income census tracts for designation as opportunity zones. These are described as State Street, Blue Avenue census tract and the Greater Putnam area. Investment made through this specified instruments into opportunity zones are eligible for federal tax relief. I would like to thank Matt Abbott for all he did for this. Second of all, I have a proclamation that I would like to read and then present it to a couple of gentlemen who are here tonight. Mayor Tilton read a proclamation honoring The Ohio State University Alumni of Muskingum County for service to the community. Mayor Tilton proclaimed that I, Jeff Tilton, Mayor of the City of Zanesville, do hereby wish to recognize the service of our community by The Ohio State University Alumni Club of Muskingum County. I call this recognition to the attention of our citizens. Then Mayor Tilton presented the Page 6 of 7  Zanesville City Council Meeting Monday, March 26, 2018 proclamation to Terry Kopchak and David Wolfe representing The Ohio State University Alumni of Muskingum County. Mr. Terry Kopchak said we very much appreciate this and we would like to plug our biggest fund raiser of the year which is our annual scholarship auction. It will be April 5 at the VFW. Events such as that are what enable us to award the scholarships to the local students. So, we thank you for this proclamation and recognition. Mayor Tilton said thank you for what you do for your community. Mr. Vincent said thank you, gentlemen. Applause followed.
