Zanesville City Council Meeting Tuesday, May 29, 2018 ZANESVILLE CITY COUNCIL MEETING – TUESDAY, May 29, 2018 The Zanesville City Council met in regular session at 7:00 p.m. on Tuesday, May 29, 2018 in the City Council Chambers, 401 Market Street, Zanesville, Ohio. Mr. Vincent led those present in the Lord’s Prayer. The Pledge of Allegiance to the Flag was led by Boy Scout Troop #128 from Trinity Lutheran Church. Mr. Vincent thanked the gentlemen for coming tonight. He invited them to stay after the meeting to meet with the Mayor or any Councilmembers for photos or to ask questions. We are glad you are here to learn about City government. The following members of Council answered Roll Call: Mr. Baker, Mrs. Gentry, Mrs. Norman, Miss Bradshaw, Ms. Gildow, Mrs. Osborn, Mr. Sharrer, Mr. Foreman, and Mr. Vincent. Mr. Roberts was absent. A motion was made by Mr. Foreman to excuse Mr. Roberts. It was seconded by Mrs. Norman. A voice vote was held with all present being in favor. None were opposed. The motion carries. Mr. Roberts stands excused. APPROVAL OF MINUTES Mrs. Osborn moved to approve the Council minutes of May 14, 2018, seconded by Ms. Gildow. A voice vote was held with all present being in favor. Motion carried. Mr. Roberts was absent. Mrs. Osborn moved to approve the Transportation Committee Meeting minutes of City Council as a Whole held on February 28, 2018. It was seconded by Ms. Gildow. A voice vote was held with all present being in favor. Motion carried. Mr. Roberts was absent. COMMUNICATIONS, REPORTS, AND RESOLUTIONS Communication from Jay Bennett, Director of Community Development – The City of Zanesville was awarded the Tree City USA Award on April 12, 2018. This is Zanesville’s twenty-first year in a row to be awarded this honor. Mr. Buck Brackman, Chair of the Shade Tree Commission for the City of Zanesville, was present in Portsmouth with his wife to receive the award. Mr. Brackman will be present at this meeting to present the award to the Mayor & City Council. Mr. Foreman moved to receive the communication from Jay Bennett, Director of Community Development, seconded by Mrs. Osborn. Mr. Brackman then presented the award to the Mayor and members of City council. All present were in favor. None were opposed. Mr. Roberts was absent. Motion carries. Resolution No. 18-40 – Postponed until June 11, 2018. Resolution No. 18-67 – Introduced by Council – A Resolution supporting the Ohio Small Legacy City vision developed by the Greater Ohio Policy Center. Resolution No. 18-69 – Introduced by Council – A Resolution authorizing the Clerk of Council to act as the designated representative of the members of the Zanesville City Council for purposes of required Public Records Training. PROPOSED ORDINANCES Ordinance No. 18-68 – Introduced by Council – An Ordinance authorizing the proper City official to execute and enter into a Settlement Agreement and Release with AT&T and declaring same an emergency. Mr. Sharrer moved to waive the readings and it was seconded by Mr. Baker. Mr. Vincent: Is there any discussion on waiving? With that we will have roll call vote for waiving of the readings. Ms. Gildow: Could we have an explanation of the situation? Mr. Tarbert shared there is a disputed claim between AT&T and the city. The initial claim was well over $200,000 and we were able to work with other attorneys and the PUCO to negotiate the claim down to this settlement amount. The Law Director's office recommends passing this claim. The city has some potential additional legal liability and I believe is in the best interest of the city. ORDINANCES FOR ACTION Ordinance No. 18-54 – Introduced by Council – An Ordinance to amend and revise the Zoning Map and make permanent zoning in the City of Zanesville, Ohio as herein provided for parcel 81-52-02-02-000 for 903 Sharon Avenue. Ordinance No. 18-53 – Introduced by Council –An Ordinance to amend and revise the Zoning Map and make permanent zoning in the City of Zanesville, Ohio as herein provided for parcel 81-52-02-01-000 for 1018 Marietta Street. Ms. Gildow moved for second reading, seconded by Miss Bradshaw. Mr. Vincent: Is there any discussion? Hearing none, all in favor of second reading signify by saying aye. All present were in favor. Ordinance No. 18-57 – Introduced by Council - An Ordinance authorizing the transfer of an asset and its debt payment from the Wastewater Division to the Sanitation Division. Ordinance No. 18-58 – Introduced by Council - An Ordinance authorizing the proper city official to purchase a leaf collection unit for the Streets Division through a competitive bidding process or a cooperative purchasing program. Ordinance No. 18-50 – Introduced by Council - An Ordinance amending Chapters 1171.01, 1171.03 and 1171.04 of the City of Zanesville’s Planning and Zoning Code. (added wording to 18-50 "as amended' in error) Mr. Baker moved for third reading and passage, seconded by Ms. Gildow. TRAFFIC ORDERS None were filed. MISCELLANEOUS AND UNFINISHED BUSINESS Mayor Tilton thanked the city divisions that came together to make the cemeteries look nice for Memorial Day. PRIVATE PETITIONS AND COMMUNICATIONS Non-agenda item petitions filed No private petitions were filed to speak at this meeting. Mr. Baker moved to enter into Executive Session for purposes of real estate matters. It was seconded by Mr. Sharrer. Roll call vote. 8 Ayes 0 Nays 1 Absent Mr. Roberts Motion carries. Entered into Executive Session at 7:26 p.m The Executive Session was exited at 7:58 p.m. Mr. Vincent: We have concluded Executive Session.
