Zanesville City Council Meeting Tuesday, November 13, 2018 ZANESVILLE CITY COUNCIL MEETING ON TUESDAY, NOVEMBER 13, 2018 The Zanesville City Council met in regular session at 7:00 p.m. on Tuesday, November 13, 2018 in the City Council Chambers, 401 Market Street, Zanesville, Ohio. Mr. Vincent led those present in the Lord’s Prayer and the Pledge of Allegiance to the Flag. The following members of Council answered Roll Call: Mrs. Gentry, Mrs. Norman, Miss Bradshaw, Ms. Gildow, Mrs. Osborn, Mr. Sharrer, Mr. Foreman, Mr. Roberts, Mr. Baker, and Mr. Vincent. APPROVAL OF MINUTES Mr. Roberts moved to approve the minutes of October 22, 2018, seconded by Mrs. Osborn. Motion carries. COMMUNICATIONS, REPORTS, AND RESOLUTIONS Communication submitted by Jay Bennett, Director of Public Services - the Zanesville Municipal Airport Quarterly Report for July 1, 2018 through September 30, 2018. Mrs. Osborn moved to receive, seconded by Mr. Foreman. All were in favor. None were opposed. Motion carries. PROPOSED ORDINANCES Mr. Roberts: I would move that we add Ordinance 18-126 as Item 5A to the agenda. Mr. Sharrer seconded the motion. A voice vote was taken with all being in favor of adding Ordinance 18-126 as Item 5A to the agenda. None were opposed. Motion carries. Ordinance No. 18-122- Introduced by Council – An Ordinance repealing and replacing Ordinance No. 18-77 which amended Chapter 1141.05 of the City of Zanesville’s Planning and Zoning Code and declaring an emergency. Mr. Baker moved to waive the readings and it was seconded by Mrs. Norman. Roll call vote on waiving of the readings. 9 Ayes 0 Nays Motion carries. Mr. Baker: Mr. Bennett can you review the details of this because honestly it has been so long I can’t remember the thought. Mr. Bennett: Sure, City Council adopted the previous Ordinance 18-77, but there were under Wrecking Yards, you see on the last page; as a use there was an existing use there that in 18-77 was stricken and moved up as a general warehousing, but the permission permitted within the district just the letter P remained with no use associated. So this just kind of cleans that up and gets rid of those permission levels. Mr. Vincent: There was a whole line of P’s that were not needed. They are gone now. With that Mr. Arnett looked this over and confirmed everything was good. So we are good there and it was just a typo. Is there anything else from Council? Ordinance No. 18-123 - Introduced by Council – An Ordinance authorizing the Mayor to enter into an agreement with the Muskingum County Commissioners, for the reimbursement of fees paid to attorneys who represent indigent defendants in Municipal Court. Mr. Baker moved for first reading, seconded by Mr. Foreman. Mr. Vincent: Is there any discussion? Hearing none, all in favor of first reading signify by saying aye. All were in favor. None were opposed. Motion carries. Ordinance No. 18-124 - Introduced by Council – An Ordinance to amend Chapter 1153 of the City of Zanesville’s Planning and Zoning Code. Mr. Baker moved for first reading, seconded by Mrs. Gentry. Mr. Vincent: Is there any discussion? Mr. Baker: This is an addition to the agenda at the request of the Community Development Director, I think that is right, Jay? We will actually be taking a closer look at this next Monday at 5:30 p.m. at the CD meeting. Just so you know it primarily has to do with updating the code in order to make it congruent with the recent Supreme Court decision concerning the content of signs. Page 2 of 8  Zanesville City Council Meeting Tuesday, November 13, 2018 Ordinance No. 18-125 - Introduced by Council – An Ordinance authorizing the proper city official to accept grant funding through the Ohio Division of Aviation, Ohio Department of Transportation, for certain improvements to the Zanesville Municipal Airport, and declaring an emergency. Mr. Roberts moved to waive the readings and it was seconded by Mr. Sharrer. Mr. Vincent: Is there any discussion on waiving? Mr. Roberts: This Ordinance was discussed at Public Service earlier tonight and it was recommended to Council to pass it as an emergency. Mr. Vincent: It is due to timelines. Now for Item 5A Ordinance No. 18-126 - Introduced by Council – An Ordinance supporting the Muskingum Valley Park District’s 2019 Land and Water Conservation Fund Application associated with the development of the Westview Community Park and declaring an emergency. Ms. Gildow moved to waive the readings and it was seconded by Mr. Sharrer. Mr. Vincent: Is there any discussion on waiving? Mr. Roberts: This Ordinance was also discussed at Public Service earlier tonight. It was recommended that we pass this as an emergency due to the time constraints with the grant application for the Muskingum Valley Park District. I would like to note the $10,000 for Westview Park frontage is Englewood and that it was already on the paving schedule for this year. Mr. Vincent: Thank you. Is there anything else? ORDINANCES FOR ACTION Ordinance No. 18-110 – Introduced by Council – An Ordinance authorizing the proper City Official to apply for grant funding through the Land and Water Conservation Fund for the Zane’s Landing Trail Improvement Project. Roberts moved for second reading, seconded by Mrs. Osborn. Mr. Roberts moved to amend in the heading of this to add comma, space, “and declaring an emergency.” Mr. Baker seconded the motion. Mr. Vincent: Is there any discussion? A voice vote was taken with all being in favor of the amendment. None were opposed. Motion carries. Mr. Vincent: We are now at Ordinance 18-110 as amended. Mr. Roberts moved to waive the readings and it was seconded by Mr. Sharrer. Roll call vote on waiving of the readings. 9 Ayes 0 Nays Motion carries. Mrs. Norman moved for passage, seconded by Miss Bradshaw. Mr. Vincent: Is there any discussion? The deadline for this is November 15 th as far as moving this along. Ordinance No. 18-112 – Introduced by Council – An Ordinance authorizing the proper City Official to purchase items for employee recognition. None were opposed. Motion carries. Ordinance No. 18-113 – Introduced by Council – An Ordinance authorizing the proper City Official to provide funds to South East Transit for the year 2019. Ordinance No. 18-114 – Introduced by Council – An Ordinance authorizing the proper City Official to provide funds to the Zanesville-Muskingum County Port Authority for organizational, promotional, and operational expenses during the year 2019. Mrs. Osborn moved for second reading, seconded by Ms. Gildow. We had a nice presentation at our last meeting on all of these. If no discussion, all in favor of second reading signify by saying aye. Ordinance No. 18-115 – Introduced by Council – An Ordinance implementing a new City Purchasing Policy for items greater than or equal to $5,000 and under $49,999.99. Ordinance No. 18-116 – Introduced by Council – An Ordinance authorizing the Proper City Official to enter into a Professional Contract with Hull Inc. for the design of Pioneer Reservoir Replacement Project. Mr. Roberts moved for second reading, seconded by Mr. Sharrer. Mr. Roberts: I would like to make a motion to amend ordinance 18-116 in the following manner:  In the first Whereas after O.R.C. the addition of Chapter 153.69  In the second Whereas we are going to change it to, “through Ordinance No. 18- 109, City Council authorized execution of all loan documents with the Ohio EPA Drinking Water Assistance Fund for the Pioneer Reservoir Replacement Project.”  Section Two: after estimated to be, striking everything past that and adding in; “$312,800 as detailed within the Scope of Services. Attached as “Exhibit A”.  Then the addition of Section Three: “Funds for the payment of the project’s design services shall be derived from the Drinking Water Assistance Fund Loan and shall be paid from City line item 611-5473-54458.”  Then moving previous Section Three into Section Four. It was seconded by Mr. Sharrer. Mr. Vincent: Is there any discussion? Is Council clear on that? All in favor of that amendment signify by saying aye. All were in favor. None were opposed. Motion carries. Mr. Vincent: We are now at Ordinance 18-116 as Amended. Mr. Roberts moved for second reading as amended, seconded by Mr. Sharrer. Mr. Vincent: Is there any further discussion? Ordinance No. 18-117 – Introduced by Council – An Ordinance authorizing the Proper City Official to enter into a Professional Contract with Poggemeyer Design Group Inc. for Design and Bidding Services for the Replacement of the Linden Avenue Sanitary Sewer Pump Station. Mr. Roberts moved for second reading, seconded by Mr. Foreman. Mr. Vincent: Is there any discussion? Hearing none, all in favor of second reading signify by saying aye. All were in favor. None were opposed. Motion carries. Ordinance No. 18-120 – Introduced by Council – An Ordinance authorizing the proper City Official to dispose of surplus property-(Sanitation Division). Miss Bradshaw moved for second reading, seconded by Mr. Roberts. Mr. Vincent: I forgot to ask someone to do this; but looking at this again today. Under the second Whereas you will see it is roll-off truck number (105) and down below under Section One it is truck number 92. The correct number is truck number 92. So I ask Council for someone to make the amendment under the second “Whereas” to change 105 to 92 for the truck number. Mrs. Osborn moved to amend to change the number of the truck to No. 92 in the Second Whereas. It was seconded by Mr. Baker. Mr. Vincent: Is there any further discussion on that amendment? Is everyone clear? All in favor of that amendment signify by saying aye. All members were in favor. None were opposed. Motion carries. Mr. Vincent: We are now at Ordinance 18-120 as amended. We are at second reading. Ms. Gildow moved for second reading, seconded by Mr. Baker. Mr. Vincent: Is there any discussion? Hearing none, all in favor of second reading signify by saying aye. Ordinance No. 18-109 – Introduced by Council – An Ordinance authorizing the Proper City Official to execute relevant documents with the Ohio Environmental Protection Agency (OEPA), Drinking Water Assistance Fund (DWAF) Loan for the Pioneer Reservoir Replacement Project. Roll call vote for passage. 9 Ayes 0 Nays 0 Absent Motion carries. Ordinance is passed. TRAFFIC ORDERS No Traffic Orders were filed for this meeting. MISCELLANEOUS AND UNFINISHED BUSINESS Mayor Tilton: I have one thing, sir. It is leaf collection season so we are asking the citizens to please don’t rake the leaves into the street. Also, we would appreciate it if they just have leaves at the curb and no other items that will be sucked into our equipment and tear it up. One thing is political signs. If they have political signs still at their house we would appreciate it if they took them out before they rake the leave up over top of them so we don’t tear up our equipment. That is all. Mr. Vincent: So save the tax payers money by not sucking up things and ruining equipment. Thank you, sir. Is there anything else from the Administration?
